COOKEVILLE PLANNING COMMISSION MINUTES FEBRUARY 27, 2017 The Cookeville Planning Commission met on Monday, February 27, 2017 at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Jim Stafne, Judy Jennings, Chris Wakefield, Jim Woodford, Kay Starkweather, Leslie Sullins Draper, Tracy Cody, and Jim Cobb. CONSIDER FOR ACTION 2017 ANNUAL REPORT AND PROGRAM DESIGN. REQUEST SUBMITTED BY STAFF. James Mills stated that the Planning Department has completed the 2017 Annual Report and Program Design. The purpose of this report is to review the activities of 2016 and to outline proposed activities for 2017. Some of the major tasks completed in 2016 included: • Initiated Envision Cookeville, long range planning effort • Completed 2016 Citizen Survey and prepared Summary Report • Assisted with implementation of TDOT Community Transportation Planning Grant for traffic flow study • Continued to assist with implementation of TDOT Multimodal Access Grant for installing sidewalks along East Spring Street • Prepared and submitted a N. Willow Ave. widening proposal to TDOT • Completed Downtown Parking Inventory and Analysis • Initiated Downtown Parking Utilization Study COOKEVILLE PLANNING COMMISSION 2 FEBRUARY 27, 2017 • Prepared unsuccessful EPA Brown Fields Area Wide Planning Grant Application for West Cookeville Revitalization Area • Approved 10 final subdivision plats containing a total of 91 lots and 41 minor plats containing 84 lots • Assisted with the development of improved regulations for Mobile Food Units Some of the major work activities proposed for 2017 include: • Continue implementation of 2030 Plan • Complete Envision Cookeville • Complete Downtown Parking Utilization Study • Continue to assist with implementation of TDOT Community Transportation Planning Grant for traffic flow study • Continue to assist with implementation of TDOT Multimodal Access Grant for installing sidewalks along East Spring Street • Complete preparation of standards for small cell tower locations within city right-of- ways • Prepare as necessary amendments to the Zoning Code including possible expansion of areas zoned as CBD and the establishment of annual permit renewal/inspection fee for billboards • Assist as required with implementation of the Major Street Plan including the Bennett Road extension, 5th I-40 Interchange, South Jefferson Avenue widening and West Stevens Street/Buffalo Valley Road realignment projects • Complete and record revised Final Plat of Highlands Business Park Staff recommended approval of 2017 Annual Report and Program Design. CONSIDER FOR ACTION AMENDMENT TO SECTION 207, GENERAL SIGN REGULATIONS, TO ALLOW VEHICLE SIGNS ON TAXI CABS. REQUEST SUBMITTED BY BOBBY SHANE FLANIGAN. James Mills stated that the owner of a local taxicab company has submitted a request to amend the provisions of the Cookeville Zoning Code to allow vehicle signs on taxicabs. Advertising on taxicabs is permitted in many municipalities; however, such signage in currently not permitted in the City of Cookeville. Vehicle signs are regulated in Section 207.3K in the General Sign Regulations of the Zoning Code, which reads as follows: 207.3K (As amended by Ordinance No. O02-12-32) The following provisions shall apply for all vehicle or trailer signs: COOKEVILLE PLANNING COMMISSION 3 FEBRUARY 27, 2017 1. The parking or placing of a vehicle or trailer sign on a public right-of-way, public property or private property so as to be visible from a public right-of-way where the apparent purpose is to advertise a message is prohibited. 2. No vehicle or trailer sign shall be parked or placed off or away from the premise that owns it, except during the normal course of business, such as deliveries, picking up merchandise, or service calls. 3. When a vehicle or trailer sign is parked or placed on the premise that owns it such signs shall be parked or placed in a designated parking space. 4. This section is not intended to prohibit signs that are placed on a vehicle to advertise the sale or lease of that vehicle. It is proposed that Section 207.3K be amended to insert the following: 5. This section shall not be applicable to vehicle signs displayed or installed on: a. Buses used for public transportation b. Taxicabs, subject to compliance with the provisions of Title 9, Chapter 4 of the City of Cookeville Municipal Code The operation of taxicabs within the City of Cookeville is regulated through the Municipal Code in Title 9, Business, Peddlers, Solicitors, Etc.; Chapter 4, Taxicabs. It is proposed that Chapter 4 be amended to insert the following: 9-416. Vehicle Signage. Each taxicab may affix one (1) advertising assembly to the top of the vehicle roof subject to the following conditions: (1) Shall not obscure any required vehicle markings (2) Shall not add more than 18 inches to the overall height of the vehicle (3) Shall not extend beyond the width or length of the roof (4) Shall be securely mounted to the top of the vehicle and shall not create a safety issue (5) Shall be static, no digital, electronic or any signage involving movement shall be permitted (6) Shall obtain a Sign Permit from the Department of Codes for each sign. Staff recommended approval of amendments to Section 207 of the Zoning Code and Title 9, Chapter 4 of the Municipal Code as specified. Jim Woodford made the motion to approve amending Section 207 of the Zoning Code and Title 9, Chapter 4 of the Municipal Code as recommended by staff. Chris Wakefield seconded the motion. APPROVED. COOKEVILLE PLANNING COMMISSION 4 FEBRUARY 27, 2017 CONSIDER FOR ACTION PRELIMINARY PLAT OF BULLINGTON FARMS SUBDIVISION PHASE I, 6 LOTS LOCATED OFF OLD SPARTA ROAD. REQUEST SUBMITTED BY BULLINGTON LAND COMPANY. James Mills stated that Mr. Chad Gilbert on behalf of Bullington Land Company, LLC has submitted for approval a Preliminary Plat of Bullington Farms Subdivision Phase I, a six (6) lot single family detached division of a portion of property located on Old Sparta Road. The subject property is identified on Tax Map 96 as an approximately 0.68 acre portion of Parcel 18.00. The section of the property was rezoned in November 2016 from RS-20, (Single Family Residential) to zoned RS-5, (Single-Family Residential). Adjacent property to the north is zoned RS-20 and adjacent property to the south is zoned RS-20 and CI (Commercial-Industrial Mixed Use). All of the new lots will front Old Sparta Road and will be addressed off Old Sparta Road, but Lots 1-5 will only have rear driveway access by a proposed 20 feet wide public alley that will run parallel with Old Sparta Road. Lot 6 will be the only lot allowed driveway access to Old Sparta Road. This new alley is proposed for connection to Old Sparta Road by two (2) new streets. One street is proposed as Bullington Drive which will run approximately 137 feet along the southwest boundary of Lot 1 connecting to the southern end of the new alley. The second one is proposed as Roley Drove which will connect from the northern end of the alley approximately 145 feet back to Old Sparta Road between Lots 4 & 5. Public Works requires that this new alley be restricted to one way traffic in a northerly direction. New four (4) foot sidewalks are to be constructed along the interior of the new connector streets. Public Works also requires that street plans be submitted and the developer must obtain a grading permit. Public Works has stated that the waste canisters must be staged at the rear of the structures along the alley for pickup. There are two (2) existing fire hydrants that are within the required proximity for fire protection. The Water Quality Control Department states that sewer can connect to the existing four (4) inch pressurized main and that water can connect to the existing six (6) inch water line, both which are located in the right-of-way of Old Sparta Road. The Water Department recommends that if the developer intends to develop the remainder of the site that utilities should be stubbed out prior to paving the streets in Phase I. The Electric Department requires that all electric is to be installed underground per CED specifications and easements be established as needed. Frontier Communications stipulates that they will require the developer to pay for the relocation of any aerial facilities if required. Staff recommended conditional approval of the preliminary plat subject to the following: • Developer must schedule and attend a pre-construction meeting with all the appropriate city departments, • Developer must submit a roadway construction plan and profile with storm sewer and sidewalk details to the Department of Public Works. Plan shall include typical road section, subgrade, base width, asphalt width and 3:1 slopes, • Developer shall submit a Storm Water Pollution Prevention Plan (SWPPP) to the Department of Public Works, COOKEVILLE PLANNING COMMISSION 5 FEBRUARY 27, 2017 • Developer must submit water and sewer plans to the Water Quality Control Department, • Developer shall submit plans for the installation of underground electric per the Electric Department design requirements, • Developer to submit plans for the installation of natural gas to the Gas Department if gas service is desired, • Developer to provide all conduit for underground communications facilities, CAD files and electrical layout plan to Frontier Communications and the developer must pay for the relocation of any of Frontier’s aerial facilities if required, • Developer shall provide all utility easements as required by the Electric, Gas and Water Quality Control Departments, and • Completion of corrections or additions to the plat as determined necessary by the Planning Department and/or other appropriate city departments. Kay Starkweather made the motion to grant conditional Preliminary Plat approval of the Bullington Farms Subdivision Phase I, subject to staff’s recommendation. Jim Woodford seconded the motion and the motion carried unanimously. CONDITIONAL PRELIMINARY PLAT APPROVAL. CONSIDER FOR ACTION PRELIMINARY PLAT OF GREYSTONE SUBDIVISION (FORMALLY BROAD STREET ESTATES), 61 LOTS LOCATED ON EAST BROAD STREET. REQUEST SUBMITTED BY TITAN DEVELOPMENT. James Mills stated that Mr. Justin Cumby on behalf of Titan Development has submitted for approval a Preliminary Plat of Greystone Subdivision, a 61 lot single family detached residential development of property located across from Briargate Subdivision on East Broad Street abutting the western right-of-way of Highway 111. The property proposed for development is identified on Tax Map 52 as Parcels 38.00 and 38.03 and combined contains approximately 34.18 acres. This property is zoned as RS-10, (Single Family Residential) as are all adjacent properties. The plat depicts the creation of three (3) new streets within the subdivision consisting of approximately 3,200 feet in total length. Greystone Way is a proposed cul-de-sac that will provide a western access point with East Broad Street and Greymoor Lane is proposed as an eastern access point to East Broad Street that will connect to Greystone Way. In addition, Greystone Court is proposed as a cul-de-sac off of Greymoor Lane. New five (5) foot wide sidewalks are proposed to be installed along both sides of all new streets, including the cul-de-sacs. The typical road section depicted on the plat also shows a curb and gutter profile with a two (2) foot grass strip between the curb and the sidewalk. Public Works requires that the developer submit street plans and obtain a grading permit. As shown on the plat, there is an area located within the southern portion of the property impacting Lots 15 through 20 that is demarcated as a Sinkhole Retention Area. As per Section 231.10 of the Zoning Code, the developer is required to enlist the services of a geotechnical engineer licensed in the State of Tennessee to determine and certify the appropriate sinkhole retention area buffer based on their analysis of the particular collapse COOKEVILLE PLANNING COMMISSION 6 FEBRUARY 27, 2017 feature. In addition, Public Works has stipulated that the developer is required to verify that there are no wetlands or streams on the property. The Water Quality Control Department requires the submittal of state approved engineered plans for the provision of water, fire hydrants and sewer. There is an existing 14” waterline and a sanitary sewer force main both located in the right-of-way of East Broad Street that will allow connections for the new development. There are two (2) existing fire hydrants located in the East Broad Street right-of-way and four (4) new hydrants are proposed within the development to provide adequate coverage for fire protection as required by the Subdivision Regulations. The Electric Department requires that all electric is to be installed underground per CED specifications and easements be established as needed. Frontier Communications stipulates that they will require the developer to pay for the relocation of any aerial facilities if required. Staff recommended approval of preliminary plat subject to the following: • Developer must schedule and attend a pre-construction meeting with all the appropriate city departments, • Developer understands and agrees that all right-of-ways must be cleared prior to any installation of utilities, • Developer must submit a street plan and profile with storm sewer and sidewalk details to the Department of Public Works for all new streets. Plan shall include typical road section, subgrade, base width, asphalt width and 3:1 slopes, • Developer shall submit a TDEC approved Storm Water Pollution Prevention Plan (SWPPP) to the Department of Public Works, • Developer will submit the required geotechnical analysis of the appropriate buffer required for the Sinkhole Retention Area, • Developer will provide verification to Public Works regarding the existence of any wetlands or streams on the site, • Developer must provide easements along all road frontage on both sides of the new streets as required by the utilities, • Developer must submit water (including fire hydrants) and pressure sewer plans to the Water Quality Control Department, • Developer shall submit plans for the installation of underground electric per the Electric Department design requirements, • Developer to submit plans for the installation of natural gas to the Gas Department if gas service is desired, • Developer to provide all conduit for underground communications facilities, CAD files and electrical layout plan to Frontier Communications, and • Completion of corrections or additions to the plat as determined necessary by the Planning Department and/or other appropriate city departments. Jim Cobb made the motion to grant conditional Preliminary Plat approval of Greystone Subdivision (formally Broad Street Estates), subject to staff’s recommendation. Jim Woodford seconded the motion and the motion carried unanimously. CONDITIONAL PRELIMINARY PLAT APPROVAL. COOKEVILLE PLANNING COMMISSION 7 FEBRUARY 27, 2017 CONSIDER FOR ACTION FINAL PLAT OF CROSS POINTE SUBDIVISION PHASE II. 36 LOTS LOCATED ON THE NORTHEAST CORNER OF OLD SPARTA ROAD AND BOB BULLOCK ROAD. REQUEST SUBMITTED BY BERNHARDT, LLC. James Mills stated that Aaron Bernhardt has submitted for approval his Cross Pointe Subdivision Phase II Final Plat, a 36 lot single family detached development located at the intersection of Old Sparta Road and Bob Bullock Road. The preliminary plat for the development was initially approved by the Planning Commission in November 2015 and a six (6) month extension was subsequently granted on November 28, 2016. The subject property is identified on Tax Map 96 as Parcel 24.02 and Phase II contains approximately 8.52 acres and is zoned RS-5 (Single Family Residential). The overall Preliminary Plat for the proposed development was granted conditional approval by the Planning Commission at the October 26, 2015 meeting and a revised preliminary plat was approved on November 23, 2015. As noted on the plat, included as part of the approval was the granting of a variance to reduce the new street right-of-way from 50 feet to 40 feet. Note C on the plat stipulates all lots in Phase II only have driveway access to the new street, Cross Pointe Drive. Public Works advised that the base stone has not been inspected and approved, the asphalt binder has not been installed, nor have the sidewalks been constructed. Once the base stone is inspected and approved and the binder has been installed and approved, Public Works will determine the amount the developer must submit to pay for the final asphalt surfacing. The developer has the option to financially guarantee the sidewalk installation for a period of up to five (5) years subject to consultation with Public Works to determine the dollar amount required and compliance with ADA sidewalk design requirements. The developer is also required to pay Public Works for the cost of required street signage in the development. A new six (6) inch water line has been installed as well as an extension of the pressurized sewer main and two (2) new fire hydrants. The Water Quality Control Department advises that once the “as-built” plans are submitted they will schedule a final inspection to correct any deficiencies. The Electric Department requests that easements be added to the plat for all overhead and underground conduits and equipment. There are no topographic constraints such as sinkholes, wetlands, streams or flood hazard areas indicated on the site. However, there are four (4) areas depicted on the plat that will require the installation of rain gardens at the time the affected lots are further developed. Public Works recommends that a note be added to the plat stating that the perpetual maintenance of the rain gardens on those lots is the responsibility of the property owner. Finally, the developer is required to post a financial guarantee in the amount of $10,000 as a two-year Warranty of Improvements for the development since these improvements are being dedicated to the public. Staff recommended conditional approval of the Final Plat subject to the following: COOKEVILLE PLANNING COMMISSION 8 FEBRUARY 27, 2017 • Base stone to be inspected and approved and asphalt must be installed and approved by Public Works prior to the determination of the payment amount to be submitted for the final surfacing, • Developer to coordinate the installation of sidewalks or financially guarantee deferral of construction with Public Works, • Developer to submit “as-built” plans to the Water Quality Control Department, • Developer must provide easements along both sides of the new streets as required by the utilities, • A note is to be added to the plat that the rain gardens depicted on the plat must be installed and approved by Public Works prior to the issuance of a Certificate of Occupancy for the affected lots and the perpetual maintenance of the rain gardens is the responsibility of the individual property owner, • Developer to submit the $10,000 two-year term Warranty of Improvements financial guarantee, • Developer to submit the fee for final surfacing as determined by Public Works, • Developer to construct sidewalks subject to inspection and approval by Public Works or financially guarantee the completion of same as stipulated by Public Works, • Developer to pay for street signage as determined by Public Works, and • Completion of corrections or additions to the plat as determined necessary by the Planning Department and/or other appropriate city departments. Aaron Bernhardt stated that they should be asphalting by next week. Jim Woodford made the motion to grant conditional Final Plat approval of Cross Pointe Subdivision Phase II, subject to staff’s recommendation. Chris Wakefield seconded the motion and the motion carried unanimously. CONDITIONAL FINAL PLAT APPROVAL. CONSIDER FOR ACTION FINAL PLAT OF DOWNTON SQUARE PHASE VI, 17 LOTS LOCATED ON BOWERWOOD CIRCLE. REQUEST SUBMITTED BY JERRY C. GAW, INC. James Mills stated that Jerry Gaw and Aaron Bernhardt have submitted for approval a Final Plat of Downton Square Phase VI, a 17 lot phase of their development off of East Spring Street and Bowerwood Circle adjacent to the City of Cookeville Public Works Department. The subject property is identified on Tax Map 53M Group B as a portion of Parcel 2.00. The property is zoned CG (General Commercial) and this portion of the site consists of approximately 3.03 acres containing 16 single family attached townhomes on individual lots. Lot 17 is the remaining common area which also encompasses two (2) rain gardens, of which one was approved as part of Phase I in April 2015. The units all front Bowerwood Circle which has been completed through the binder stage. Sidewalks have not yet been constructed in this phase. Each of the dwelling units are being outfitted with sprinkler systems that meet the National Fire Protection Association design standard 13D. All of the property including the streets, common areas and infrastructure components are private. Repair and maintenance of the common elements will be covered under an amended homeowner’s association agreement that is to be submitted in a timely manner COOKEVILLE PLANNING COMMISSION 9 FEBRUARY 27, 2017 after the final plat is recorded. The developer has previously submitted an amended letter of credit to cover the remaining improvements for the prior phases in the amount of $77,500.00 which is valid until April 1, 2017. Public Works has agreed to accept an amended letter of credit in this amount to guarantee the remainder of the improvements in the overall development for an extended period. No Warranty of Improvements financial guarantee is required due to the fact that all infrastructure is to remain privately owned. Staff recommended conditional approval of the Final Plat as submitted, subject to any additions and/or corrections to the plat as required by the Planning Department and other city departments, the submission of an amended Letter of Credit to guarantee the remaining improvements and the submission of the amended Homeowner Agreement in a timely manner after the plat is recorded. Jim Woodford made the motion to grant conditional Final Plat approval of Downton Square Phase VI, subject to staff’s recommendation. Tracy Cobb seconded the motion and the motion carried unanimously. CONDITIONAL FINAL PLAT APPROVAL. CONSIDER FOR ACTION PRELIMINARY PLAT OF DOWNTON SQUARE PHASE IV-B, 5 LOTS LOCATED ON BOWERWOOD CIRCLE. REQUEST SUBMITTED BY JERRY C. GAW, INC. STAFF HAS REQUESTED THAT THIS ITEM BE MOVED FROM STUDY TO ACTION SINCE PHASE IV HAS PREVIOUSLY BEEN REVIEWED AND APPROVED. MOVING THIS ITEM FROM STUDY TO ACTION REQUIRES THE APPROVAL OF THE PLANNING COMMISSION. James Mills stated that Jerry Gaw and Aaron Bernhardt have submitted for approval a final revision of the Preliminary Plat of Downton Square Phase IV-B, a five (5) lot single family attached development off East Spring Street. This area of the development was initially granted conditional Preliminary Plat approval by the Planning Commission on October 26, 2015. A revised preliminary plat was subsequently given conditional approval by the Planning Commission on May 23, 2016. A second revised preliminary plat of Phase IV-A & B was granted conditional approval on August 22, 2016. Phase IV-A was also granted conditional final approval at the August meeting. Phase IV-B is intended to be the final portion of this development. The subject property is identified on Tax Map 53M Group B as a portion of Parcel 2.00. The property is zoned CG (General Commercial) and Phase IV-B comprises .34 acres with four (4) building lots and Lot 5 encompassing the remaining common areas in this phase. The remaining four (4) units proposed for construction in Section IV-B have been delayed due to on-site logistical issues. The units will face Bowerwood Circle with rear garage access via Branson Alley, both which have been completed through the binder stage. Utility mains for these last units have also been installed. Public Works has requested that the rain garden constructed in Phase VI be shown on this plat as well. Repair and maintenance of the common elements will be covered under an amended homeowner’s association agreement that is to be submitted in a timely manner after the final plat is recorded. COOKEVILLE PLANNING COMMISSION 10 FEBRUARY 27, 2017 Staff recommended conditional approval of the submitted Preliminary Plat subject to any additions and/or corrections as required by the Planning Department or other city departments.
