COOKEVILLE PLANNING COMMISSION MINUTES JUNE 25, 2018 The Cookeville Planning Commission met on Monday, June 25, 2018 at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Jim Stafne, Judy Jennings, Chris Wakefield, David Webb, Jim Woodford, Kay Starkweather, Leslie Sullins Draper, Tracy Cody, and Jim Cobb. STAFF MEMBERS PRESENT: James Mills, Jayne Barns, Ken Young, and Jon Ward. STAFF MEMBERS ABSENT: Mike Davidson. OTHERS PRESENT: Ben Wheeler, Gail Mackie Smith, Joel Deason, Bob Jett, Jerry Gaw and Eric Walker. CONSIDER FOR APPROVAL MOVING FROM STUDY TO ACTION THE FOLLOWING: ACTION ITEM #5: CONSIDER FOR ACTION REVISED PRELIMINARY PLAT OF WINDSOR HILL PHASE II, 31 LOTS LOCATED OFF NOTTINGHAM DRIVE. REQUEST SUBMITTED BY JERRY GAW AND AARON BERNHARDT. Kay Starkweather made the motion to approve moving Action Item #5 from study to action. APPROVED. CONSIDER FOR ACTION REZONING 2075 FOUNTAIN CIRCLE FROM CI (COMMERCIAL-INDUSTRIAL MIXED USE) TO HM (HEAVY MANUFACTURING). REQUEST SUBMITTED BY JOEL DEASON ON BEHALF OF NELL DEASON. James Mills stated that Mr. Joel Deason, on behalf of property owner Mrs. Nell Deason, has submitted a request to rezone from CI, Commercial- Industrial Mixed Use to HM, Heavy Manufacturing Mrs. Deason’s property located at 2075 Fountain Circle. The subject property is identified as Parcel 3.00 on Tax Map 40D, Group C and consists of approximately 0.739 acres. It is also identified as Lot 3 in the Tony Deason Division, a six (6) lot subdivision located off Shag Rag Road approved by the Planning Commission in 2007. The parcel is contiguous on the north, south and east with properties zoned as CI and on the west with property zoned as HM. The property is currently undeveloped. COOKEVILLE PLANNING COMMISSION 2 JUNE 25, 2018 The CI District is intended to accommodate a mixture of compatible commercial and light industrial developments. The HM District is intended for heavy industrial uses and establishments in the basic processing and manufacturing of materials or products predominantly from extracted or raw materials. The Cookeville 2030 Plan depicts the property as being best suited for general industrial use. Mr. Deason indicates in the petition that the purpose of the request is to allow the location of an auto body repair shop, with an auto wrecker service and storage yard. Auto wrecker service and storage yards are permitted only in the HM District and as a special exception in the LM, Light Manufacturing District. In both districts the use is subject to the additional standards of Section 206.15. Many uses permitted in the HM District may have potential impacts on nearby properties. Mr. Deason has informed the Planning Department that the property is subject to deed restrictions that restrict its use and would minimize any impact on adjacent properties. He also indicates that his family owns the other five (5) parcels within the subdivision. Staff recommended approval of the rezoning request, subject to including Lot #1. Mr. Mills added that in order to get on the towing list for the Cookeville Police Department the towing lot has to be in the city limits of Cookeville. Mr. Deason agreed to the inclusion of Lot #1 in the proposed rezoning to HM. He stated that his Dad put restrictions on the lots to include fencing and screening which is comparable to the lot where their business is located and he would appreciate the Planning Commission’s consideration on this matter. Leslie Sullins Draper made the motion to approve rezoning 2075 Fountain Circle from CI (Commercial-Industrial Mixed Use) to HM (Heavy Manufacturing), subject to including Lot #1 as part of the request. Chris Wakefield seconded the motion and the motion carried unanimously. APPROVED REZONING, SUBJECT TO INCLUDING LOT #1 AS PART OF THE REQUEST. CONSIDER FOR ACTION ESTABLISHMENT OF ZONING FOR THE MACKIE FARM AREA AS CI, COMMERCIAL-INDUSTRIAL MIXED USE. REQUEST SUBMITTED BY STAFF. James Mills stated that the annexation of the Mackie Farm area became effective on June 9, 2018. The Mackie Farm annexation area is located on the eastern fringe of the Cookeville corporate limits south of Interstate 40 and east of State Highway 111. The area consists of nine (9) parcels comprising approximately 249 acres. A Referendum to annex the area was held on May 1, 2018. The Plan of Service for this annexation area, as adopted through Resolution No. R18-03-03 specifies that the area shall be zoned as RS-20, Single Family Residential upon the effective date of annexation. It also provides that the petitioners for annexation have requested CI, Commercial-Industrial Mixed Use zoning for the area and the Planning COOKEVILLE PLANNING COMMISSION 3 JUNE 25, 2018 Department will submit a recommendation to the Planning Commission for rezoning to CI within three (3) moths after the effective date of annexation. The Cookeville 2030 Plan depicts the property as being best suited for mixed used of a commercial and industrial nature. The CI District conforms with this land use classification. Staff recommended approval of rezoning the Mackie Farm annexation area to CI (Commercial-Industrial Mixed Use). Bob Jett, property owner at 2330 Salem Road, stated that there are four (4) tracts that he and his neighbors would like to keep as RS20 (Single Family Residential). Jim Woodford made the motion to approve zoning the Mackie Farm Area as CI (Commercial-Industrial Mixed Use). Jim Cobb seconded the motion and the motion carried unanimously. APPROVED ZONING TO CI (COMMERCIAL-INDUSTRIAL MIXED USE). James Mills asked Mr. Jett to get him the names and addresses of the properties that they want to remain as RS20 and he will pass on the information to the City Council. STAFF HAS REQUESTED THAT THIS ITEM BE MOVED FROM STUDY TO ACTION, SINCE THE NUMBER OF LOTS HAS BEEN REDUCED. MOVING THIS ITEM FROM STUDY TO ACTION REQUIRES THE APPROVAL OF THE PLANNING COMMISSION. James Mills stated that Developers Aaron Bernhardt and Jerry Gaw have submitted for approval a revised Preliminary Plat of Windsor Hill Phase II, now a 31 lot single family attached development of their property located on East Spring Street and Nottingham Drive. The subject property is identified on Tax Map 67A Group F as Parcel 59.00. The property contains approximately 19.07 acres total and the portion to be developed is zoned CL, “Local Commercial” and contains approximately 8.54 acres. The remainder of the property is property is zoned CR, “Regional Commercial” and the adjacent Windsor Hill Subdivision is zoned RD, “Single Family and Duplex Residential”. Section 221.3 of the Zoning Code stipulates that single family detached townhouses are allowed as a use permitted on review by the Planning Commission in the CL zone. The revised plat now consists of 30 building lots instead of 33 as previously approved by the Planning Commission in June 2017. Lot 31 will encompass the remaining common areas. All of these lots will front a new looped private interior street (Windsor Hill Drive) that will have ingress/egress access from Nottingham Drive and East Spring Street (US70N) and is under construction. Public Works Director, Greg Brown, has confirmed that the Tennessee Department of Transportation permitted, inspected and approved this existing driveway cut on the state route. COOKEVILLE PLANNING COMMISSION 4 JUNE 25, 2018 The units are planned to all contain two (2) bedrooms without garages and off street parking is calculated at the rate of 1.25 spaces per bedroom and the required number of spaces are shown on the plat. A new four (4) foot wide sidewalk is depicted along one side of the private street that will serve the units. However, the developers indicated they may want to install a walking trail along the development area perimeter to provide pedestrian access in lieu of a sidewalk, subject to approval by Public Works. There are several topographic constraints on the site. There is a portion of the property designated as a Sinkhole Retention Area (SRA ID # 215) with a base flood elevation established as 1094’. In 2010 the developers enlisted Littlejohn Engineering to conduct a drainage study (on file) to establish appropriate development of the site to comply with the SRA regulations. This study has been reviewed and accepted by Public Works as being compliant with the SRA development requirements. In addition, there are areas that have been delineated as wetlands which are shown on the plat with a 15’ minimum buffer. The plat has been revised to depict additional wetland buffer areas as requested by Public Works. Each dwelling unit is to be outfitted with sprinkler systems that meet the National Fire Protection Association design standard 13D. The developer is working with Fire Chief Daryl Blair to locate new hydrants in the development to ensure adequate coverage for fire protection. Sewer and water will be connected to the eight (8) inch gravity sewer line and six (6) inch water line located within the adjacent street right-of-ways. Water for the lots will be on a master meter. Water Quality Control Engineer Barry Turner has consulted with the project engineer, Phil Staton with Clinton Engineering and they have determined that several of the lots will require fill material to establish an acceptable first floor elevation in order to connect to the gravity sewer. The Electric Department requires that all electric is to be installed underground per CED specifications. The developer states he does not intend to install natural gas. All of the property including the driveway, parking areas and other common areas and infrastructure components are private. Repair and maintenance of the common elements will be covered under a homeowner’s association agreement that is to be submitted in a timely manner after the final plat is recorded.
