The Cookeville Planning Commission met on Monday, July 23, 2018 at 5:30 p.m., in the
Council Chambers, 45 E. Broad Street, Cookeville, Tennessee.

CONSIDER FOR ACTION ESTABLISHMENT OF RAO, “REDEVELOPMENT
AREA OVERLAY” DISTRICT FOR PROPERTIES IDENTIFIED AS PARCELS
5.02, 5.05, 12.00 & 13.00 ON TAX MAP 53B “P’ AND LOCATED AT 358 W. 4TH
STREET, 281 & 319 CHESTNUT AVENUE AND 350 WEST 3RD STREET.

Mills stated that Mr. Aaron Bernhardt has submitted a request for RAO (Redevelopment
Area Overlay) zoning of property located along North Chestnut Avenue between West 3rd
and West 4th Streets for the purpose of developing a 17 unit townhouse development to be
identified as University Park.
The RAO District was created in 2013 as a mechanism for the redevelopment,
revitalization, rehabilitation, and general improvement of areas within the City of
Cookeville as identified within the Cookeville 2030 Plan as being in need of such action,
or other areas within the city as may be determined to be in need of such action. Within
RAO districts, the city may waive or modify certain development requirements to provide
incentives for redevelopment, including increases in density, reduction of setbacks, and
reductions of lot sizes. Specific criteria must be met for properties to qualify for RAO

zoning and a detailed process for approval must be followed. Only those uses permitted in
the underlying zoning may be permitted in a RAO district. To qualify for RAO zoning the
site must contain a minimum of one (1) acre when located within an area identified in the
Cookeville 2030 Plan as being in need of revitalization/redevelopment. The developer
must submit and adhere to an approved development plan.
The process for the approval of RAO zoning involves several steps. First the developer is
required to meet with the Planning Director to determine whether the RAO zoning is
appropriate for the proposed property. If it is determined that the property is appropriate
for RAO zoning, then the developer must submit a request for overlay zoning, a written
statement describing the proposed development and how it meets the objectives of the
2030 Plan, and a Preliminary RAO Concept Plan. The Concept Plan must include site,
floor and elevation plans. The Planning Commission, after reviewing the overlay zoning
request and required submittals, must submit a recommendation to the City Council for
approval, modification, or denial of the request. Upon receipt of the Planning Commission
recommendation the City Council then considers enactment of the overlay.
Once the overlay is enacted, a Final RAO Plan must be submitted to and approved by the
Planning Commission. The Final RAO Plan must be submitted within six (6) months after
the effective date of the enactment of the overlay by the City Council or the overlay zoning
action shall become null and void. Extension of no more than 18 months may be granted
by the Planning Commission. The Final RAO Plan must substantially conform to the
Preliminary RAO Concept Plan. Any substantial modifications to the approved Final RAO
Plan must be resubmitted to the Planning Commission.
The properties proposed for RAO zoning are identified as Parcels 12.00 and 13.00 on Tax
Map 453B, Group P and consists of approximately 0.84 acre, or 36,590 square feet. The
site is located entirely within an area identified in the Cookeville 2030 Plan as being in
need of redevelopment/revitalization. The minimum land area requirement for designation
as a RAO is one (1) acre, or 43,560 square feet. Section 232A.5 of the Zoning Code
provides that an area of less than the minimum size may be considered if, due to number of
dilapidated or condemned structures or other factors, it can be demonstrated that
significant public benefit can be achieved.
The underlying or existing zoning classification of the property is RD, Single Family and
Duplex Residential. The subject properties are currently used for multi-family residential
purposes. Located on Parcel 12.00 is a dwelling that was converted into multiple
apartments, the number of which is unknown, and on Parcel 13.00 is a 12 unit apartment
building. Both structures are in dilapidated condition and have been condemned by the
city. The properties are located in an area locally known as the “L Block”. In the opinion
of the Planning Department significant public benefit will be achieved by the removal of
these dilapidated structures and the approval of an area less than the required minimum
size is justified for this site.
Mr. Bernhardt has submitted a Preliminary RAO Concept Plan, written statement, site
plan, floor plans, elevation plans, photos and other materials required for RAO zoning
consideration. The application indicates that seventeen (17) townhomes (single family

attached dwellings) would be constructed. Townhouses are a permitted use in the RD
district upon review by the Planning Commission provided they are located in a RAO
zone.
The site plan indicates that the townhouses would be clustered into one (1) group of eight
(8) units and one (1) group of nine (9) units fronting Chestnut Avenue. A total of 45
parking spaces are shown, which is three (3) more than required. Thirteen of the spaces
are parallel spaces located along an alley adjacent to the east of the subject property. The
alley is proposed to serve as access to the proposed development. The alley is located
within a right-of-way of sixteen (16) feet. In order to accommodate the anticipated traffic
Mr. Bernhardt is requesting the city approve designating the alley for one-way traffic,
entering from the south and exiting to the north. The developer will be required to widen
and improve the alley to required street standards.
According to the submitted development schedule all existing structures would be removed
within six (6) months of approval of the RAO with new construction beginning thereafter
and to be completed within two (2) years. The floor plans for the townhouses depict the
construction of two (2) story dwellings with kitchen and living area and a half-bath on the
first floor and two (2) bedrooms and two (2) bathrooms located on the second floor. The
elevation plans indicate that the structures will be all brick and Hardie Plank construction.
Sidewalks along Chestnut Avenue and West 3rd Street will be installed and rain gardens
would be utilized for storm water detention instead of a detention pond. Parking areas
would be provided in the interior of the development and no direct vehicle access from
public streets to any dwelling will be provided. A dumpster would be utilized for garbage
collection. Canopy trees are to be planted along all street frontages.
As noted, the underlying zoning for the property is RD in which a minimum of 5,000
square feet of land area is required per dwelling unit. Under the provisions of the RAO
district, the city may allow a density bonus of up to 20 units per acre, which is
approximately 2,178 square feet per dwelling unit. For an area containing 36,590 square
feet, up to sixteen (16) dwelling units could be approved. As noted, Mr. Bernhardt is
proposing 17 dwelling units. To construct 17 units a land area of approximately 37,026
square feet would be required, or approximately 436 square feet more than is present. Mr.
Bernhardt is asking that the requirement for the additional 436 square feet be waived and
that he be allowed to construct 17 units.
The proposed development includes the dedication of property as right-of-way along
Chestnut Avenue. The Preliminary RAO Plan depicts the dedication of 6.5 feet of property
along Chestnut Avenue between West 3rd and West 4th Streets. Approximately 2,178
square of property would be dedicated to provide 20 feet of right-of-way from the
centerline of Chestnut Avenue. Mr. Bernhardt is requesting that he be held harmless in
regards to required land area and building setbacks as a result of this dedication.
Mr. Bernhardt is requesting a reduction in the front setback requirements along West 3rd
and West 4th Streets from 20 feet to 15 feet. He is also asking that he be allowed to use
setback averaging to reduce the setbacks from 20 feet to 18 feet for eight (8) of the

dwellings along Chestnut Avenue as measured from the property line prior to dedication of
property as right-of-way.
In addition the developer is requesting that the city pay half the expense for the provision
of decorative street lighting as was done for the University Square development.
Staff recommended approval of Preliminary RAO Concept Plan for the development of 17
townhouse dwelling units and approval of the requested setback reductions with
recommendation to City Council for the enactment of RAO zoning and for authorization of
the requested assistance in street lighting.
Jim Stafne asked if safety vehicles would be able to use the alley.
James Mills stated that 16’ is the minimum width for an alley and that safety vehicles
would be able to use the alley.`
Jim Woodford made the motion to approve the establishment of RAO (Redevelopment
Area Overlay) District for properties identified as Parcels 12.00 & 13.00 on Tax Map 53B-
P and located at 358 West 5th Street and 319 Chestnut Avenue, subject to staff’s
recommendation. Jim Cobb seconded the motion and the motion carried unanimously.
APPROVED ESTABLISHMENT OF RAO.
CONSIDER FOR ACTION SIX (6) MONTH EXTENSION OF THE
PRELIMINARY PLAT OF THE JOHNNY HAMMOCK DIVISION, 16 LOTS
LOCATED OFF HUDDLESTON DRIVE. REQUEST SUBMITTED BY JOHNNY
HAMMOCK. James Mills stated that Mr. Johnny Hammock has submitted a request for a
six (6) month extension of the Preliminary Plat for his Johnny Hammock Division, which
is a 16 lot single family residential subdivision located off of Huddleston Drive. The
Preliminary Plat was initially approved by the Planning Commission on July 21, 2015 for a
period of one year. Since that time, multiple extension requests have been submitted and
approved by the Planning Commission.
As provided in Article II, Section D, Subsection 9 of the Subdivision Regulations, an
extension of time can be applied for by the developer and granted by the Planning
Commission provided a $50.00 fee is submitted with the request. Mr. Hammock submitted
the fee with his request for an extension. No work has begun to install improvements on
the site, nor have any changes been made to the plat since the most recent preliminary plat
was approved.
Staff recommended approval of the request for a six (6) month extension of the
Preliminary Plat as requested.
Leslie Sullins Draper made the motion to approve six (6) month extension of the
Preliminary Plat of the Johnny Hammock Division. Jim Woodford seconded the motion
and the motion carried unanimously. APPROVED SIX (6) MONTH EXTENSION.

CONSIDER FOR ACTION FINAL PLAT OF MAGNOLIA CREEK PHASE I, 25
LOTS LOCATED OFF FREEHILL ROAD. REQUEST SUBMITTED BY KMJ
PROPERTIES, LLC. James Mills stated that Mr. Michael Petty, on behalf of property
owner KMJ Properties, LLC, has submitted a Final Plat of Phase I of Magnolia Creek
RAO (Redevelopment Area Overlay) located off Freehill Road. The Preliminary
Plat/Final RAO Plan was approved by the Planning Commission on July 24, 2017.
The RAO for the site was created by Ordinance Number O17-04-06 and became effective
on June 2, 2017. The underlying or existing zoning classification of the property is RM-8,
Multi-Family Residential. The subject property is identified as Parcel 12.00 on Tax Map
27N, Group B and Phase I consists of approximately 5.99 acres containing 25 single
family detached residential lots.
Phase I involves the development of a new public cul-de-sac with the proposed name of
Juniper Drive. The street is being constructed with curb and gutter with a primarily
previously approved right-of-way reduction of 40 feet. In addition, 25 on-street parking
spaces are to be constructed in the right-of-way along the southern side of the proposed
Juniper Drive. Sidewalks, four (4) feet in width, are to be constructed on both sides of the
new street and along Freehill Road. Public Works has stipulated that financial guarantees
in the form of letters-of-credit may be submitted to guarantee the completion of the street
binder surface, curb and gutter, and the sidewalks. After the six (6) inch stone base course
is applied, compacted, inspected by Public Works and approved, a one (1) year $81,500
letter-of-credit may be submitted to guarantee the application of additional base stone (i.e.,
up to two (2) inches if required to meet the six (6) inch minimum depth requirement),
completion of the two (2) inch binder surface and the curb and gutter. A sidewalk letter-of-
credit in the amount of $31,500 for a period of up to five (5) years may be submitted in
lieu of completion. Also in lieu of completion, a certified check in the amount of $25,500
is acceptable to pay for the final surfacing of the new street. In addition, the developer
must submit payment in the amount of $150 to Public Works for street signage.
Water, sanitary sewer and underground electric service are being installed. The Water
Quality Control (WQC) Department reports that the water has been installed and tested but
the sewer installation has not been completed. The location of all utility extensions serving
Phase I that traverse through the Phase II area of the property must be depicted on the
Phase I plat as a 20 foot wide utility easement. (When Phase II is completed these
easements will be shown as absorbed by the right-of-way in the new street proposed for
construction in Phase II). WQC also requires that the developer submit “as-built” plans for
water and sewer and in addition, must submit a letter-of-credit in the amount of $2,300 for
two (2) years to cover for any needed adjustments of meter boxes, valves, manholes or
other appurtenances.
A bio-retention area (i.e., rain garden) is to be constructed in the first phase on Lot Number
49. The maintenance of this bio-retention area will be the responsibility of the respective
owner. There are no FEMA identified Special Flood Hazard Areas indicated on the
property, however there is a stream in the southwest area of the property that is to be
depicted on the plat with a 30 foot buffer as required by the Public Works Department.

As the new street and other improvements are to be dedicated to the public, the developer
must also submit a $10,000 letter-of-credit for a two (2) year period payable to the City of
Cookeville as a Warranty of Improvements. If the binder surface and curb and gutter are
not installed within three months of recording of the Final Plat the developer shall be
required to submit a new 2 year letter-of-credit beginning at the date of the completion of
the binder surface and curb and gutter.
Staff recommended conditional Final Plat approval subject to the following conditions:
• A one (1) year letter-of-credit payable to the City of Cookeville in the amount of
$81,500 to guarantee up to an additional two (2) inches of base stone if needed,
completion of the two (2) inch binder surface, and curb and gutter shall be submitted
by the developer in lieu of completion,
• A letter-of-credit (period up to 60 months) payable to the City of Cookeville in the
amount of $31,500 shall be submitted to guarantee sidewalk construction,
• A certified check payable to the City of Cookeville in the amount of $25,500 to pay for
final street surfacing shall be submitted by the developer in lieu of completion,
• Developer shall pay $150 to the Public Works Department for street signage,
• Developer shall submit “as-built” plans for water and sewer to Water Quality Control
for review and approval,
• Developer shall submit a Warranty of Improvements two (2) year letter-of-credit in the
amount of $10,000 payable to the City of Cookeville, with timing coordinated by
Planning Department, and
• Completion of corrections or additions to the plat as determined necessary by the
Planning Department and/or other appropriate city departments.
Michael Petty stated that he would like to pay into a sidewalk fund.
Ken Young stated that he was unaware of this, but that he would check into it.
Jim Woodford made the motion to grant conditional Final Plat approval of Magnolia Creek
Phase I, subject to staff’s recommendation. Leslie Sullins Draper seconded the motion and
the motion carried unanimously. CONDITIONAL FINAL PLAT APPROVAL.
CONSIDER FOR ACTION SIX (6) MONTH EXTENSION OF THE
PRELIMINARY PLAT OF THE COTTAGES, 49 LOTS LOCATED OFF
MCCULLEY ROAD AND SPRINGBORO ROAD. REQUEST SUBMITTED BY
TIM HUDDLESTON. Ken Young stated that Mr. Tim Huddleston has submitted a
request for a six (6) month extension of The Cottages Subdivision Preliminary Plat, which
is a 49 lot single family detached residential subdivision located off of McCulley Road and
Springboro Road. The current Preliminary Plat was approved by the Planning Commission
on January 23, 2017 for a period of one year. The initial preliminary plat of the
development was approved on July 26, 2010.
As provided in Article II, Section D, Subsection 9 of the Subdivision Regulations, an
extension of time can be applied for by the developer and granted by the Planning
Commission provided a $50.00 fee is submitted with the request. Mr. Huddleston

submitted the fee with his request for an extension. Limited grading work has been done
on the site and no changes been made to the plat since the most recent preliminary plat was
approved.
Staff recommended approval of a six (6) month extension of the Preliminary Plat as
requested.

Plat of The Cottages. Jim Cobb seconded the motion and the motion carried unanimously.

CONSIDER FOR ACTION FINAL PLAT OF GREYSTONE SUBDIVISION, 61
LOTS LOCATED ON EAST BROAD STREET. REQUEST SUBMITTED BY
JUSTIN CUMBY OF TITAN DEVELOPMENT, LLC. Ken Young stated that Mr.
Justin Cumby on behalf of Titan Development has submitted for approval the Final Plat of
Greystone Subdivision, a 61 lot single family detached residential development of property
located across from Briargate Subdivision on East Broad Street abutting the western right-
of-way Highway 111.
The development property is identified on Tax Map 052 as Parcels 038.00 and 038.03 and
combined contains approximately 34.18 acres. This property is zoned as RS-10, (Single
Family Residential) as are all adjacent properties. The plat depicts the construction of three
(3) new streets within the subdivision consisting of approximately 3,200 feet in total
length. Greystone Way is a new cul-de-sac that provides a western access point with East
Broad Street and Greymoor Lane is an eastern access point to East Broad Street that
connects to Greystone Way. In addition, Greystone Court is a new cul-de-sac off of
Greymoor Lane. New five (5) foot wide sidewalks are proposed to be installed along both
sides of all new streets, including the cul-de-sacs.
The new streets have been constructed with curb and gutter. Public Works advises that the
Tennessee Department of Environment and Conservation is to evaluate and approve
wetland delineation on the site in the near future. A detention pond in the northeast area of
the property must be completed and inspected and approved by Public Works. (This
includes installing a headwall on the 30 inch pipe going into the pond). Backfilling behind
all curbs, catch basin soil removal and stabilization of both detention ponds must be
completed.
Public Works Director, Greg Brown, has stipulated that a letter-of-credit in the amount of
$121,000 for a period of up to 60 months is to be submitted to the City of Cookeville to
guarantee the completion of the sidewalks. A certified check in the amount of $61,500
payable to the City of Cookeville is required to cover the cost of final street surfacing. In
addition, the developer is to pay Public Works a total of $600 for four (4) street signs and
four (4) stop signs.
The Water Quality Control Department reports that all water and sewer construction has
been completed, tested and “as-built” plans have been approved. Four (4) new hydrants
have been installed to provide adequate coverage for fire protection as required by the

Subdivision Regulations. The Electric Department reports that all electric has been
installed underground as per CED specifications and easements must be established as
needed.
As all new streets and infrastructure is to be dedicated to the public, the developer must
also submit a $10,000 letter-of-credit payable to the City of Cookeville for a two (2) year
period as a Warranty of Improvements.
Staff recommended conditional Final Plat approval subject to the following:
• Developer to make all site adjustments and/or completions as stipulated by Public
Works,
• Developer to submit a letter-of-credit payable to the City of Cookeville in the amount
of $121,000 for a period of up to 60 months to guarantee the completion of all
sidewalks,
• Developer to submit a certified check payable to the City of Cookeville in the amount
of $61,500 for the final street surfacing,
• Developer to pay Public Works $600 for street signage,
• Developer shall submit a Warranty of Improvements in the form of a two (2) year
letter-of-credit in the amount of $10,000 payable to the City of Cookeville, with timing
coordinated by Planning Department staff, and
• Completion of corrections or additions to the plat as determined necessary by the
Planning Department and/or other appropriate city departments, including the depiction
of wetlands as determined by TDEC.
Jim Woodford made the motion to grant conditional Final Plat approval of Greystone
Subdivision, subject to staff’s recommendation. Jim Cobb seconded the motion and the
motion carried unanimously. CONDITIONAL FINAL PLAT APPROVAL.
CONSIDER FOR ACTION FINAL PLAT OF THE RESUBDIVISION OF LOT #4,
5, 6 AND PORTION OF 7 OF SPECK SUBDIVISION, 3 LOTS LOCATED ON
SPECK ROAD. REQUEST SUBMITTED BY BRANDON & RACHEL PRUETT.
Ken Young stated that property owner Brandon Pruett has submitted for approval a final
plat of the Speck Subdivision Re-division of Lots 4-7, a three (3) lot single family
detached subdivision of his property located on Speck Road. A preliminary plat is not
required because the development requires no new street or utility construction and there
are less than 10 lots proposed.
The subject property is identified on Tax Map 39I Group A as Parcel 005.00 containing
approximately 1.45 acres and is zoned RS-20, “Single Family Residential” as are all
adjacent parcels.” The proposed development consists of three (3) lots with Lot 2
containing an existing single family residential structure. Lots 1 and 3 are undeveloped.
There is a six (6) inch waterline and two (2) inch pressure sewer line available in the right-
of-way of Speck Road for utility connections. There are no existing hydrants within the
required coverage area. However, the Water Quality Control Department reports that they
intend to install a hydrant to serve the area by the first week in August. Available GIS data
does not indicate any natural constraints on the site such as sinkholes or flood hazard areas.

Staff recommended conditional approval of the Final Plat subject to the installation of the
new hydrant and the completion of corrections or additions to the plat as determined
necessary by the Planning Department and/or other appropriate city departments
Jim Woodford made the motion to grant conditional Final Plat approval of the
Resubdivision of lots #4, 5, & 6 and a portion of lot 7 of the Speck Subdivision. Leslie
Sullins Draper seconded the motion and the motion carried unanimously.
CONDITIONAL FINAL PLAT APPROVAL.
CONSIDER FOR ACTION FINAL PLAT OF DONOVAN DIVISION, 3 LOTS
LOCATED ON FORREST COVE LANE. REQUEST SUBMITTED BY MICHAEL
& DORIS DONOVAN. Ken Young stated that property owners Michael & Doris
Donovan have submitted for approval a final plat of the Donovan Division, a three (3) lot
single family detached subdivision of their property located on Forrest Cove Lane. A
preliminary plat is not required because the development requires no new street or utility
construction and there are less than 10 lots proposed.
The subject property is identified on Tax Map 27 as Parcel 127.02 containing
approximately 2.00 acres and is zoned RS-10, “Single Family Residential” as are adjacent
parcels to the east and west. The northern property boundary is also the corporate limits of
the City of Cookeville. The proposed development consists of three (3) lots with Lot 1
containing an existing single family residential structure. Lots 2 and 3 are undeveloped.
There is a six (6) inch waterline and eight (8) inch gravity sewer line available in the right-
of-way of Forrest Cove Lane for utility connections. There is an existing hydrant located
across the street that provides adequate coverage for the lots. Available GIS data does not
indicate any natural constraints on the site such as sinkholes or flood hazard areas.
Staff recommended conditional approval of the Final Plat subject to the completion of
corrections or additions to the plat as determined necessary by the Planning Department
and/or other appropriate city departments

Donovan Division, subject to the completion of corrections or additions to the plat as

submitted a request to allow a six (6) month extension of the $10,000 letter of credit
serving as a Warranty of Improvements for the River’s Edge Subdivision, a 30 lot single
family detached residential development located at the southern end of Old Sparta Road.
The current warranty is due to expire on August 10, 2018. Public Works has advised Mr.
Bilbrey of several items that need to be corrected at the site under the warranty. Due to

time constraints, Mr. Bilbrey has asked for the extra time to address and correct any and all
issues.
Staff recommended approval of the request as submitted subject to receiving the extension
of the letter of credit no later than Monday August 6, 2018.
Jim Woodford made the motion to approve six (6) month extension of the $10,000 letter of

(2) TRANSPORTATION SURVEY. Jon Ward gave the following summary of the results from
the 2018 Putnam County Joint Transportation Improvements Survey:
The Putnam County Joint Transportation Committee was formed in late 2017 under the
direction of Putnam County Executive Randy Porter. The Committee is composed of
elected officials, engineers and planners representing Putnam County, the Towns of
Algood, Baxter, Monterey, and the City of Cookeville. The purpose of the Committee
is to develop a comprehensive, multi-jurisdictional transportation improvement
plan. Over the past several months the committee has met to identify transportation
improvement needs for the county and its four (4) municipalities. The identified needs
consist of projects that would be wholly state funded, state and local funded, and
wholly locally funded. To determine which of the state funded and combination state
and local funded projects are most important to the citizens, the Committee elected to
utilize a survey to solicit public input. The survey was developed by the Cookeville
Planning Department, and was hosted on Survey Monkey. The survey was open from
June 9, 2018 through July 7, 2018 and 1,254 people participated in the survey.
Planning Staff presented the survey results to the Planning Commission. The

Committee plans to rank the projects and utilize the rankings to introduce needed road
and street improvement projects to the Tennessee Department of Transportation.
