The Cookeville Planning Commission met on Monday, March 25, 2019 at 5:30 p.m., in the
Council Chambers, 45 E. Broad Street, Cookeville, Tennessee.

CONSIDER FOR ACTION FINAL PRD PLAN FOR THE AERIE, PROPERTY
LOCATED AT 1000 NORTH FRANKLIN AVENUE (TAX MAP 40I-D-1.00 & 2.00).
REQUEST SUBMITTED BY COOKEVILLE AERIE, LLC. James Mills stated that
Mr. Eric Jakimier, of Domus Development and on behalf of property owner Cookeville
Aerie LLC, has submitted for approval the Final PRD Plan for The Aerie, a 160 unit, 412
bedroom student housing apartment complex located on West 9th Street and North Franklin
Avenue. Cookeville Aerie LLC purchased the property from Titan Development LLC in
February 2019. The Preliminary PRD Plan was approved by the Planning Commission at
its November 2017 meeting. The Cookeville City Council, through Ordinance Number
O17-12-24, approved the rezoning to PRD for the development at its January 18, 2018
meeting and it became effective on February 1, 2018.
The property proposed for rezoning originally consisted of Parcels 1.00 and 2.00 on Tax
Map 40I, Group D and together comprised approximately 11.11 acres. A plat combining
these parcels was recently reviewed, approved and recorded by the City of Cookeville.

The combination plat dedicated additional right-of-way along North Franklin Avenue (25
feet from street centerline), reducing the total land area to 11.09 acres.
The City Council, as a part of the rezoning approval, established the following additional
requirements for the PRD development:
• Exterior lighting shall be LED and Dark Sky compatible,
• Berms shall be constructed on the north, west, and south perimeters where there are no
significant elevation changes with the adjoining property, locations to be established by
the Planning Department,
• Evergreen trees 20 feet in height for screening as depicted on the submitted plans,
• Decorative metal fencing provided around the perimeter, and
• Sidewalks to be installed along Franklin Avenue to University Drive extension.
A Final PRD Plan must be submitted to and approved by the Planning Commission within
18 months after the effective date of the enactment of the PRD district by the City Council
or the rezoning action shall be repealed. Approval of the Final PRD Plan is required
before construction can begin. The Final PRD Plan must substantially conform to the
Preliminary PRD Plan. It must contain detailed information on the proposed development
including circulation diagrams for vehicles and pedestrians, areas to be preserved as open
space, each building site including height and bulk of all buildings, floor plans of all
structures to be built, and plans for utilities including storm water facilities. Additionally,
a development schedule must be submitted indicating when each phase of the development
is to begin and be completed.
The developer has submitted the materials required for approval, including the Final PRD
Plan, Open Space Plan, Grading and Drainage Plan, Utility Plan, Landscape Plans and
Calculations, Building and Club House Floor Plans, Building and Club House Elevations,
and Lighting Plan (Photometrics). The Final PRD Plan substantially conforms with the
Preliminary PRD Plan as approved by the Planning Commission and City Council. It
indicates that the proposed 160 dwelling units would be located in three (3) separate
buildings. This represents a density of approximately 14.5 dwelling units per acre which is
less than the 21 units per acre permitted in the PRD District. The units would be
comprised of 32 one (1) bedroom, 66 two (2) bedroom, and 62 four (4) bedroom floor
plans. The 412 bedrooms require the provision of 470 off-street parking spaces which is
indicated on the plan. The Final PRD indicates that parking canopies will be provided at
13 locations, covering approximately 95 spaces. Also depicted on the plan are a club
house, swimming pool and maintenance building.
The three (3) buildings are each indicated as being split levels, partially four (4) stories and
three (3) stories in height, to better accommodate the terrain of the property. The three (3)
stories are to be located on the western half of the buildings facing the adjacent single
family residential area. Based on the grading plan submitted with the Final PRD, the site
will be excavated to a depth of up to 14 feet along the western border so the parking and
buildings will sit at a lower elevation, reducing the visibility from adjoining properties.

The Final PRD Plan depicts two (2) points of access, one from North Franklin Avenue and
one from West 9th Street. It was noted during the review of the Preliminary PRD Plan that
the Tennessee Tech University Master Plan depicts the extension of University Drive to
North Franklin Avenue. The extension is proposed to intersect North Franklin Avenue
approximately 200 feet south of the proposed access to the subject property. In 2018 the
Planning Department recommended that the developer approach the university about
realigning the proposed extension to line up with the entrance of The Aerie. The
university has indicated that they did not want to alter the planned alignment. In the
opinion of the Planning Department the proposed extension of University Drive to North
Franklin Avenue will have a major impact on traffic in the immediate area, much more so
than the proposed PRD project. Since it intersects North Willow Avenue at a signalized
intersection it is anticipated a large amount of traffic will utilized the extension as a direct
route to campus. Aligning the extension with the entrance to The Aerie will create an
intersection where a 4-way stop can be implemented which will provide a safer
intersection, a safer place for pedestrians to cross, and will slow traffic on North Franklin
Avenue. City officials will be meeting from representatives of the university later this
month to discuss the potential realignment.
PRD zoning requires that a minimum of 25 percent of the land area be preserved as open
space. The submitted Open Space Plan depicts approximately 45 percent of the site
remaining as open space (5.02 of 11.09 acres). The bulk of this open space is comprised of
an environmentally sensitive area along the eastern boundary of the site. A hiking trail is
to be located in the large open space area.
The Landscape Plan depicts a Type 3 Screen along the northern and western perimeters of
the property. A total of 187 Southern Magnolias, 20 feet in height at the time of planting,
are indicated as the primary tree for screening. Berms from six (6) to 14 feet in height are
depicted along the northern boundary. As previously noted the western landscaped buffer
yard will be significantly elevated from the development, almost the entire length being at
least seven (7) feet below grade. The northwest corner of the site will be at grade due to
drainage. In this area the developer is proposing significant landscaping to screen and
buffer the adjoining property. The Landscape Plan also depicts a metal decorative fence
along the perimeter of the property.
The Building and Club House Elevations depict the use of stucco, fiber cement lap siding,
and cultured stone as exterior finish materials. Composite shingles are proposed for
roofing for the apartment buildings. Metal seam roofing is proposed for the Club House.
The Lighting Plan indicates the use of LED lighting for all exterior lighting. The
maximum height of any exterior lighting is 20 feet. The photometrics indicate little, if any,
light bleed onto adjoining property. The required perimeter screening will further reduce
any off-site light.
The submitted Development Schedule specifies that the project will be completed in one
phase. The property owner’s engineer, Cain-Click, indicates that construction is anticipated
to start in June 2019. The Clubhouse is expected to be completed in November 2019 and
the apartments are to be completed by July of 2020.

Staff recommended approval of Final PRD Plan as submitted.
Eric Walker asked what type of stucco will be on the exterior of the buildings.
Erick Jakimier stated that it was concrete stucco.
Eric Walker asked if the developer does not plant the 20’ trees as noted in the plan what
would be the next step.
James Mills stated that it would have to go back to the City Council, since that was a
condition for approval.
Jim Stafne asked if they would have security on the property.
James Mills responded that the property would be gated at both entrances.
Jim Cobb made the motion to approve the final PRD Plan. Daniel Odom seconded the

CONSIDER FOR ACTION FINAL PLAT FOR RESUB DIVISION OF LOT #167-
170 OF D. C. WICHITA ADDITION, 5 LOTS LOCATED ON CROCKETT
AVENUE AND A REQUEST TO CHANGE THE NAME TO THE ENCLAVE AT
CROCKETT. REQUEST SUBMITTED BY DONNIE SUITS OF CAPITAL
COMMUNITIES, LLC. Jon Ward stated that Mr. Donnie Suits with Capital
Communities, LLC has submitted for approval a Final Plat of the Re-subdivision of D.C.
Wichita Addition Lots 167-170 with a request to change the name to The Enclave at
Crockett. This is a five (5) lot single family attached development of his property located
on Crockett Avenue that was granted conditional preliminary plat approval on May 22,
2018.
The subject property is identified on Tax Map 53L Group A as Parcel 7.01. The property is
zoned CL, “Local Commercial” and consists of approximately 0.37 acres. Adjacent
properties to the north and east are also zoned CL and property to the south is zoned RS-5,
“Single Family Residential”. Single-family attached townhouse developments are
permitted on review in the CL district subject to submittal of a plat and approval of the
Planning Commission.
The development consists of four (4) building lots and Lot 5 encompasses the remaining
common areas. All of the lots front a new private interior parking and ingress/egress area
and are addressed off of Crockett Avenue. Two (2) units are two (2) bedrooms and two (2)
are three (3) bedrooms. Off street parking calculated at the rate of 1.25 spaces per bedroom
requires a minimum total of 12 parking spaces which are now in place. The preliminary
plat depicted the proposed construction of a new five (5) foot wide sidewalk along the
Crockett Avenue street frontage. Due to issues with the grade, Public Works Director Greg
Brown approved the developer’s request to waive the requirement to construct the
sidewalk provided the developer pay into the sidewalk in lieu of fund. Mr. Suits paid
$1,615.00 into the fund on February 22, 2018 as directed by Mr. Brown.

Two (2) rain gardens have been constructed on both sides of the driveway entrance. The
retaining wall constructed at the rear of the site and the trench drain that has been installed
in the driveway entrance are both depicted on the plat. The development ties into the
existing eight (8) inch sewer line and the two (2) inch water line in the right-of-way of
Crockett Avenue. The water meter and sewer tap locations have been verified and
corrected on the plat. All of the dwelling units are outfitted with sprinkler systems that
meet the National Fire Protection Association design standard 13D. In addition, an existing
fire hydrant approximately 200 feet from the site on East Hodgins Street is within the
required proximity for fire protection. All electric has been installed underground per
CEDE specifications. All of the property including the driveway, parking areas and other
common areas and infrastructure components are private. Repair and maintenance of the
common elements will be covered under a homeowner’s association agreement that is to
be submitted in a timely manner after the final plat is recorded.
Staff recommended approval of the request to change the name to The Enclave at Crockett
and conditional approval of the final plat subject to the following:
• Submission of the Homeowner Association Agreement in a timely manner after the
final plat is recorded, and
• Completion of corrections or additions to the plat as determined necessary by the
Planning Department and/or other appropriate city departments.
Kay Starkweather made the motion to approve changing the name to The Enclave at
Crockett and to grant conditional approval of the Final Plat, subject to staff’s
recommendation. Jim Cobb seconded the motion and the motion carried unanimously.

CONSIDER FOR ACTION FINAL PLAT OF RESUB DIVISION OF LOT 4 OF
10TH & FISK PROPERTIES, LLC DIVISION, 10 LOTS LOCATED AT 1020 FISK
ROAD. REQUEST SUBMITTED BY MATT DAVIDSON ON BEHALF OF
TENTH AVENUE PARTNERS, LLC. Jon Ward stated that Mr. Matt Davidson on
behalf of Tenth Avenue Partners LLC has submitted for approval the Final Plat of 10th &
Fisk Properties LLC Division, Re-subdivision of Lot 4, a 10 lot single family attached
development of their property fronting Fisk Road. The preliminary plat was initially
approved on March 27, 2017. Six (6) month extensions were granted on March 26, 2018
and September 24, 2018.
The subject property is identified on Tax Map 40L Group K as Parcel 013.03. The property
is zoned CN, “Neighborhood Commercial” and consists of approximately 1.03 acres.
Adjacent properties to the south and west are also zoned CN, and remaining properties to
the north are zoned RS-10, “Single-Family Residential”. The development consists of nine
(9) building lots and Lot 10 encompasses the remaining common areas. On January 12,
2017 the Board of Zoning Appeals granted a variance to reduce the total square footage per
dwelling unit to allow a maximum of nine (9) dwelling units to be constructed on the site
based on the submitted site plan. Six (6) dwelling units have two (2) bedrooms and the
remaining three (3) units have three (3) bedrooms. The total 21 bedrooms require 26

parking spaces as is depicted on the plat. All lots will front existing private vehicular
access easements to the north and south. These existing easements are also used to access
adjacent properties. A new 16 foot wide private vehicular access easement is to be
constructed along the western property boundary, connecting the two (2) existing
easements and creating a continuous traffic loop. This private vehicular access easement
loop is to be named Dansby Drive and all lots will be addressed off it. New four (4) foot
wide sidewalks are to be constructed within the property and a new five (5) foot wide
sidewalk is to be constructed along the Fisk Road frontage. The developer has installed a
detention pond under the direction of the Public Works Department. All of the dwelling
units are outfitted with sprinkler systems that meet the National Fire Protection
Association design standard 13D. In addition, there is one (1) existing fire hydrant located
on the southwest corner of the site. The All electric is installed underground per CEDE
specifications and easements are to be provided. The Gas Department reports that gas has
been installed. The developer intends to provide solid waste management using individual
canisters in lieu of a dumpster. They will consult with Public Works to determine the best
location for staging the containers for pickup. All of the property including the driveway,
parking areas and other common areas and infrastructure components are private. Repair
and maintenance of all common elements will be covered under a homeowner’s
association agreement that is to be submitted in a timely manner after the final plat is
recorded.
Staff recommended conditional approval of the Final Plat subject to the following:
• Sidewalks and street construction must be completed,
• Utility easements are to be provided as requested by the CEDE and WQC,
• Developer to coordinate canister placement with Public Works,
• All landscaping must be installed,
• All signage must be installed,
• Submission of the Homeowner Association Agreement in a timely manner after the
final plat is recorded, and
• Completion of corrections or additions to the plat as determined necessary by the
Planning Department and/or other appropriate city departments.
Eric Walker made the motion to grant conditional approval of the Final Plat, subject to

CONSIDER FOR ACTION SIX (6) MONTH EXTENSION OF THE
PRELIMINARY PLAT OF FRANKLIN COURT, 5 LOTS LOCATED ON SOUTH
FRANKLIN AVENUE (BETWEEN HUGHES STREET & SHORT STREET).
REQUEST SUBMITTED BY LARRY SUGGS OF WATERMILL
CONSTRUCTION GROUP, LLC. Jon Ward stated that Mr. Larry Suggs on behalf of P
& N Investments LLC has submitted for approval a request for a second six (6) month
extension of the Preliminary Plat of Franklin Court, a five (5) lot single family attached
residential development of their property located on South Franklin Avenue. The
Subdivision Regulations provides that up to two (2) six month extensions of preliminary
plat approval may be requested by the developer. The development was granted

conditional preliminary approval at the September 25, 2017 Planning Commission
meeting. A request for a six (6) month extension was granted by the Planning Commission
on September 24, 2018.
The undeveloped site is identified on Tax Map 53I Group B as Parcel 23.00 and consists of
approximately 0.32 acres total prior to right-of-way dedication. The plat depicts the
dedication of approximately five (5) feet of property along the right-of-way of South
Franklin Avenue to provide for future widening of the road. The size of the parcel
remaining after the dedication is approximately 0.29 acres. The parcel is zoned as CL,
local commercial as are all surrounding parcels. Section 221.31 of the Zoning Code states
in part that single family attached dwellings (townhouses) are a use permitted on review
subject to conditions which include submittal to and approval of the Planning Commission
of a site plan depicting the location of all proposed structures and improvements. The plat
depicts Lots 1-4 as attached building lots. Lot 5 is the total area of the parcel excluding
Lots 1-4 and is common area only and not a building lot. There have been no changes to
the plat as previously approved.
Staff recommended approval of a six (6) month extension of the Preliminary Plat subject to
the original terms and conditions specified at the September 25, 2017 meeting.
Chris Wakefield made the motion to approve the six (6) month extension of the
Preliminary Plat subject to the original terms and conditions specified at the September 25,
2017 meeting. Kay Starkweather seconded the motion and the motion carried
unanimously. APPROVED SIX (6) MONTH EXTENSION OF THE PRELIMINARY
PLAT.
CONSIDER FOR ACTION FINAL PLAT REDIVISION OF TRACT 2, PHASE III,
REVISED PLAT OF THE EYE CENTERS OF COOKEVILLE, 1 LOT LOCATED
ON OLD WALTON ROAD. REQUEST SUBMITTED BY RKB GROUP, LLC. Jon
Ward stated that the RKB Group LLC has submitted for approval the Final Plat of the Re-
division of Tract 2, Phase III Revised Plat of the Eye Centers of Cookeville, a one (1) lot
commercial development located on Old Walton Road between Neal Street and South
Maple Avenue. Although only one (1) new lot was proposed, the project required the
extension of sewer and improvements to the existing street and the construction of a new
cul-de-sac. Therefore, the submission of a preliminary plat and consideration by the
Planning Commission was required by the Subdivision Regulations. The plat was initially
approved on November 28, 2016 and a six (6) month extension was granted on November
27, 2017. Since that time a portion of the site at the corner of Neal Street and Old Walton
Road was subdivided into one (1) new 3.64 acre lot that was subsequently purchased by
the City of Cookeville and is intended to be the site of a new Police Department facility.
The Planning Commission conditionally approved the revised plat on March 26, 2018.
The subject property is a 2.25 acre portion of Parcel 33.00 shown on Tax Map 66. The
remainder of the parcel is not required to be surveyed because it is greater than five (5)
acres. The entire property is zoned CR, “Regional Commercial” as are all adjacent
properties. The overall development site including the property purchased by the City of
Cookeville required that a center turn lane on Old Walton Road be constructed from Neal

Street south to the northern property line of the new lot and the remainder of Old Walton
Road widened to 24 feet to the southern boundary of the property. A new five (5) foot
wide sidewalk along Old Walton Road was also required. These improvements were
required in anticipation of future traffic demands. As a condition of the sale of the lot on
the corner of Neal Street and Old Walton Road to the City of Cookeville, the City agreed
to complete the improvements to Old Walton Road, including sidewalks, and to construct a
new interior street. The property owner/developer agreed to be responsible for the
extension of all the required utilities. The section of Old Walton Road has been improved
and widened to the southwest corner of the developer’s new lot with the exception of the
final asphalt top coat. In addition, a new 36 feet wide public street named Guardian Way
approximately 560 feet in length and terminating in a cul-de-sac has been constructed
(except final asphalt top coat) that will serve both the developer’s property and the City of
Cookeville property. Public Works Director Greg Brown advises that the department will
apply the final asphalt top coat when appropriate. Public Works has installed a five (5)
wide sidewalk along the northern side of Guardian Way. The new sidewalk for Lot 1 will
be constructed when the lot is developed and Greg Brown advised that the sidewalk along
the new police station and Old Walton Road will be done when that site develops.
Codes Director Jeff Littrell stated that an address for the developer’s lot would be assigned
upon the submittal of a site plan. The Water Quality Control Department verified that the
water and sewer has been installed and inspected but the required “as-built” plans have not
yet been submitted. A new fire hydrant has been installed at the end of the cul-de-sac that
will provide adequate coverage for fire protection. All electric is installed underground per
CED specifications and 15 feet wide easements are provided for all street frontages. The
Gas Department reports that a natural gas main and service line is there and readily
available. There are no topographic constraints such as sinkholes, wetlands, streams or
flood hazard areas indicated by available GIS data on this site.
Staff recommended conditional approval of the Final Plat subject to the following:
• Sewer and water “as-built” plans must be submitted to WQC, and
• Completion of corrections or additions to the plat as determined necessary by the
Planning Department and/or other appropriate city departments.
Eric Walker made the motion to grant conditional approval of the Final Plat, subject to

CONSIDER FOR ACTION PRELIMINARY PLAT OF KRISHNA HOSPITALITY
PARTNERS PROPERTY, 2 LOTS LOCATED AT 970 SOUTH JEFFERSON
AVENUE. REQUEST SUBMITTED BY BOB VICK ON BEHALF OF NEIL
PATEL AND THE KRISHNA HOSPITALITY PARTNERSHIP. THE PROPERTY
OWNERS HAVE REQUESTED THAT THIS ITEM BE MOVED FROM STUDY
TO ACTION. MOVING THIS ITEM FROM STUDY TO ACTION REQUIRES
THE APPROVAL OF THE PLANNING COMMISSION. Jon Ward stated that Mr.
Neil Patel with Krishna Hospitality Partnership has submitted for approval the Preliminary
Plat of the Krishna Hospitality Partnership Property, a two (2) lot commercial development

located at 970 South Jefferson Avenue which is currently the location of the Quality Inn
hotel. The property has rear access to an unnamed private drive located on adjacent
property that serves as access to four (4) government office buildings located north of the
subject property. Although there are only two (2) lots created, there are several
infrastructure improvements proposed, including dedicating a portion of the private drive
as a permanent vehicular access easement, that require the submittal of a Preliminary Plat.
The subject property is identified on Tax Map 66 as Parcel 47.00 and contains
approximately 5.42 acres. The property is zoned CG, “General Commercial” as are
adjacent properties. The proposed Lot 2 currently has no street frontage. The developer is
proposing to bring a portion of the adjacent private driveway up to city street standards and
to create a private permanent access easement. The private driveway is located on adjacent
property identified as Parcel 16.01 on Tax Map 66K, Group A and owned by Neal Street
Investments, LLC. The developer will be required to improve this approximately 50 foot
wide easement for a distance of approximately 177 feet from Neal Street north. The Public
Works Department has completed cores of the existing driveway to determine how much
additional surfacing will be required to meet city street construction standards for a 20 feet
wide section of the proposed vehicular access easement. This proposed permanent access
easement will remain unnamed and Lot 2 will be addressed off Neal Street. As noted by
Codes Director Jeff Littrell this is necessary because the four (4) government office
buildings it serves are all addressed off of Neal Street.
A new five (5) foot wide by 125 foot long sidewalk is proposed to connect Neal Street to
the southeast corner of the new lot. A new 240 foot by five (5) foot sidewalk is proposed to
run north/south adjacent to the west side of the new proposed parking spaces. A total of 23
parking spaces are shown on the plat straddling the lot property line into the adjoining
property adjacent to the private unnamed street. It was determined at the plat review
meeting that this would still provide the number of total parking spaces required on the
site. A private vehicular access/parking easement must be added to the plat to address this
situation. There is an existing fire hydrant on the western right-of-way of the private
unnamed street that will provide adequate fire protection coverage. The Electric
Department requires all conduit and pads installed as per CED specifications. They further
require that all utilities are shown on the utility/site plan. The Gas Department reports they
currently serve the site and an additional meter will be set by the rotary that is already

Staff recommended conditional approval of the Preliminary Plat subject to the following:
• Developer shall schedule and attend a pre-construction and site plan review meeting
with all the appropriate city departments,
• Developer must submit a street plan and profile and sidewalk details to the Department
of Public Works for the new private street. Plan shall include typical road section,
subgrade, base width and asphalt width,
• Developer shall submit plans for the installation of underground electric per the
Electric Department design requirements ,

• Developer shall provide all utility easements as required by the Electric, Gas and Water
Quality Control Departments, and
• Completion of corrections or additions to the plat as determined necessary by the
Planning Department and/or other appropriate city departments.
There were several questions by the Commission concerning the dedication agreement
between property owners, parking on the street, traffic on the street and setback questions
for each parcel.
Eric Walker made the motion to keep this request as a study item for 30 days for further
review. Kay Starkweather seconded the motion and the motion carried unanimously.
