COOKEVILLE PLANNING COMMISSION MINUTES SEPTEMBER 27TH, 2021 The Cookeville Planning Commission met on Monday, September 27th, 2021, at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. MEMBERS PRESENT: Jim Cobb, Chad Gilbert, Judy Jennings, Lauren Metts, Jim Stafne, Eric Walker & Jim Woodford. MEMBERS ABSENT: Kay Starkweather & Leslie Sullins. APPROVED. CONSIDER FOR ACTION THE PRELIMINARY PLAT OF ENCORE SUBDIVISION, SIX (6) LOTS LOCATED ON EAST 10TH STREET. REQUEST SUBMITTED BY CAPITAL COMMUNITIES, LLC. DEVELOPER HAS REQUESTED THIS ITEM BE POSTPONED UNTIL THE OCTOBER 25TH PLANNING COMMISSION MEETING. Mr. Donnie Suits has requested that this item be postponed until the October 25th Planning Commission meeting. DEVELOPER HAS REQUESTED THIS ITEM BE POSTPONED UNTIL THE OCTOBER 25TH PLANNING COMMISSION MEETING. CONSIDER FOR ACTION THE PRELIMINARY PLAT OF LONE OAK TOWNHOMES, 15 LOTS LOCATED ON LONE OAK DRIVE. REQUEST SUBMITTED BY KDR3 INC. Jon Ward stated that Owner/Developer KDRS, Inc. has submitted for approval a preliminary plat of Lone Oak Townhomes, a 15- lot townhome development located on Lone Oak Drive. This proposal was taken for study by the Planning Commission at the August 23, 2021, meeting. Analysis: The subject property is a vacant lot identified as Tax Map 066, Group A, Parcel 010.00 and contains approximately 1.05 acres. The property is zoned CG, “General Commercial,” as are the properties to the east, south, and west of the subject property. The properties to the north are zoned RS-10, “Single- Family Residential.” Section 222.3A of the Zoning Code stipulates single-family attached dwellings (townhouses) are allowed in the CG Zone as a use permitted on review, subject to the submission of a plat in accordance with the Cookeville Subdivision Regulations. The development consists of 14 single-family attached building lots. Lot 15 is the remaining common area that is not a building lot and will include construction of a new private street and installation of utilities. A new five (5) foot wide ADA compliant sidewalk is required to be constructed along Lone Oak Drive. An interior sidewalk is to be constructed in front of the building lots. All proposed sidewalks must be depicted on the plat. The private access drive extends approximately 265 feet with no proposed turn around area. COOKEVILLE PLANNING COMMISSION 2 September 27th, 2021 The Planning Department recommends the plat be revised to depict a hammerhead or similar type turn around. A new currently unnamed private street is proposed to provide access off Lone Oak Drive. The developer must submit drainage and street construction plans to the Public Works Department. Public water service will connect to the existing six (6) inch water line located in the right-of-way of Lone Oak Drive. The developer must determine how water will be installed and coordinate service and the location of the water meter(s) with Water Quality Control. Private sewer will connect to the existing eight (8) inch gravity sewer main also located in the street right-of-way (Sewer availability was approved in writing by Water Quality Control on September 17, 2021). The developers must submit state approved water and sewer plans to the Department of Water Quality Control for review and approval prior to construction. There is one (1) existing hydrant located approximately 335 feet to the east at the intersection of Lone Oak Drive and Willow Avenue. An additional fire hydrant will be required to be installed. All of the dwelling units will have 303D residential sprinkler systems. The developer has advised that Clinton Engineering is in the process of preparing all required engineering plans for the development including storm water drainage features after the plat is considered by the Planning Commission. A decision has not yet been made regarding trash pickup. All common areas, sewer, and other infrastructure improvements will be maintained by a Homeowner Association Agreement that will be required upon final plat recording. No portion of the subject property is in a Special Flood Hazard Area according to the Flood Insurance Rate Maps for the area, nor are there indications of Sinkhole Retention Areas according to the available GIS data. Recommendation: Conditional approval of the Preliminary Plat subject to the following:  Plat shall be revised to show proposed location of stormwater infrastructure  Plat shall be revised to show proposed name of private street  Plat shall be revised to depict proposed sidewalks along Lone Oak Drive  Plat shall be revised to depict installation of an additional fire hydrant, to be in place by code per the Fire Department  Developer shall schedule a pre-construction review with the Planning Department in tandem with a site plan review with the Codes Department  Developer must submit a street plan and profile with storm sewer and sidewalk details to the Department of Public Works. Jim Cobb seconded the motion and the motion carried unanimously. APPROVED. CONSIDER FOR ACTION THE PRELIMINARY PLAT OF MAGNOLIA EAST, 20 SINGLE- FAMILY ATTACHED LOTS LOCATED AT 1011 EAST 10TH STREET. REQUEST SUBMITTED COOKEVILLE PLANNING COMMISSION 3 September 27th, 2021 BY JERRY GAW. Jon Ward stated that Mr. Jerry Gaw has submitted for consideration a preliminary plat of Magnolia East, a 20-lot single-family attached development of property located at 1011 East 10th Street. This proposal was taken for study by the Planning Commission at the August 23, 2021, meeting. Analysis: The subject property is vacant and identified as Tax Map 040M, Group B, Parcel 004.18 and contains approximately 1.45 acres. The property is zoned CL, “Local Commercial.” as are the properties to the east, north, and west of the subject property. The properties to the south are zoned RS-10, “Single- Family Residential”. Section 221.3A of the Zoning Code stipulates that single-family attached dwellings (townhouses) are allowed in the CL Zone as a use permitted on review, subject to the submission of a plat in accordance with the Cookeville Subdivision Regulations. The development consists of 20 single-family attached building lots and the construction of a private street and installation of utilities. The remaining lot consists of common area and is not a building lot. A new private street is proposed as Magnolia East Court to provide access off East 10th Street and terminates in a hammerhead to accommodate vehicle turn around. The developer must submit drainage and street construction plans to the Public Works Department. Public water will connect to the existing six (6) inch water line located in the right-of-way of East 10th Street and the developer must coordinate the locations of the water meters with Water Quality Control. The Water Quality Control Department requires a minimum of five (5) feet between sidewalk and structures to site a water meter. Also, a note will need to be included on the final plat regarding property restoration as required by the WQC Department for maintenance and repairs of the water line. Private sewer will connect to the existing eight (8) inch gravity sewer main also located in the street right-of-way (sewer availability was approved in writing by Water Quality Control on September 17, 2021). The developers must submit state approved water and sewer plans to the Department of Water Quality Control for review and approval prior to construction. There is one (1) existing hydrant located to the west of the subject property and all dwelling units will have 303D residential sprinkler systems. Trash pickup will consist of an on-site dumpster. Eric Walker seconded the motion and the motion carried unanimously. APPROVED. CONSIDER FOR ACTION THE FINAL PLAT OF DOWNTON NORTH PHASE II, 11 LOTS LOCATED ON EAST HUDGENS STREET. REQUEST SUBMITTED BY JERRY GAW. Jon Ward stated that Mr. Jerry Gaw has submitted for approval a Final Plat of Downton North Phase II, a 11-lot single- family attached development located between East Spring Street and East Hudgens Street across from Downton Square. A preliminary plat for the development was initially approved on June 24, 2019. A revised 20-lot plat was considered and approved at the November 25, 2019, Planning Commission Meeting for a period of one (1) year. A six (6) month extension was granted with a revised 19-lot plat on November 23, 2020, which also served as a six (6) month extension of the preliminary plat. Final approval was granted to Phase I of the development on January 25, 2021, consisting of seven (7) townhomes and a portion of the common area. An extension was approved for the remaining development on May 24, 2021. Analysis: The subject property is identified on Tax Map 053L, Group C, as Parcels 011.00 - 014.00. The property contains approximately 2.33 acres and is zoned CG. “General Commercial,” as are the adjacent properties to the east, west and south. Properties to the north are zoned RS-15 “Single Family Residential). Section 221.3 of the Zoning Code stipulates that single-family detached townhouses are allowed as a use permitted on review by the Planning Commission in the CG Zone. The final phase of the development consists of eleven (11) townhomes with the remaining common area. Lots 9-13 front East Hudgens Street and the City agreed to allow additional on-street parking in the right-of-way for these lots as shown on the plat. A new five (5) foot wide ADA compliant sidewalk (with easement) has been constructed on the subject property along East Hudgens Street. The remainder of the lots (14-19) front a new private street with the proposed name of Downton North. All these units have been addressed on the new private street. New four (4) foot sidewalks have been constructed internally. There are now 17 three (3) bedroom units and one two (2) bedroom unit for a total of 53 bedrooms. Parking is calculated at 1.25 spaces per bedroom which totals a minimum requirement of 67 parking spaces. All units have two (2) car garages and there are a total of 91 designated parking spaces. This includes 16 spaces in the East Hudgens right-of-way. The plat depicts the proposed location of a storm water detention pond as required by Public Works. The plat also depicts the proposed location of a dumpster for solid waste management. A central mailbox unit receptacle (CBU) is shown on the plat for mail pickup and delivery as required by USPS. Each dwelling unit is outfitted with sprinkler systems that meet the National Fire Protection Association design standard 13D. There is an existing hydrant (2000+ GPM) located on East Hudgens Street in front of the site. Water for the lots will be public and sewer will be private. Water Quality Control will require a sewer as-built for the portion of sewer installed to the east of this property. The underground electric utilities have been installed to conformity with the Electric Department requirements. All remaining property including the driveway, parking areas, and other common areas and infrastructure components other than water are private. Repair and maintenance of the common elements will be covered under a Homeowner Association Agreement that will be submitted in a timely manner after final plat approval. Recommendation: Conditional final plat approval subject to the following:  Developer to submit “as-built” water and sewer record drawings to Water Quality Control  Developer to complete construction of infrastructure for the development as required by Public Works  Completion of corrections or additions to the plat as requested by the Planning Department and/or any other appropriate city departments. COOKEVILLE PLANNING COMMISSION 5 September 27th, 2021 CONSIDER FOR ACTION THE FINAL PLAT OF REDIVISION OF LOT 8 OF MIDWAY HEIGHTS SUBDIVISION, SEVEN (7) LOTS LOCATED AT EAST 10TH STREET & WALL AVENUE. REQUEST SUBMITTED BY WADE VERBLE. Jon Ward stated that Mr. Wade Verble submitted for approval a Final Plat of the Redivision of Lot 8 of the Midway Heights Subdivision, a proposed seven (7) lot subdivision for single-family home construction. Analysis: The subject property is identified as Tax Map 041P, Group B, Parcel 009.00, and Tax Map 041P, Group B, 008.02 and contains approximately 1.87 acres. The subdivision is Zoned RS-10, “Single-Family Residential” and is contiguous with properties zoned RS-10 on the east, south, and west. The subject property is contiguous with RS-15 zoning to the north. The seven new lots will range between 0.23 acres or 10,139 square feet, to .44 acres or 19,288 square feet. A 20-foot utility easement is depicted on the final plat. As per the Subdivision Regulations, the proposal does not require prior preliminary plat approval since it contains less than 10 lots, and all infrastructure is existing. Water Quality Control has confirmed there is capacity to serve the proposed lots which will connect to the eight (8) inch gravity sewer line located in the Wall Avenue right-of-way and a hydrant is located at the intersection of Wall Avenue and Inglewood Drive that is within the required proximity to serve the lots. Per Article VI Section J of the Subdivision Regulations, new sidewalks are not required for subdivisions fronting existing streets. There are no natural geographic constraints on the property, such as sinkholes, wetlands, or special flood hazard areas. Proposed lot seven (7) of the development has frontage on East 10th Street and includes an existing single- family home located at 1281 East 10th Street. East 10th Street is under design for street improvements, included widening the street from three (3) to five (5) lanes and constructing sidewalks on both sides of the street. The entire project area extends from Highway 111 to Fisk Road. The property in question is located in phase II of these planned improvements. The Cookeville City Council approved right-of-way acquisition for this phase of the project on April 15, 2021. The Planning Department has discussed the 10th Street improvement project and right-of-way acquisition with the developer. Due to the submitted plat, Public Works has instructed the right-of-way consultant to begin acquisition with the subject property. Mr. Verble has agreed to delay recording of the plat until acquisition can be completed and the revised lot boundaries can be depicted on the final plat. Recommendation: Conditional approval of the Final Plat as submitted, subject to completing right-of-way acquisition for the East 10th Street improvement project, subject to additions and corrections as requested by the Planning Department and/or other appropriate city departments. Mr. John Wall stated that he lives in Algood but used to own the property in question and was born in the house located on the property. He has concerns with subdividing the property since the surrounding houses are larger and on larger lots. Mr. Wall believes the subdivision would lower property values and doesn’t believe other owners around the proposed property would be in favor of the subdivision. Mr. Wall suggested that the Planning Commission consider the effects that the proposed subdivision would have on the surrounding neighborhood. Councilman Eric Walker asked Mr. Wall if he was the property owner. Mr. Wall responded with no, his son is an adjoining property owner. Mr. Chad Gilbert asked if the plat is subject to the right-of-way being bought, is that holding the developer hostage before subdividing the plat? Mr. Jon Ward stated that subdivision plats take into consideration the development of roads. Mr. Gilbert asked if the owner is okay with holding off the plat until the right-of-way is purchased. Mr. Ward responded yes, the developer understands the conditions. Ms. Dora Yates asked what the size of the lots are before they are subdivided. Mr. Ward stated that each lot is around 0.9 acres each. COOKEVILLE PLANNING COMMISSION 6 September 27th, 2021 Mr. Wall stated that when the property was sold, his intent was to sell the house and keep the back lot as a single-family lot. He was surprised to see it being divided. Mr. Wall stated that he doesn’t remember signing anything to allow the new owner to subdivide the property. Mr. Ward stated that the City doesn’t enforce restrictions or covenants. Jim Woodford made the motion to approve the request submitted by staff. Eric Walker seconded the motion and the motion carried unanimously. APPROVED. CONSIDER FOR ACTION THE REZONING OF 315 SCOTT AVENUE (TAX MAP 053 PARCEL 019.00) FROM RS-10 (SINGLE-FAMILY RESIDENTIAL) TO CG (GENERAL COMMERCIAL). REQUEST SUBMITTED BY AARON BERNHARDT. Jon Ward stated that Mr. Aaron Bernhardt on behalf of property owner Larry Burgess, submitted a request to rezone from RS10, Single Family Residential and CG, General Commercial property located at 315 Scott Avenue. Analysis: The subject property is identified as Tax Map 053J, Group J, Parcel 019.00 and consists of approximately 0.325 acres. The property is bordered by CG General Commercial District Zoning to the north and west and RS-10, Single Family Residential to the south and east. The Future Land Use Concept Plan Element of the Cookeville 2030 Plan depicts the property as best suited for Regional Commercial Development and lower density residential development. The Future Land Use Plan boundary is similar to the properties to the west that are zoned CG, General Commercial. The rezoning application was submitted to combine the property with the parcel to the north to allow townhome development. Both West Stevens Street and Scott Avenue are classified as Minor Collector streets. Although Scott Avenue is classified as a collector street, development on Scott Avenue consists primarily single-family homes, with commercial properties with frontage and access on West Jackson Street and West Stevens Street. The petitioner has indicated that access to the development would be limited to West Stevens Street. Recommendation: Approval of the rezoning request, subject to access for commercial or higher density residential development being limited to West Stevens Street. CONSIDER FOR ACTION THE REZONING OF 2414 NORTH WASHINGTON AVENUE (TAX MAP 027 PARCEL 012.00) FROM CL (LOCAL COMMERCIAL) TO RS-20 (SINGLE-FAMILY RESIDENTIAL). REQUEST SUBMITTED BY JASON COBBLE. Jon Ward stated that Mr. Jason Cobble submitted a request to rezone from CL, Local Commercial to RS20, Single Family Residential property located at 315 Scott Avenue. Analysis: The subject property is identified as Tax Map 027, Parcel 012.00 and consist of approximately 3.126 acres. The property is bordered by CL Local Commercial and RS20, Single Family Residential to the north, RS20, Single Family Residential to the west, CL Local Commercial and RS20, Single Family Residential to the south, and LM, Light Manufacturing and RS20 Single Family Residential to the east. The Future Land Use Concept Plan Element of the Cookeville 2030 Plan depicts the property as best suited for mixed use Commercial-Industrial Development and lower density residential development. The commercial industrial boundary includes the areas of the lot with frontage on North Washington Avenue for a depth of approximately 100’ The rezoning application is a down zone from the current CL classification. The rezoning request was submitted to allow a single-family home to be constructed on the property. The Planning Department has concerns with the request. Rezoning this property entirely to single-family residential would sever the contiguous CL Zoning along the western side of North Washington Avenue, creating an area of CL Zoning located north of the subject property of approximately 5.2 acres (225,528 sq. ft). While this remaining area is over five (5) acres, this does sever the contiguity of the CL District. Also, North Washington Avenue is COOKEVILLE PLANNING COMMISSION 7 September 27th, 2021 classified as a Major Arterial Street. TDOT Annual Average Daily Traffic (AADT) just south of this site for 2018 was 6,165 vehicles per day. The Planning Department has concerns with continued impacts a major arterial street will have on single-family development. Typically, commercial, or higher density residential uses are better suited on streets of higher classification, while single family development is better suited on streets of lower classification, such as collector or local streets. While the contiguity of the CL Zone and impacts the arterial street will have on single-family residential development are concerns, the property does not have access to sufficient infrastructure for commercial development. The nearest sewer service is located on North Washington Avenue at Vickers Lane. This is approximately 1,175 feet from the southern boundary of the Cobble property. The Planning Department discussed maintaining 100 feet of the frontage along North Washing Avenue as CL, Local Commercial with the petitioner. This would allow for the CL District to remain contiguous and would require a single-family home to be sited further from the arterial street. Recommendation: Approval of the rezoning request, maintaining the frontage along North Washington Avenue for 100 feet as CL, Local Commercial. Eric Walker asked if the 100-foot buffer matches the Future Land Use Plan. Jon Ward responded with yes, it does. Chad Gilbert asked if the petitioner wants the 100-foot buffer if the Planning Department is recommending the buffer. Jon Ward stated that the petitioner wants to rezone the whole property, but the Planning Department feels that a 100 foot buffer would be beneficial. Lauren Metts asked if the Planning Commission votes in favor of the recommendation as requested, is it agreed upon by the petitioner? Mr. Ward stated that the Planning Commission can ask the petitioner when he speaks. Mr. Jason Cobble stated that the land was purchased over 20 years ago and borders his parents and grandparents houses. He stated that the land originally was not part of the farm but since has been combined with his parent’s intentions of having their children build a home on the property. Mr. Cobble stated that he doesn’t understand the benefit for him or anyone else of the 100-foot buffer. He stated he would like to rezone the whole property. Mr. Cobble stated that the surrounding properties around the property in question have single-family homes, so he would like for his property to be allowed to have a single-family home. Councilman Walker stated that if the whole lot is zoned residential, then it could be subdivided in the future. Mr. Ward stated that was correct, at least two (2) lots could be created. He stated that single-family homes cannot be developed in commercial zoning. The 100-foot buffer would keep from developing multiple lots. Mr. Jim Woodford asked if the entrance would come off of North Washington Avenue or the bordering property on the west. Mr. Ward stated that zoning would not deter a driveway if the 100-foot commercial zoning buffer is in place. Mr. Gilbert stated that downzoning isn’t normal, and the driveway would be off of a TDOT road. He stated that there is an anecdotal risk associated with downzoning. He is trying to plan and think for the future. Mr. Jim Cobb asked if the 100-foot buffer is from centerline of roadway or edge of property. Mr. Cobble asked how the 100-foot buffer would affect his property. Mr. Ward stated that he could not build a structure in the commercially zoned area. Councilman Walker stated that he is okay with the 100-foot buffer from the property line. He believes that it solves the issue and gives maximum property coverage to build a home. Eric Walker made the motion to approve the request submitted by staff. Jim Cobb seconded the motion and the motion carried unanimously. APPROVED. – 100 ft from property line. COOKEVILLE PLANNING COMMISSION 8 September 27th, 2021 HOLD A PUBLIC HEARING AND CONSIDER FOR ACTION THE REOPENING CONNECTION OF SALEM CHURCH ROAD AND ENGLAND DRIVE. REQUEST SUBMITTED BY STAFF. Jon Ward stated that The Planning Commission requested Planning Staff to study reopening a connection from Salem Church Road to England Drive. Analysis: Salem Church Road is classified as a local street. The northern terminus of the street is at a traffic- light controlled intersection with Neal Street and Perimeter Park Drive. The street extends south approximately 3,045 feet, terminating at a cul-de-sac. The street was renamed from South Old Kentucky Road to Salem Church Road in January of 2002. England Drive is also classified as a local street. This street provides a through connection from State Highway 111 and South Maple Avenue. England Drive consist of two previous street segments, one of South Old Kentucky Road and another of an unnamed segment extension (referenced as Jeffery Circle extension in previous Planning Commission minutes) from South Maple Avenue to Highway 111. This street was renamed to England Drive in November 2002. At the March 27, 2000, Planning Commission meeting, the Planning Commission considered a request submitted by property owners of Salem Church Road (then South Old Kentucky Road) to close the road. As included in the minutes, residents expressed concerns about safety issues involving the increase of commercial traffic on the street. At that time, the Cookeville Police, Fire, and Public Works Departments along with the Putnam County Emergency Services Department, recommended denial of the request. The Planning Department also recommended denial of the request. At this time, the motion was tabled by the Planning Commission to give additional time to study safety issues. The Planning Commission also approved installing a sign to prohibit truck travel on the street. The Planning Commission again considered the issue at the November 26, 2001, Planning Commission meeting. The closure was reintroduced due to the eastward extension of what was then known as proposed Jeffery Circle; however, the Planning Department cannot determine that this extension was officially named Jeffery Circle. At the November 2001 meeting, Public Works recommended that the street remain open for traffic flow, fire protection and access to the future convention center site. The length of the dead-end street would exceed the maximum permitted under the Subdivisions Regulations. Utility departments requested appropriate easements be retained and the Fire Department requested an emergency access point be provided. The Planning Department concurred with Public Works and recommended that the street remain open. An area resident offered comments about traffic and safety for children, also commenting that the road had been built up with significant grade differences that could pose problems with maintaining a connection to the new road. The Planning Commission recommended closure, with the stipulation that emergency vehicles have complete access to the street. The Salem Church Road and England Drive connection was officially closed to through traffic by Ordinance number O01-12-17. This Ordinance was approved by the City Council on first reading on January 3, 2002, and on second and final reading on July 2, 2002. The Ordinance stipulated that access for emergency vehicles would continue to be provided and that the street may be reopened for through traffic at such time as the Council determines it is necessary and appropriate. At its August 23, 2021 meeting, the Planning Commission requested that the Planning Department study reopening the connection of England Drive and Salem Church Road as a condition of the recommendation to rezone the property located on England Drive and Salem Church Road, adjacent to Highway 111. Mr. Aaron Bernhardt has provided a draft of a proposed development of the property if the rezoning is approved by City Council. This draft proposed two points of ingress/egress on England Drive to serve 66 one-story townhomes on the northern portion of the property. The western access aligns with an access point to access the property on England Drive to the south that will serve 23 two-story townhomes. No points of ingress or egress are proposed on Salem Church Road. According to the developer, the topography of the site is too challenging to access Salem Church Road and a connection to Salem Church Road is not necessary to develop the property. When England Drive was improved, the road was elevated, which provided significant topographic relief. Public Works indicated that a reconnection would require the street to be elevated further north on Salem Church Road to meet required street grades. The Planning Department requested an engineering analysis of COOKEVILLE PLANNING COMMISSION 9 September 27th, 2021 reconnecting the street, but we have not yet received this analysis. A preliminary engineer analysis of the reconnection would provide context on the feasibility of constructing the connection. The Planning Department agrees with the recommendations provided in 2000 and 2001. The Subdivision Regulations limit dead-end streets to 1,200 feet. At 3,045 feet, the dead-end street exceeds the length requirement by approximately 61 percent. Reopening the street would provide access to a traffic light- controlled intersection at Neal Street. At closure, it was stipulated that access would remain open for emergency vehicles, however, at current conditions, it does not appear emergency vehicles could utilize the connection. A fire station is located on England Drive south of the proposed reconnection and reopening the connection would provide better fire protection coverage for the area. Recommendation: Approval of reopening the connection from England Drive to Salem Church Road, subject to the feasibility of constructing the connection. Eric Walker stated that he feels that it is important to reopen Salem Church Road to allow access for Emergency Services to be able to access that area of town faster. Jon Ward stated that Mr. Aaron Bernhardt on behalf of property owner Terry Bullock, submitted a request to rezone from RS15, Single Family Residential and CR, Regional Commercial to CG, General Commercial property located on Salem Church Road and England Drive. Analysis: The subject property is identified as Tax Map 066, Parcel 036.00 and consists of approximately 13.82 acres. The entire rezoning area including right-of-way consists of approximately 31.13 acres. The property is bordered by CR, Regional Commercial to the south, CR and RS15 Single Family Residential to the west, CR, Regional Commercial to the north and CR Regional Commercial and RS20 Single Family Residential to the east. The parcel is split by England Drive. The northern portion of the property borders Salem Church Road to the west and England Drive to the south. the southern portion borders England Drive along the northern and western boundaries and Interstate 40 right-of-way to the south. The entire parcel borders Highway 111 to the east. The application was submitted to allow for single-family attached townhome residential development of the property. The area located north of England Drive is split zoned with a portion zoned RS15, Single Family Residential, and a portion zoned CR, Regional Commercial. The area located south of England Drive is zoned CR, Regional Commercial. The RS15 District is intended to provide a low density single- family residential environment in areas where public wastewater services are available, and the CR District is intended for medium to large-scale commercial operations of a predominately regional nature. The CG District is intended for moderate and larger sized offices, personal and business services, and general retail business. The maximum square footage of individual developments is restricted to 120,000 square feet. It is the intent of this district to promote the clustering and development of commercial facilities that are directly dependent on transient patronage or draw users from an area beyond the immediate environs of the city. Higher density residential development, including single-family attached (townhomes), is permitted upon review by the Planning Commission COOKEVILLE PLANNING COMMISSION 3 AUGUST 23RD, 2021 in the CG General Commercial Zoning District. The rezoning request would be an up zoning of the existing RS15 portion and a downzoning of the CR portion. The Future Land Use Concept Plan element of the Cookeville 2030 Plan depicts this area as best suited for regional commercial development. The CG, General Commercial District is compliant with the Future Land Use Plan. The area located south of England Drive is encumbered with a TVA utility easement along the northern portion of the property. Both areas north and south have sections of property with challenging topography. The Water Quality Control Department has approved a sewer service availability request, confirming capacity for 100 townhomes on the parcel. In the single-family zoned area located west of Salem Church Road are three (3) existing single-family homes. Townhome development would provide a buffer area between the limited access Highway 111 and the existing single-family residential area to the west. Recommendation: Approval of the rezoning request. Jon Ward stated that the Planning Department has reviewed the road classification and Salem Church Road is intended to support commercial development. Jim Stafne asked if anyone had contacted the Planning Department regarding the townhome development. Jon Ward stated that letters were sent out to the homeowners near the development and there have been no phone calls regarding this development. Aaron Bernhardt stated that the neighbors to the property are the ones selling the property. He has spoken to the owners through the realtors and the property owners are aware of his development intentions. Mr. Bernhardt stated that he is wanting to do a U-shaped development where all access will be off of England Drive as it is easy access to Highway 111 and closer to town. He stated that there is no need to reopen the road as there will be two (2) access cuts on England Drive. He wants to leave the trees bordering the development so there will be no access onto Salem Church Road. Jon Ward stated that Salem Church Road would need major engineering and grading in order for it to be reopened. Eric Walker stated that the land is suitable for commercial development and the rezoning to General Commercial would require the Planning Department to look at reopening Salem Church Road. Mr. Walker stated that both roads are classified as a local street and asked if the road would need to be reclassified before the plat is recorded. Jon Ward stated that the road was never reclassified when Salem Church Road was closed. The Planning Commission would need to amend the Major Street Plan to reclassify the street if the property is rezoned to General Commercial. Jim Cobb stated that in Section 2 of Ordinance O01-12-17 that closed Salem Church Road stated that access for emergency vehicles is required. The road doesn’t seem to meet those standards and would need to be looked at. Jon Ward stated that in order for Salem Church Road to reopen, the City Council would hold a public hearing and notify all residents on the road.
