Cookeville Planning Commission Minutes May 20th, 2024 The Cookeville Planning Commission met on Monday, April 22nd, 2024, at 5:30 p.m., in the Council Chambers, 45 E. Broad Street, Cookeville, Tennessee. Members Present: Councilman Ali Bagci, Jim Cobb, Bob Faulhaber, Jason Fowler, Judy Jennings, Lauren Metts, Mallie Rogers, & Kay Starkweather. Members Absent: Jim Woodford. Staff Members Present: Matt Billings, Christopher Phillips, Jon Ward, Ken Young & Haley Dickson. Staff Members Absent: James Mills. Others Present: Andy Bouton & Andrea Williams. Establishment of Quorum: Vice-Chairman Judy Jennings announced that a quorum was present for the meeting. Consider for Approval the Agenda as Submitted. Kay Starkweather made the motion to approve the agenda as submitted. Jim Cobb seconded the motion and the motion carried unanimously. Approved. Consider for Approval the Minutes of April 22nd, 2024. Councilman Ali Bagci made the motion to approve the minutes of April 22nd, 2024. Kay Starkweather seconded the motion and the motion carried unanimously. Approved. Consent Agenda: All matters listed under the Consent Agenda are considered to be routine and will be enacted by one motion. There will be no separate discussion of these items unless a Planning Commission member so requests, in which case the item will be removed from the Consent Agenda and considered separately. Additionally, any citizen or agenda applicant may request that consideration be given by the Planning Commission to remove any item from the Consent Agenda so that discussion may be held on the item. a. Consider the six-month extension of the preliminary plat of Emerald Forest Estates, 73 lots located on Bowser Road (Tax Map 041, Parcel 012.00). Request submitted by Navin Jain. Councilman Bagci made the motion to approve the request recommended by staff. Kay Starkweather seconded the motion, and the motion was carried unanimously. Approved. Consider for action the final plat of Andrew & Pamela Bouton Property, two (2) lots located on Crescent Spring Lane (Tax Map 039-M, Group A, Parcel 008.00). Request submitted by Andy Bouton. Mr. Jon Ward stated that Mr. Andy Bouton has submitted for approval the final plat of the Andrew & Pamela Bouton Property, a two (2) lot subdivision located on Crescent Spring Lane. Analysis: The subject property is identified as Parcel 008.00 on Tax Map 039-M, Group A and contains approximately 5.50 acres. The property is zoned RS-10, “Single-Family Residential” as are the adjacent properties to the west, north, and east. The property is bordered by CL, “Local Commercial” to the south. As depicted on the plat, Lot 2 is 4.50 acres and contains an existing house (1220 Crescent Spring Lane) and a detached carport, two (2) detached garages, a detached storage building, a gazebo, a shed and a spring house. Lot 1 is a proposed 0.99 acre building lot that will also front Crescent Spring Lane at the northern property boundary and will share the existing private ingress/egress. A 25-foot-wide access and utility easement is depicted on the submitted plat covering the proposed Cookeville Planning Commission 2 May 20th, 2024 shared portion of the private driveway. A 20-foot-wide easement for the extension of utilities isshown in the eastern portion of the parcel extending through Lot 1 and ending within Lot 2 at an existing power pole. A 20-foot-wide sewer easement is also depicted on the plat starting at a manhole at the southern property boundary line and terminating at the common line of Lots 1 & 2. The Cookeville Subdivision Regulations, Article V – Streets – Design Standards and Specifications, F Substandard Existing Streets note, “The subdivision of property abutting existing streets that do not meet the minimum construction standards of these regulations shall generally be prohibited. Should improvements to the existing street be required to meet the demands of the proposed subdivision, the cost of said improvements shall be borne by the developer unless determined otherwise by the City of Cookeville.” Crescent Springs Lane connects to Crescent Drive and terminates at the northern boundary line of the subject property. It is classified as a Local Street with approximately 441 feet in length with a 20-foot right-of-way and a surface width of 15 feet. Local Streets are required to have at least 45 feet of right-of-way, and at least 18 feet of surface width if curb and gutter are installed. This would classify Crescent Spring Lane as a substandard street. However, in the opinion of the Planning Division a two (2) lot subdivision to allow for the construction of a single-family residence is a low-impact subdivision. As requested by Public Works, a note has been added to the plat stating “The existing driveway shall be maintained by the property owners to allow trash pickup service. The City of Cookeville will not be responsible for the maintenance of this drive or damage to the trucks using this drive for trash pick-up”. Water Quality Control has verified that water service is adequate to serve both the existing lot and the proposed lot and therefore, no new infrastructure is required. A new water meter is proposed at the northern property line, as requested by WQC, and depicted on the plat. The Cookeville Fire Department has confirmed that fire protection is adequate. In the RS-10 District minimum lot width at the right-of-way is 50 feet. Crescent Spring Lane terminates abruptly at the northern property boundary with no cul-de-sac or turn around. The existing lot was annexed in 1978 and is nonconforming to the minimum lot width at the right-of- way requirement having only 20 feet of right-of-way width. The proposed new lot will bisect the existing 20-foot private drive connecting to Crescent Spring Lane. The 25-foot shared access and utility easement depicted on the plat covers the entirety of the proposed Lot #2 western property line and will provide both lots with access to the existing ingress/egress. City services are currently provided to the existing lot and the proposed lot will be sufficiently served by city services. A plat review meeting was held on May 14, 2024. All relevant city departments were present and provided comments for plat approval consideration. Recommendation: Conditional approval of the final plat subject to the following:  Owner to submit CAP Fee to Water Quality Control in order for the plat to be signed by WQC.  Completion of corrections and/or additions to the plat as determined necessary by the Planning Division and/or other appropriate city departments. Mr. Bouton stated that the reason for his request is to build house for daughter. Jim Cobb made the motion to approve the request recommended by staff. Lauren Metts seconded the motion, and the motion was carried unanimously. Approved. Consider for action a request for Planning Commission approval of a sidewalk waiver along the existing Mine Lick Creek Road for the Bungalows at Cookeville. Request submitted by Cookeville Planning Commission 3 May 20th, 2024 Staff. Mr. Jon Ward stated that Planning Staff requests the Planning Commission consider approval of a sidewalk waiver along the Mine Lick Creek Road frontage for the previously approved Bungalows at Cookeville preliminary plat. The preliminary was given conditional approval at the April 22, 2024, meeting. Analysis: At the April 2024 Planning Commission Meeting, the preliminary plat of the Bungalows at Cookeville unanimously received conditional approval. A condition for approval was, “A decision to be made regarding sidewalk construction on Mine Lick Creek Road.” The Cookeville Subdivision Regulations, Article VI – Streets – Construction Procedures and Specifications, J Sidewalks note, “The Planning Commission may waive the requirement to install sidewalks for residential subdivisions along existing streets in accordance with Section 209 Sidewalk Requirements, Section 209.6 Procedure for Waiver of Installation Requirements, Section 209.6A.1.-209.6A.3. of the Zoning Code.” Section 209.6A.1.-209.6A.3. identifies the requirements for a waiver and states, “The Building Official, upon consultation with the Planning Director and Public Works Director and approval of the City Manager, may waive all or part of the requirements for the installation of sidewalks or payment of the optional fee in lieu of construction when all the following exist: 1. The location is not specified in the Cookeville Pedestrian Circulation Plan. 2. The location is not within 1,000 feet of an existing sidewalk on the same side of the street. 3. The location is not within 2,500 feet (street distance) of an existing or proposed school. Mine Lick Creek Road is not included in the 2019 Pedestrian Network Plan, but a shared bike path is proposed along Mine Lick Creek Road in the 2019 Cookeville Pedestrian and Bicycle Circulation Plan. The proposed development is not located within 2,500 feet of an existing or proposed school, and there are currently no sidewalks along the entirety of Mine Lick Creek Road from Tennessee Avenue to Holladay Road. The Planning Division has consulted with the Public Works Department and the City Manager regarding a waiver. The developer has dedicated a 50-foot greenway easement along the entirety of the western boundary of the subject property for the proposed Cane Creek Greenway planned by the city. The frontage along Mine Lick Creek is encumbered by ditches and inadequate shoulders along the street. Both the Public Works Director and City Manager have agreed a waiver would be acceptable in this location. Sidewalks will still be required along one (1) side of the newly constructed internal street for the subdivision. Recommendation: Approval of the request to waive sidewalk construction along the existing Mine Lick Creek Road property frontage for the proposed subdivision. Councilman Bagci made the motion to approve the request recommended by staff. Kay Starkweather seconded the motion, and the motion was carried unanimously. Approved. Adjournment: 5:41 P.M.
