The Board of Zoning Appeals met on Thursday, June 13th, 2024, at 5:15 p.m. in the Council
Chambers located at 45 E. Broad Street, Cookeville, Tennessee.

Consider for Approval the Agenda as Submitted. Elwood Ervin made the motion to approve
the agenda as submitted. Michael Detwiler seconded the motion, and the motion was carried
unanimously. Approved.
Consider for Approval the Minutes of May 9th, 2024. Nancy Bohannon made the motion to
approve the minutes of March 14th, 2024 as submitted. Michael Detwiler seconded the motion,
and the motion was carried unanimously. Approved.
Consider a request for a variance to the height of a privacy wall from eight (8) feet to nine
(9) feet two (2) inches for a total variance of 14 inches for the property located at 30 South
Pickard Avenue (Tax Map 052H, Group B, Parcel 012.01). Request submitted by Christine
Morales. Mr. Chris Phillips stated that property owner Christine Morales has submitted a request
for a variance to the height of a portion of a privacy fence from eight (8) feet to nine (9) feet two
(2) inches for a total variance of 14 inches for her property located at 30 South Pickard Avenue.
Analysis: The subject property is identified as Parcel 012.01 on Tax Map 052-H, Group B and
contains approximately 0.23 acres. The property is zoned RS-15, “Single-Family Residential” as
are all adjacent properties. A single-family residential home is currently located on the property.
Ms. Morales has submitted a request for the height of a portion of the privacy fence currently under
construction on the subject property. A fence permit was obtained prior to construction, but the
privacy fence has been built higher than the maximum height of eight (8) feet. Section 204.9D.5.
Additional Standards, Fences and Walls, Maximum Height states, “In all zoning districts, except
CI, LM, HM, and QM districts, no fence or wall shall exceed eight (8) feet in height when placed
within the area to the side or rear of the principal structure.” The fence as currently constructed
measures nine (9) feet two (2) inches in height as measured by the Codes Division at the highest
point at the northeast corner of the fence. The request for the additional 14 inches is due to the
topography of the property. The rest of the fence meets the eight (8) foot requirement. Current
GIS shows the elevation of the subject property at 1094 feet. The house located on the adjacent
property to the east is shown at 1106 feet. The adjacent house is approximately 12 feet higher in
elevation than the petitioner’s house. Section 233.9, Administration and Enforcement, Powers and
Duties of the Board of Zoning Appeals, 3. Variances, d. notes,
“The particular physical surroundings, shape, or topographic conditions of the specific
property involved would result in a particular hardship upon the owner as distinguished
from a mere inconvenience, if the strict application of this Zoning Code were carried out”
The Planning Division notes a 12-foot difference in elevation constitutes a hardship based on
topography of the subject property. The petitioner is requesting the variance to provide adequate
privacy from the constructed fence. The variance request of 14 inches constitutes a variance of
less than 15 percent.

In the opinion of the Planning Division, the requested variance would not be detrimental to the
public welfare or injurious to other property in the area.
Recommendation: Approval of the variance request.
Elwood Ervin made the motion to approve the variance request as recommended by staff. Michael
Detwiler seconded the motion, and the motion was carried unanimously. Approved.

feet for a total variance of 20 feet for a sign within 750 feet of Interstate 40 right-of-way, and
a variance to the maximum sign height of 35 feet to 44 feet for a variance of 9 feet, and the
maximum signage area from 500 square feet to 592.5 square feet for a total variance of 92.5
square feet for property located at 1100 South Willow Avenue (Tax Map 065, Parcel 098.00).
Request submitted by Ken Knuckles of Development Management Group, LLC. Mr. Chris
Phillips stated that Mr. Ken Knuckles of Development Management Group, LLC has submitted
for approval a variance request to the maximum sign height requirement from 100 feet to 120 feet
for a total variance of 20 feet for a sign within 750 feet of Interstate 40 Right-of-Way, a variance
request to the maximum sign height of 35 feet to 44 feet for a total variance of nine (9) feet, and a
variance request to the maximum signage area from 500 square feet to 592.5 square feet for a total
variance of 92.5 square feet for property located at 1100 South Willow Avenue. The variances
were submitted for signage for a new commercial development. A previous variance addressing
sign height and maximum signage area was approved at the February 9, 2023, meeting. The
previous variance requests were a height variance of 20 feet, a heigh variance of 15 feet, and a
maximum sign coverage variance of 225 square feet. The current variance request is the same
request for the 20-foot sign height and a reduction in the 15-foot sign height, and the 225 square
foot of sign coverage.
Analysis: The subject property is identified as Parcel 001.01 on Tax Map 053C, Group A, and
contains approximately 39.72 acres. The property is zoned CR, “Regional Commercial” with a
portion of the property along the eastern boundary zoned as CG, “General Commercial”. The site
is bordered by CG, “General Commercial” on the east, north, and west. The property is bordered
by RM-14, “Multi-Family Residential” to the south. The property is currently vacant.
The subject property was rezoned from CG, “General Commercial” to CR, “Regional
Commercial” by Ordinance #O220406 in May 2022. The rezoning was requested due to the size
of the development proposed for the property. The CG District restricts individual development to
120,000 square feet.
Mr. Knuckles has submitted drawings depicting three (3) proposed signs for a proposed new
commercial development. The first sign is a hi-rise sign that will provide visibility from Interstate
40. The Zoning Code restricts hi-rise signage to 100 feet in height. The CR District restricts all
signs to a maximum height of 35 feet in height. The proposed sign is 120 feet tall. Section
207.6D.12 notes that the maximum height for on-premises freestanding signs for any parcel
located within 750 feet of the closest right-of-way of Intestate 40 within the CG, CI, LM, or HM
Districts shall be 100 feet from street level at a point nearest the sign.
The Planning Division acknowledges that signs over 35 feet in height are not permitted within the
CR District, but hi-rise signs have been erected within the CR District in areas such as Sam’s Club.
The subject property was rezoned due to the size of the development proposed. The proposed
development would have been permitted within the CG District if the total square footage had
been under 120,000 square feet. The rezoning action also changed signage height requirements.
Current GIS Data shows the elevation of the Interstate 40 right-of-way as 1,060 feet. The proposed
hi-rise sign is shown at an elevation of 1,057 feet. This would reduce the requested variance to 17

feet. A variance of 17 feet would constitute a 17 percent (17%) variance in the maximum 100 feet
allowance.
The second proposed sign for the development is a monument sign that will be located near the
proposed entrance to the development from South Willow Avenue. The monument sign will
provide a sign area for all proposed tenants within the development. The sign is proposed as 44
feet in height. The CR District restricts signs to a maximum of 35 feet from street level. The CG
District permits a freestanding sign height of 50 feet. The submitted Grading Plan shows the
proposed sign at an elevation of approximately 1068 feet, and the grade for South Willow Avenue
is shown as approximately 1074 feet. This would allow for a sign to be constructed at 41 feet in
height. The requested variance would then be for a total of three (3) feet. A variance of three (3)
feet would constitute a nine (9) percent variance in the maximum 35 feet height allowance. The
previously approved variance was for a 50-foot sign and a 26 percent variance.
The third sign proposed is a fifteen-foot-tall monument sign located by the proposed entrance on
Green Gate Lane. This sign is compliant with height requirements of the Zoning Code. An
additional variance request pertains to the combined total square footage of all signs being
proposed for the development. Section 207.6C of the Zoning Code includes “Each commercial
and industrial premise with greater than 400 feet of frontage on any one (1) public street, regardless
of the number of commercial or industrial establishments on such premise, shall be allowed two
(2) on-premise freestanding business sign structures per public street frontage, but in no case shall
more than three (3) freestanding sign structures be permitted on any premise regardless of the
number of street frontages.” The proposed development has over 4,200 linear feet of street frontage
on three (3) public streets (South Willow Avenue, Green Gate Lane, and Interstate 40) which
permits three (3) freestanding signs. The petitioner has stated that the outparcels within the
development will potentially be allowed a “small monument sign but will require that they be
installed along the access road frontage versus Willow or I-40.”
Section 207.6D.4 states that in cases where a commercial or industrial premise is allowed three (3)
freestanding signs, “the aggregate sign face area of all signs shall not exceed 500 square feet.” The
total square footage proposed for all three signs totals 592.5 square feet. The proposed hi-rise sign
will include the two (2) anchor tenants for the development. The proposed monument signage for
the development is for multiple tenants. One (1) is located on South Willow Avenue, and one (1)
on Green Gate Lane. A variance of 92.5 square feet would constitute a 19 percent (19%) variance
in the maximum 500 square feet allowance. The previously approved variance was for 225 square
feet and a 45 percent variance.
The sign height of the monument sign is consistent with the allowed height in the CG, General
Commercial District. The request to increase the height of the hi-rise sign is due to topography
and to improve visibility from Interstate 40. Vegetation in the median of I-40 does obstruct
visibility from the west-bound lane of I-40. The development has a considerable amount of street
frontage (over 4,000 linear feet), with the proposed sign depicting up to eight (8) retail
establishments to be sited within the development. While the hi-rise sign does count toward total
square footage, this only includes the anchor tenant. The signage on Green Gate Lane will be less
visible as this street is not a through street. The street primarily provides access to Miracle Road
and the River Church and will provide access to the proposed commercial development.
In the opinion of the Planning Division, the requested variances proposed to the sign height and
total square footage of the sign face area would not be detrimental to the public welfare or injurious
to other property in the area.
Recommendation: Approval of the variance request.

Ken Knuckles, petitioner, stated that he believes that this is an easy request based on their initial
request. He stated that they have reduced their request and sees it as an improvement from last
year’s variance request.
Elwood Ervin made the motion to approve the variance request as recommended by staff. Michael

Consider a request for a variance to the Parking Area landscape design requirements to
allow for an adjustment to the interior parking islands for property located at 1100 South
Willow Avenue (Tax Map 065, Parcel 098.00). Request submitted by Ken Knuckles of
Development Management Group, LLC. Mr. Chris Phillips stated that Mr. Ken Knuckles of
Development Management Group, LLC has submitted for approval a variance request to the
parking area landscaping design requirements to allow for an adjustment to the interior parking
islands for property located at 1100 South Willow Avenue. The variance was submitted to address
the parking area of a new commercial development. A previous variance addressing the parking
area landscape design requirements was approved at the February 9, 2023, meeting.
Analysis: The subject property is identified as Parcel 001.01 on Tax Map 053C, Group A, and
contains approximately 39.72 acres. The property is zoned CR, “Regional Commercial” with a
portion of the property along the eastern boundary zoned as CG, “General Commercial”. The
parcel is bordered by CG, “General Commercial” on the east, north, and west. The property is
bordered by RM-14, “Multi-Family Residential” to the south. The property is currently vacant.
At the February 2023 BZA Meeting, Mr. Knuckles submitted a site plan depicting three (3)
proposed landscape central islands located within the parking lot area of the development. Each
landscape island was approximately 1,290 square feet. The proposed islands were also being used
as bioretention areas for the development. The current submitted plans do not show the location of
the proposed landscape islands, but final plans have not been submitted for review.
Section 205.7E of the Cookeville Zoning Code states, “Off-street parking areas containing 24 or
more parking spaces shall be subdivided into sub-lots containing not more than 24 parking spaces
separated by landscape strips meeting the requirements of Section 208.5B of this Zoning Code.”
The submitted site plan shows eight (8) parking rows more than 24 parking spaces for Parcel A.
The overall development consists of 1,016 parking spaces. The submitted plan depicts landscape
islands at the ends of each parking aisle. The provided landscape areas appear to provide more
square footage of landscape areas than the eight (8) required landscape islands. The plan depicts a
parking row island along the northern property boundary separating 38 parking spaces equally at
19 spaces and 19 spaces. The request to reduce parking islands is only for the parking aisles
fronting Parcel A. All other parking aisles meet the parking requirements of the Zoning Code.
In the opinion of the Planning Division, the proposed variance to the parking lot landscape islands
will not be detrimental to the public welfare or injurious to other property in the area.
Recommendation: Approval of the variance request.
Michael Detwiler made the motion to approve the variance request as recommended by staff.

Consider a request for a variance to reduce the front yard setback from 50 feet to 25 feet
along Green Gate Lane and to reduce the setback from 50 feet to 25 feet from Interstate 40
for property located at 1100 South Willow Avenue (Tax Map 065, Parcel 098.00). Request
submitted by Ken Knuckles of Development Management Group, LLC. Mr. Chris Phillips
stated that Mr. Ken Knuckles of Development Management Group, LLC has submitted a request

for a variance to reduce the front yard setback from 50 feet to 32 feet along Green Gate Lane and
to reduce the setback from 50 feet to 25 feet along Interstate 40 for the property located at 1100
South Willow Avenue. The variance was submitted to accommodate a new commercial
development.
Analysis: The subject property is identified as Parcel 001.01 on Tax Map 053C, Group A, and
contains approximately 39.72 acres. The property is zoned CR, “Regional Commercial” with a
portion of the property along the eastern boundary zoned as CG, “General Commercial”. The
parcel is bordered by CG, “General Commercial” on the east, north, and west. The property is
bordered by RM-14, “Multi-Family Residential” to the south. The property is currently vacant.
The petitioner has submitted a site plan depicting the construction of a new commercial
development. The submitted plans depict the northwest corner of Parcel A encroaching into the
50-foot Interstate 40 setback approximately 25 feet. The plans also depict the southern edge of the
perimeter chain link fence of the garden center of Parcel B encroaching into the 50-foot front
setback along Green Gate Lane approximately 18 feet. The petitioner notes that the combined store
frontage of both parcels, including the proposed garden center, is 1,035 feet in length.
The CR District notes that front yard setbacks are 50 feet. The submitted plan depicts the northwest
corner of Parcel A encroaching approximately 25 feet into the required front yard setback along
Interstate 40 at an angle approximately 205 feet. The Zoning Code does not list Interstate 40 as a
Major Street in Section 204.12, Required Setbacks Along Major Streets, of the Zoning Code.
Section 202, Construction of Language and Definitions, defines street classification as, “For the
purposes of this Zoning Code the classification of public streets shall be as identified in the
Cookeville 2030 Plan.” The Cookeville 2030 Plan defines Interstate 40 as an “Interstate/Limited
Access Highway.” As a public street, the CR Zoning District would require a 50-foot setback. The
total square footage of the encroachment is approximately 2,563 square feet. The 25-foot
encroachment constitutes a variance request of 50 percent.
Parcel B includes a garden center along Green Gate Lane. The garden center will include a metal
roof that adjoins the structure and a canvas awning located within the outdoor garden center. The
garden center will be a fenced-in area surrounded by a 20-foot chain link perimeter fence. The
roof and the canvas awning will not encroach into the required 50-foot setback. Only the 20-foot
perimeter fence will encroach approximately 18 feet into the required 50-foot setback for a length
of 183 feet. The 18-foot encroachment constitutes a variance request of 36 percent.
Recommendation: Approval of the variance request.

Consider a request for a variance to the height of an accessory structure exceeding that of
the primary structure located at 202 Freedom Avenue (Tax Map 054-D, Group B, Parcel
025.00). Request submitted by Richard Bugan. Mr. Christopher Phillips stated that property
owner Mr. Richard Bugan has submitted a request for a variance to allow the height of a proposed
accessory structure to exceed the height of the principal structure located at 202 Freedom Avenue.
Analysis: The subject property is identified as Parcel 025.00 on Tax Map 054-D, Group B and
contains approximately 0.74 acres. The property is zoned RS-10, “Single-Family Residential” as
are the adjacent properties to the east, south, and west. The property is bordered by CL, “Local
Commercial” to the north.
The petitioner has submitted a drawing of a proposed accessory building to be constructed within
the rear yard of the subject property. The petitioner states that the base of the proposed building
site lies above the height of the roof ridge of the principal structure. Section 204.8H, Additional
Standards for Accessory Structures notes,
“On any lot or tract of less than five (5) acres in size located in the RS-20, RS-15, RS-10, RS-
5, or RD Districts no accessory structure shall be of a height exceeding that of the principal
structure and/or of a size exceeding 50 percent of the total square footage of the principal
structure.”
Current GIS shows a slope of approximately 20% within the rear yard of the property. The
topographic contour directly behind the principal structure shows 1070 feet in elevation, and the
area depicted on the submitted drawing for the proposed accessory building shows 1086 feet in
elevation. The principal structure is a one-story single-family home. The proposed accessory
structure’s foundation would be approximately 18-20 feet higher than the elevation of the principal
structure’s foundation. The proposed accessory building will meet the required 20-foot rear
setback of the RS-10 District.
Section 233.9D, 3. Variances, d. General Standards for Variances states, “The particular physical
surroundings, shape, or topographic conditions of the specific property involved would result in a
particular hardship upon the owner as distinguished from a mere inconvenience, if the strict

application of this Zoning Code were carried out.” The topographic conditions of the subject
property provide a hardship for construction of the proposed accessory structure within the rear
yard of the property.
In the opinion of the Planning Division, the requested variance would not be detrimental to the
public welfare or injurious to other property in the area.
Recommendation: Approval of the variance request to the height of the proposed accessory
structure exceeding that of the principal structure.

Consider a request for a variance to allow property located at 2131 Mine Lick Creek Road
(Tax Map 065-G, Group A, Parcel 002.00) to be subdivided into two (2) lots with one (1) lot
including an existing accessory structure with no principal structure. The accessory
structure is proposed to be converted into a single-family residence in the RS-20 District.
Request submitted by Ted Thomas. Mr. Christopher Phillips stated that property owner Mr. Ted
Thomas has submitted a request for a variance to allow his property to be subdivided into two (2)
lots with one (1) lot including an existing accessory structure with no principal structure. The
accessory structure is proposed to be converted into a single-family residence in the RS-20 District.
Analysis: The subject property is identified as Parcel 002.00 on Tax Map 065-G, Group A and
contains approximately 1.05 acres. The property is zoned RS-20, “Single-Family Residential” as
are all adjacent properties.
The petitioner has submitted a survey proposing to subdivide the current property into two (2) lots.
The newly created Lot #1 will contain the existing principal structure and measure 0.46 acres, or
20,004 square feet. The newly created Lot #2 will contain the existing accessory structure and
measure 059 acres, or 25,580 square feet. The RS-20 District requires 20,000 square feet per lot.
The petitioner notes that the purpose of the subdivision is to sell the proposed Lot #2 and existing
accessory structure. The existing structure is proposed to be converted into a new single-family
residence. Both lots will be served by septic sewer service. The septic tank serving the existing
principal structure will remain on Lot #1. Lot #2 has been given TDEC approval for a new septic
system to serve an estimated house size of three (3) bedrooms, as noted on the proposed
subdivision plat.
The petitioner has stated that the property has been listed with a real estate company and that there
has been serious interest in the subject property if the variance is approved. He has stated that the
potential buyer will convert the accessory structure into a two (2) bedroom single-family home.
The current property was purchased as three (3) individual lots and the lots were combined in May
2017. The lots were combined for tax purposes. The existing principal home and accessory
structure were present at this time. The accessory structure was located on two (2) parcels and the
principal home was located on the third parcel. The combination of the three (3) parcels brought
the lot and existing structures into zoning compliance within the RS-20 District. The two (2)
proposed lots meet lot size requirements for the RS-20 District and setback encroachments for the
structure on the proposed Lot #2 are existing and not created by the proposed subdivision.
In the opinion of the Planning Division, the requested variance would not be detrimental to the
public welfare or injurious to other property in the area.

Recommendation: Approval of the variance request with the condition that a building permit is
pulled for the single-family dwelling unit within one (1) year of approval.
Mr. Ted Thomas stated that he initially bought this property as 3 lots, and he combined them for
tax purposes.
Mr. Elwood Ervin asked if Mr. Thomas is going to have the property replatted to show two lots.
Mr. Jon Ward stated that the property currently exists as one lot, and the property will be
subdivided into two lots with approval from this board.
Mr. Ervin asked what the plan of service is for this area.
Mr. Ward stated that this area has the same stipulations as the other unserved portion of the city
limits.
Michael Detwiler made the motion to approve the variance request as recommended by staff.

The Board of Zoning Appeals meets the 2nd Thursday of each month. Applications must be submitted to
the Planning Department no later than 12:00 p.m. on the third Monday of the month prior to the meeting.
