June 24th, 2024
The Cookeville Planning Commission met on Monday, June 24th, 2024, at 5:30 p.m., in the Council
Chambers, 45 E. Broad Street, Cookeville, Tennessee.
Members Present: Councilman Ali Bagci, Jim Cobb, Jason Fowler, Judy Jennings, Lauren Metts,
Mallie Rogers, Kay Starkweather & Jim Woodford.
Members Absent: Bob Faulhaber.
Staff Members Present: Matt Billings, Christopher Phillips, Jon Ward & Haley Dickson.
Staff Members Absent: James Mills & Ken Young.
Others Present: Lindsay Pride, Larry Stone & John Turvaville.
Establishment of Quorum: Chairman Woodford announced that a quorum was present for the
meeting.
Consider for Approval the Agenda as Submitted. Kay Starkweather made the motion to
approve the agenda as submitted. Jim Cobb seconded the motion and the motion carried
unanimously. Approved.
Consider for Approval the Minutes of May 20th, 2024. Councilman Ali Bagci made the motion
to approve the minutes of May 20th, 2024. Kay Starkweather seconded the motion and the motion
carried unanimously. Approved.
Consent Agenda:
All matters listed under the Consent Agenda are considered to be routine and will be enacted by
one motion. There will be no separate discussion of these items unless a Planning Commission
member so requests, in which case the item will be removed from the Consent Agenda and
considered separately. Additionally, any citizen or agenda applicant may request that consideration
be given by the Planning Commission to remove any item from the Consent Agenda so that
discussion may be held on the item.
a. Consider the six-month extension of the preliminary plat of Ashbury Farms Subdivision
Phase I, 49 lots located on West Broad Street (Tax Map 039, a portion of Parcel 157.00).
Request submitted by Aaron Bernhardt.
b. Consider the six-month extension of the preliminary plat of Creek Side, nine (9) lots
located on Holder Avenue (Tax Map 054-D, Group A, Parcels 023.00 & 007.01). Request
submitted by Josh Stites.
Councilman Bagci made the motion to approve the request recommended by staff. Kay
Starkweather seconded the motion, and the motion was carried unanimously. Approved.
Consider for action the final plat of Magnolia East, 19 lots located on East 10th Street (Tax
Map 040-M, Group B, Parcel 004.18). Request submitted by Jerry Gaw. Mr. Jon Ward stated
that Mr. Jerry Gaw has submitted for approval the final plat of Magnolia East, a 19-lot single-
family attached development located on East 10th Street. The preliminary plat was approved on
September 27, 2021. Two (2) six (6) month extensions were granted September 26, 2022, and
March 27, 2023. The preliminary plat was resubmitted and approved September 25, 2023.
Analysis: The subject property is identified as Parcel 004.18 on Tax Map 040-M, Group B and
contains approximately 1.27 acres. The property is zoned CL, “Local Commercial” as are the
adjacent properties to the east, north, and west. The property is bordered by RS-10, “Single-Family
Residential” to the south. The plat depicts 18 single-family attached townhomes. Lot 19 is a
common area and not a building lot.

The plat depicts a parking area island that contains an electric department transformer. Public
Works notes that the island has been changed to a striped-only island to provide easier access to
the dumpster pad. The Electric Department notes that the transformer will need to be protected
with bollards.
A plat review meeting was held June 11, 2024. All relevant city departments were present and
provided comments for conditional approval.
Recommendation: Conditional 90-day approval of the final plat subject to the following:
Water Quality Control requires as-builts to be submitted prior to final plat recording.
HOA required when final plat is recorded.
HOA standard water and sewer notes required by WQC.
Completion of corrections and/or additions to the plat as determined necessary by the
Planning Division and/or other appropriate city departments.
Kay Starkweather made the motion to approve the request recommended by staff. Jim Cobb
seconded the motion, and the motion was carried unanimously. Approved.
Consider for action a recommendation to increase the sidewalks in lieu of construction fee.
Request submitted by Staff. Mr. Jon Ward stated that the Planning Division staff have submitted
a request for a Planning Commission recommendation to increase the sidewalk in lieu of
construction fee.
Analysis: Section 209 of the Cookeville Zoning Code established requirements for sidewalk
installation for developments within the City of Cookeville. Section 209.4 sets forth circumstances
where an Optional Fee In Lieu of Construction can be paid for developments that require sidewalk
construction. On February 21, 2002, the Cookeville City Council, through Resolution R02-02-02
established the amount of the fee to be paid in lieu of sidewalk construction. The sidewalk fees
were increased by Resolution R19-09-17 in September 2019. The current fees are as follows:
A. Sidewalks with required widths of four (4) feet: $22.00 per linear foot
B. Sidewalks with required widths of five (5) feet: $26.00 per linear foot
C. Sidewalks with required widths of six (6) feet: $32.00 per linear foot
The established fee has been in place for five (5) years without an increase. Due to increased costs
for sidewalk construction, the Planning Division, after consultation with the Public Works
Department, has proposed an increase to the current established fees as follows:
A. Sidewalks with required widths of four (4) feet: $36.00 per linear foot
B. Sidewalks with required widths of five (5) feet: $45.00 per linear foot
C. Sidewalks with required widths of six (6) feet: $54.00 per linear foot
Recommendation: Approval of the proposed Sidewalk In Lieu of Construction Fee increase.
Kay Starkweather asked if there is a special fund to build sidewalks elsewhere or just for the project
that the fee is submitted for.
Mr. Ward stated that the fee is intended for that particular property when the project is ready for
sidewalks.
Jason Fowler asked if instead of pouring sidewalks, the developers can pay a fee.
Mr. Ward responded yes, the fee in lieu of sidewalks is approved by Public Works. He stated that
property is to be graded for sidewalks, but the fee has to be paid before a building permit is issued.

Jim Cobb asked if the fees are used to replace existing sidewalks or new sidewalk installation in
an area where Public Works deems necessary.
Mr. Ward responded that the fees are put in the sidewalk fund, which are intended to be used for
the particular development at a further date.
Kay Starkweather made the motion to approve the request recommended by staff. Councilman
Bagci seconded the motion, and the motion was carried unanimously. Approved.
Study Items:
(1) Consider for study the preliminary plat of HS Group Property, six (6) lots located on South
Jefferson Avenue, Joff Drive & East Veterans Drive (Tax Map 066, Parcels 030.00 & 031.04
and Tax Map 066-C, Group A, Parcels 022.00 & 024.00). Request submitted by HS Group.
(2) Consider for study the preliminary plat of Turnberry, 61 lots located on Hawkins Crawford
Road (Tax Map 064, a portion of Parcel 018.01). Request submitted by Capital Communities.
(3) Consider for study rezoning a portion of the property located at Neal Street, South Maple
Avenue & Old Walton Road (Tax Map 066, Parcel 032.00) from CR (Regional Commercial)
to CG (General Commercial). Request submitted by Paul Gaw on behalf of Jeanette Gaw
Family Partnership.
(4) Consider for study amendments to the Zoning Code relative to defining Truck Stops,
Automobile and Truck Fuel Centers, and Gasoline and Motor Fuel – Retail, and to allow
Automobile and Truck Fuel Centers in the CI, “Commercial-Industrial Mixed Use” Zoning
District as a use permitted by right. Request submitted by Staff.
Kay Starkweather made the motion to accept the above items for study. Jim Cobb seconded the
motion, and the motion was carried unanimously. Approved.
