City of Coral Gables Page 1 City Commission Meeting Minutes October 11, 2016 A. PRESENTATIONS AND PROTOCOL DOCUMENTS Agenda Items A-1-and I-1 are related. A.-1. 16-5410 Presentation of a Proclamation declaring October 2016 as "Americans with Disabilities Month" in Coral Gables. [Note for the Record: Following Mayor Cason’s reading the title to Agenda Item 1(i.e., Presentation of a Proclamation declaring October 2016 as "Americans with Disabilities Month" in Coral Gables.), he read the proclamation into the public record; following same, Mayor Cason read an excerpt from the bio of Ernie Martinez with the Center for Independent Living (CIL). Commission Keon asked that City Attorney Craig Leen join the discussion, as he has become our conscience on how we serve the different members in our community, further expressing gratitude for his leadership helping make us a community of inclusion. Ernie Martinez thanked the Commission for the opportunity to speak, and further stated that in every neighborhood there is a person with a disability, and it could be a parent, grandparent or child, and that some disabilities are impossible to identify; however, he said he brings the good news that every disability fosters amazing abilities, and that we acquire abilities just from having our disabilities. Mr. Martinez stated that a local champion Bonnie Blaire and Coral Gables Advisory Board set on a mission to have a place where people with disabilities may come out and quickly discover what their special abilities may be in partnership with CIL of South Florida. Mr. Martinez also said he discovered that the City has many champions. He cited Chief Hudak whose stellar department is doing amazing things that other departments should copy. He also cited Craig Leen, Stephanie Throckmorton, Raquel Elejabarrieta, your ADA Coordinator, and Dona Spain and applauded the City, the Commission today for proclaiming its unwavering support and commitment to inclusion of people living with disabilities. Commissioner Keon then introduced SallyBaumgartner, the Chair of the Disability Advisory Committee and asked her introduce her Board Members. Ms. Baumgartner said the City’s support has been unwavering, and we are very proud to have the Satellite Office of the CIL located at the Youth Center, and we will work hard to ensure that people with disabilities have an equal opportunity to enjoy the benefits of living in the Gables. [Note for the Record: Following Mayor Cason’s reading the title to Agenda Item 2(i.e., Presentation of a Proclamation declaring October 9, 2016 through October 15, 2016 as "Fire Prevention Week" in Coral Gables), he read the proclamation into the public record; following same, Deputy Chief Marco de la Rosa stated that we still have home fires that we have not been able to prevent outright, further, stating that smoke detectors are the greatest lifesaver next to sprinklers and reiterated the Mayor’s statements that everyone needs to make sure that their home is protected by smoke detectors, and you are attentive to in maintaining it and making sure it’s up-to-date. Chief de la Rosa invited the Commission to join the department next week for the Opening Ceremony at the Youth Center for Fire Prevention Week,” where the department host over 2,000 children educating them in Fire Safety as this is where it starts, Fire Prevention in the home. Vice Mayor Quesada asked about the fire at 90 Edgewater and whether there was a fire alarm present. Chief de la Rosa answered that the building had a fire alarm that alerted residents to evacuate, and said that the buildings sprinkler system contained the fire, further noting that the fire displaced 900 people, and the building is still recovering from the fire. Jason Barger, recipient of the City of Coral Gables "Firefighter of the Month Award," for the month of October, 2016. Jason Barger, recipient of the City of Coral Gables "Firefighter of the Month Award," for the month of October, 2016), Deputy Chief de la Rosa said on behalf of Chief Stolzenberg, it was his honor and pleasure to introduce Lt. Jason Barger as the Firefighter of the Month for October, for his outstanding display of initiative in orchestrating the Coral Gables Fire Department’s participation in the Tunnel to Tower 5K, benefiting the Stephen Siller Foundation in helping firefighters in burn units and wounded warriors who come back from war. Deputy Chief de la Rosa explained that Stephen Siller was New York City firefighter who was off-duty, who donned his gear and ran through a tunnel into Manhattan and ultimately to the Twin Towers, where he perished. The Miami event signifies what Stephen Siller did by starting at the Miami Tunnel and going to one of the towers in Miami. Deputy Chief de la Rosa further stated that Lieutenant Barger is an accomplished firefighter here and participates in the FEMA, Extrication and Advanced Life Support Teams, and added that Lieutenant Barger was the first firefighter to complete the 5K, the climbing the tower carrying 100 pounds of additional weight from his from bunker gear and air-tanks. Chief de la Rosa stated for his feats at the Tower-Tunnel Competition, his orchestrating the Fire Department’s participation and for making us proud, Lieutenant Barger has been selected as Employee of the Month. Lieutenant Barger thanked Deputy Chief de la Rosa, the Fire Department and Mayor Cason and the City Commission for allowing him to receive this award. Gomez, Finance Director, recipient of the Government Finance Officers Association ’s Certificate of Achievement Award, for the fiscal year ended September 30, 2015. She further stated to accomplish the Triple A Rating, we made a commitment to decrease the unfunded liability of the Pension Plan, maintain a 25 percent reserve (currently $25,000,000) and maintain transparency. City Manager Swanson-Rivenbark said that it was accomplished by the Budget and Audit Advisory Committee and the Finance Department best represented by the Director herself, namely Diana Gomez. Finance Director Diana Gomez said that this was really done by the whole department, especially Assistant Finance Director Sally Ola Ola and the Accounting Division. Commissioner Lago also wanted to recognize the efforts of Mayor Cason and Vice Mayor Quesada, who five years ago helped set the course for the City with assistance of the Finance Department, who implemented the policy to increase the fund balance to regain the bond rating Mayor Cason thanked Finance Director Gomez for clarifying the Finance Statements and her work and that of her staff. Let’s start on the discussion Commissioner Slesnick, you have anything? Commissioner Slesnick: I would just like to say that the Coral Gables Community Foundation has their annual fundraiser this Friday night at the Coral Gables Country Club and the Coral Gables Community Foundation is really a vital organization in our town, because they supply funds for various causes that the City cannot award and scholarships and all sorts of other things that are given in support of the non-profits in the rest of our community. And one thing that I want people to think about is, the City is always in need of parks and we are trying to buy more open spaces is that around ten years ago Robert Fewell donated the land that’s on the corner of Granada and Coral Way and now it’s Fewell Park, and he gave that land to the City; and if anybody is thinking about wanting to make a contribution, and have their name memorialized in the City down the line or do something good for their City that everyone would really appreciate is, if you have land that you are thinking about how to dispose of, giving it to the Coral Gables Community Foundation, which would then give you a tax break and you can write it off with your Income Tax, and then the Community Foundation would give it onto the City. So that’s a great way to make a difference in the lives of the rest of your community and citizens if you gave that land to the City. So, I’d like people to keep that in the back of their minds. Mayor Cason: Very good idea. Vice Mayor Quesada: A few quick things. First of all, next meeting wear pink, breast cancer awareness month. Second thing, streetscape concerns - every time I sit down with Cathy I discuss this with her. I know Peter is doing a good job sort of giving suggestions and working with them to give them whatever they need, but I just want it to be on you guys radar, we haven’t discussed it in the last few meetings, maybe we don’t need to, but every time I go down Giralda, every time I go down Miracle Mile I get concerned, I want to see more movement there. I know that staff has been doing a great job meeting with the business owners, but really just keep it on your radar, see what everything that we can do. I know we’ve got, I think it’s over 180 signs… City Manager Swanson-Rivenbark: 188. Vice Mayor Quesada: 188 signs to let you know businesses are still open and City of Coral Gables Page 19 City Commission Meeting Minutes October 11, 2016 operating. You know it’s funny, I was thinking about Giralda, I don’t know the last time you guys were on it, right now with the barricades it’s so narrow, I mean you really only just have a sidewalk, you have like three feet of width if you want to walk down to one of the retailers on Giralda. I was trying to think of different ideas of what we can do to help move people through there. Fortunately, I’ve gone to a few of the restaurants recently and there have been a lot of people in the restaurants, so I’ve been happy about that. Mayor Cason: The signs helped. Vice Mayor Quesada: Yes, I think that the signs actually do help. But I’m just saying, I think we should, all of us, I think we have a duty just to keep our mind open for any out of the box ideas. Doesn’t matter if no one’s ever done it before, we’ve never done it before, but it’s a long haul for them and obviously we are doing everything we can, but again, any out of the box ideas that any resident has at home or we can think of, please bring them up. Last night I got home from the office late, about 1:30 in the morning I went out there, it’s frustrating not seeing any workers out there and I feel like there is not much movement. I know they are doing everything they can; I know staff is working with them. I’m not trying to create a big issue out of this, but it’s a concern that we need to be cognizant of. Commissioner Slesnick: I did see that we got a memo this morning that they were talking about waiting till after Christmas, after the holidays to finish the street and maybe have a hold on it, but that they are going to plough ahead and keep going right now. Vice Mayor Quesada: Was that the final vote? I know as of yesterday… Commissioner Slesnick: This just came in this morning. Vice Mayor Quesada: No that’s great. I don’t mean to make a big thing out of it. I just wanted to make you guys aware. Mayor Cason: We are all meeting with Peter and meeting with business owners on this. Vice Mayor Quesada: But what I’m saying is, I don’t want anyone to hold back any out of the box ideas. I was thinking about a way of bringing Segway to try to move people up and down those streets to make it easier, to make it attractive, to make it like that could be fun and interesting, let’s go to one of those retailers. Mayor Cason: Rickshaw’s. Vice Mayor Quesada: Its doesn’t work, they are too wide. I looked into that. The average rickshaw is like four to five feet wide and we only… Mayor Cason: Ric Man could bring rickshaws. Anything else? Vice Mayor Quesada: The solar resolution to put in the Herald. Commissioner Lago: I was going to speak about that. Vice Mayor Quesada: Well, I wasn’t sure if you were or not. I don’t want to steal your thunder. Commissioner Lago: Not at all. Now you have solar panels on your house, you are entitled to speak about solar. Vice Mayor Quesada: So I just want to make sure we can put the way that obviously that item has been phrased is very confusing, very, very confusing. Mayor Cason: On purpose. Vice Mayor Quesada: Whether it’s on purpose or not, it’s very confusing, and I just want to be clear and make sure that we get it out to as many people as possible. Commissioner Lago: I spoke to the City Manager and staff about that issue and I wanted you input as a Commission to find out, because you know we are very careful in reference to items that are coming before the voters in either showing support or stating that we are opposed to certain legislative matters that are coming before the Commission, excuse me, before the voters. Do we want to put something out there either in print or through a resolution that states that we are either in favor or against that ordinance that’s coming before the voters? I’m in favor of it. I’m just being sensitive. City of Coral Gables Page 21 City Commission Meeting Minutes October 11, 2016 City Manager Swanson-Rivenbark: You are in favor of the ordinance or you are in favor of putting something out? Commissioner Lago: Let me be clear. I’m in favor of putting something out on behalf of this Commission which educates as many residents and business owners as possible that what FPL and the other four utility companies that have spent close to $20 million of their own money, which actually it’s our money, is being used to confuse the voters in an effort to ensure that they continue control over all the electricity that’s produced; and obviously, results in people not wanting to install solar in their homes or in their businesses. Mayor Cason: Maybe what can be done would be something in the way of information that says, if you vote yes here’s what you are really voting for, if you vote no here’s what you are voting for, because it’s very confusing. Vice Mayor Quesada: Is the City precluded for saying…. City Attorney Leen: The City Commission can take whatever position it believes is appropriate in an interest of the City. So you could for example, be against the amendment based on what’s said. The limitation is when the funds, City funds are expended, so for example to buy an advertisement. What the legal authority indicates is that in those situations you can only buy, because you know residents may be for or against it, so the idea is if you are going to use public funds then it has to be done to educate. But educating could be, for example, where you have a question that is confusing or that may cause people to vote in favor of solar and it’s not really…. Vice Mayor Quesada: OK - ,because there is a legal technicality here; can you can your office draft up something for us to review and then we can decide whether… Commissioner Lago: When is the next Commission meeting? So then I make a motion to direct the City Attorney to draft an advertisement related to the solar amendment that’s going to be on the November Ballot to clarify the impact of what voting yes would do, and what voting no would do, to be placed in our Herald article; and then also pursuant to my motion for the Mayor to determine whether, just so that it doesn’t have to go through all of us, he’ll have the final say since we can’t have a vote outside of the public realm, so he’ll have the final say on it. But really that’s what it is, to educate what the impact would be if you vote for or against it, more educational than anything else. City Attorney Leen: Appoint a designee and I will show them and the City Manager the item and if - I don’t think you should delegate all your authority to one individual, because that then may require us to have a Sunshine Meeting when I meet with the Mayor. What I would say is that, I understand what you want, I fully understand. Vice Mayor Quesada: I would like an educational advertisement put out by the City Commission related to the solar vote coming up in November. City Attorney Leen: OK. I want to make it as eye-catching as easy to read as possible, because obviously it’s buried amongst other advertisements. I don’t want it to look like three paragraphs and then you look at it and you go, I’m not reading this, see what I’m saying. City Attorney Leen: Yes. I understand. Mayor Cason: Anything else?- any other items? Vice Mayor Quesada: No that’s it. Commissioner Lago: OK. Just a few quick items -- the Alhambra Circle Park, I’ve received several e-mails. I know that probably my colleagues have also, and I spoke City of Coral Gables Page 25 City Commission Meeting Minutes October 11, 2016 to the Manager in reference to that. They are looking for just a simple swing set; they are not looking for like a water park just so we are aware. I have my in-laws that live two blocks away, they have no issues with a simple swing set, so you can take your children or your grandchildren. I’d also like to reiterate to staff… Vice Mayor Quesada: Is this the same item or you are jumping? Commissioner Lago: I’m jumping to another item. City Manager Swanson-Rivenbark: A tot lot is planned as a part of that. I think we made a mistake perhaps on calling it passive, thinking that its only green space, but they met with the neighbors, we are able to speak on it if you like, but there is a small children’s play component as a part of that. Commissioner Lago: Perfect. OK. I’ll make sure now I have a way to quickly respond to the residents that were calling, they were a little bit confused. The second issue is, I’ve been getting a few phone calls from the residents on Algardi, Cantoria, and Garcia, and I spoke to the Manager about that. They’ve been waiting; they are eagerly waiting for the tree succession. If you are familiar with this area, they are basically boxed in by 57th Avenue and Bird Road. It’s a little bit of a tough area in our City; they get a lot of cut-through traffic. Their main two concerns right now obviously, besides the venders or the traffic calming, which is not going to happen any time soon, because we are obviously doing an analysis citywide. What they are really looking forward to is getting the tree succession plan for it to commence in their neighborhood and also they are having an issue with 57th Avenue; and the issue there is, that they are hoping for the swales to be beautified. You have a lot of cars that to cut-through standing traffic they go on the sidewalk, they go on the swales, and they are kind of sick and tired of it. So I’d like to see if hopefully we can get this addressed. I know we’ve been dealing with it for like the past two years with staff, maybe we can put something together that can alleviate some of the issues for those residents. The third issue - I know that we are working on an open space code review. I wanted to see when that was going to come before the Commission, and I also wanted to bring to the attention, I know that staff is already dealing with it, 4835 University Drive. Its two townhomes on the water next to Doctor’s Hospital and it’s basically like a fraternity house. For example, at the game on Saturday there were probably a few hundred students there, they leave garbage everywhere, there is an adjacent construction project, which has also been cited on numerous times for working on Sundays, they are not supposed to. This is probably about two minutes City of Coral Gables Page 26 City Commission Meeting Minutes October 11, 2016 from my house and its eyesore on a continual basis, and there is no grass there, it’s basically a mud pit in front of these two properties. And the final issue I wanted to bring to your attention and now I’m going to force you to look around when you drive through the downtown and notice, kind of like what the Mayor did with the buttons. When you drive through downtown or when you walk through downtown, I’ve been encountering through the alleys and all of our sidewalks, you start noticing these bushes that are growing everywhere; or you notice for example, these trees that are growing everywhere in the alleys, and I’ll give you a copy of all of this so you can see it. Basically, these are items that break our sidewalks, so what I’d like to see and this is adjacent to the actual parking garage. So what I’d like to see is if maybe staff can put together a plan to eradicate the growth of all these weeds and hedges that are growing, which at the end of the day are not beneficial in any form, and cause a lot more damage than necessary. Mayor Cason: Commissioner Keon. Vice Mayor Quesada: You know I just thought of something; I apologize Commissioner Keon. The advertisement that we create and this resolution that we just passed related to solar, can we communicate that to all neighboring municipalities? Commissioner Lago: Great idea. Vice Mayor Quesada: And let them know that we are going to be advertising it and send it to them in Word format so if they want to copy and paste it and do their own advertisement. City Attorney Leen: Yes. The City Manager sent me a Word version of South Miami’s. City Manager Swanson-Rivenbark: Commissioner Lago sent to us. Commissioner Lago: I reached out to the Mayor of South Miami. Vice Mayor Quesada: I just want to make sure that we get the other municipalities doing the same thing; we can really spread the word. City Attorney Leen: So we’ll send the Word version to the Miami-Dade League of City of Coral Gables Page 27 City Commission Meeting Minutes October 11, 2016 Cities, to the County, and then we’ll try to send it to as many cities as we can. Vice Mayor Quesada: Yes - perfect. Thank you. Mayor Cason: Commissioner Keon. Commissioner Keon: I’d like to one, commend staff for the crosswalks that have gone in that connect Ingraham Park, both on the north and on the west side and I’m forever grateful to Ernesto Pino for connecting that on the east. He was able to come up with a sidewalk that I see a number of people that are in wheelchairs using so they can access and go to the park, so I want to really applaud the Public Works staff for their work on connecting that park to the community. It is a beautiful park, but somehow the plan for the connecting it to the people got left out, and they’ve done a wonderful job in connecting that park to all of the residents in the surrounding areas. So thank you, thank you very, very much. City Manager Swanson-Rivenbark: And the County was very supportive, they allowed us to do something that we would not normally be able to do. Commissioner Keon: Yes, we thank the County, thank our staff, thank everyone for really looking at the connectivity of that park for people, and it’s a good lesson learned for us as we plan open spaces and we plan parks that we make sure that they can be accessed safely by pedestrians and bicyclists. So thank you very much, you did a great job on that. The other thing also, along LeJeune there in front of Ingraham Park, that swale is always beaten up, because of people wanting to make a right hand turn at that place. I don’t know what you do; there is always a mud puddle kind of there. I don’t know if we widen the access, the dedicated lane to turn right. Commissioner Slesnick: Where is it? Commissioner Keon: Right on LeJeune right after you come over the bridge going north either to turn on Ingraham Highway or I know that we have put into place the opportunity to actually plant in the swales certain types of materials and certain plants or whatever. I don’t know if maybe you can just talk about whether you think that if there were actual plants there that people may not be as quick run over and destroy them, grass is very easy to… Mayor Cason: Curbs are another… City of Coral Gables Page 28 City Commission Meeting Minutes October 11, 2016 Commissioner Keon: The issue with curbs always is, part of what allows things to drain and the streets to drain and the run off from the streets is the fact that we don’t have curbs, and so our swales are even with our streets. So our streets have a place for water to go more quickly to run off and to be absorbed into the grassy areas and the grassy swales, so it doesn’t puddle on the streets and if you get a lot of puddling on the street and you get hydro-planing, I have no expertise in that, but I know that our Public Works staff does so I think they can make a decision where curbs are appropriate and where it isn’t appropriate to putting curbs. But I’m wondering if - and I don’t know, there are mountable curbs whether that makes a difference or just planting material made to sway people from cutting those corners and cutting those things, but if you can just maybe just take a look at it and it’s an internal issue, you can decide, but it should help kind of beautify the area, because I do think our swales add a very attractive element to our City when they are maintained and cared for; and I want to also make sure that we go back, there was a discussion at the last meeting was on the removal of “no parking” signs that don’t serve any purpose other than… Mayor Cason: And “no dumping”. Commissioner Keon:…and “no dumping” signs serve no purpose other than to not allow -, because you have the homeowner that just doesn’t want anybody to ever park in front of their, in that house, and it’s not due to any encroachment from businesses or schools or those sorts of things. I noticed that all along, where was I walking the other day?- actually it’s on Edgewater Drive, all along the north side of the street they have “no parking” in the parkway, “no dumping” signs, but there are parking spaces. I don’t know who they are referring to and the parkway is where there is a curb and there is a big tree in it, so I don’t know where you can park. If you can just go up Edgewater and take a look, it’s on the north side of the street, what purpose does “no parking” signs serve. Mayor Cason: A lot of those may have been put in 40-50 years ago. Commissioner Keon: Well it could have, but there are parking spaces all along there, so the only place they have a parking sign is in front of a very big tree on a little curbed bump-out, so I’m not sure what purpose they serve and it’s just lots and lots of signage. So if you can take a look at it, you may find that it does serve a purpose, it’s hard to understand what it would be, but if it doesn’t take them out I know that along, I think along Almeria or Valencia and some of those streets in there apparently City of Coral Gables Page 29 City Commission Meeting Minutes October 11, 2016 there were “no parking” signs were put up prior to some construction that has since been done, and now the construction is finished and they asked to have the “no parking” signs put back in, because the individuals that are, I don’t know if they are condo associations, I don’t know if they have been sold out to be condo associations, but the people that the fees are being paid to really don’t want to have to maintain the swale so they put in “no parking” signs so that nobody parks there, so that there is no maintenance for those swales. I don’t think that there is any encroachments from anybody else, because they are in residential areas, they just don’t want to have anybody park on their swales. In that area also if you could take a look at, I know in the French Village there is one or two, I think along that area, I know there’s a few, and I know a lot of them along Edgewater and those I can’t figure out what they refer to. That’s all. Thank you. Mayor Cason: The only thing I have is, I’ve had some discussions with the City Manager and staff on collecting monies still owed to the City. We were very successful in collecting the garbage, but we are still owed about $800-and some thousand dollars from residents who haven’t paid. Code Enforcement, we had some ambulance fees that are mainly covered by insurance, but their cases where people don’t follow through and so we don’t get reimbursed, and that’s a lot of money that we could use for parks and other things. So again, hardship cases aside, where people have just not made the effort to collect the money from their insurance companies, we ought to make the effort and get those people to pay because that’s a lot of money that’s sitting out there on the table that we could use.
