Minutes Board of Adjustment Meeting February 22, 2010 Item #1: Meeting called to order 6:00 PM Item #2: Member present: Snyder, Wells and Rice. Absent: Shannon and Szcech Others present: Jim Kessler, Building and Zoning Official. Dee Marshek, Administrative Assistant Item #3: Minutes from November 16, 2009 meeting approved. Motion by: Wells 2nd by: Rice Motion carried: 3-0 Item #4: Public Hearing requested by Hy-Vee for a Conditional Use Permit for a seasonal Lawn & Garden Center located at 2008 8th Ave. Public Hearing opened: Public Hearing closed. Kessler explains the new construction plans that will be underway at this location, and the result of that construction being the loss of 53 parking spaces. Members discuss their concerns for approval with the condition that employee and business parking be located farther from the store to make customer parking more readily available. Motion for approval by: Wells 2nd by: Rice Motion Carried: 3-0 Item #5 Public Hearing requested by Lenoch & Cilek for a Conditional Use Permit for a seasonal Lawn & Garden Center located at 1701 2nd Street. Public Hearing opened: Public Hearing closed. Kessler explained that this was the same request as in past years and no problems should occur as a result of this Garden Center. Motion for approval by: Wells 2nd by: Rice Motion Carried: 3-0 Item #6 Public Hearing requested by Wal-Mart for a Conditional Use Permit for a seasonal Lawn & Garden Center located at 2801 Commerce Dr. Public Hearing opened: Public Hearing closed. Kessler explains that this request is about half the size of previous years and again should not present any concerns for a Lawn & Garden Center at this location.
