Call to Order
The City Council for the City of Crossville met in special session on Tuesday, May 3,
2022 at Crossville City Hall. Mayor James Mayberry was present and presiding. He
called the meeting to order at 5:30 p.m.

1. Consent Agenda
A motion was made by Council Member Rob Harrison, seconded by Mayor
Pro-tem R.J. Crawford, to approve the Consent Agenda, Items 1 A-F. The
motion carried by the following vote:

Ordinances on Third Reading
a. Ordinance amending FY21-22 budget for Maintenance Building Roof
Replacement
The City of Crossville Maintenance department accepted bids to replace the
maintenance building roof. Over the years, the roof has sustained wear and tear
resulting in the need to replace it. The submitted bids were reviewed by the
Maintenance department manager. He recommends approving the lowest bid from
Ridgeline Construction in the amount of $51,720.00. This cost will require a budget
amendment.
This Ordinance was adopted on third reading.
b. Ordinance removing Title 11, Chapter 5 of the Crossville Municipal Code
As recommended by the City Attorney, the ordinance regarding Fortune-Telling and the
Like should be removed in its entirety as the City cannot restrict spiritual beliefs and
this violates the First Amendment.
This Ordinance was adopted on third reading.

c. Ordinance amending FY21-22 budget to replace high mast pole & traffic
light
Staff recommends approval of low bid for High Mast Pole and Light replacement for a
pole that was damaged in a traffic accident and had to be removed because of the
damage to the pole. The High Mast pole is located at the eastbound off ramp on
Interstate 40 at Exit 322 - Peavine Road. A budget amendment is necessary.

d. Ordinance amending FY21-22 regarding purchase of a Utility
Maintenance truck
The Utility Maintenance Manager obtained a price quote from Ford of Murfreesboro for
a 2022 Ford F150, regular cab, 4WD pick-up truck for a purchase price of $30,768.00.
Ford of Murfreesboro has a contract with the State of Tennessee, Central Procurement
Office for vehicles. This vehicle would replace the truck that insurance totaled after a
tree fell on it. This purchase will require a budget amendment for $30,768.00.
This Ordinance was approved on second reading.
e. Ordinance amending FY21-22 budget for non-budgeted items
A budget amendment is requested to add costs that were not budgeted for FY21-22.
This Ordinance was approved on second reading.
f. Approval of Engineering Proposal for Greenway Pedestrian Bridge on
the Little Obed River and Ordinance amending FY21-22 budget for Three
Star grant
The City has received a proposal from Neel - Schaffer, Inc. in the lump sum amount of
$32,800 for all required engineering services for the greenway bridge on the Little Obed
River. The services will be funded with a Three Star grant and it is anticipated that the
construction of the bridge will be performed with City Crews and TCAT students.
This Ordinance was approved on second reading.
2. Other Business
a. Discussion and action regarding Medical Director Services for the City of
Crossville
Mayor Mayberry explained that Cumberland County recently named Dr. James Wojcik
as the Medical Director for Cumberland County EMS. He indicated that the County
Mayor, Allen Foster, requested to change the City's Medical Director's title to avoid
confusion.
The Mayor questioned the Central Communications budget, and asked what is
included in it.
City Attorney Will Ridley recommended that the City keep, terminate, or amend

contract with Dr. Fox. If termination occurs, the current contract with Dr. Fox requires a
30 day notification.
Mayor Pro Tem Crawford asked once County made decision to hire Dr. Wojcik, did it
make the City's contract with Dr. Fox null and void? City Attorney Ridley explained that
the EMS agreement (MOU) is based on state code and the City has a separate
agreement with Dr. Fox. The change in the MOU does not affect the City's current
agreement with Dr. Fox. He related that if the City keeps Dr. Fox as Medical Director,
he would fall under County coordination and that legally two directors are not required,
but not prohibited. He also stated all First Responder services would be subject to
County protocols.
Mayor Pro Tem Crawford stated he had done research and the City having a separate
Medical Director isn't the norm. He also spoke with Chris Miller, EMS Director, who
advised the City would need to change Dr. Fox's title to retain Dr. Fox because only
one "Medical Director" is needed. Mayor Mayberry agreed that two medical directors
are not necessary.
Dr. Fox stated that the Crossville Fire Department had a Medical Director prior to the
First Responder Program. A lot of activities and services he provides for the City do
not fall under the EMS agreement. He explained that if Crossville Fire Department
responds to mutual aid and issues advanced care, that would not be under County
jurisdiction. He related that the City needs its own to provide that care, no matter what
the title. There is justification for having someone in the position as there is ample
work to be done. Dr. Fox stated that it is his pleasure to serve the City of Crossville,
and wants to continue to make sure the First Responders' duties and performance are
protected.
A motion was made by Mayor James Mayberry, seconded by Mayor Pro-tem
R.J. Crawford, to rescind agreement with Dr. Fox due to new medical director
of the Cumberland County EMS. The motion failed by the following vote:
Aye: 2- Mayor Pro-tem R.J. Crawford and Mayor James Mayberry
Nay: 3- Council Member Scot Shanks, Council Member Rob Harrison and Council
Member Art Gernt
The motion to rescind the contract failed; however, the Council asked the City Attorney
to move forward with an amended contract for Dr. Fox.
b. Approval of contracts with TDOT on utility relocations on HWY 127 S and
HWY 68 ( from South of SR-68 to South of the Bridge over Byrd’s Creek,
Homestead Triangle Intersection, PIN 101044.01 Project Number
18006-3214-04)
Contracts were presented that cover the relocation of water and sewer lines for the Hwy
127 S Road Widening and Signalization Project. The City will be responsible for the
cost of inspection.
A motion was made by Mayor James Mayberry, seconded by Council Member
Scot Shanks, to approve contracts with TDOT as presented. The motion carried
by the following vote:
