Main Street The purpose of this meeting was to consider Personnel & Ordinance Committee matters; however, members of the Town Council who were not members of the committee were in attendance and participated in the discussion, resulting in a special meeting of council. Hively, Town Manager; Mary Jones, Human Resources Director; Andrew Hopewell, Planning & Community Development Director CALL TO ORDER Chairwoman Dyke called the meeting to order at 9:30 a.m. PREVIOUS MEETING MINUTES For Reference Only – Minutes from February 2026 There were no changes to the minutes. APPROVAL OF AGENDA Mr. Short moved, Ms. Schmidt seconded, approval of the agenda as presented. The motion carried by voice vote. PUBLIC COMMENTS Jeanne Maloney, 602 S. Blue Ridge Ave., spoke in opposition of the proposed ordinance to amend the Town Code allowing for an early clearing and grading permit. ITEMS REFERRED BY COUNCIL OR INDIVIDUAL MEMBERS Discussion Item (Dyke): Resolution Urging the U.S. Department of Justice to Investigate and Hold Accountable All Alleged Sex Offenders Identified in the Epstein Files Ms. Dyke presented the resolution stating the community is passionate about this topic and it’s an opportunity for council to use their platform to support the citizens and give a voice to those who don’t feel heard. She further stated that when resolutions are brought forward for topics outside of council’s purview, like this one, guidelines are needed so there aren’t resolutions for everything moving forward. Discussion ensued. The committee directed Town Clerk Clatterbuck to make several wording modifications. Mr. Sternberg moved, Mr. Short seconded, approval of the resolution, as amended, for submission to council. The motion carried by voice vote. SPECIAL ITEMS & RECOGNITIONS – None Page 3 of 15 Personnel-Ordinance Committee March 24, 2026 – Page 2 of 3 PERSONNEL ITEMS Departmental Activities Mrs. Jones presented the report and provided an update on recruitment. ORDINANCE ITEM R/R Re: Ordinance No. O-2026-003; Amending Chapter 7 of the Town Code, Relating to Erosion and Sediment Control, to Add an Early Clearing and Grading Permit (first reading) Mr. Hopewell presented the report and recommendation stating the Town has received several requests to permit early clearing and grading of a site in advance of a site plan being approved. This process is available in several other jurisdictions and allows for land disturbance to occur concurrently with site plan review. Additionally, where two or more projects are adjoining, this can allow for grading to occur over multiple sites concurrently which can have the effect of reducing cut dirt being removed from the vicinity, reducing fill dirt being brought into the vicinity, and reducing the volume of trucks on the road hauling dirt to or from a site. The ordinance would require approval of all erosion and sediment control measures by the Town, and storm water management measures by the Virginia Department of Environmental Quality. A bond would be required to cover all work to ensure that the Town would not be left with a degraded site should the developer cease operations. There may be some additional fee revenue related to multiple erosion control plan reviews and land- disturbing permits, but these will be offset by additional staff time for review and inspections. It was recommended that Council holds first reading and adopts Ordinance No. O-2026-003, amending Chapter 7 of the Town Code, Relating to Erosion and Sediment Control, to permit early clearing and grading, and authorizes the Mayor and Town Clerk to execute the document. It was further recommended that Council order that the second reading be waived, and pass this ordinance on first reading without the necessity of waiting until the next regular meeting of the Town Council for action, pursuant to the Council's power to 'otherwise order' under Town Code § 2-32. Discussion ensued about the need to amend the ordinance permanently for a site specific area now, referring to Culpeper Technology Campus and Copper Ridge. Ms. Schmidt moved, Mr. Short seconded, approval of the report and recommendation for submission to council as presented. The motion carried by voice vote. TOWN & COUNTY INTERACTION COMMITTEE Potential Items for Discussion at Next Interaction Committee Meeting – Scheduled for April 24, 2026 – None FY27 PROPOSED BUDGET REVIEW Review of Departmental FY27 Draft Budgets Mr. Hively presented the item. Council – There were no comments. Town Manager – There were no comments. The policy amendment would become effective immediately upon approval by council. Financial Impact: There is no financial impact. Recommendation: That Council approves the amendment to section 8.20, Military Leave, of the Personnel Policies and Employee Handbook. Page 8 of 15 8.20 Military Leave (a) Employees mobilized or ordered to active military duty who are members of the uniformed services, including the Armed Forces of the United States, reserve components, the Virginia National Guard, or the Commonwealth’s militia, and who are called to active duty, training duty, or state active service will have their job status protected in full compliance with current Federal requirements applicable federal and state law, including the Uniformed Services Employment and Reemployment Rights Act (USERRA) and § 44-93 of the Code of Virginia., including fringe benefits as mandated by law Such protections include reemployment rights and the preservation of seniority, accrued leave, and benefits as required by law.. (b) All employees attending annual Reserve or National Guard active duty for training who are required to perform federally funded military duty, including training or active duty, or state active duty as ordered by the Governor are entitled by State Law to not more than fifteen (15) work days of leave annually with full pay up to twenty-one (21) workdays (168 hours) of military leave with pay per federal fiscal year (October 1 through September 30), in accordance with § 44-93 of the Code of Virginia. This leave is not charged to the vacation leave of individuals shall be provided without charge to accrued leave balances, and employees shall not lose seniority, accrued leave, or performance ratings while on such leave. Weekly or monthly drills must be attended on the employee’s own time. (c) Employees are entitled to military leave for qualifying duty as defined above. For periods of service exceeding available paid military leave, employees may be placed on military leave without pay or may elect to use accrued paid leave, in accordance with applicable policies. (d) Employees shall provide advance notice of military service to their supervisor when practicable and submit appropriate documentation (e.g., military orders) to the Human Resources Department to support the leave request, consistent with USERRA requirements. (b)(e) Military leave may be with or without pay, depending on the nature and duration of service.
