Consider the Purchase of Stream Mitigation Credits-Vision Parkway Extension IX. Announcements X. Executive Session (If Needed) XI. Adjourn. CITY OF CUMMING COUNCIL MINUTES WORK SESSION MAY 2, 2023 I. There was a Work Session meeting of the Mayor and Council of the City of Cumming on Tuesday, May 2, 2023, at 6:00 P.M., at City Hall in Cumming, Georgia. The Mayor and all Council Members were properly notified as required by law and all were present. Mayor Brumbalow presided over the meeting and called the meeting to order. II. Invocation: Mayor Brumbalow asked City Administrator Phil Higgins to deliver the invocation. III. Pledge to the Flag. Mayor Brumbalow led everyone in the Pledge to the American Flag. IV. Consider Agenda for Adoption- A motion was made by Chad Crane and seconded by Jason Evans to adopt the agenda as presented. The motion carried unanimously. V. Consider for adoption the following meeting minutes: A. Regular Council Meeting of April 18, 2023: A motion was made by Chad Crane and seconded by Christopher Light to approve the minutes of the Regular Council Meeting of April 18, 2023 as presented. The motion carried unanimously. VI. Acknowledgements, Proclamations, Resolutions, etc.- A. Key to the City Recognition: Jim Otwell: Mayor Brumbalow presented an honorary “Key to the City” to Jim Otwell for his service and dedication to the City of Cumming. VII. Old Business: A. Administration: 1. 2022 Final Budget Amendment: City Administrator Phil Higgins explained that the City of Cumming, in order to comply with State of Georgia Audit regulations, has to amend its 2022 Budget to account for any increases/decreases in revenue received or any unexpected expenditures. City Administrator Phil Higgins presented the Final Budget Amendment for the 2022 Budget. A motion was made by Jason Evans and seconded by Chad Crane to adopt the 2022 Budget Amendment as presented by City Administrator Phil Higgins. The motion carried unanimously. 2. Consider Adoption of 2022 Audit: Clay Pilgrim with the Rushton Group presented the audit at the regular meeting on April 18, 2023. After some discussion, a motion was made by Jason Evans and seconded by Joey Cochran to accept the 2022 Audit Report by Rushton Group as presented and submit to the State Auditors. The motion carried unanimously. VIII. New Business A. Administration: 1. Consider Approval of Purchase Agreement- Creative Enterprises: City Administrator Phil Higgins explained that earlier this year, Creative Enterprises approached the City about the potential purchase of the property they currently occupy on Pilgrim Mill Road from the City of Cumming. After discussion in executive session and obtaining an appraisal, it was agreed upon to sell the property at the appraised value of $719,305.82. The surveyed parcel desired by Creative Enterprises totals 5.232 acres which included the current structure that is occupied. A motion was made by Jason Evans and seconded by Christopher Light to authorize Mayor Brumbalow to sign the sale agreement on behalf of the City of Cumming. The motion carried unanimously. 2. Consider the Purchase of Stream Mitigation Credits- Vision Parkway Extension: City Administrator Phil Higgins explained that as part of the construction of the Vision Parkway Extension we are required to work inside of an existing stream buffer. In getting the permit to do this work we are required to purchase stream mitigation credits from the Corp of Engineers from the same basin (Upper Chattahoochee Service Area), that the work is being done. The total cost of the required credits is $260,550.00. After further discussion, a motion was made by Joey Cochran and seconded by Christopher Light to authorize the purchase of stream mitigation credits for $260,550.00. The motion carried unanimously. IX. Announcements: none X. Executive Session: Mayor Brumbalow stated there was a need to have Executive Session to discuss real property acquisition. A motion was made by Joey Cochran, seconded by Linda Ledbetter to recess into executive session. The motion carried unanimously. After a brief executive session, a motion was made by Chad Crane and seconded by Linda Ledbetter to reopen the regular meeting. The motion carried 3-0. XI. Adjournment: A motion was made by Linda Ledbetter and seconded by Chad Crane to adjourn. The motion carried 3-0. Approved this 16th day of May, 2023.
