COUNCIL MINUTES
WORK SESSION
DECEMBER 5, 2023
I. There was a Work Session meeting of the Mayor and Council of the City of Cumming
on Tuesday, November 5, 2023, at 6:00 P.M., at City Hall in Cumming, Georgia. The
Mayor and all Council Members were properly notified as required by law and all were
present. Mayor Brumbalow presided over the meeting and called the meeting to order.
II. Invocation: Mayor Brumbalow asked City Administrator Phil Higgins to deliver the
invocation.
III. Pledge to the Flag. Mayor Brumbalow led everyone in the Pledge to the American
Flag.
IV. Consider Agenda for Adoption- A motion was made by Chad Crane and seconded
by Joey Cochran to adopt the agenda as presented. The motion carried unanimously.
V. Consider for adoption the following meeting minutes: A. Regular Council Meeting
of November 21, 2023: A motion was made by Chad Crane and seconded by Joey
Cochran to approve the minutes of the Regular Council Meeting of November 21, 2023 as
presented. The motion carried unanimously.
B. Executive Session Meeting of November 21, 2023: A motion was made by Chad Crane
and seconded by Jason Evans to approve the minutes of the Executive Session minutes of
November 21, 2023. The motion carried unanimously.
VI. Acknowledgements, Proclamations, Resolutions, etc.-Proclamation- Marlon
Priest: A motion was made by Joey Cochran and seconded by Christopher Light to move
this item to the end of the agenda. The motion carried unanimously.
VII. Old Business: A. Administration: 1. 2024 Budget (Public Hearing): City
Administrator Phil Higgins stated the 2024 Budget was presented to the Council at the
Regular Meeting on November 21, 2023, so now the public hearing could be held. A
motion was made by Jason Evans and seconded by Joey Cochran to open the public hearing
for the 2024 Budget. The motion carried unanimously. No public comments were recorded.
A motion was made by Chad Crane and seconded by Jason Evans to close the public
hearing. The motion carried unanimously. The 2024 Budget will be up for adoption at a
Regular Council Meeting on Tuesday, December 19, 2023.
VII. New Business: A. Planning and Zoning: 1. Capital Improvements Element
Annual Update (Public Hearing): Planning Director, Scott Morgan explained that he and
the Planning Department staff are conducting the annual update of the CIE in our
Comprehensive Plan. This includes providing the ARC and the DCA the FY2022 annual
financial report for our Impact Fee Program and an updated Schedule of Improvements for
the five-year period, 2023-2027. After holding a public hearing to solicit public input,
authorization is needed for the Mayor to sign the transmittal resolution for review by ARC
and DCA. A motion was made by Jason Evans and seconded by Joey Cochran to open the
public hearing. The motion carried unanimously. No public comments were recorded. A
motion was made by Joey Cochran and seconded by Jason Evans to close the public
hearing. The motion carried unanimously. A motion was made by Christopher Light and
seconded by Joey Cochran to authorize Mayor Brumbalow to sign the transmittal
resolution. The motion carried unanimously.
B. Administration: 1. Sales Agreement with Access Area, LLC-Mary Alice Park Road
Parcel: City Administrator, Phil Higgins explained that Access Area, LLC purchased the
western corner of Mary Alice Park Road and Marketplace Boulevard. Attached to the
Parcel is a strip of abandoned road bed that was formerly part of Mary Alice Park Road
many years ago. That road bed was made City Right of Way. Access Area LLC has
contacted the City wanting to purchase this ROW from the City. It totals approximately
0.34 acres. Council approval is needed to sell this 0.34-acre parcel to Access Area, LLC at
the appraised price of $52,000. A motion was made by Jason Evans and seconded by Chad
Crane to authorize the sale of 0.34-acre parcel to Access Area, LLC. The motion carried
unanimously. A motion was made by Jason Evans and seconded by Chad Crane to
authorize Mayor Brumbalow to sign the sales agreement on behalf of the City. The motion
carried unanimously.
IX. Announcements:
A. The City of Cumming Employee Luncheon will be Thursday, December 7, 2023 at
11:30 a.m. at the Recreation Center Multipurpose Room at 437 Pilgrim Mill Road.
B. The City of Cumming Christmas Parade is Saturday, December 9th beginning at 5
p.m. Route is from Forsyth Central High School to the Cumming Fairgrounds on
Tribble Gap/Castleberry Road.
VI. Acknowledgements, Proclamations, Resolutions, etc.-Proclamation- Marlon
Priest: Mayor Brumbalow read aloud and presented a proclamation proclaiming today,
December 5, 2023 as MARLON PRIEST DAY in the City of Cumming for his heroic
efforts to help save people and property at a fire in the Aubrey’s Landing Apartment
Community.
X. Executive Session: Mayor Brumbalow stated there was no need for Executive
Session.
XI. Adjournment: A motion was made by Jason Evans and seconded by Chad Crane to
adjourn. The motion carried unanimously.
