Adjourn.  CITY OF CUMMING COUNCIL MINUTES WORK SESSION JUNE 6, 2023 I. There was a Work Session meeting of the Mayor and Council of the City of Cumming on Tuesday, June 6, 2023, at 6:00 P.M., at City Hall in Cumming, Georgia. The Mayor and all Council Members were properly notified as required by law and all were present with the exception of Christopher Light. Mayor Brumbalow presided over the meeting and called the meeting to order. II. Invocation: Mayor Brumbalow asked City Administrator Phil Higgins to deliver the invocation. III. Pledge to the Flag. Mayor Brumbalow led everyone in the Pledge to the American Flag. IV. Consider Agenda for Adoption- A motion was made by Chad Crane and seconded by Jason Evans to adopt the agenda as presented. The motion carried 4-0 with Councilman Light absent. V. Consider for adoption the following meeting minutes: A. Regular Council Meeting of May 16, 2023: A motion was made by Chad Crane and seconded by Jason Evans to approve the minutes of the Regular Council Meeting of May 16, 2023 as presented. The motion carried 4-0 with Councilman Light absent. VI. Acknowledgements, Proclamations, Resolutions, etc.- A. Key to the City Recognition: Dr. Shannon Mize: Mayor Brumbalow presented an honorary “Key to the City” to Dr. Shannon Mize for his service and dedication to the City of Cumming. VII. Old Business: none VIII. New Business A. Fairgrounds: 1. Consider Purchase of Skid Steer Loader: Fairgrounds Director Tracy Helms reported the quotes on the purchase of a new skid steer loader for the Fairgrounds, replacing a 23-year old loader requiring extensive maintenance to keep running. This was not a budgeted item and the price quoted included trade-in of the old equipment. The quote results were as follows: Bobcat S86 T4: $61,027.52 CAT 272D3-C1: $68,955.00 Case SV340B: $71,980.00 A motion was made by Linda Ledbetter and seconded by Joey Cochran to authorize the purchase of the Bobcat S86 T4 from Bobcat of Atlanta for the low quote of $61,027.52. The motion carried 4-0 with Councilman Light absent. B. City Center: 1. Consider Agreement for a Hotel Feasibility Study: City Administrator Phil Higgins explained that in considering the best use for the remaining property at the Cumming City Center the need for a Hotel has been discussed. We have a group that is willing to front the cost of a feasibility study in exchange for the right of first refusal to develop the Hotel. The City would have the right to determine whether their concept will qualify as an acceptable development regarding the City’s plan and vision for the property. The developer will have 90 days to commission the study. (see attached agreement) A motion was made by Joey Cochran and seconded by Jason Evans to authorize the developer to commission a feasibility study in exchange for the right of first refusal to develop the Hotel. The motion carried 4-0 with Councilman Light absent. C. Administration: 1. Consider Rescheduling the July 2023 Work Session from July 4th to July 5th, if needed. A motion was made by Jason Evans and seconded by Chad Crane to move the July 2023 Work Session from July 4th to July 5th if needed. The motion carried 4-0 with Councilman Light absent. 2. IGA with Forsyth County for Collection and Distribution of Library and Fire Impact Fees: City Attorney Kevin Tallant explained that in December 2022 the City and County entered into a Local Option Sales Tax Agreement (the “LOST IGA”), which contained several provisions, one of which was an agreement that the City would modify its impact fee ordinance to collect impact fees for libraries and public safety/fire and remit such collected fees to the County. The City would have to amend its Impact Fee Ordinance to reflect the inclusion of the Library and Fire Impact Fees. The plan is to coordinate with Forsyth County to avoid amending the ordinance multiple times. A motion was made by Jason Evans and seconded by Chad Crane to authorize Mayor Brumbalow to sign the Impact Fee IGA with Forsyth County. The motion carried 3-1 with Councilman Light absent and Councilmember Ledbetter opposed. IX. Announcements: none X. Executive Session: Mayor Brumbalow stated there was a need to have Executive Session to discuss real property acquisition and threatened litigation. A motion was made by Chad Crane and seconded by Jason Evans to recess into executive session. The motion carried 4-0 with Councilman Light absent. After a brief executive session, a motion was made by Chad Crane and seconded by Jason Evans to reopen the regular meeting. The motion carried 4-0 with Councilman Light absent. A motion was made by Chad Crane and seconded by Jason Evans to authorize the City Attorney to offer $37,000.00 to the property owner of a parcel needed for the Sawnee Drive Extension Project. If the offer is rejected, authorization to condemn is granted. The motion carried 4-0 with Councilman Light absent. XI. Adjournment: A motion was made by Chad Crane and seconded by Jason Evans to adjourn. The motion carried 4-0 with Councilman Light absent. Approved this 20th day of June, 2023.
