7:00 p.m.
ROLL CALL:
Chairman Bernard Gallo called the meeting to order at 7:07 p.m.. Present by roll call:
Alex Wolk Jr., Elizabeth Falk, Geoff Herald, and Matthew Rose (arrived at 7:11 p.m.). Staff
present was Melissa Llera, Secretary, and Larry Liebman, Environmental Compliance Inspector.
Absent were Mary Cronin, Tom Giegler, and Mark Massoud.
PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was led by Alex Wolk Jr.
Chairman Bernard Gallo sat alternate Alex Wolk Jr. for Mary Cronin for voting.
ACCEPTANCE OF MINUTES: October 25, 2023
Motion to accept the minutes of October 25, 2023 as presented was made by Geoff
Herald; seconded by Elizabeth Falk. No remarks. All in favor with Ayes of those eligible to
vote: Geoff Herald, Elizabeth Falk, and Bernard Gallo.
Next regular meeting is scheduled for December 13, 2023.

OLD BUSINESS:
#1206 20 Apple Blossom Lane, Vitti, Anthony; (I10080), RA-20 Zone, Legalize 2
previously completed additions and installation of a dock
Bob Vitti was present to represent the application. He acknowledged receipt of the staff
report. He states that he understands the report is recommending to legalize the two additions
and the boat dock. He is very happy with that and accepts the conditions and report.
Motion to approve No. 1206, 20 Apple Blossom Lane, with a summary ruling and five
conditions was made by Geoff Herald; seconded by Elizabeth Falk. All in favor with Ayes from
Alex Wolk Jr., Elizabeth Falk, Geoff Herald and Bernard Gallo.

#1204 4 Lee Mac Ave., J.A.R. Associates, Beecher, Thomas W. Esq., Agent; (K14122),
IL-40 Zone, Construction of two new buildings and site improvements including parking and
storm drainage.
Ben Doto, licensed engineer, was present to represent the applicant. He stated they made
revisions requested from two meetings prior. They have provided the size on the water quality
unit, along with adding specifications to the landscape plan for the invasive species removal. He
also had a site visit the other day to review this information. He also acknowledged receipt of
the report. He commented that there was a condition requiring a maintenance plan on the oil
water separator(s) for the floor drains. He said he does not object, but this is something that
would be regulated by the local Department of Public Works anyway. He does accept the report
as presented with no objections.
Matthew Rose arrived to the meeting at 7:11 p.m. during the discussion of this
application.
Motion to approve No. 1204, 4 Lee Mac Ave., with a summary ruling and conditions as
noted in the report was made by Geoff Herald, seconded by Alex Wolk Jr. Geoff Herald then
clarified that the report contains 8 conditions. All in favor with Ayes from Alex Wolk Jr.,
Elizabeth Falk, Geoff Herald, Matthew Rose, and Bernard Gallo.

#1188 1 Mariana Farms Dr., Piacente, Devin & Josemary, (B13048), RA-80, Feasibility
of Subdivision
Mr. Gallo informed the Commission that Ralph Gallagher has not sent the letter of
withdrawal that he said he would. Mr. Gallo recommended to deny the application without
prejudice. Geoff Herald asks if denying without prejudice means that they are still waiting for
their report. Mr. Gallo says no, but allows them to come back before the commission.
Motion to deny without prejudice No. 1188, 1 Mariana Farms Dr, was made by Geoff
Herald, seconded by Elizabeth Falk. All in favor with Ayes from Alex Wolk Jr., Elizabeth Falk,
Geoff Herald, Matthew Rose, and Bernard Gallo.

VIOLATIONS: Barnum Road, Danbury, CT- Cease & Desist
An engineer arrived in anticipation of presenting regarding a violation by his client at 24
Barnum Rd. It was then clarified by Chairman Gallo that 24 Barnum Road violation is not listed
on the agenda. The Barnum Road violation listed represents the Halas violation. Larry Liebman
said he received plans on November 8th regarding 24 Barnum Road for a clearing violation.
There is also clarification that an additional violation on Barnum Road exists regarding a pool,
but this is not related to 24 Barnum Rd. Geoff Herald requests a site visit prior to the 24 Barnum
Road violation being added onto the next agenda for discussion.
Mr. Gallo informs the Commission that the Halas violation on Barnum Road will
probably end up starting over in proceedings due to the change in administration. Current
Corporation Counsel would need to have it completed by the first week in December which is
not realistic. Geoff Herald expressed his frustration as this has been going on for a year and a
half.

Motion to adjourn was made by Geoff Herald; seconded by Matthew Rose. All in favor
with Ayes from Alex Wolk Jr., Elizabeth Falk, Geoff Herald, Matthew Rose, and Bernard Gallo.
