ROLL CALL:
Chairman Bernard Gallo called the meeting to order at 7:02 p.m. Present by roll call:
Elizabeth Falk, Alex Wolk Jr., Matthew Rose, and Mark Massoud. Alternate Alex Wolk Jr. was
seated for Geoff Herald. Staff present was Melissa Llera, Secretary, and Larry Liebman,
Environmental Compliance Inspector. Absent was Geoff Herald.
PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was not performed.
ACCEPTANCE OF MINUTES: February 28, 2024
Motion to accept the minutes of February 28, 2024 as presented was made Mark
Massoud; seconded by Matthew Rose. No remarks. All in favor with Ayes of those eligible to
vote: Elizabeth Falk, Mark Massoud, Matthew Rose and Bernard Gallo.
Next regular meeting is scheduled for March 27, 2024.
OLD BUSINESS:
#1211 117 Boulevard Drive, Cavalcanti, Sergio R.; (D16023), RA-40 Zone, Legalization
of previously built/ installed dock, deck, shed, and platform
Chairman Gallo informed the Commission that they have not received an answer from
the State on the status of Lake Kenosia.

Motion to table No. 1211, 117 Boulevard Drive, until the next regularly scheduled
meeting was made by Matthew Rose; seconded by Mark Massoud. All in favor with Ayes from
Elizabeth Falk, Alex Wolk Jr., Matthew Rose, Mark Massoud, and Bernard Gallo.
#1207 39-41 Old Boston Post Rd, Lake Waubeeka Association; (H23056), RA-80 Zone,
Relocation of retaining wall and gates, demolition of gatehouse, and reconfiguration of driveway
and turn around
Chairman Gallo stated on the record that Elizabeth Falk recused herself for this
application and left the dais.
David Zwang, Board President, was present to represent the application. The
Commission acknowledged receipt of the revised plan, and a staff report was prepared. Mr.
Zwang acknowledged receipt of the staff report, and feels it is acceptable.
Motion to approve No. 1207, 39-41 Old Boston Post Rd, with a summary ruling and six
conditions was made by Matthew Rose; seconded by Alex Wolk Jr.. All in favor with Ayes
from Alex Wolk Jr., Matthew Rose, Mark Massoud, and Bernard Gallo.

#1208 7A Brighton St, Katz, Jeffrey, Ralph Gallagher Jr., Agent; (I06077), RA-20 Zone,
Construction of single-family dwelling, driveway, well and septic system
Mr. Liebman informs the Commission he performed a site walk with Ms. Falk this week.
Mr. Gallagher has hung flags to mark the location of the house and septic. He feels an alternate
plan should be discussed. Ms. Falk acknowledges they are restricted on where they can place the
septic. She recommends a stormwater management plan due to the flow of stormwater over the
site. She would like to see an engineered bio-swale on either side of the lot to keep the
stormwater on the site and also away from the septic fields. She would also like to see improved
filtration of the stormwater prior to it entering the wetlands with the use of plantings.
Motion to table No. 1208, 7A Brighton St., until the next regularly scheduled meeting
was made by Matthew Rose; seconded by Mark Massoud. All in favor with Ayes from
Elizabeth Falk, Alex Wolk Jr., Matthew Rose, Mark Massoud, and Bernard Gallo.

VIOLATIONS
1. Halas, Barnum Road, Danbury, CT- Cease & Desist
Chairman Gallo informed the Commission that the response letter was sent to Halas’
attorney, and they are awaiting a response.
2. 24 Barnum Road Violation
Chairman Gallo informed the Commission they are awaiting the remediation plan from
the engineer now that the property was surveyed and staked.

Motion to adjourn was made by Matthew Rose; seconded by Mark Massoud. All in favor
with Ayes from Elizabeth Falk, Alex Wolk Jr., Matthew Rose, Mark Massoud, and Bernard
