Staff present was Melissa Llera, Secretary, and Larry Liebman, Environmental Compliance Inspector. Chairman Gallo welcomed the two new, regular members Cristina Britton and John Schwartz; along with the new alternate, Gary Dufel. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Bernard Gallo. ACCEPTANCE OF MINUTES: May 8, 2024 Motion to accept the minutes of May 8, 2024 as presented was made Geoff Herald; seconded by Elizabeth Falk. No remarks. All in favor with Ayes of those eligible to vote: Elizabeth Falk, Mark Massoud, Geoff Herald, Matthew Rose, and Bernard Gallo. Next regular meeting is scheduled for June 12, 2024. OLD BUSINESS: #1214 15 Barnum Road, Cedar Gable Preschool; (G06021), RA-40 Zone, Site improvements including proposed parking, septic gallery relocation, new stormwater gallery, retaining walls and grading Nick Yuschak of CCA was present. He acknowledged receipt of the staff report and had no objections. Motion to approve No. 1214, 15 Barnum Road, with five conditions as noted in the staff report was made by Geoff Herald; seconded by Matthew Rose. John Schwartz stated on the EIC Minutes – May 22, 2024 Page 2 record that he performed the site walk and reviewed the information from the last meeting. All in favor with Ayes of those eligible to vote: John Schwartz, Elizabeth Falk, Mark Massoud, Geoff Herald, Matthew Rose, and Bernard Gallo. #1211 117 Boulevard Drive, Cavalcanti, Sergio R.; (D16023), RA-40 Zone, Legalization of previously built/ installed dock, deck, shed, and platform Motion to approve No. 1211, 117 Boulevard Drive, with five conditions as noted in the staff report was made by Geoff Herald; seconded by Matthew Rose. All in favor with Ayes of those eligible to vote: Elizabeth Falk, Mark Massoud, Geoff Herald, Matthew Rose, and Bernard Gallo. VIOLATIONS 1. Halas, Barnum Road, Danbury, CT- Cease & Desist Mr. Gallo informed the Commission he spoke with the attorneys, and informed them he was going to recommend they send this for litigation. Motion to accept Chairman Gallo’s recommendation to send Halas, Barnum Road Cease & Desist, to Corporation Counsel for litigation was made by Geoff Herald; seconded by Elizabeth Falk. All in favor with Ayes of those eligible to vote: Elizabeth Falk, Mark Massoud, Geoff Herald, Matthew Rose, and Bernard Gallo. 2. 24 Barnum Road Violation Mr. Gallo informed the Commission that staff doesn’t have a report ready for this matter. Motion to table 24 Barnum Road Violation until the next regularly scheduled meeting for staff review of revised remediation plan was made by Geoff Herald; seconded by Mark Massoud. All in favor with Ayes of those eligible to vote: Elizabeth Falk, Mark Massoud, Geoff Herald, Matthew Rose, and Bernard Gallo.
