City Commission

On Wednesday, June 5, 2024, at 6:00 p.m., the Dayton City Commission met in regular session in the Commission Chambers of City Hall. CALL TO ORDER The Temporary Chairperson, Commissioner Joseph called the meeting to order. ROLL CALL Roll call was taken, and Commissioners Joseph, Shaw, Fairchild, and Turner-Sloss were present. The Clerk of Commission, Ms. Regina Blackshear, and the City Manager, Ms. Shelley Dickstein, were also present. Commissioner Shaw made a motion to excuse Mayor Mims from this week’s commission meeting. Commissioner Fairchild seconded the motion. The motion was unanimously approved. INVOCATION Commissioner Shaw gave the invocation. PLEDGE OF ALLEGIANCE The Temporary Chairperson, Commissioner Joseph led the public in the Pledge of Allegiance. APPROVAL OF MINUTES Commissioner Shaw made a motion to approve the minutes from the May 29, 2024, City Commission meetings. Commissioner Fairchild seconded the motion. The previous meeting minutes were unanimously approved. COMMUNICATIONS AND PETITIONS There were no communications or petitions. SPECIAL AWARDS/PRESENTATIONS Dayton Equity Center The Temporary Chairperson, Commissioner Joseph invited Pastor Peter E. Matthews, Founder/CEO and Mr. Ashton Dupler, Associate Director Dayton Equity Center to the podium for a community update. Pastor Matthews greeted the Dayton City Commission on behalf of the United Methodist Church and their presiding Prelate Gregory Von Palmer of the West Ohio Annual Conference. He said they are a socially mobile institution that believe through the love of Jesus Christ there is an opportunity for them to reach people where they are and make the most of opportunities for them. Pastor Matthews said The Dayton Equity Center is creating initiatives and building coalitions that restore communities. He said the urban laboratory will be focused on food security, workforce development, youth development, and community wellbeing. Mr. Dupler said they have addressed food security by providing food to 50 families, they have distributed 95 snack bags at Rosevelt Elementary, and a community meal weekly. He said they have addressed workforce development by partnering with 24 local agencies to assist with participants with reentry, resettlement, and recovery. Mr. Dupler said they have addressed youth development and community wellbeing with enrichment afterschool programs centered around STEM, math and reading, summer camps and monthly family events. Mr. Dupler said citizens may contact them at 937-716-1098 or davidh@daytonequity.org or workforce@daytonequity.org. The Dayton City Commission thanked Pastor Matthews and Mr. Dupler for their presentation and their work. ADDITIONS OR DELETIONS TO THE CALENDAR The Clerk of Commission, Ms. Regina Blackshear requested the addition of Ordinance No. 32101-24-Levying a Motor Vehicle License Tax Pursuant to Ohio Revised Code Section 4504.173. She said the legislation would receive a first reading. DISCUSSION OF CALENDAR ITEMS Calendar Item No. 2. American Fireworks Company – Service Agreement The City Manager, Ms. Shelley Dickstein said the agreement is in support of the July 3, 2024, fireworks. Calendar Item No. 4. CJ Hughes Construction Co., Inc. – Award of Contract The City Manager, Ms. Shelley Dickstein said the contract is a continuation of work addressing PFAS and is totally funded by the Ohio EPA. Ordinance No. 32101-24- Levying a Motor Vehicle License Tax Pursuant to Ohio Revised Code Section 4504.173. The City Manager, Ms. Shelley Dickstein said the ordinance will help the City of Dayton take advantage of increasing the permissive tax for the continuation of investment in the roadways. REPORTS 1. APPROVAL OF CITY MANAGER’S REPORTS Commissioner Shaw made the motion to approve the City Manager’s Reports. Commissioner Fairchild seconded the motion. The City Manager’s Reports were approved with a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild and Turner-Sloss. LEGISLATION EMERGENCY ORDINANCE – FIRST AND SECOND READING Emergency Ordinance No. 32100-24- Amending the Living Wage Ordinance to Remove the Sunset Provision, Make It Permanent and Declaring an Emergency. Commissioner Shaw moved that this being an emergency measure for the immediate consideration of the Ordinance. Commissioner Fairchild seconded the motion. The motion was passed with a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild, and Turner-Sloss. The question being shall Emergency Ordinance No. 32100-24 be passed. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild, and Turner- Sloss. The Emergency Ordinance was passed. EMERGENCY ORDINANCE – SECOND READING Emergency Ordinance No. 32098-24- Amending Section 34.01 of the Revised Code of General Ordinances Relating to the Divisions of the Department of Police, and Declaring an Emergency. The question being shall Emergency Ordinance No. 32098-24 be passed. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild, and Turner-Sloss. The Emergency Ordinance was passed. EMERGENCY RESOLUTION – FIRST AND SECOND READING Emergency Resolution No. 6805-24-Objecting to the Issuance of Liquor Permit No. 84416600020, Sporty’s Taphouse & Grill Inc., dba Sport Coats Bar, 3493 W Sibenthaler Avenue, Dayton, Ohio 45406, and Declaring an Emergency. Commissioner Turner-Sloss moved that this being an emergency measure for the immediate consideration of the Resolution. Commissioner Shaw seconded the motion. The motion was passed with a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild, and Turner-Sloss. The question being shall Emergency Resolution No. 6805-24 be adopted. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild, and Turner- Sloss. The Emergency Resolution was adopted. ORDINANCE – SECOND READING Ordinance No. 32099-24- To Vacate Faulkner Avenue from the Alley North of Negley Place to West Riverview Avenue and the Alley North of Negley Place from Faulkner Avenue to North Paul Laurence Dunbar Street. The question being shall Ordinance No. 32099-24 be passed. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild, and Turner-Sloss. The Ordinance was passed. RESOLUTION – SECOND READING Resolution No. 6803-24- Establishing The Poet Laureate of the City of Dayton. The question being shall Resolution No. 6803-24 be adopted. A roll call vote was taken resulting in a 4-0 vote. Voting in the affirmative were Commissioners Joseph, Shaw, Fairchild, and Turner-Sloss. The Resolution was adopted. RESOLUTION – FIRST READING Resolution No. 6804-24-Authorizing the City Manager to Accept Federal Fiscal Years 2025 and 2026 Federal Aviation Administration Airport Improvement Project Grants from the United States Department of Transportation for Airport Improvement Projects at the James M. Cox Dayton International Airport and Dayton Wright Brothers Airport on Behalf of the City of Dayton in an Amount Not to Exceed Twenty-Five Million Dollars and Zero Cents ($25,000,000.00). THIS ITEM WAS ADDED EMERGENCY ORDINANCE – FIRST READING Emergency Ordinance No. 32101-24- Levying a Motor Vehicle License Tax Pursuant to Ohio Revised Code Section 4504.173. BOARD APPOINTMENTS Commissioner Turner-Sloss made a motion to reappoint William Allen, Leslie Lovelace, Matt Sauer, and Ann Schenking to the City Plan Board for a term ending June 30, 2027. Commissioner Fairchild seconded the motion. The motion was unanimously approved. Commissioner Fairchild made a motion to reappoint Cheryl Garrett and Katie Joseph to the Board of Tax Review for a term ending June 30, 2026. Commissioner Shaw seconded the motion. The motion was approved with a 3-1-0. Voting in the affirmative is Commissioners Shaw, Fairchild, and Turner-Sloss. Commissioner Joseph abstained. CITIZENS’ COMMENTS Citizen’s comments were received from the following: 1. Ms. Lynn LaMance, 1061 Betram Ave. – spoke about housing issues around the City of Dayton. 2. Ms. Annette Gibson-Strong, 437 Hopeland St. – spoke about a drug rehabilitation center in her neighborhood. 3. Ms. Amy Grillot, 4400 Daleview Dr. – spoke about proposed legislation for the deaf. COMMENTS BY THE CITY COMMISSION Commissioner Turner-Sloss Commissioner Turner-Sloss thanked citizens and community leaders for their comments at the meeting. Commissioner Turner-Sloss highlighted her attendance at the Pride event. Commissioner Turner-Sloss invited citizens to attend an update on the City’s demolition on Thursday, June 25, 2024, at 5:30 p.m. at Central State West located 840 Germantown Street. Commissioner Fairchild Commissioner Fairchild thanked citizens and community leaders for their comments at the meeting. Commissioner Fairchild highlighted his 40th Class Reunion of Belmont High School. Commissioner Fairchild invited citizens to the Rec Youth Hood event, Long Fellow development, and the Levitt Pavilion events. Commissioner Shaw Commissioner Shaw highlighted his attendance at the Pride Festival, and the Dayton Chamber of Commerce announcement of the NATO Summit in Dayton, Ohio. Commissioner Joseph Commissioner Joseph highlighted World Refugee Day, the Living Wage Ordinance. He asked for a moment of silence to commemorate the passing of Mr. Bob Wolf.
