CALL TO ORDER: The meeting was called to order at 6:00 p.m. Ms. Angelia Briggs introduced herself to the Committee as the Community Development Manager. She introduced Mr. Ron Paradise as the Director Planning and Development Services, Damaris Miranda as a Housing Coordinator and Committee Secretary, and Ms. Jessica Entwistle as Planning and Development Services Administrative Assistant. She welcomed all Committee members to the Affordable Housing Advisory Committee, and thanked them for volunteering and working to help the residents of the City. 2. Williams Absent: 1 - Member Sylvia Hayes B. Staff Presentation Mr. Paradise explained the order of the meeting would be switched up due to a prior engagement with a separate meeting. Mr. Paradise thanked everyone for attending the remote access meeting and advised the Committee meetings may continue this way for the rest of the year. Mr. Paradise explained the Affordable Housing Advisory Committee (AHAC) is a creation of the Florida Legislature memorialized as Florida Statute 420.9076. The AHAC is a requirement for entitlement communities that receive State Housing Initiative Partnership funds (SHIP), and Deltona is an entitlement community. He explained the AHAC membership is unique compared to other City Boards and Committees due to there being an elected Commissioner and Planning and Zoning Board Member on the Committee. The mission for AHAC is to analyze certain City policies and City of Deltona Page 2 Printed on 5/5/2021 Affordable Housing Advisory Minutes April 20, 2021 Committee procedures with regard to incentivizing affordable housing and to make recommendations regarding policies and procedures. He spoke regarding Florida Statute 420.9076, explaining the 11 policies and parameters that involve land development matters. The end goal of the AHAC is to write a report to be submitted to the Florida Housing Finance Corporation. This report is now due annually to ensure the City receives funds from SHIP. He explained, the City hired the Florida Housing Coalition out of Tallahassee as a consultant to give guidance through this process. They will be assisting in the process and will attend the next meeting. There will be Planning and Development Services staff at each meeting to explain City concepts and answer any questions you may have. Mr. Paradise explained the AHAC would not be discussing the CARES Act, stimulus funds, homelessness, social services, or any other federal money. A. Committee Introductions The Committee took turns introducing themselves along with any experience they have within the community. B. Election of Officers Member James explained he would not be able to be Chairperson this year. Member Ulicny-Hoback opened the floor for nominations. Motion by Patricia Ulicny-Hoback, seconded by Michael Williams, to nominate Jodi Pena-Castaldi as Chairperson of the Affordable Housing Advisory Board. The motion carried unanimously. Motion by Michael Putkowski, seconded by Eric James, to nominate Patricia Ulicny-Hoback as Vice Chair of the Affordable Housing Advisory Committee. The motion carried unanimously. 3. APPROVAL OF MINUTES & AGENDA: A. Minutes of July 16, 2019 This item was not voted on and will be presented again next meeting. 4. PRESENTATIONS/AWARDS/REPORTS: A. Presentation - Sunshine Laws and Social Media by City Attorney Scott George Mr. Paradise stated he would give a speech on Sunshine Laws until City Attorney George City of Deltona Page 3 Printed on 5/5/2021 Affordable Housing Advisory Minutes April 20, 2021 Committee arrived. He stated as per the title, Sunshine, it relates to a state body of law and jurisprudence that requires all local government bodies make decisions in the open. It's important to avoid situations that influence the outcome of decisions, which may come in front of this body. Meaning members cannot talk to each other regarding any item on the agenda or anything that may come in the future. He asked for members to be aware of the appearance of interactions that could be perceived wrongly. He spoke regarding email transmissions and stated when receiving an email from staff to reply to City employees. Mr. Paradise explained members cannot get together to represent AHAC at a social event without being advertised and duly noticed by the City for all residents to have due notice. City Attorney George explained social media posts, in all 50 states can be used as s public record. He spoke regarding communication on social media and stated it could cause ethics violations, which can cost a lot of money or cause someone to serve minimal jail time for violating the Sunshine Law. He explained the Committee cannot get together to brainstorm any ideas unless it is done within the AHAC Meetings. Discussion occurred regarding the creation of a subcommittee to brainstorm ideas and ideas for the City. City Attorney George explained the subcommittee would have to be created by the Commission, and it would need to be clearly stated the subcommittee was created for fact-finding only. The members of the subcommittee could not be on any other Board or Committee in the City. City Attorney George spoke regarding accessing Public Records and how having a Commissioner on the Committee works. He stated he would check if Commissioner Avila-Vazquez can abstain from voting on items from this Committee, although he believes she is free to vote on items from the AHAC going to the City Commission. City Attorney George stated he would give the Committee a Youtube video on Sunshine Laws. Ms. Briggs explained that Mr. Paradise would present the AHAC report to the City Commission. She spoke regarding the importance of the Local Housing Assistance Plan. 5. PUBLIC FORUM: Time permitted, public comment shall be permitted at the end of agenda items only and shall not exceed two minutes. Public forum was opened and closed due as there were no public comments. 6. OLD BUSINESS: None. 7. NEW BUSINESS: None. 8. STAFF COMMENTS: City of Deltona Page 4 Printed on 5/5/2021 Affordable Housing Advisory Minutes April 20, 2021 Committee Ms. Briggs spoke regarding the consultant requesting the meeting times change to 4 p.m. to allow them to give presentations and have speakers available. Discussion occurred regarding the officials being paid during this time and the Committee being volunteers. Discussion between the Committee and staff occurred regarding the possible time change. Motion by Patricia Ulicny-Hoback, seconded by Manny Rodriguez, to move the meeting to 4 p.m. on the third Tuesday of every month moving forward until the project is finished. The motion carried by the following vote: For:10 - Chair James, Vice Chair Ulicny-Hoback, Member Avila-Vazquez, Member Ellis, Member Guzman, Member Landron, Member Pena-Castaldi, Member Putkowski, Member Rodriguez and Member Williams 9. BOARD/COMMITTEE MEMBERS COMMENTS: Chair Jodi Pena-Castaldi asked each member if they had anything to say or ask any questions. Many of the members spoke regarding their excitement about working together on the projects. Many members thanked everyone for coming and expressed their eagerness to learn. 10.
