1. CALL TO ORDER:
Mayor Masiarczyk called the meeting to order at 5:30 p.m.
2. ROLL CALL – CITY CLERK:
Mayor Masiarczyk stated that Commissioner had asked to be excused from tonight's
meeting and he asked that the records show the City Attorney and City Manager are
present.

3. INVOCATION AND PLEDGE TO THE FLAG:
Mayor Masiarczyk led the Pledge to the Flag.

Mayor Masiarczyk stated the Silent Invocation will be presented by Commissioner Honaker.
4. APPROVAL OF MINUTES & AGENDA:
Mayor Masiarczyk stated next are the minutes. Commissioner Honaker responded that he
will have comments stating he was marked as absent and it should have been marked
excused.

5. PRESENTATIONS/AWARDS/REPORTS:

A. Recognition - Detective Jan Jennings
B. Presentation - Scott McGrath will present the FPZA 2017 Outstanding
Development Award received for the Lakeshore Loop Trail.
C. Request for City of Deltona funds - Trinity Christian Academy Baseball
Mayor Masiarczyk stated the City Manager had requested this item regarding the request
for funds by the Trinity Baseball Team. H asked that this item be discussed at the Regular
Commission Meeting as the request is unusual.

6. CITY COMMISSION SPECIAL REPORTS AND REQUESTS:
Mayor Masiarczyk asked if there were any Commission Special Reports.
Commissioner Herzberg stated she attended her first Healthy Start Board Meeting and she
will have a short report.
Mayor Masiarczyk stated he attended the Round table of Elected Officials and he thinks he
should bring up the discussion of the 1 cent sales publicly. He stated he believes he is the
only one who spoke out or cautioned about what is going on. City Manager Shang
responded as an FYI that the deadline for completing the survey was last week and for
those who did provide comments, she forwarded them on. Mayor Masiarczyk stated he was
going to have to be very blunt about this topic and Vice Mayor Nabicht suggested that
Mayor Masiarczyk bring this up under City Commission Special Reports.
Commissioner Alcantara stated he had a couple of requests/motions he wanted to put out
there and he asked if he should do that under Commission Special Reports and Requests
or under Commission Comments. Mayor Masiarczyk asked what the motions were .
Commissioner Alcantara stated one (1) was regarding not getting clear direction on the
decommission of the Fisher Plant as far as the costs involved and two (2) was regarding
modification of the Consumptive Use Permit (CUP) and getting clear direction if that is what
we want to do.
Vice Mayor stated he had a question about our policy in that his understanding is that the
motions that would be made with regards to that subject matter is that the motions would be
that this matter be put on an agenda so that staff can prepare. Mayor Masiarczyk asked
Commissioner Alcantara if that is what he intended. Commissioner Alcantara responded
"no" and asked if he could make a motion to direct the City Manager to give an estimate .
City Attorney Segal-George responded for a subsequent agenda and ask for the City
Manager to come forth with that information but you cannot take action on the substance
tonight because it was not advertised.

Commissioner Alcantara stated he had one (1) other question regarding him having a
meeting with another Commissioner; would it have to be noticed. City Attorney
Segal-George responded "yes" it would have to be noticed. Commissioner Alcantara
asked if he would be allowed to ask that Commissioner to have a public meeting without
telling that Commissioner what the substance is or does he have to do it in an open setting .
City Attorney Segal-George responded it would have to be done in an open setting. Mayor
Masiarczyk asked to clarify that Commissioner Alcantara was wanting to meet with just one
(1) Commissioner and Commissioner Alcantara responded "yes" but anybody can come.
City Attorney Segal-George stated just so you understand that when you say "public
meeting" not only does it have to be public but the conversation has to be recorded so there
will be an expense. She added that the other Commissioner does not have to agree to
meet.
Vice Mayor stated he has a letter from the Transportation Planning Authority (TPO) that he
will read into the record and he will be giving a summary on about $ 5.3 million in City
projects that are in the pipeline.
Commissioner Bradford stated she will have a motion in relation to the unlicensed
contractors to further the sting by the Volusia County Sheriffs' Office (VCSO) that just took
place on unlicensed contractors. She stated she would like to know our role as far as
Business Tax Receipts are concerned when a person has been arrested a couple of times .
She stated she has done research and other cities and counties have additional
ordinances to deal with this issue. Mayor Masiarczyk suggested getting with the City
Manager to look into whether we need an ordinance and he asked if she would be doing
this under Commission Comments. Commissioner Bradford responded that we risk now
with the meeting running over that there is not time under Commission Comments. She
stated one (1) other issue she plans to bring up is the emergency transport where the City
can transport in emergency situations when the County is not able to facilitate. Vice Mayor
Nabicht stated the problem is that EVAC will not let the City do it because it is a guaranteed
pay. Mayor Masiarczyk stated if there is a list of questions he would like to get into depth
and have the Fire Chief explain that to us at a future meeting so we all understand it. He
suggested having the City Manager get the Chief and a county representative for
discussion on a future agenda so the public can see it also. Vice Mayor Nabicht reminded
the Commissioners that the City already has the ability to transport however the County
refuses to call the City.

8. CONSENT AGENDA:
A. Order Repealing City of Deltona Burn Ban No. 2017-001
Commissioner Honaker stated he would have comments on this item. He stated the Fire
Chief has the authority to declare a burn ban and the authority to dismiss it so why is this on
the agenda. City Manager Shang responded that the Commission did it in the form of a
motion and Mayor Masiarczyk explained that because of an action by this body of making a
motion to direct the burn ban be brought before the Commission to be lifted and this action
should not have been taken. Mayor Masiarczyk stated he is going to make a motion that the
Fire Chief being the Chief Safety Officer with the approval of the City Manager can issue
burn bans and lift them.

9. ORDINANCES AND PUBLIC HEARINGS:
A. Public Hearing - Resolution No. 2017-11, Establishing the Preliminary
Annual Rate Resolution - Stormwater Services for FY 2017/2018 - Robert
Clinger, Finance Department (386) 878-8552.
Strategic Goal: Fiscal Issues.
Mayor Masiarczyk stated the next items are just resolutions establishing the preliminary
annual rates that have to be sent to the Property Appraiser so none of these should be
controversial as they are just maintaining the same rates until the Commission gets into the
budget discussions where changes can be made if needed. He stated the Commission can
go through each one if you like.

B. Public Hearing - Resolution No. 2017-12, Establishing the Preliminary
Annual Rate of Assessment for Solid Waste Services for FY 2017/2018 -

E. Request for approval of Resolution No. 2017-22 and Execution of State
Revolving Loan Agreement for the Alexander Avenue Reclaimed Water
Augmentation Project (also known as Lake Monroe Project Phase 4A). -

Strategic Goal: Infrastructure.
Mayor Masiarczyk stated the next item is regarding the Execution of State Revolving Loan
Agreement. Vice Mayor Nabicht commented this is just a housekeeping item because the
Commission had already approved this previously. It was determined that this was
approved in December.
Commissioner Honaker stated this authorizes the City Manager to sign the letter. Mayor
Masiarczyk commented that the City already got the money and Mr. Doan responded this is
just to put the actual bid amount in the actual loan versus what was approved in December
that was a loan that could exceed what the bid amount was so that it defines what the bid
came in at; it accepted the bid amount but it needed a resolution with that amount in it as
required by the State and that is what this is.

A. Consideration of two alternate appointments to the Economic
Development Advisory Board. - Joyce Raftery, City Clerk (386) 878-8502,
Strategic Goal: Internal and External Communications.
Mayor Masiarczyk stated the next item is the appointment of two (2) alternate members to
the Deltona Economic Development Advisory Board (DEDAB). He stated there are two (2)
applicants and we need two alternates.

B. Consideration of appointment of one (1) member to the Affordable Housing
Advisory Committee for the remainder of a term to expire October 5, 2017 -
Joyce Raftery, City Clerk (386) 878-8502.
Strategic Goal: Internal and external communication.
Mayor Masiarczyk stated the next item is the appointment of one (1) member to the
Affordable Housing Advisory Committee (AHAC) to serve out the remainder of a term that
will expire October 5, 2017.
Commissioner Honaker commented he had reviewed all of the applicants and he likes Diaz
who says she resides in District 1 but she actually resides in District 2. Mayor Masiarczyk
stated Commissioner Honaker can make that recommendation.

C. Discussion of current and future trash collection rules. - Jane Shang, City
Manager, (386) 878-8860.
Mayor Masiarczyk stated the next item is a discussion of current and future trash collection
rules and basically this is a request to discuss the once a month pickup at a cost of $ 10.20
per year per house. City Manager Shang stated she needed to make a clarification that the
pickup would have to be done on Saturday only.
Commissioner Bradford asked if the Commission would be voting on this tonight. Mayor
Masiarczyk stated someone asked for this to come back and the way this is written it is just
for discussion. He stated it includes discussion on the contract and that contract comes due
in 2019. City Manager Shang clarified that the contract comes due January 1, 2019. Mayor
Masiarczyk stated the Commission will be working on this so there is no need to talk about
it tonight and the Commission has made it clear that this contract is going out to bid.
Vice Mayor asked if he had not asked to discuss Redman also. Mayor Masiarczyk

responded that is on the agenda also and the idea he got was to talk about Redman
helping the City during the negotiations. Vice Mayor Nabicht stated he wants the City to
contract with Redman as a consultant to come in and review everything regarding waste
collection and make recommendations as to what needs to go in the RFP.
Commissioner Herzberg asked to add monitoring the contract as well and City Manager
Shang responded that is why she included current and future rules.
Commissioner Alcantara asked if there was no one at the City that could tell us what needs
to go in the contract. Mayor Masiarczyk responded it has been done a number of times and
the Commission keeps changing it; Redman has been around a long time and is very
knowledgeable about waste handling services and he does not know of anyone better. It
was suggested that the Commission discuss this at the regular meeting downstairs.
Mayor Masiarczyk suggested that tonight the discussion is only to hire Redman to go over
the current contract and help with putting together the RFP for a future contract and discuss
whether we want to set up a once per month collection on Saturdays.

12. CITY ATTORNEY COMMENTS:
There were no City Attorney comments.
13. CITY MANAGER COMMENTS:
City Manager Shang stated she will just be making an announcement in regards to the next
workshop that will be a combination of Economic Development and Parks CIP. She stated
also she is looking for direction regarding whether we want to extend the advertisement for
the new City Attorney position.
Commissioner Herzberg asked if an announcement can be made regarding the 4th of July
fireworks event being moved to Saturday, July 1st. Mayor Masiarczyk stated that was when
it was scheduled. City Manager Shang clarified that it was usually scheduled on July 4th and
the direction of the Commission was that it would be on Saturday the 1st. Mayor Masiarczyk
stated normally we have it on the 4th and a Commissioner made a motion to move it to
Saturday (July 1st), the meeting on Monday was cancelled and that is how he remembered
it. He stated the Commission agreed to go with Saturday, July 1st, it was never scheduled
for July 4th as in the past.
Commissioner Herzberg asked just to make a public service announcement. Mayor
Masiarczyk suggested it could be done during Commission Comments. He added that
there are people that are upset about it. Commissioner Bradford stated there are concerns
because the reason for having the event on July 4th was to try to reduce residents doing
their own fireworks and now we have said you are going to get a special treat on July 1st
and now everyone is going to be free to do their own fireworks on July 4th. Mayor

Masiarczyk stated if there is a lull in the rain the fireworks will be going off now and every
day. Commissioner Herzberg asked what if the event gets rained out on July 1st, will it
move to the 4th. It was determined there is a rain day in the contract.

5. PRESENTATIONS/AWARDS/REPORTS:
A. Recognition - Detective Jan Jennings
Background: Recognition to Detective Jan Jennings for going above and beyond her
duties and using her own time to be a positive role model in a young
autistic child’s life. As stated in a letter by the grandmother of this child,
Detective Jennings truly defines “Serve and Protect”.
Detective Jennings took the time with an autistic 10 year old boy. He is
very intelligent, but does not seem to have the ability to think things
through realistically before acting on impulse. He has been running
away when faced with discipline/punishment after doing something

wrong. He is getting too big and too strong for his mother to restrain
him, and she has had to call the sheriff’s department on several
occasions to aid in finding him. The young boy fights anyone who tries
to come near him during these times, including his mother and the
deputies.
Detective Jennings talked with this child and showed interest in him. In
that conversation, this young boy told her he could cook macaroni and
cheese. She told him she would have to come over and let him cook
for her one day. The detective followed through and made
arrangements with the family. She went to their house, let him cook
mac 'n cheese, and spent time with him.
Deputy Jennings wants this child to know the deputies are here to help
and not the enemy. She realizes if this child can identify with officers in
a positive light, things may go more smoothly the next time he bolts
and law enforcement involvement is needed.

B. Presentation - Scott McGrath will present the FPZA 2017 Outstanding
Development Award received for the Lakeshore Loop Trail.
Background: The Florida Planning and Zoning Association (FPZA) awarded the City
of Deltona’s Lakeshore Loop Trail as the 2017 Outstanding
Development project on Friday, June 9th at the Ritz Carlton Golf
Resort in Naples.
The City of Deltona’s Lakeshore Loop Trail connects Deltona’s Thornby
Park, the Deltona Community Center, Deltona Boat Ramp Park, Lake
Monroe, and Volusia County’s Green Springs Park and connects to
back to the Coast2coast and River2Sea trails. This project took 7
years from vision to completion and the wait was worth it. This lakefront
trail offers scenic views, Live Oak trees estimated to be over 500 years
old, and a pair of rustic looking bridges that have quickly become
photographic hot spots.
The Lakeshore Loop Trail is an outstanding quality trail segment that is
defined as being extremely scenic and blending into the natural
environment. It has quickly become a local favorite for cyclists, walkers,
and families and the heavy duty construction and tree/root protection
methods used in construction ensure that it will be a state and local
treasure for decades to come.
C. Request for City of Deltona funds - Trinity Christian Academy Baseball

Background: The Commission discussed at several meetings the $35,000
discretionary fund which could be provided to non-profit organizations
who applied for them. The Commission directed staff to come up with
an application and guidelines for this funding which has been
completed with a limit of $1,000.00.
Attached is a request from the Trinity Christian Academy High School
Baseball Team for City funds in the amount of $1000.00 to assist with
reimbursement of funds and to buy sports memorabilia for the State
Championship finals. The FHSAA Class 2A Baseball Program is
returning to the State Championship finals for the ninth time in ten
years.

A. Order Repealing City of Deltona Burn Ban No. 2017-001
Background: On April 17, 2017, the City Commission recognized the need to enact a
burn ban due to extremely dry weather conditions in Deltona and voted
to establish a resolution.
The Deltona Fire Chief has observed and determined that due to the
significant amounts of rainfall in recent days, which has reduced and
mitigated the drought and atmospheric conditions and local
circumstances, originally warranting the issuance of an outdoor burn
ban. The Fire Chief hereby recommends the burn ban order dated April
20, 2017, be repealed effective June 20, 2017 at 0800 hours.

Rate Resolution - Stormwater Services for FY 2017/2018 - Robert Clinger,
Finance Department (386) 878-8552.
Strategic Goal: Fiscal Issues.
Background: The Stormwater Utility System is based on operational and capital
needs, and is funded by fees levied to the property owners in the City.
Section 54-158 of the Code of Ordinances requires that the City
Commission adopt an Annual Rate Resolution during its budget
adoption process for each fiscal year. The initial proceedings for the
adoption of an Annual Rate Resolution require the adoption of a
Preliminary Rate Resolution. Attached is the Preliminary Rate
Resolution for stormwater utility assessments for FY 2017/2018. Staff is
proposing the current annual rate of $108.00 per ERU (Equivalent
Residential Unit).

needs, and is funded by fees levied to the property owners in the City.
Section 54-56 of the Code of Ordinances requires that the City
Commission adopt an Annual Rate Resolution during its budget
adoption process for each fiscal year. The initial proceedings for
adoption of an Annual Rate Resolution require the adoption of a
Preliminary Rate Resolution. The annual solid waste assessment rate
for FY 2017/2018 is proposed at $173.96 per Equivalent Residential
Unit (ERU) which reflects no increase from the rate for the current fiscal
year. Attached is the Annual Rate Resolution for solid waste
assessments.

D. Public Hearing - Resolution No. 2017-14, Establishing the Preliminary Annual
Rate Resolution - Lake McGarity Aquatic Weed Control Services for FY

Strategic Goal: Fiscal Issues.
Background: The Lake McGarity Special Assessment District was established to
provide aquatic weed control services for the Lake. The cost of those
services are apportioned to properties that will benefit from those
services and will be levied to the property owners.
Section 54-16 of the Code of Ordinances requires that the City
Commission adopt an Annual Rate Resolution during its budget
adoption process for each fiscal year. The initial proceedings for the
adoption of an Annual Rate Resolution require the adoption of a
Preliminary Rate Resolution. Attached is the Preliminary Rate
Resolution for Aquatic Weed Control Services assessments for the
Lake McGarity Special Assessment District for FY 2017/2018. Staff is
proposing the current annual rate of $487.80 per assessed parcel.

Background: The Commission on December 12, 2016 authorized staff to seek a low
interest loan for the Alexander Avenue Reclaimed Water Augmentation
Project. See attached Resolution No. 2016-68. The Florida
Department of Environmental Protection, for administrative purposes
only, requires a specific resolution authorizing the City Manager to

Strategic Goal: Economic Development
Background: On February 27, 2017, as part of the ongoing economic development
plan and City of Deltona strategic goals, the Office of Economic
Development presented an incentive based presentation to the City of
Deltona Commission. Wherein, the City Commission indicated a
positive response to a “City of Deltona Incentives Package”. Staff is
herein presenting a draft of the “City of Deltona Incentives Package” to
the City Commission for approval. This “City of Deltona Incentives
Package” will be paid based upon proof of performance and all grants
and incentives are at the discretion of the Deltona City Commission
and are approved on a case-by-case basis.

11. NEW BUSINESS:
A. Consideration of two alternate appointments to the Economic Development
Advisory Board. - Joyce Raftery, City Clerk (386) 878-8502,

Background: At the Regular Commission Meeting held on Monday, May 15, 2017 the
City Commission appointed/re-appointed seven (7) members and two
(2) alternate members to the Deltona Economic Development Advisory
Board (DEDAB) for a term to expire May 31, 2019.
The Board/Committee By-Laws were revised at the Regular
Commission Meeting held on May 4, 2015 to include four (4) alternate
members and the City has received two (2) additional applications for
the alternate members from Edward Elliott and Robert “Bob” Koslow.
The City has run press releases, posted the opening on D-TV, the
City's web page and on bulletin boards.

B. Consideration of appointment of one (1) member to the Affordable Housing
Advisory Committee for the remainder of a term to expire October 5, 2017 -
Joyce Raftery, City Clerk (386) 878-8502.
Strategic Goal: Internal and external communication.
Background: Member Ruben Colon has resigned from the Affordable Housing
Advisory Committee leaving an opening for “One citizen who
represents essential services personnel, as defined in the local housing
assistance plan.”
The City has run press releases, posted the openings on D-TV, the
City’s web page and bulletin boards. To date the City has received
applications from the following individuals: Felicia Diaz, Shirley
Battle-White, Peal Janice Rivera and Walesca Vazquez.
The SHIP Act and Rule requirement has been reinstated per SHIP
statute (F.S. 420.9076 and Rule 67-37.010) that in order to continue to
qualify for funding, the local government must appoint an Affordable
Housing Advisory Committee.
If, due to reasonable factors, a citizen actively engaged in these
activities in connection with affordable housing is not available for
appointment to the Committee, a citizen engaged in the activity without
regard to affordable housing may be appointed.
The AHAC Committee shall evaluate and report to the City
Commission on established policies, procedures, ordinances, land
development regulations, and review the comprehensive plan; to
include, recommended changes as established in Section 420.9076,
F.A.C.
The City shall transmit an electronic copy of the report, which was
presented to the City Commission for consideration, to Florida Housing
Finance Corporation.

C. Discussion of current and future trash collection rules. - Jane Shang, City

Background: The Commission directed staff to place an agenda item to discuss a
City-wide once a month bulk waste pickup (additional
$10.20/year/resident), the future of the Waste Pro contract and
obtaining advisory services from Redman Consulting Group, Inc.
