1. CALL TO ORDER:
Mayor Masiarczyk called the meeting to order at 5:30 p.m.

3. INVOCATION AND PLEDGE TO THE FLAG:
Mayor Masiarczyk led the Pledge to the Flag.
City Manager Shang stated Commissioner Herzberg called to say she will be late and that
she had also received an email from Commissioner Alcantara at 5:09 p.m. today that he
will not be able to make tonight's meeting. She stated Commissioner Alcantara also asked
in that email that a statement be read into the record regarding Halifax.
There were no other comments.
A. Silent Invocation Presented by Commissioner Honaker
Mayor Masiarczyk stated Commissioner Honaker will present a silent invocation and ask
for a moment of silence for Las Vegas.
4. APPROVAL OF MINUTES & AGENDA:
Mayor Masiarczyk stated next is the approval of the minutes from the Special Meeting and

the Regular Commission Meeting.
Commissioner Honaker stated he will have a correction to the Regular Commission
Meeting minutes.

A. Approval of minutes for the Special Commission Meeting and Regular
Commission Meeting of September 18, 2017, as presented. - Joyce Raftery,

5. PRESENTATIONS/AWARDS/REPORTS:
Mayor Masiarczyk stated under presentations is the Deltona "Making it Happen" video and
Employee Recognitions. He asked if anyone had the list of the employees being
recognized and City Manager Shang responded "yes" that Mr. Adams has the list. Mr.
Adams stated the Commission will have a list on the dais and that he will not be reading off
the names on the list but he will read a prepared statement about the employee recognition
program.
Mayor Masiarczyk stated next will be the Fire Prevention Week Proclamation and he
suggested if the Commissioners do not have a problem the proclamation is long and he
asked if Chief Snyder could shorten it in the future and asked if Chief Snyder could read it
tonight.
Mayor Masiarczyk stated next is the Proclamation for Hispanic Heritage Month and that
there will probably be a number of people at the meeting for this proclamation.
Mayor Masiarczyk stated next will be a recognition of Patricia Corr from Galaxy Middle
School for earning the 2017 Secondary Principal of the Year Award followed by the
presentation of the Super Star Student Certificates for the Month of September.

6. CITY COMMISSION SPECIAL REPORTS AND REQUESTS:
Mayor Masiarczyk asked if anyone would have any Special Reports or Requests.
Vice Mayor Nabicht stated he would have a Transportation Planning Organization (TPO)
update and Commissioner Bradford responded she had a couple of items including an
update on the unlicensed contractor sting.
Commissioner Honaker asked if City Manager Shang wanted to bring up the facilitator and
Mayor Masiarczyk suggested the City Manager bring it up at the end of the Regular
Commission Meeting.
There were no other questions or comments.
7. PUBLIC FORUM: - Citizen comments are limited to issues and concerns not on
the agenda and comments on items listed on the agenda will take place after
discussion of each item.
CONSENT AGENDA: The consent agenda contains items that have been determined
to be routine and non-controversial. If anyone in the audience wishes to address a
particular item on the consent agenda, now is the opportunity for you to do so.
Additionally, if staff or members of the City Commission wish to speak on a consent
item, they have the same opportunity.
8. CONSENT AGENDA:
A. Request for consideration and Approval of an Interlocal Agreement
between Halifax Hospital Medical Center and the City of Deltona. Jane K.

Strategic Goal: Economic Development and Public Safety
Mayor Masiarczyk stated this item is a little confusing to him and this is the item that
Commissioner Alcantara asked for his statement to be read into the record.
There were no questions or other comments.
9. ORDINANCES AND PUBLIC HEARINGS:
A. Request for approval of Resolution No. 2017-31, declaring certain property
of the City as surplus and authorizing the donation or disposal of such
property - Fire Chief Snyder, Fire Department (386) 575-6902.

Strategic Goal: Fiscal Issues
Mayor Masiarczyk stated the next item is Resolution No. 2017-31 declaring certain property
as surplus and authorizing the donation or disposal of such property to a volunteer fire
department.
There were no questions or comments on this item.
B. Public Hearing - Resolution No. 2017-37, Local Agency Program
Supplemental Agreement for a Southbound Right Turn Lane on Catalina
Blvd. - Ron A. Paradise, Assistant Director, Planning and Development
Services, (386) 878-8610.
Mayor Masiarczyk stated the next item is Resolution No. 2017-37 for the Local Agency
Program Supplemental Agreement for a southbound right turn lane on Catalina Blvd. It was
noted that Mr. Paradise saved the City money.
There were no other comments on this item.
10. OLD BUSINESS:
A. Request for consideration of appointments of five (5) members to the
Affordable Housing Advisory Committee - Joyce Raftery, City Clerk (386)
878-8502.
Strategic Goal: Internal and external communication.
Mayor Masiarczyk stated the next item is the consideration of five (5) members to the
Affordable Housing Advisory Committee (AHAC) which is confusing as one (1) member
was left off and that was Michael Putkowski who had already been appointed. He stated
according to the rules there only has to be six (6) of the 11 members appointed. He stated
there are more than six (6) appointed according to rules so the Commission can appoint
anyone they want.
City Manager Shang explained the Commission does have to appoint people that are
qualified in certain fields referring to the agenda memo.
Mayor Masiarczyk asked if anyone had any problem with any of the applicants and the
Commissioners agreed there was not a problem with the applicants but it was just
confusing. Vice Mayor Nabicht responded that no one called attention to the little letters.
City Manager Shang stated the Commission can skip H because Michael Putkowski is in
that position.

After discussion the Commission decided to do one (1) motion for the re-appointments and
individual motions for the appointments to C and J and leave D vacant for tonight.

The Interim City Attorney did not have any comments.

City Manager Shang stated she would have four (4) items to comment on.
14. CITY COMMISSION COMMENTS:
Mayor Masiarczyk commented that the Pickle Ball issue was taken care of and just so the
Commissioners know Mayor Buddy Snowden of Lake Helen is retiring as he is term limited
out. He stated he wanted to do something for Mayor Snowden because he has been active
in the community. He stated Lake Helen is having a going away party for Mayor Snowden
and he will get more information.
There were no other comments.

B. Employee Recognition
Background: As part of the employee recognition program, employees are awarded
for going above and beyond. We will be recognizing those who have
received “Shout Out” awards for the last quarter of 2017 and reading
some examples of the types of actions which warranted the awards.
C. Proclamation - Fire Prevention Week October 8-14, 2017
Background: The 2017 Fire Prevention Week theme, “Every Second Counts: Plan 2
Ways Out!” reinforces why everyone needs to have an escape plan.
In a fire, seconds count. Seconds can mean the difference between
residents of our community escaping safely from a fire or having their
lives end in tragedy. This year’s key campaign messages:
· Draw a map of your home using a grid from NFPA.org with all
members of your household, marking two exits from each room and a
path to the outside from each exit.
· Practice your home fire drill twice a year. Conduct one at night and
one during the day with everyone in your home, and practice using
different ways out.
· Teach children how to escape on their own in case you can’t help
them.
· Make sure the number of your home is clearly marked and easy for
the fire department to find.
· Close doors behind you as you leave - this may slow the spread of
smoke, heat, and fire.
· Once you get outside, stay outside. Never go back inside a burning
building.

D. Proclamation - Hispanic Heritage Month September 15-October 15, 2017
Background: Each year, Americans observe National Hispanic Heritage Month from
September 15 to October 15, by celebrating the histories, cultures and
contributions of American citizens whose ancestors came from Spain,
Mexico, the Caribbean and Central and South America.
The observation started in 1968 as Hispanic Heritage Week under
President Lyndon Johnson and was expanded by President Ronald
Reagan in 1988 to cover a 30-day period starting on September 15
and ending on October 15. It was enacted into law on August 17, 1988,
on the approval of Public Law 100-402.
The 2017 theme for this annual tribute is “Shaping the Bright Future of
America.”

Background: The School District of Volusia County and FUTURES Foundation
announced the Principals of the year on May 30, 2017. Ms. Patricia
Corr, Principal of Galaxy Middle School in Deltona, was chosen as the
2017 Secondary Principal of the Year. The announcement was made
during a surprise visit by school board members, the superintendent of
schools, district administrators and FUTURES Foundation
representatives.
The Principal of the Year award is co-sponsored by Volusia County
Schools and FUTURES Foundation. The purpose of the award is to
honor outstanding leadership and service by school-level
administrators.

Strategic Goal: Economic Development and Public Safety
Background: Halifax staff will present a power point presentation is support of an
Interlocal Agreement between Halifax Health Medical Center and the
City of Deltona. This Interlocal Agreement will recognize the new
construction planned for a full service hospital in the City of Deltona.

the City as surplus and authorizing the donation or disposal of such property -

Strategic Goal: Fiscal Issues
Background: Over time certain items of the City become obsolete or lose their
usefulness via replacement, upgrade, or they are no longer functional
and need to be declared surplus and disposed of by the most
appropriate means available. We are donating 40 air packs,
approximately 28 work and the others would be use for parts.
We will be donating 39 to Pittman Volunteer Fire Department, small
volunteer department with an annual budget of approx. $5,000.00 and
one non-functioning air pack to Deltona Rehab for when they are
working with injured firefighters.
The Deltona Fire Department has out of service air packs that have
been replaced due to the age of the packs, increasing maintenance
issues, and they cannot be updated to the current National Fire
Protection Agency (NFPA) 1981 standard on Self Contained Breathing
Apparatus. The air packs cannot be upgraded to the current NFPA
standards. The attached Resolution declares the air packs items as
surplus.

Agreement for a Southbound Right Turn Lane on Catalina Blvd. - Ron A.
Paradise, Assistant Director, Planning and Development Services, (386)

Background: On April 3, 2017 the City Commission approved a Local Agency
Program (LAP) agreement with the Florida Department of
Transportation (FDOT) as part of Resolution No. 2017-06. The LAP
agreement was to facilitate the construction of a right turn lane off of the
southbound travel lane of Catalina Blvd. on to Howland Blvd. At the time
of the approval of Resolution No. 2017-06, the cost of the project was
estimated to be $393,051. The City had pledged to pay $156,741 of
the $393,051 cost.
Since the initial LAP agreement was approved, the costs of the project
have changed necessitating the attached supplemental LAP
agreement with FDOT. The total project costs have been reduced to
$346,269 with the City now pledged to pay $136,530 of the project
costs. The cost reduction is predicated on actual contractor bids to
construct the project.

10. OLD BUSINESS:
A. Request for consideration of appointments of five (5) members to the Affordable

Strategic Goal: Internal and external communication.
Background: The terms of five (5) members of the Affordable Housing Advisory
Committee (AHAC) expired on October 5, 2017. At the Regular
Commission Meeting held on September 18th the Commission
re-appointed six of the current members of AHAC and since then staff
has received confirmation that Eric Strano (a) and Patricia
Ulicny-Hoback (i) both wish to be re-appointed also. Although staff has
not heard from member Michael Ruggieri (d) he has missed numerous
meetings and staff is recommending not to re-appoint him to the
Committee.
The City has run press releases, posted the openings on D-TV, the
City’s web page and bulletin boards. To date the City has received
applications from the following individuals: Maribel Mejias Montanez
(c), Dorinda Ortiz (h), Pearl Janice Rivera (b) and Shirley Battle-White
(j).

The SHIP Act and Rule requirement has been reinstated per SHIP
statute (F.S. 420.9076 and Rule 67-37.010) that in order to continue to
qualify for funding, the local government must appoint an Affordable
Housing Advisory Committee. F.S. 420.9076 (2) “The governing board
of a county or municipality shall appoint the members of the affordable
housing advisory committee. Pursuant to the terms of any interlocal
agreement, a county and municipality may create and jointly appoint an
advisory committee. The local action adopted pursuant to F.S.
420.9072 which creates the advisory committee and appoints the
advisory committee members must name at least 8 but not more than
11 committee members and specify their terms.”
The committee must consist of one representative from at least six of
the categories below. The proposed Housing & Community
Development staff recommendations and the eleven (11) Committee
members shall include:
(a) One citizen who is actively engaged in the residential home building
industry in connection with affordable housing.

(b) One citizen who is actively engaged in the banking or mortgage
banking industry in connection with affordable housing

(c) One citizen who is a representative of those areas of labor actively

persons in connection with affordable housing.

If, due to reasonable factors, a citizen actively engaged in these
activities in connection with affordable housing is no available for
appointment to the Committee, a citizen engaged in the activity without
regard to affordable housing may be appointed.
The AHAC Committee shall evaluate and report to the City
Commission on established policies, procedures, ordinances, land
development regulations, and review the comprehensive plan; to
include, recommended changes as established in Section 420.9076,
F.A.C.
The City shall transmit an electronic copy of the report, which was
presented to the City Commission for consideration, to Florida Housing
Finance Corporation.
