1. CALL TO ORDER:
Mayor Masiarczyk called the meeting to order at 5:30 p.m.

Mayor Masiarczyk asked if Commissioner Bradford was prepared for the invocation and
Commissioner Bradford responded "yes".
Mayor Masiarczyk led the Pledge to the Flag.

4. APPROVAL OF MINUTES & AGENDA:
There were no questions or comments on this item.
A. Approval of minutes - Regular Commission Meeting of October 2, 2017, as

5. PRESENTATIONS/AWARDS/REPORTS:
Mayor Masiarczyk stated next under Presentation/Awards/Reports are the Quarterly
Reports and the reports are all written reports.

6. CITY COMMISSION SPECIAL REPORTS AND REQUESTS:
Mayor Masiarczyk stated the next item is City Commission Special Reports and Requests
and he asked if anyone had any reports or requests.
Commissioner Alcantara responded he would have a report.
Vice Mayor Nabicht responded he would have a Transportation Planning Organization
(TPO) report.
There were no other comments or requests.
7. PUBLIC FORUM: - Citizen comments are limited to issues and concerns not on
the agenda and comments on items listed on the agenda will take place after
discussion of each item.
CONSENT AGENDA: The consent agenda contains items that have been determined
to be routine and non-controversial. If anyone in the audience wishes to address a
particular item on the consent agenda, now is the opportunity for you to do so.
Additionally, if staff or members of the City Commission wish to speak on a consent
item, they have the same opportunity.
8. CONSENT AGENDA:
A. Request for approval of the 2018 holiday meeting schedule - Joyce
Raftery, City Clerk’s Department (386) 878-8502.
Mayor Masiarczyk stated it is understood that Consent Agenda items go straight through
unless an item is pulled. The first item is the meeting and holiday schedule and he does not
see a problem with that.
Commissioner Honaker commented that there is no Workshop in December and Mayor
Masiarczyk responded "no", there is only the one (1) meeting in December.
There were no other quests or comments.
B. Communal Housing Temporary Moratorium - Chris Bowley, AICP, Planning
& Development Services Director, (386) 878-8602.

Strategic Goal: Economic Development - work with existing business to
expand/grow.
Mayor Masiarczyk stated the other item under the Consent Agenda is the Communal
Housing Moratorium and it is his understanding that it could not be completed before the
end date as additional information was needed. He stated there is one person who is trying
to do this but she does not have her license yet and that is what the City is trying to look into.
Commissioner Bradford asked if the person had any licenses and do we know what
experience the person has. Mr. Bowley responded he did not know.
Mayor Masiarczyk stated the person has a house and if the person has a license it is up to
the person to contact Mr. Bowley.
City Attorney Segal-George stated the moratorium allows for Mr. Bowley to look at the
specifics and determine if this situation is not what the moratorium is trying to deal with. She
stated under that Mr. Bowley does have some discretion and staff is asking for additional
time. Mr. Bowley clarified that this is for the original 120 days from August 21, 2017 if the
Commission decides to move forward and this is so the City can go through the due
process. He added it will be going to the Planning & Zoning (P&Z) Board this Wednesday,
October 18th so it is on schedule. City Attorney Segal-George stated she will be attending
the P&Z Meeting because the City will need to discuss the enforcement question as that will
be key to this.
Commissioner Alcantara stated he had a couple of questions that a couple of people had
asked him downstairs: 1) does the City need to rezone the Center and the answer was
"no". And 2) he had asked about the Swaption issue when he was in Jacksonville and does
the City still do business with that financial advisor and the answer was "no". Mayor
Masiarczyk responded the City will never do another Swaption as long as he is Mayor.

A. Request for approval to renew the health insurance with Cigna - Richard
Adams, Human Resources (386) 878-8752.
Strategic Goal: Fiscal Issues
Mayor Masiarczyk stated this item is an add-on regarding the Health Care and the City
Manager will go through this down stairs. He stated hopefully Mr. Clinger will have some

additional information on what the dollar amount will be as the Commission will have to
make a decision.
City Manager Shang stated the amount is $262,000 and Mr. Adams is available.
There were no other comments.
12. CITY ATTORNEY COMMENTS:
There were no City Attorney comments.
13. CITY MANAGER COMMENTS:
There were no City Manager comments.
14. CITY COMMISSION COMMENTS:
Commissioner Ramos asked when the negotiations with the City Attorney would take place
and Mayor Masiarczyk responded that Mr. Fowler was on vacation. City Attorney
Segal-George stated she would be doing the negotiations. Mayor Masiarczyk stated he, the
City Manager, Mrs. Segal-George and Mr. Fowler will conduct the negotiations, a contract
will be prepared and we will come back to the Commission for approval. He stated the
proposed contract will be sent to the Commission in plenty of time to be reviewed before
the Commission Meeting.
Commissioner Bradford asked if the City will be able to ask who the lead attorney will be .
Mayor Masiarczyk responded the City is hiring the firm but he understood that Mrs .
Segal-George would be the lead attorney. Commissioner Ramos commented he believed
that Mr. Fowler would be the lead but 90% of the time the Commission would see Mrs.
Segal-George. Mrs. Segal-George stated she believed Mr. Fowler had said she would be
doing the majority of the work but Mr. Fowler is the City Attorney and he will be the one (1)
who will come to the Regular Meetings and she will be coming to the Workshop Meetings .
City Manager Shang stated the Commission can request that Mrs. Segal-George attend
the meetings and Mrs. Segal-George responded she had no objections. Mayor Masiarczyk
suggested that can be brought up during the negotiations.
There were no City Commission comments.
15. ADJOURNMENT:
Mayor Masiarczyk adlourned the meeting at 5:42 p.m.

Background: In the past, the Commission has chosen to change the Commission
meeting schedule in December due to the holiday season, i.e.
combining the two (2) regular meetings in December to one (1)
meeting in the middle of the month of December and to have no
workshops during the month of December.
Attached for the Commission's approval is the proposed schedule for
the calendar year 2018 City Commission meetings which includes one
(1) regular City Commission meeting and no workshops for the month
of December, 2018 and for the Commission's information the
invocation schedule for 2018 is also included.

Strategic Goal: Economic Development - work with existing business to
expand/grow.
Background: At the August 21, 2017, City Commission public hearing, City staff
brought forward Resolution No. 2017-29 (attached) with a request for a
120-day moratorium to study, write an ordinance, include comments
from applicable departments, and the ability to process the ordinance
through public hearings with required due public notice. The public
hearing process for City ordinances includes at least one (1) Planning
& Zoning Board hearing and two (2) City Commission hearings with
required advertising and public notices. On August 21, 2017, the City
Commission voted to reduce the 120-days temporary moratorium
period to 60-days, which results in the moratorium expiring prior to the
ability to adopt the ordinance. The 60-day moratorium will expire on
October 21, 2017. The Planning & Zoning Board date for the ordinance
is October 18, 2017, with first and second reading of the ordinance
within the City Commission public hearings in November 2017.
Therefore, the moratorium date should be the originally recommended
120-days to accommodate the due public notice process.

A. Request for approval to renew the health insurance with Cigna - Richard
Adams, Human Resources (386) 878-8752.
Strategic Goal: Fiscal Issues
Background: The Health Insurance renewal rates have come in from Cigna. Earlier
Cigna requested a 36% increase, however, after negotiating, we have
a verbal for 19.5% - pending final approval from Cigna, and the
Commission, and City Manager. We have looked at other companies,
and Cigna’s rates are the most competitive without changing levels of
coverage.
