CALL TO ORDER: The meeting was called to order at 5:30 p.m. by Mayor Herzberg. 2. ROLL CALL – CITY CLERK: Present: 8 - Commissioner Avila-Vazquez Commissioner Bradford Commissioner King Commissioner McFall Commissioner Nabicht Vice Mayor Ramos Mayor Herzberg City Attorney 3. INVOCATION AND PLEDGE TO THE FLAG: A. Invocation Presented by Commissioner McFall. Mayor Herzberg led everyone in the pledge to the flag. Commissioner McFall stated he will do a silent prayer followed by the pledge and a song. 4. APPROVAL OF MINUTES & AGENDA: A. Approval of minutes -Regular Commission Meeting of February 18, 2019, as presented. - Joyce Raftery, City Clerk (386) 878-8502. There were no comments on this item. 5. PRESENTATIONS/AWARDS/REPORTS: A. Super Star Student of the Month Certificates for February 2019 Mayor Herzberg stated that she invited the Girl Scouts to tonight's meeting to give them a shout out for a generous donation given to the Methodist Children's home. CITY COMMISSION SPECIAL REPORTS AND REQUESTS: Mayor Herzberg spoke about a new ADA (Americans with Disabilities Act) widget on Deltona's website and she stated a video demonstrating it will be presented before the presentation to the Girl Scouts. She also stated that she would like Healthy Start to give an update/presentation in April, that Advent Health Rob Deininger would like to give an update sometime in the future and that at tonight's meeting Assistant City Manager Dr. Cooper will provide an update on Mr. Siews' code case. Vice Mayor Ramos will give a report on the Community Liffe Center (CLC) Second Harvest event from Thursday. Commissioner Avila-Vazquez stated that she spoke to the City Manager regarding a flooding issue at Normandy and Providence Blvds. The county was contacted and she stated they do not have a project right now for this. She would like to see what would be Deltona's next step. Commissioner Nabicht explained that the problem is caused by an inadequate stormwater retention area installed by the county. However, there may be an opportunity to address this with the design of Phase 2 of the Providence Blvd. trail. He suggested getting with the water department, stormwater and the county and possibly creating a single pond with a pump and running it back into the reclaim plant. He also suggested introducing the idea tonight and have staff start thinking along those lines then have conversations during budget. Commissioner Bradford stated she has something, but wants to talk about it downstairs. 7. PUBLIC FORUM: Citizen comments are limited to issues and concerns not on the agenda and comments on items listed on the agenda will take place after discussion of each item. Please be courteous and respectful of the views of others. Personal attacks on Commission members, City staff or members of the public are not allowed, and will be ruled out of order by the Mayor. CONSENT AGENDA: The consent agenda contains items that have been determined to be routine and non-controversial. If anyone in the audience wishes to address a particular item on the consent agenda, now is the opportunity for you to do so. Additionally, if staff or members of the City Commission wish to speak on a consent item, they have the same opportunity. 8. CONSENT AGENDA: 9. ORDINANCES AND PUBLIC HEARINGS: A. Public Hearing - Ordinance No. 01-2019, protocol for returning security deposits at second and final reading. Marsha Segal-George, Assistant City Attorney, (386) 878-8872. City of Deltona Page 2 Printed on 6/3/2020 City Commission Minutes March 4, 2019 Strategic Goal: Fiscal Issues City Attorney Segal-George stated that this seems to be what everyone wants. B. Public Hearing - To provide Exclusive Solid Waste Service by the City of Deltona - Residential & Commercial. - Marsha Segal-George, Assistant City Attorney, (386) 878-8872. Strategic Goal: Fiscal Issues City Attorney Segal-George stated that this is what was agreed to in the Waste Pro contract and that she included a copy of the draft ordinance. Tonight's voting will be on whether to proceed with the exclusivity. At that point she would place the ordinance on the agenda on the 18th, with a franchise revised ordinance and an addendum to the Waste Pro contract to include commercial, if that is what the Commission decides to do. A notice went to everyone on the list, they received letters and also there was a Public notice. If the Commission decides to approve it on the 18th and the second reading in April, another notice is sent out advising commercial businesses that the Commission has approved the ordinance and that they have to reveal their contract. The City starts clocking everything because in 3 years or less (as soon as their agreement expires) Waste Pro gets it. 10. OLD BUSINESS: 11. NEW BUSINESS: 12. CITY ATTORNEY COMMENTS: 13. CITY COMMISSION COMMENTS: Mayor Herzberg stated that she will address Public Comments because of a comment made at the last workshop that there was not enough time for Public Comments. She will also give a history of what the Commission has done and are going to do on that portion of Public comments. Commissioner King stated that he noticed Arbor Day on the calendar and because we are a Monarch City, could a portion of the plants distributed, be plants that would be habitats for Monarch Butterflies. 15.
