CALL TO ORDER: The meeting was called to order at 6:30 p.m. 2. INVOCATION AND PLEDGE TO THE FLAG: A. Invocation Presented by Commissioner Avila-Vazquez. Commissioner Avila-Vazquez led everyone in a silent invocation and the pledge to the flag. The National Anthem was sung by JD Marie a sophomore at Pine Ridge High School. 4. APPROVAL OF MINUTES & AGENDA: A. Approval of minutes of the Regular Commission Meeting of June 7, 2021 and June 21, 2021, as presented. - Joyce Raftery, City Clerk (386) 878-8502. Motion by Commissioner Ramos, seconded by Vice Mayor Bradford, to approve the minutes of the Regular Commission Meeting of June 7, 2021 and June 21, 2021, as presented. PRESENTATIONS/AWARDS/REPORTS: C. Purple Heart Parking Signs Mayor Herzberg asked that Item 5-C be moved up to 5-A and there was no objection from the Commission. Daytona Beach Commissioner and member of the Military Order of the Purple Heart Chapter 316, Stacy Cantu reached out to Deltona to designate a parking space for Purple Heart recipients. Senator Wright will be providing the parking signs and the Deltona sites are: Veterans Memorial Park, The Center at Deltona and City Hall. A. Update on the Deltona Community Gardens presented by Terri Ellis. - John A. Peters, III, P.E., Acting City Manager (386) 878-8858. Strategic Goal: Internal & External Communication Troy Shimkus provided an update on the Deltona Community Gardens to include Growing Deltona’s Future, Grow, Play, Growing Creativity, Connect, How To, Needs, Funds/Donations, Supporters/Volunteers, Future Projects, Opening Day and contact information. Commissioner Avila-Vazquez stated the organization is doing a beautiful job, she is glad they are working on the butterfly garden, and she would like Mr. Shimkus to reach out to Deltona Middle School who helped start the butterfly garden. B. Presentation - Quarterly Reports of City Advisory Boards/Committees - Joyce Raftery, City Clerk (386) 878-8502. Mayor Herzberg stated the Quarterly Board Reports are in written format and will be accepted as presented. D. Proclamation - Hispanic Heritage Month- September 15 - October 15, 2021 The Mayor and Commission presented a Proclamation for Hispanic Heritage Month from September 15 to October 15, by celebrating the histories, cultures and contributions of American citizens whose ancestors came from many different countries including Central and South America. E. Proclamation - Fire Prevention Week - October 3-9, 2021. The Mayor and Commission presented a Proclamation for “Fire Prevention Week” which is City of Deltona Page 2 Printed on 10/20/2021 City Commission Minutes October 4, 2021 the week of October 3-9, 2021 throughout the City and the City is committed to ensuring the safety and security of all those living and visiting Deltona. F. Proclamation - Breast Cancer Awareness Month The Mayor and Commission presented a Proclamation for Breast Cancer Awareness Month. Breast cancer is one of the most frequently diagnosed cancers and the leading cause of cancer deaths among women worldwide. The City recognizes the importance of this ongoing fight and proclaims October, 2021 as Breast Cancer Month. G. Proclamation - Cybersecurity Awareness Month The Mayor and Commission presented a Proclamation for Cybersecurity Awareness Month 2021 and the theme is “Do Your Part. #Be CyberSmart.”™. Maintaining the security of cyberspace is a shared responsibility in which each of us has a critical role to play, and awareness of computer security essentials will improve the security of the City’s information, infrastructure and economy. Vice Mayor Bradford left the meeting at 7:09 p.m. and returned at 7:10 p.m. H. Presentation - City of Deltona Fire Department’s overview of the proposed Deltona Fire Training Ground and Emergency Operations Center. Presented by Fire Chief Bill Snyder and Deputy Chief Bush Swisher. Fire Chief Snyder and Deputy Fire Chief Swisher gave a presentation on the proposed Deltona Fire Training Ground and Emergency Operations Center to include Why Our Own Training Ground is Needed?, Steps of the project, Multi-Use Areas Within The Complex, Emergency Operations Center Meeting Room/Large Indoor Training, Structure Fire Training, Multi-Story Training, Outdoor Burn Props, Motor Vehicle Extrication, CDL/FD Vehicle Course, Emergency Management Area, Underground and Above Ground Confined Space Training, Trench Rescue Training, Cell Phone and Tower Training, High-Line Rope Training, Community Physical Fitness Course, Community Rope Confidence Course, Potential Law Enforcement Training, Helping Other Departments, and Summary. Commissioner Sosa left the meeting at 7:20 p.m. and returned at 7:22 p.m. Commissioner Ramos left the meeting at 7:28 p.m. and returned at 7:29 p.m. The Commission and staff discussed the training center in Daytona, the proposed site, the size of the site, in planning stages, the Day Road facility, total current training budget, types of training, recertification, other cities' training costs, instructors, in-house trainings/instructors, revenue stream, interest from other cities, and being a multi-hazard department. Commissioner McCool left the meeting at 7:30 p.m. and returned at 7:32 p.m. 6. ORDINANCES AND PUBLIC HEARINGS: City of Deltona Page 3 Printed on 10/20/2021 City Commission Minutes October 4, 2021 None. 7. OLD BUSINESS: None. 8. NEW BUSINESS: A. Public Hearing - Resolution No. 2021-50, Declaring certain City property as surplus and authorizing sale of such property - Ron A. Paradise, Director, Planning and Development Services (386) 878-8610. Strategic Goal: Economic Development - Focus on Howland Blvd. as a gateway for commercial growth. Planning & Development Services Director Ron Paradise gave a brief explanation of the item. The Commission and staff discussed staff's recommendation, why selling the property, the tree fund, keeping the property, adjacent owners, cost of appraisals, no formal offers, potential buyers, not doing another appraisal, maintenance of the property, the difference between appraisals, reconciliation of the appraisals, land acquisition policy, no property tax revenue currently, City's liability, the size of the parcel, needing a review appraisal, the market value, and staff being conservative. Motion by Vice Mayor Bradford, seconded by Mayor Herzberg, to approve Resolution No. 2021-50 declaring an approximately 4,000 square foot property described as follows: That portion of Lots 1 through 4 inclusive, Block 6, Davis Park, 3rd Addition, as recorded in Map Book 6, Page 205 of the Public Records of Volusia County Florida, lying northeasterly of a line that is 100.00 feet northeasterly of and parallel with the Centerline of Construction as shown on the map of State Road 472 Extension, as recorded in Right of Way Map Book 2, Page 8 of said Public Records as surplus property and direct the City Manager to initiate a 'review of appraisal' from a qualified appraiser to help establish a value. The City will be under no obligation to sell the property. The Acting City Manager has the authority to make corrections of scrivener's errors and the like. Mayor Herzberg opened the public comments. Elbert Bryan, Deltona, spoke about 4,000 square feet, shape of lot, selling off the property, having no offers, wasting money, species of trees, community gardens, monument sign, and growing something there. The Commission and staff discussed interest in the property, the abutting landowner, selling to private entity, in-fill lots, commercial vs. residential build, stand alone entity, utilities, modern development, appraisal comparables, splitting the appraisal fee with interested party, dates of appraisals, keeping the property, devaluing the property, and the Commission can decline the sale. The motion carried by the following vote: For: 4 - Commissioner Avila-Vazquez, Commissioner Ramos, Vice Mayor Bradford, and Mayor Herzberg Against: 3 - Commissioner King, Commissioner McCool, and Commissioner Sosa Resolution No. 2021-50 was approved at 8:16 p.m. After discussion, the majority of the Commission concurred to have the party interested in the parcel split the cost with the City for the new appraisal review. 9. PUBLIC FORUM: Citizen comments are limited to issues and concerns not on the agenda and comments on items listed on the agenda will take place after discussion of each item. Please be courteous and respectful of the views of others. Members of the City Commission shall not enter into discussion or respond to individuals' comments during the public forum other than to give directions or to ask for clarification. However, individual Commissioners may wish to respond under their "City Commission Comments". Personal attacks on Commission members, City staff or members of the public are not allowed, and will be ruled out of order by the Mayor. Mike Williams, 2889 Cottageville Street, Deltona, spoke about the cost of a 1/4 acre lot, use of property, his application to the AHAC (Affordable Housing Advisory Committee), his experience, what he brings to the table, NSP (Neighborhood Stabilization Program), and wanting to hear from the Commission. Richard Bellach, Deltona, spoke about the new Deputy City Manager, asbestos and testing, and the Special Magistrate. 10. Elbert Bryan, Deltona, spoke about pulling Item 11-A and 11-E, hourly rate difference, agenda memo vs. attachments, hours per month, proposals, discussion on personal City of Deltona Page 5 Printed on 10/20/2021 City Commission Minutes October 4, 2021 contracts, and The Center derailed from COVID. Deputy City Manager stated there are a few items on the Consent Agenda that she did want to bring to the Commission's attention. It was brought to her attention during the meeting that on the agenda memo there was a misprint. It is supposed to be $97.50 per hour, the contract is correct for Mr. O'Grady. The other item is Mr. Hearn's contract, just a couple of things there which are pretty minor, we just need to update the contract it include the language for the insurance and the contract has a previous City Manager's name listed. Those two improvements need to be made and other than that there is no issue with his contract. 11. CONSENT AGENDA: The Consent Agenda contains items that have been determined to be routine and non-controversial. If discussion is desired by any member of the City Commission, that item must be removed from the Consent Agenda and considered separately. All other matters included under the Consent Agenda will be approved by one motion. Citizens with concerns should address those concerns by filling out a public participation slip and giving it to the Deputy City Clerk prior to Consent Agenda items being pulled. Commissioner Sosa requested to pull Items 11-A, 11-C and 11-E.Commissioner Ramos was called to speak Motion by Commissioner Ramos, seconded by Commissioner Sosa, to approve Consent Agenda Items 11-B and 11-D. The motion carried by the following vote: For: 7 - Commissioner Avila-Vazquez, Commissioner King, Commissioner McCool, Commissioner Ramos, Commissioner Sosa, Vice Mayor Bradford, and Mayor Herzberg A. Approval of a one year Renewal of Agreement for Events Manager, Joe Hearn Events. John Peters, Acting City Manager, (386) 878-8850. Strategic Goal: Fiscal The Commission and Deputy City Manager discussed what was paid to Mr. Hearn, Mr. Hearn's commission on events he solicited, Mr. Hearn's commission on events he did not solicit, $4,000 management fee, how much revenue Mr. Hearn brought in, and that Mr. Hearn is doing a great job. Motion by Commissioner Avila-Vazquez, seconded by Commissioner McCool, to approve the Renewal of the Agreement for Events Manager, Joe Hearn Events. Strategic Goal: Public Safety Approved by Consent - to approve West Volusia Humane Society DBA New Hope Animal Shelter Agreement for animal services. Request for Approval of Halifax Humane Society Redinger Clinic Memorandum of Understanding for animal services. - Ron Paradise, Community Development Director (386) 878-8600. Strategic Goal: Public Safety The Commission and staff discussed TNR (Trap Nueter Release) and is it separate, animal control services, what Halifax offers, the Redinger contract and last year's expenses, if the $35,000 coming from the $50,000, who collects of TNR, veterinary costs, purchase order process, and other services. Motion by Vice Mayor Bradford, seconded by Commissioner McCool, to approve Halifax Humane Society Redinger Clinic Memorandum of Understanding for animal services. Request for approval of contract with John O’Grady of Maitland, Florida, Part-Time Employment, Assist with Code Enforcement Training, Accreditation, Contract Negotiations and other assignments as requested. - Acting City Manager John A. Peters, III, PE, City Manager’s Department, 386-878-8850. Strategic Goal: Public Safety The Commission, Mr. O'Grady and Deputy City Manager discussed list of accomplishments, perception of Code Enforcement, Town Hall questions, rebranding, residents vision, implemented processes, uniform and appearance, best practices nationwide, training, defending themselves, Parks & Recreation staff training, TNR (Trap Neuter Release), Special Magistrate, stray dog policy, volunteers, residents' quality of life, personnel matters and VSO (Volusia Sheriff's Office), VSO MOU (Memorandum of Understanding) and Amendment 10, cost and competitive rate, reimbursable expenses, consulting costs, tabling the item, utilizing his knowledge, background check process, Union negotiations, Fire training facility, plants that attracts cats, public perception of code, not making exceptions, compliance, abatements, foreclosures, rewording Section B, average hours, needing a full time consultant, to workshop the item, and items not reflected in contract. Commissioner King left the meeting at 9:01 p.m. and returned at 9:03 p.m. The Commission, Mr. O'Grady and Deputy City Manager discussed goals, job fair and filling open positions, garbage and Waste Pro, addressing violations, Exhibit A, expanded services, pulling other experts, needing a better understanding of the contract/process, taking away from code, falling behind, the department structure, and accreditation. Commissioner Ramos left the meeting at 9:12 p.m. and returned at 9:14 p.m. Commissioner Sosa left the meeting at 9:13 p.m. and returned at 9:13 p.m. The Commission and Mr. O'Grady discussed restructuring the organization, rules and traditions, past practice, and what consultants bring to the table. Mayor Herzberg passed the gavel to Vice Mayor Bradford. Motion by Mayor Herzberg, seconded by Commissioner Avila-Vazquez, to approve a Letter Contract with John O'Grady to assist with Code Compliance Training, Accreditations, Contract Negotiations and other City of Deltona Page 8 Printed on 10/20/2021 City Commission Minutes October 4, 2021 assignment as requested. The Acting City Manager has the authority to make corrections of scrivener's errors and the like. The Commission, Mr. O'Grady and Deputy City Manager discussed consultants' knowledge and responsibility, quality over quantity, not exceeding 32 hours, juggling and scheduling the 32 hours, making little changes, hiring Mr. O'Grady vs. hiring his company, the increase in the contract, vetted expertise, internal processes, sweeps, and wanting to understand all aspects of the contract. The motion carried by the following vote: For: 6 - Commissioner Avila-Vazquez, Commissioner King, Commissioner McCool, Commissioner Ramos, Vice Mayor Bradford, and Mayor Herzberg Against: 1 - Commissioner Sosa After discussion, the Commission concurred to have a workshop to review and discuss Mr. O'Grady's contract. Vice Mayor Bradford passed the gavel to Mayor Herzberg. 12. CITY COMMISSION SPECIAL REPORTS AND REQUESTS: Mayor Herzberg requested to approve $1,000 for Wreaths Across America as was done last year and the Commission concurred. Mayor Herzberg requested to place a line item in the budget for Wreaths Across America in the future. 13. CITY ATTORNEY COMMENTS: None. 14. CITY MANAGER COMMENTS: Deputy City Manager stated there was a job fair on September 30th which was successful and it sounds like the City is going to get some good candidates to fill open positions for the CIty. Staff is also looking at the possibility of having a future job fair to include other employers Deltona. She thinks the focus for the first round is going to be health care providers. She also wanted to speak about the fire training facility and remind everyone that the MOU (Memorandum of Understanding) for transports did provide for money to go specifically for the training facility. So just keep that in mind when the Commission is evaluating the process but, certainly Mr. Peters will be reporting back to the Commission on the finances and the plan for moving forward with such a facility. 15. CITY COMMISSION COMMENTS: Commissioner McCool thanked the Deputy City Manager for doing a good job tonight and she is doing a fantastic job with the City. She has been great at listening and City of Deltona Page 9 Printed on 10/20/2021 City Commission Minutes October 4, 2021 recommending and she wanted to give her a resounding welcome. Commissioner McCool stated she also wanted to address comments from a resident, Mr. Williams, regarding what he felt was a slight towards his service on AHAC (Affordable Housing Advisory Committee). His contributions to the City have been invaluable. When she voted to place someone else on that committee, he has been a mentor of the Deltona and his services are appreciated with regards to his involvement in with SHIP (State Housing Initiatives Partnership). There are other stepping up to the plate, really wanting to add service and learn which was part of her reason for voting to place someone else on that committee. She went over with the Acting City Manager his involvement with the committee and SHIP and it was absolutely not a slight to his valuable service to the City, his involvement in the City and everything he does. If Mr. Williams ever felt less than valued she would feel awful about that so she wanted to speak publicly about his concerns and she is always available to speak with. Commissioner King thanked the Commission for their donation on behalf of Wreaths Across America who is working very hard this year to cover 2,000 Veterans' graves at Deltona Memorial Gardens. On the dais and on the back table there are personal forms that can be picked up. The wreaths are $15 each and if two wreaths are purchased a third will be provided for free. He encouraged everyone to donate out of their own pocket like he is. There is also a small flier that announces that this is the first year that the Wreaths Across America Mobile Educational Unit will be coming to this area. On Wednesday, October 13, 2021 they will be in the shopping plaza behind Applebee's and in front of Woody's BBQ from 10:00 a.m. to 6:00 p.m. He encouraged everyone to come out and bring out any youth groups if you can because is a lot of educational presentations on what Wreaths Across America is about. Again, this is the first time the mobile unit has been in our area and it travels all across America all year round. He thanked the Commissioners who have already donated, he appreciates it. Tonight the first hour was all about proclamations and he read a proclamation, a spoof, just for fun. Commissioner Avila-Vazquez stated she was asked to extend an invitation by the local Sons and Daughters of Italy for October 13, 2021 at the Sons of Italy, Doyle Road, where they will be celebrating Italian Heritage Month by having a pasta night which starts at 4:30 p.m., dancing starts at 6:30 p.m. and she believes the cost is $7 a person. The organization is hurting like everyone else due to the pandemic so they are trying to build it back up and she encourage everyone to attend.
