DECORUM POLICY: The City of Deltona has a significant interest in conducting
orderly and efficient public meetings, which includes preventing disruption,
promoting civility, and preserving decorum. To that end, behavior which disrupts
or impedes the efficient and orderly conduct of any public meeting, as
determined by the Mayor, or presiding officer, or a majority of the City
Commission, is not permitted. The Mayor, or presiding officer, or a majority of
the City Commission, may interrupt, warn, or terminate a speaker’s statement
when that statement is too lengthy, personally directed, abusive, obscene,
irrelevant, or otherwise reasonably perceived to be a disruption to the fair and
orderly progress of the discussion at hand. The Mayor, or presiding officer, or a
majority of the City Commission, may also interrupt any part of the meeting to
warn any individual that they are being disruptive or otherwise impeding the
efficient and orderly conduct of the meeting. The Mayor, or presiding officer, or a
majority of the City Commission, may require any individual to leave a public
meeting for its duration if that individual is unable to observe this Policy after
being warned. Should an individual be required to leave a meeting for violating
this Policy, that person shall be escorted from Commission Chambers by a
Volusia County Sheriff’s Deputy.
PUBLIC FORUM: Public Forum will begin at 6:00 PM at the start of each regular
meeting and will conclude after 30 minutes. Comments during Public Forum are
limited to items of City business that are listed on the Agenda and/or items that
are not listed on the Agenda. Comments regarding listed Agenda items will take
place after discussion of each item. Please be courteous and respectful of the
views of others. In order to address the Commission, citizens must fill out a
public participation slip and give it to the Deputy City Clerk. All citizen comments
are limited to 4 minutes and shall be addressed to the Mayor or the Commission
as a whole. Members of the City Commission shall not enter into discussion or
respond to a citizen’s comments other than to give directions or to ask for
clarification. However, individual Commissioners may choose to respond under
the "City Commissioner Comments" portion of the meeting.
Tara D'Errico, Doug MacDonald, Hope George, Barb Girtman, Terri Ellis, Elbert Bryan,
Kathy Bryan, and Dot Bradley addressed the City Commission.

Stacy Cantu with Halifax Urban Ministries Barracks of Hope Construction gave a brief
presentation to include an Overview of Project, Funding Received, Site Plan-962
Derbyshire Rd, Review of Costs, $25,000 Room Sponsorship, and a brief video.
Motion by Commissioner McCool, seconded by Commissioner
Avila-Vazquez, to for the City of Deltona to approve $25,000 for the
Barracks of Hope Construction.
Mayor Avila opened the public comments.
Kathy Bryan addressed the City Commission.

E. Presentation - Senator Tom Wright will present a check to the City of
Deltona for the Fisher Wastewater Treatment Facility Plant Conversion in
the amount of $1,500,000 and the Eastern Wastewater Treatment Facility
Expansion - Sewer Improvement in the amount of $2,000,000. Funding
was secured with assistance from Senator Tom Wright, Representative
Webster Barnaby and Representative Tom Leek.
G. Presentation - Quarterly Reports of City Advisory Boards/Committees -

H. Presentation - FEMA’s Interagency Recovery Coordination (IRC) -
Federal Programs: R2P2, RTCA, CUPP & EDA Grant - Kimberly Castro,
Project Manager (386) 8859.
Strategic Goal: Economic Development
The Commission, Interim City Manager, and staff discussed raising tax dollars,
matching grant funding, budgeting, recent awarded grants, hazard mitigation, raising
Elkcam Boulevard, grant application timelines, home elevations, new sidewalks along
Elkcam Boulevard, pedestrian safety, an 80/20 cost split, previous septic conversion,
innovation, leadership vision, grant projects, Lakeshore Drive, not starting over,
advancing prior community visions, residents' support, taxes and assessments, the
Justice 40 Area, flood mitigation, progressive materials, pervious surfaces, smart
development, ecological considerations, grant applications, visioning sessions, and
surface ground water.

Terri Ellis and Elizabeth Chavez addressed the City Commission.
Mayor Avila closed the public comments.
After discussion, the Commission concurred to allow the Project Manager to
apply for four grants, of which three are completely free and the fourth is at a 20%
-25% cost.
6. ORDINANCES AND PUBLIC HEARINGS:
A. Public Hearing - Ordinance No.12-2023, to Amend Chapter 14- Animals,
of the Code of Ordinances, at first reading and to schedule second
reading for November 6, 2023 - Marsha Segal-George, City Attorney,
(386) 878-8872.
Strategic Goals: Internal/External Communications
The City Attorney gave a brief explanation of the item and read the title of Ordinance
No. 12-2023.
The Commission and City Attorney discussed the Volusia County Sheriff's Office (VSO),
adding temperature, inclement weather and guard dog permits to the ordinance, water
or shelter, animals covered under the ordinance, enforceability, trespassing, property
rights, animal safety, hurricanes and tropical storms, extreme temperatures, the noise
ordinance, clearly defining language, ticketing, preventative ordinances, severe
language, parameters, safeguards, stepping outside the law, working dogs,
domesticated animals, animals being family, clean water, pet licensing, pet vaccinations,
as well as the current registration process and fees.
Motion by Vice Mayor Bradford, seconded by Commissioner McCool, to
adopt on first reading Ordinance No. 12-2023, with the addition of a
temperature, inclement weather and guard dog permit added to the Code
of Ordinance and to schedule a second and final reading for November
6, 2023.
Mayor Avila opened the public comments.

The Commission discussed pet registrations, consequences, Code Enforcement's
responsibilities, peaceful assembly, required animal tags, fines for non-compliance, and
the Special Magistrate.

10. CONSENT AGENDA: The Consent Agenda contains items that have been
determined to be routine and non-controversial. If discussion is desired by any
member of the City Commission, that item must be removed from the Consent
Agenda and considered separately. All other matters included under the Consent
Agenda will be approved by one motion. Citizens with concerns should address
those concerns by filling out a public participation slip and giving it to the
Deputy City Clerk prior to Consent Agenda items being pulled.
Vice Mayor Bradford requested to pulled Item 10-A for discussion.

Fire Chief Snyder gave a brief explanation of the item and provided a correction to the

Mayor requested Fire Chief Snyder make the correction to the cost and forward that
information to the City Commission.
Motion by Vice Mayor Bradford, seconded by Commissioner McCool, to
approve the purchase of a transport unit with approved budgeted funds
based on the actual numbers. The motion carried by the following vote:

B. Request for approval of proposed changes to the By-Laws for the
Affordable Housing Advisory Committee (AHAC) - Angelia Briggs,
Housing & Community Development (386) 878-8614.
Strategic Goal: Internal and External Communication
Approved by Consent Agenda - to approve the changes to the AHAC
By-Laws and extend the current terms of the Committee members to
expire on December 31, 2023.
11. CITY COMMISSION SPECIAL REPORTS AND REQUESTS:
Commissioner Avila-Vazquez requested to work with Barb Girtman, Foundation to
Freedom Domestic Violence, to have the domestic violence event at The Center as
she requested and the Commission concurred.
Commissioner Avila-Vazquez requested that staff work with the Volusia County
Sheriff's Office to create a QR code for human trafficking and bring back the
VSO's human trafficking event which was held in the past and the Commission
concurred.
Commissioner McCool stated there will be an informational session regarding flooding
and she gave a brief overview of the TPO (Transportation Planning Organization)
meeting.
Vice Mayor Bradford requested to have the schools come in once a month to do
the invocation and the Commission concurred.
Vice Mayor Bradford reported about emails concerning meetings going into recess when
there is an issue with the broadcast. She also reported that Lake Baton is a private
subdivision and dedicated to the HOA (Homeowners' Association) with the exception of
the public right away and noted that the City does not have the right to assist this private
subdivision. Additionally, Vice Mayor Bradford reported that there is a home on Loblolly
that is using a cut through on the lawn to avoid Howland Boulevard.

Mayor Avila requested a special day where the Commission would help Habitat
For Humanity and the Commission concurred.
Mayor Avila requested on October 13th to light up Deltona City Hall with purple in
support of not having domestic violence and the Commission concurred.

13. CITY MANAGER COMMENTS:
The Interim City Manager stated he received a request from the City of Port
Orange on behalf of the Volusia League of Cities Board of Directors to join in with
a resolution against the fuel tank farm in Ormond Beach and the Commission
concurred.
14. CITY COMMISSION COMMENTS:
Commissioner Avila-Vazquez discussed the domestic violence event, Discovery
Elementary tour of City Hall, the Wig Out event, the October 12th CompStat Meeting,
October 11th Sons and Daughters of Italy's Italian Heritage Month event, and residents
parking in the right-of-way.
Commissioner McCool discussed the Wig Out event and her health journey.
Vice Mayor Bradford discussed Spooktacular, the Veterans Day event, and driving in the
right-of-way.
Mayor Avila discussed Commissioner and staff attendance during meetings, being
nominated for an award from the 2023 Florida Latino Leaders, a potential Sister City
Agreement, and his duty and obligation to report concerns brought forward by residents.

B. Proclamation - Fire Prevention Week - October 8-14, 2023
Background: The City of Deltona recognizes the week of October 8-14, 2023 as
“”Fire Prevention Week” throughout the City of Deltona . The 2023
Fire Prevention WeekTM theme, “Cooking safety starts with YOU.
Pay attention to fire preventionTM,” effectively serves to remind us to
stay alert and use caution when cooking to reduce the risk of kitchen
fires.
C. Proclamation - Domestic Violence Awareness Month
Background: Domestic Violence is a problem that is not confined to any group or
groups of people, but crosses all economic, racial, gender,
educational, religious, and social barriers, and is sustained by
societal indifference.
All citizens are encouraged to speak out against domestic violence
and support local efforts to assist victims of these crimes in finding
the help and healing they need.
D. Proclamation - Breast Cancer Awareness Month
Background: October is designated as Breast Cancer Awareness Month. Breast
cancer is one of the most frequently diagnosed cancers and the
leading cause of cancer death among women worldwide. The
American Cancer Society estimates that there will be an estimated
297,790 new cases of breast cancer in the United States in 2023.
The City of Deltona recognizes the importance of this ongoing fight
and proclaims October, 2023 as Breast Cancer Month.
E. Presentation - Senator Tom Wright will present a check to the City of Deltona

Florida Legislature for the 2022-2023 Florida Budget and signed by
Governor DeSantis on June 15, 2023.
F. Presentation - Halifax Urban Ministries Barracks of Hope Construction,
presented by Daytona Beach Commissioner, Stacy Cantu.
Background: Barracks of Hope Construction: overview of project, funding
received, site plan, review of costs and sponsorship. The Barracks of
Hope will offer Veterans housing stability.

Strategic Goal: Economic Development
Background: Project Manager, Kimberly Castro will present federal programs (1-3)
to assist the City of Deltona with recovery and resiliency initiatives.
(1) Recovery and Resiliency Partnership Projects (R2P2) -
Environmental Protection Agency (EPA) sponsored technical
assistance program to support each city’s vision for long-term
economic recovery by developing design concepts and
strategies that integrate recreation, stormwater management,
community connectivity, and downtown development.
(2) National Parks Service Rivers, Trails and Conservation

Assistance (NPS-RTCA) program assists communities,
public land managers and nonprofit organizations with
conservation and outdoor recreation projects to provide
professional planning, design and technical expertise that help
to achieve the community’s conservation and outdoor
recreation vision.
(3) EPA’s College/Underserved Community Partnership
Program (CUPP) to provide meaningful support to
underserved communities seeking to address legacy
environmental and economic impacts while building the next
generation of leaders with an awareness and vision for
meeting the our community. Communities receive vital
assistance and services on a voluntary basis at no cost.
FY2023 Diaster Supplemental Dept. of Commerce Economic
Development Administration (EDA) Grant - 80/20: EDA portion -
$120,000 (80%); City of Deltona portion: $30,000 (20%) = Total
$150,000. (4) Economic Development Administration (EDA) Disaster
Supplemental Opportunity will help Deltona devise and implement
long-term economic recovery strategies through a variety of
non-construction and construction projects, as appropriate, to
address economic challenges in areas where a Presidential
declaration of a major disaster was issued. Project Manager is
requesting approval to submit grant request.
(4) Economic Development Administration (EDA) Feasibility and
Impact Studies to align ecological, environmental, and economic
development community goals; assist with public engagement, and
examine projects that will be identified in the R2P2 and NPS-RTCA
initiatives.

Statute 828.13 to be put in an Ordinance and moved for first reading.

Background: The Fire Department is continuing to modernize our fleet in order to
provide the best service to our community. We have budgeted
$475,000 to purchase an ambulance this fiscal year in order to
maintain our fleet’s readiness status. Our current reserve units
already exceed their recommended life span and current build times
are between 12-24 months.
We received Estimate# Q3363-1 from Frazer for a Frazer 2023
International ambulance for $399,400. Pricing is in accordance with
the Buy-board Purchase Co-Op, which the City is a member,
contract #650-21 valid 10/1/21 - 9/30/24. We have provided Frazer
with a letter of intent to reserve our spot in line pending Commission
approval. This intention letter allows us to receive the ambulance
within a 4-6 month timeline once ordered. The remaining $135,600

of budgeted funds will be utilized to purchase essential equipment
required to make the ambulance ready for service such as
stretchers, radios, medical equipment, etc.

B. Request for approval of proposed changes to the By-Laws for the Affordable
Housing Advisory Committee (AHAC) - Angelia Briggs, Housing & Community
Development (386) 878-8614.
Strategic Goal: Internal and External Communication
Background: At the Regular Commission Meeting held on May 4, 2015 the City
Commission approved to change the term of the Committee
members from one year to two years with the term expiring every
October 5th. The expiration date is in the middle of the AHAC
reporting process and needs to be changed so that the same
members start and finish that process.
At the Regular Commission Meeting held on October 19, 2020 the
City Commission approved per the change to F.S. 420.9076 to
appoint an elected official to the Committee, however, this was not
included or updated in the by-laws and the attached Resolution
included the new change per the Florida Statue listed above.
