CALL TO ORDER: The meeting was called to order at 5:30 p.m. by Mayor Herzberg. 2. ROLL CALL – CITY CLERK: Present: 7 - Mayor Herzberg Vice Mayor Avila-Vazquez Commissioner Bradford Commissioner King Commissioner McCool Commissioner Ramos Commissioner Sosa 3. PLEDGE TO THE FLAG: 4. BUSINESS: A. Section 11(1) of the City of Deltona Charter (“Charter”) which requires that the Charter be reviewed at least every 10 years. This item is to review and discuss the recommendations presented by the Charter Review Committee (CRC) during the Regular Commission Meeting held on February 21, 2022. - Stacey Kifolo, Deputy City Manager (386) 878-8552. Strategic Goal: Effective Governance The Deputy City Manager gave an overview of the City Charter, the matrix, and the five Charter Amendments recommended by the Charter Review Committee (CRC). Amendment #1: The Commission, Acting City Manager, Deputy City Manager, City Attorney, and staff discussed case law, City Attorney, thought process, Mayor/Commissioner representation, impact to voters/candidates, the word "represent", legality, implementation, AGO (Attorney General Opinion), Districts, and campaign costs. Mayor Herzberg opened the public comments. Tara D'Errico, Deltona, spoke about residents, dedicated Commissioners, and fielding issues citywide. Elbert Bryan, Deltona, spoke about CRC thought process, block voting, HOAs (Homeowners Association), CRC attendance, and legal representation. Mayor Herzberg closed the public comments. Amendment #2: The Commission and Deputy City Manager discussed compensation and justification, percentages, benefits and cost, candidate attraction, cost of living, reasons to run, quality candidates, perception, total compensation package, Charter content, ordinance change, Charter rewrite, and CPI (Consumer Price Index). After discussion, the Commission concurred to move Amendment #2 forward for further discussion. Mayor Herzberg opened the public comments. Tara D'Errico, Deltona, spoke about percentage, incremental increase, benefits, and residents struggling. Elbert Bryan, Deltona, spoke about compensation, specific calculation, quality candidates, and CPI. Mayor Herzberg closed the public comments. Amendment #3: The Commission and Deputy City Manager discussed "extraordinary circumstances", staff support, Charter rewrite, State Statutes, policies, "18 months", selection process, residency, the current situation, matrix, meeting attendance, historical voting, removing language, changes by ordinance, residency, and unstable environment. After discussion, the Commission concurred to move Amendment #3 forward for discussion. Mayor Herzberg opened the public comments. Elbert Bryan, Deltona, spoke about prior City Managers, the process, evaluations, pandemic, and residency. Mayor Herzberg closed the public comments. Amendment #4: The Commission and Deputy City Manager discussed historical voting, Volusia County, members/alternates, CRC quorum, and legal challenges. After discussion, the Commission concurred to not move Amendment #4 forward. Mayor Herzberg opened the public comments. Elbert Bryan, Deltona, spoke about two part question, members/alternates, timeframe, Commission control, and number of amendments. Mayor Herzberg closed the public comments. Amendment #5: The Commission, Acting City Manager and Deputy City Manager discussed standards, land use, duplications, legal issues, CRC discussion, policy, development, Comprehensive Plan, and amendment language. After discussion, the Commission concurred to not move Amendment #5 forward. Mayor Herzberg opened the public comments. Tara D'Errico, Deltona, spoke about strategic planning. Elbert Bryan, Deltona, spoke about amendment language, questioning, policy, and Florida/State Constitutions. Mayor Herzberg closed the public comments. Mayor Herzberg gave an overview of the discussions that took place. The Commission, Deputy City Manager and staff discussed resigning to run vs. a resignation, election vs. appointment, quorum, qualifying, and resignation letter/effective date. City of Deltona Page 3 Printed on 3/29/2022 City Commission Workshop Minutes March 28, 2022 Mayor Herzberg read on Page 8 of 30 the Charter Review Committee's policy recommendation. The Acting City Manager stated the charge from the Commission to the Charter Review Committee was to make recommendations to the Charter, not to make recommendations regarding policy. It is within the Commission's right to make additional training part of a policy, but it is his recommendation to put this aside and for the Commission to have a discussion at another time. The Commission concurred to put the recommendation aside. Mayor Herzberg asked if the two items would be discussed at another workshop or placed on an agenda. The Acting City Manager stated his preference would be to workshop it or have a special meeting. When the discussion takes place, does the Commission intend to bring forward their own amendments for discussion? If that is the case he suggested a special meeting so action can be taking and there is no meeting time limit. The Commission concurred to have a Special Commission Meeting with food. 5. PUBLIC COMMENTS: Time permitted, public comments shall be limited to items on the agenda and shall not exceed two minutes. Please be courteous and respectful of the views of others. Personal attacks on Commission members, City staff or members of the public are not allowed, and will be ruled out of order by the Mayor. 6. CITY MANAGER COMMENTS: 7.
