Discussion - Proposed rental ordinance, creating new Chapter 36, City Code of Ordinances to regulate rental dwellings within the City - Ron A. Paradise, Community Services Director (386) 878-8610 Strategic Goal: Effective governance Background: The regulation of residential rentals has been a topic of discussion within the City for a number of years. There is an understanding that poorly managed properties, including rental properties, can negatively impact neighborhoods by bringing down property values. Based on that general premise, the City in 2007 passed an ordinance that required rental properties to be issued a business tax receipt and did provide for emergency inspections. The ordinance also required absentee owners to establish a local contact for property management. Notwithstanding the 2007 ordinance never being repealed, the City in 2014 adopted another ordinance intended to regulate residential rentals. The 2014 ordinance required a license and a registration fee. There were also requirements for inspections and the designation of a local contact. The 2014 ordinance was quickly repealed about four months after adoption. Attached for review and discussion is a draft of the proposed Deltona City of Deltona Page 1 Printed on 8/19/2022 City Commission Workshop Agenda August 22, 2022 Rental Registry ordinance. The new ordinance requires absentee owners to register properties with the City on an annual basis. The annual registration fee is proposed to be $250.00. Note: The City five-year budget accounts for the registration fees anticipated to be collected predicated on there being approximately 5,500 rental properties within the City. The ordinance splits the City into four generally equal quadrants for the purpose of creating a four-year inspection rotation. The reason for splitting up the City into quadrants is to ensure an orderly administration of the program. As part of the inspection process, the landowner/landlord would have to establish a local contact if the owner/landlord was not located within 30 miles of the City; indicate the number of people residing the dwelling and the number of rooms/sleeping accommodations; and submit an inspection performed by a licensed home inspector and septic system professional. Implementation of the program will include accepting the registration fee, archiving the data and reviewing inspections. City staff has already outreached to a real estate and data base-oriented consultant to help manage the data base, assist in notifications and maintain a real time, quick reference ‘dashboard’ type of spreadsheet. With regard to compliance, the City will require certification of registration within the program to have utilities connected to an absentee owned property and the City also has the option to undertake Code Compliance actions as appropriate. OPTIONS: Review the rental ordinance (Deltona Rental Registry) and provide direction to staff.
