1. CALL TO ORDER:
The meeting was called to order at 5:30 p.m. by Mayor Avila.
2. ROLL CALL – CITY CLERK:

A. Ordinance No. 12-2023, to Amend Chapter 14- Animals. Workshop to
review the comments of Mayor, Vice Mayor, Commissioners and the
Public concerning items that needed to be added prior to 2nd and final
reading scheduled for November 6, 2023 - Marsha Segal-George, Legal
Department (386) 878-8872.
The City Attorney gave a brief overview of the item.
The Commission, staff, and Volusia County Sheriff's Office (VSO) Lieutenant Ryan Mills
discussed the Palm Beach County animal ordinance, surrendering animals, A/C units and
fans, permits needed, grants for animal crates and houses, temperature limits, working with
animal owners, protecting animals, enforceability of the ordinance, animals covered by the
ordinance, domesticated animals, emotional support animals, treatment of animals, costs,
status of Barrack (dog), euthanizing animals, humane societies, expense to citizens,
warrants, privacy, private property, search & seizure, citizens' rights, felony crimes, VSO's
inability to enforce, process to involve VSO, Florida State Statutes, access to indoors,
Commission workshops, priorities, City Attorney filing cases, backyard visibility, loose and
lost animals, proof of vaccination, documentation, spay & neuter, citations, other animals,

Trap-Neuter-Return (TNR) program, the complexity of the ordinance, neighbor grudges, and
exercising animals.
Mayor Avila opened the public comments.
Jess Carrion, Jesse Simmons, Charleen Smith, and Elbert Bryan addressed the
Commission.
Mayor Avila closed the public comments.
The Commission and staff discussed ordinances versus laws, simplifying the ordinance,
seizing animals, immediate & compounding fines, utilizing the Special Magistrate,
enforcing current ordinances, Code Compliance reports, status reports, Code Enforcement
training, continuing education, complexity of animal cruelty cases, case timelines, number of
animal cruelty cases, harassment, red flags, monthly reports, citizen perceptions and input,
Ordinance Review Committee (ORC), violating citizens' rights, reactive enforcement, cases
going to court, and recouping costs.
Commissioner JodyLee requested to bring the rewritten Ordinance No. 12-2023
to a Regular Commission Meeting and the Commission concurred.

Background: The City Commission on August 28, 2023 regular City Commission
meeting concurred for the City to amend the Chapter 14-Animals, of the
Code of Ordinances. The Commission on October 6, 2023 approved
the first reading of Ordinance 12-2023 with revisions. The workshop is
to review the comments of Mayor, Vice Mayor, Commissioners and the
Public concerning items that needed to be added prior to 2nd and final
reading scheduled for November 6, 2023.

and evidence upon which the appeal is to be based (F.S. 286.0105).
Individuals with disabilities needing assistance to participate in any of these
proceedings should contact the City Manager in writing at
CityManager@deltonafl.gov or to Deltona City Hall, 2345 Providence Blvd.,
Deltona, FL 32725 at least 48 hours prior to the meeting at which the person
wishes to attend. The City is not permitted to provide the use of human physical
assistance to physically handicapped persons in lieu of the construction or use of
ramps or other mechanical devices in order to comply with Florida law. If proper
accommodations for handicapped access cannot be made at a particular public
meeting venue pursuant to a timely written request under Section 286.26 F.S., the
City Manager shall change the venue of that meeting to a location where those
accommodations can be provided.
