The Development Review Committee meeting is held in the virtual environment via Webex and can be accessed by the following methods: 1. CALL TO ORDER: The meeting was called to order at 9:00 am. 2. ROLL CALL: Also present: Toborrah Cottingham and Willam Lopez-Colon, Public Works;Nashla Merced, Dinelia Santana, and Vanessa Suazo, Planning and Development Services; Renee Cairney, Code Compliance; Sharon Shivers, Fire Department; Kat Kyp and Bret Messer, Building Services; Jeff Wingdar, Volusia County Sheriffs Office; Keegan Ayala and Karen Neher, Trinity Christian Academy Deltona; Leah Wind and Eric Boyle, LGI Homes; Hope George, Lake Baton Homeowners Association; Michelle Murphey, Herman Campos, and George Guimond. APPROVAL OF MINUTES & AGENDA: A. Minutes of August 18, 2022 Motion by Ron Paradise, seconded by Carl Lynch, to approve the Minutes of August 18, 2022, as presented. The motion carried unanimously. 4. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the agenda and shall not exceed two minutes. Please be courteous and respectful of the views of others. Personal attacks on Committee/Board members, City staff or members of the public are not allowed and will be ruled out of order by the Chair. Public forum was opened and closed as there were none. 6. OLD BUSINESS: None. 7. NEW BUSINESS: A. Trinity Christian Academy - Pre-application Meeting - Shed Permit BLDC22-0116 Mr. Ayala explained the shed Trinity is requesting to build would not affect any driving aisles and would be placed in a green space. The Committee explained institutional uses have to do an abbreviated Site Plan process for sheds. They explained going forward for future developments Trinity Christian Academy would need to submit their impervious and pervious spaces, along with their stormwater calculations. Ms. Neher explained the requested shed is only to store athletic equipment because the storage closet currently used for this is no longer allowed, according to their last fire inspection. She stated the future expansion of the institution would require strategic planning and building more buildings. Motion by Ron Paradise, seconded by Jerry Mayes, for the DRC sign off on the 120 square foot shed addition consistent with all requirements of the zoning within the Planning Unit Development and the Land Development Code with the understanding that any other additions will need to be more thoroughly planned. The motion carried unanimously. B. LGI Homes - Pre-application Meeting - Building Permit Issuance Mr. Boyle explained he has met with both Public Works and the Building Department with turning in the Building Permit and the Septic Permit simultaneously. He stated the septic permit is taking four (4) to eight (8) weeks. Mr. Lynch stated he will not take a building permit without the septic permit. They do not do this for any other contractors. Mr. Paradise explained this is a concurrency issue with a Building Permit Application. The City can not issue a Building Permit that does not comply with this. The Health Department is running behind, which we call can appreciate, because the volume of permits coming into the City is substantial. Lake Baton Drive - Pre-application Meeting - Site Plan Ms. George explained she has three (3) concerns which consists of traffic from Spirit Elementary, gating the community, and the three islands being maintained by the HOA. She requested for one of the school exits to say no left turn onto Meadowlark to limit the traffic on the private road. Mr. Wingdar explained the top priority is to get kids in and out as fast and safe as possible. He stated he has a meeting with the principal regarding the traffic issues and the ideas behind making it run smoothly. Discussion occurred regarding school traffic. Ms. George asked if putting speed humps would be an option, and Mr. Wingdar explained this could cause a delay in emergency vehicles. He stated, unfortunately they do not work like they used to and the Fire Chief is actively against speed humps because the wear and tear it puts on the Fire Trucks. Discussion occurred regarding parents lining up early causing congestion in the line and safety. The Committee suggested the applicant get with their insurance company and the Fire Department before installing the speed humps. Ms. Shivers stated the Fire Chief has to approve the speed humps before being installed. Ms. George asked about the City taking one of the island's back. Chair Wallace explained the HOA was in charge of this, but if they no longer want to maintain this, the City may take it over. The City will evaluate what is there, irrigation would be turned off, and plantings that require minimum attention would be kept in this area. Ms. George stated she was told when they purchased these homes there would be gates installed. The Committee explained DR Horton did not pull the permits for the gates, but if the HOA would like to install these they would need to go through the Site Plan application process. They suggested the applicant hire a Civil Engineer to assist in the process. Discussion occurred regarding the Site Plan process. Ms. Shivers reminded the applicant that roads needed to be a minimum of 20 feet wide and the gates would be required to have a Knox Key switch and a SOS Fire Alarm System. Mr. Wingdar explained if all stop signs, stop bars, and speed signs are up to code an officer can enforce in this area. She also stated she would send her the original agreement with the City and the Developer that was for 25 years. 8. STAFF COMMENTS: None. 9. BOARD/COMMITTEE MEMBERS COMMENTS: None. 10. Lake Baton Drive - Pre-application Meeting - Site Plan Background: Applicant: Hope George Lake Baton Estates HOA Project Name: Lake Baton Project Type: Site Plan Project Acreage: ± 52.17 Current Zoning: R-1AA Reference: Lake Baton Parcel Number.: n/a Property Location: East of Spirit Elementary School Background: This meeting has been scheduled to allow the DRC to all questions/concerns the HOA Representative(s) along with the Property Management may have. Ms. Georges email is below: Lake Baton Estates has spoken with City Officials in the past, however, we continue to have issues with our "Private Roads" and with Hampton Oaks coming to fruition, we're afraid it's only going to get worse. We appreciate the opportunity to be at the meeting on 9/1. As the new President of the HOA, I am trying to gather as much information as I can, with help from George a homeowner and Chris Smith our Property Manager from Vista Community Management in Maitland Fl. so we will know how to proceed. 1. Cars going to and from Spirit Elementary both at the AM and PM are clogging our roads, lining up in our development, blocking our exit and entrances. In addition, these cars back up on Meadowlark Drive from Lake Baton Drive to Saxon Blvd. This is against Deltona's traffic ordinances. From my e-mail to the Sheriff Lt. Schoeps 10-2021 · Sec. 66-9. - Stopping, standing, or parking so as not to obstruct traffic. City of Deltona Page 3 Printed on 8/25/2022 Development Review Committee Agenda September 1, 2022 No person shall stop, stand or park any vehicle in the street in such a manner or under such conditions as to leave available less than ten feet of the width of any lane of the roadway for free movement of vehicular traffic, except that a driver may stop momentarily during the actual loading or unloading of passengers or when necessary in obedience to a traffic regulation, a traffic sign or signal, or a law enforcement officer. (Ord. No. 16-98, § 2, 5-3-99; Ord. No. 23-01, § 1, 7-16-2001) This Ordinance is absolutely not being followed or enforced and the double lines on Meadowlark puts the traffic at a standstill for 10-15 minutes. In addition, when Hampton Oaks come to term with 200+ new homes we believe we will have a confrontational situation and much more congestion. We have asked the Sheriff's office to help us move traffic, and they have complied some of the time, which we are very grateful for. On Exit from school, cars make a left turn into our development to get away from other traffic on Meadowlark. If our roads are private, shouldn't that mean that through traffic should not be permitted. 2. Can we ask for a new sign: "NO LEFT TURNS 7AM to 9AM and 1:30 to 3:30PM.”? FROM MEADOWLARK onto LAKE BATON DRIVE? 3. Cars going into Spirit Elementary line up taking both lanes of Meadowlark. We have asked the school more than once to tell the parents to stay in the left lane so Lake Baton Estates residents can use the right lane to enter into the development. The Principal told us that the police have told them to use the right lane and they will not make the change. The cars line up at least 1 hour before dismissal and both lanes are usually stopped. a. Can Police or Sheriff amend their instructions to the school Principal so that the right lane is free for homeowners at Lake Baton Drive and soon Hampton Oaks as well? 4. Can the City put up barricades that you can only turn left if you come out of Hampton Oaks? These would be the same as on Saxon and Race Track Gas Station, before the entrance to I-4 to Daytona 5. The cars mentioned above do not obey our speed limit or stop at the stop signs. This causes a safety concern as we have children walking home from school, walking dogs, etc. Police have told us they cannot come into our development to help enforce the traffic rules because we have private roads. From my e-mail to the Sheriff 10-13-2021 I've spoken to Sgt. Bryan on the telephone, regarding having the Sheriff's department invited into our development to help enforce the stop signs. The school parents don't seem to want to stop at the STOP City of Deltona Page 4 Printed on 8/25/2022 Development Review Committee Agenda September 1, 2022 signs. He was going to review the city ordinances to see what was needed and get back with me. Unfortunately, I don't seem to have his e-mail. 6. In the past the HOA has asked the city to allow us to Close Off the back entrance, and/or install gates and both times we were told we could not because the roads have been open to the public for many years and DR Horton did not pay the permit fees to have this be a community with gates. But if they are private roads, and if we are responsible for their up-keep, how can the City make that case? Is there a city ordinance that states that? 7. Is there information as to how much that permit fee would be should we be allowed to have gates installed? I have be unable to find anything on-line. 8. If we are to allow any and all traffic through our development, breaking down our roads, how can they be called "Private" and why should the Homeowners of Lake Baton Estates be responsible for their upkeep? 9. SPEED HUMPS - Because we can't seem to slow down the traffic, we are looking at installing 2-4 Speed Humps on Lake Baton Drive as you first come into the development. This will depend on the cost of installation. However, on the City of Deltona website, it shows the steps in the process to have speed humps installed on Public Roads, however I don't see any information on Private Roads. Is there a procedure for Private Roads? Please advise. 10. Three large islands on Meadowlark - Public Road. DR Horton agreed with the City of Deltona to maintain three large islands in front of Spirit Elementary. The Lake Baton HOA has had to continue with the upkeep and irrigation of these islands. We would like to request that the DRC review how and if the City of Deltona can take back ownership of these islands. The HOA pays to have them mowed each week, trees pruned and palm trees cut when necessary, along with weekly irrigation. It has become a burden to the association. With the development of Hampton Oaks, we feel that we should not be the responsible party and would like to know the parameters of how this could be done.
