1. CALL TO ORDER:
The meeting was called to order at 7:03 pm.
2. ROLL CALL:
Also present: Planning & Development Director, Chris Bowley, AICP; Planning &

A. Election of Officers
Mr. Bowley called for nominations for the position of Chairman. Member Harper
nominated Tom Burbank. With no further nominations for the position of Chairman,
nominations were closed. The motion was seconded by Member Putkowski and the
motion carried unanimously.
Chairman Burbank called for nominations for the position of Vice-Chairman. Member
Harper nominated Donald Philpitt. With no further nominations for the position of
Vice-Chairman, nominations were closed. The motion was seconded by Member
Putkowski and the motion carried unanimously.
Chairman Burbank called for nominations for the position of Secretary. Member
Putkowski nominated John Harper. With no further nominations for the position of
Secretary, nominations were closed. The motion was seconded by Member Philpitt and
the motion carried unanimously.
3. APPROVAL OF MINUTES & AGENDA:

Motion by Member Harper, seconded by Member Putkowski, to adopt the
Minutes of December 21, 2016. The motion carried by the following vote:
For: 4 - Chair Burbank, Secretary Harper, Vice Chair Philpitt and

A. Resolution No. 2017-01 - Application for a Variance at 2601 Providence
Blvd., File No. VR 16-005.
Mr. Paradise stated that the application for a zoning variance is a request to encroach
seven (7) feet into the required 10 foot rear yard setback and to encroach two (2) feet
into the required six (6) foot side yard setback with a 12’x20’ (240 square foot) shed. He
noted that there is no zoning ordinance hardship for the applicant. Chairman Burbank
asked the name of the manufactor for the shed. Mr. Paradise stated that he would defer
to the applicant.
David and Alice Pacitti, 2601 Providence Blvd. Deltona, spoke as the applicant and
stated that reasons for the zoning variance application are due to the erosion of the
incline in the backyard and the height of the shed would be visibly higher.
Discussion between Vice-Chairman Philpitt and the applicant ensured regarding
changing the orientation of the shed. Member Putkowski and the applicant discussed
the surrounding area and the facade of the shed. The applicant agreed that the shed
would be painted to match the house.
Chairman Burbank opened the public hearing.
Chairman Burbank closed the public hearing.
Chairman Burbank and Secretary Harper discussed the potential issues the applicant is
encountering.
Motion by Member Harper, seconded by Member Philpitt, to recommend
for denial, Resolution No. 2017-01 - Application for a Variance at 2601
Providence Blvd., File No. VR 16-005. The motion carried by the following
vote:

Amendment to the Future Land Use Map for the S/E Corner of Normandy
Blvd. and Saxon Blvd., File No.CP16-001.
Mr. Paradise provided a history of the application and stated that it is associated with a
rezoning application. This application is to amend the City’s Future Land Use Map by
changing ±2.5 acres of land located at the southeast corner of the intersection of
Normandy Blvd. and Saxon Blvd. from Low Density Residential (LDR) to Commercial
(C). The property built-in at a commercial capacity will need to have adequate public
services such as; central water and sewer, transportation, and stormwater management.
The applicant provided a Traffic Impact Analysis, which used a gas station with fueling
stations as their model and was reviewed by both staff and a peer consultant traffic
engineer. Findings stated that the change would not change traffic conditions. He noted
that access management would be discussed during the site plan application process.
Mr. Paradise stated that this is a policy decision and is appropriate in the 2025 plan, and
complies with the Comprehensive Plan and the Community Redevelopment Area.
Chairman Burbank asked Mr. Bowley about the status of the FDOT project. Mr. Bowley
replied that FDOT has concept plans, but the funding of the project is unverified.
Discussion ensued amongst the Board and staff regarding future FDOT improvements
along Saxon Blvd., access management, connecting to central sewer and conceptual
design. Mr. Paradise stated that central sewer is available within 1/4 mile radius and the
project would need to connect per the City's code; likely to the lift station at Antillies
Terrace.
Chairman Burbank stated that the topography shows the floor of the building would be
at the roof line of surrounding property. He discussed access management and
adjacency concerns.
Paul Holub, Holub Development Company, 675 N. Beach St. Ormond Beach, Fl,
applicant, stated that he is available for questions.
Robert J. Riggio, PA, 400 S. Palmetto Ave, an attorney representing Charles and
Sharon Pimenta, spoke regarding their property, 1860 Saxon Blvd. Deltona. He states
their property is bordering two sides of the proposed location and stated the owner's
have issues surrounding the Future Land Use change and the proposed land use. Their
concerns are; hours of operation, lighting and major development change to the area.
Clients had a lease to buy option, which fell through because of the potential
development. He continued and spoke regarding jobs, inverse condemnation, and that
this is a discretionary decision presented to the Board. He requested that the Board
deny the application.
Secretary Harper and Mr. Paradise discussed bufferyard and screening requirements
between the commercial and residential uses. Vice-Chairman Philpitt stated the area
west of Normandy Blvd. is zoned commercial, the northeast is vacant, and is in the
CRA. All the property is vacant and the client has it is listed for sale by owner. Mr. Riggio
stated his clients live in Winter Springs and are trying to sell their home to move back to
Deltona. Discussion ensued amongst the Board regarding the surrounding zoning.

Mr. Holub stated that the amendment is for the land use change and is not currently in
design. The intersection is in excess of 40,000 AADT and is not an area that promotes
single family residential uses. He stated that he contacted the owner six (6) months ago
with an offer to purchase the property, and they did not contact him. He stated he
attempted to contact him before the application was submitted to the City. He noted that
there is a potential conflict of interest with Mr. Riggio and will be checking with his
company. He has no issue with putting a wall or screening in at the time of
development.
Gale Bodurtha, 1630 Farley Ct. spoke against the application, wanted to retire in
Deltona and has concerns regarding the lighting, traffic, and a gas station every ten feet.
Christina Bloncourt, 1619 Farley Ct., spoke against the application and has concerns
about safety, property values dropping, lighting and location to another gas stations.
Secretary Harper stated that he understands the objections from surrounding neighbors.
He noted that commercial is needed and that the Normandy Blvd. and Saxon Blvd.
intersection is probably the busiest in the City and forsees future commercial growth.
Vice-Chairman Philpitt stated his concerns are the topography and the stormwater run
off below the property, Mr. Paradise stated that the city's code is comprehensive in
regards to stormwater for closed and open basin and would be mitigated and would not
allow any stormwater run off to the neighbors. Vice-Chairman Philpitt asked Mr. Holub if
they own the nine (9) parcels and are doing studies for the property. Mr. Holub noted
that they maintain and manage all of their properties long-term.
Member Putkowski and Mr. Paradise discussed central sewer and cost sharing. Mr.
Paradise stated the developer would incur the cost to connect to central sewer. Member
Putkowski asked about the FDOT improvements and whether the application would be
included, Mr. Paradise stated 300 feet would be included with the latest plans.
Discussion regarding sewer and cost sharing ensued.
Chairman Burbank stated his concerns are the topography, lighting and the need for
potential walls.
Motion by Member Harper, seconded by Member Philpitt, to recommend
for approval, Ordinance No. 35-2016 - Application for a Small Scale
Comprehensive Plan Amendment to the Future Land Use Map for the S/E
Corner of Normandy Blvd. and Saxon Blvd., File No.CP16-001. The
motion failed by the following vote:
For: 2 - Secretary Harper and Vice Chair Philpitt
Against: 2 - Chair Burbank and Member Putkowski
C. Ordinance No. 36-2016 - Application to Amend the Official Zoning Map for
the S/E Corner of Normandy Blvd. and Saxon Blvd., File No. RZ16-004.

Discussion between staff and Chairman Burbank ensued regarding hearing the rezoning
item. Mr. Paradise recommended taking a vote on the rezoning item. Chairman Burbank
asked Mr. Bowley for the process and Mr. Bowley stated that the item would need to be
opened to the public hearing process and a motion made. Chariman Burbank stated the
item would not be heard as agendaed.
8. STAFF COMMENTS:
Mr. Bowley commented that the Lakeshore Loop Trail project was underway and that it
is a positive project that will enhance the area. The bridges are being installed and look
very nice.
