City of Deltona 2345 Providence Blvd. Deltona, FL 32725 Minutes Planning and Zoning Board Wednesday, May 19, 2021 6:00 PM Deltona Commission Chambers A. In an effort to reduce the possibility of exposure of residents to the COVID-19 (Coronavirus) we are allowing limited public access into the Commission Chambers and practicing social distancing with the Planning and Zoning Board Members, staff, and residents. 1. CALL TO ORDER: The meeting was called to order at 6:00 pm. Mr. Paradise recommended the Planning and Zoning Board appoint Member Northey as acting Chairperson and Member Berk as Vice Chair to conduct the meeting. 2. ROLL CALL: Motion by Ruben Munoz, seconded by Allen Pfeffer, to have Member Northey as acting Chairperson and Member Berk as acting Vice Chair for the May 19, 2021, Planning and Zoning Board Meeting. The motion carried unanimously. Election of Officers Motion by Ruben Munoz, seconded by Dwayne Kennedy, to defer Election of Officers until the next meeting. APPROVAL OF MINUTES & AGENDA: A. Minutes of February 17, 2021 Motion by Ruben Munoz, seconded by Allen Pfeffer, to approve the Minutes of the Planning and Zoning Board Meeting of February 17, 2021, as presented. The motion carried by the following vote: For: 6 - Kennedy, Vice Chair Munoz, Chair Northey, Member Berk, Secretary Pfeffer and Alternate Rodriguez 4. PRESENTATIONS/AWARDS/REPORTS: A. Presentation - General overview of the City's Land Development process Ms. Merced gave a presentation regarding parking regulations. She spoke regarding the importance of parking regulations and requirements. She explained DRC staff review on parking illumination, access, design, surface material, and impervious areas, setbacks, landscape requirements, stormwater runoff, and dimensional requirements. Member Northey asked questions regarding the size of vehicles and dimensions of handicap and parking spaces. 5. PUBLIC FORUM: Time permitted, public comment shall be permitted at the end of agenda items only and shall not exceed four minutes. 6. OLD BUSINESS: 7. NEW BUSINESS: A. Ordinance No. 02-2021 - Amending the official Zoning Map to rezone ± 128.24 acres of land generally located on the east side of Normandy Blvd. and south of Graves Ave. from City of Deltona Industrial (I) to Industrial Planned Unit Development (IPUD). Mr. Paradise stated the application is for a rezone, explaining that this would be a quasi-judicial hearing. He turned the meeting over to City Attorney Segal-George to swear in those who wanted to speak on the rezone. Interim Chair Northey asked each member if they had ex-parte communications for the record. Member Munoz, Member Kennedy, and Alternate Rodriguez stated they had no ex-parte communication. City of Deltona Page 2 Printed on 9/7/2021 Planning and Zoning Board Minutes May 19, 2021 Member Pfeffer and Interim Vice Chair Berk stated they drove by the site and did some research on the Industrial Buildings. Interim Chair Northey stated she drove the site multiple times. Mr. Paradise explained to the Board that the rezone is to change the current zoning, Industrial zoning to an Industrial Planned Unit Development (IPUD). He stated the property is south of the EPIC Movie Theater and across from Amazon, located in the Deltona Activity Center. He spoke regarding the use being a high profile use facility and explained there would also be office and flex spaces. He spoke regarding there being a limited opportunity for a fueling station or restaurant at 15,000 square feet. He stated the project is a chance for two (2) million square feet of growth. Mr. Paradise spoke regarding the traffic cap with a limit of 5,407 trips, and only 848 of those will consist of heavy cargo trucks, like 18 wheelers. There are several methods to manage traffic like access management, right-of-way designations, and offsite mitigation. He spoke regarding the proposed three (3) driveways, stating two (2) would be fully signalized. He explained the turns would be designed for trucks to ensure truck traffic is minimal. He spoke regarding Opticon license plate readers being installed by the signage of Normandy Blvd. and Graves Ave. and the fully signalized entrances. Mr. Paradise explained shift changes will be done outside of peak hours like Amazon. The shift changes will ensure traffic would not be impacted. He spoke regarding the fair share calculations being 5.84 million to offset traffic impact, and explained most of the money would be used to improving roadways such as Veteran's Memorial Parkway and Kentucky Ave. The City would use a portion of this money to facilitate four (4) lanes on Normandy between Energy Ave. and Firwood Dr. Mr. Paradise stated the property is currently forested but has no floodplains or wetlands. He explained this development would be job-oriented and represents a continuation of job growth. He explained based on the substantial evidence jobs would be created in the City from Portland Industrial Park. He stated the jobs would have benefits and would benefit the City by being served by City utilities. He stated the development is consistent with the IPUD and the Comprehensive Plan. Member Pfeffer asked questions regarding job growth. Mr. Paradise explained the property is already zoned Industrial, but with the IPUD the tax base increases. The project would also extend utilities and facilities. He stated Portland Industrial Park is consistent with the Comprehensive Plan. Mr. Paradise stated there were two (2) alternatives given to the Board at the end of the Staff Report. He explained the rationale is provided in the Staff Report to either deny or approve the project. He stated City staff recommends the Planning and Zoning Board recommend City of Deltona Page 3 Printed on 9/7/2021 Planning and Zoning Board Minutes May 19, 2021 the City Commission approve Ordinance No. 02-2021, with the condition for the applicant to work with City Staff for the Conceptual Plans. Interim Chair Northey stated she would like to see the environmental study for the gopher tortoise and scrub jay habitats. Mr. Paradise explained an Environmental Study is performed during the land development process. Interim Vice Chair Berk asked about the properties surrounding the proposed project. Mr. Paradise explained the residential zoning to the south is Pine View Estates which is a paper Plat. He stated the area is in the Activity Center and the Future Land Use designation is Industrial. Member Pfeffer asked how the City plans to manage the project. Discussion between the Board and Mr. Paradise occurred on building height limits, fire safety, the Building Code, and future jobs for the City residents. Mr. Paradise explained once the rezone is accepted, the applicant would Plat the property to build roads and utilities. Before the applicant would submit the Plat Application, they would attend a pre-application meeting at the Development Review Committee (DRC). He stated there would be Site Plan Applications for each facility built to ensure all requirements are followed like parking, landscaping, etc., and the Plans would need to be signed off by DRC for approval. The applicant would not be able to pull a permit to build until the Site Plan was approved. Interim Chair Northey asked Mr. Paradise if Planning and Zoning Members were able to attend the DRC Meetings. Mr. Paradise explained the members could attend any time, and staff would send out the information to Board members. He reminded the Board members that attending a DRC Meeting would count as educational credits. Member Munoz spoke regarding the development process and regulations. City Attorney Segal-George explained how buildings are regulated. The applicant, Jason Moore with Kimley Horn Associates, thanked the staff for their hard work. He explained to the Board that the project is capped and spoke regarding the walls being concrete to allow various users. Discussion between the Board and Mr. Moore occurred regarding job fairs and traffic limits. Mr. Paradise noted the applicant would need to come in for an Amendment if they would like to change their intensity. Interim Chair Northey asked the Board to be notified when Portland Industrial Park comes to the DRC for their pre-application meeting. Discussion occurred regarding the taxes generated by industrial uses. City of Deltona Page 4 Printed on 9/7/2021 Planning and Zoning Board Minutes May 19, 2021 Motion by Ruben Munoz, seconded by Manuel Rodriguez, to recommend the City Commission approve Ordinance 02-2021, amending the official Zoning Map to rezone ±128.24 acres of land generally located on the east side of Normandy Blvd. and south of Graves Ave. from City of Deltona Industrial to Industrial Planned Unit Development with the condition the developer works with City Staff on the Conceptual Plan. The motion carried the following vote: For: 6 - Kennedy, Vice Chair Munoz, Chair Northey, Member Berk, Secretary Pfeffer and Alternate Rodriguez Acting Vice Chair Berk stated she voted for the rezone because it is consistent with the Comprehensive Plan and land use behavior. Member Kennedy voted for the rezone because it is consistent with the Comprehensive Plan and for the City to have more opportunities of growth. Member Munoz and Pfeffer voted for the rezone due to being consistent with the Comprehensive Plan. Acting Chairperson Northey stated she voted for the rezone because its important for economic development, it's consistent with the Comprehensive Plan and will bring benefits to the City that will increase the tax base. Member Rodriguez stated the rezone would bring progress and opportunities to the City. 8. STAFF COMMENTS: City Attorney Segal-George thanked the Planning and Zoning Board and stated the Election of Officers would happen next meeting. She asked if staff could send the Board members information to join the Development Review Committee meetings. 9. BOARD/COMMITTEE MEMBERS COMMENTS: Member Munoz asked if Board members were able to contact the Staff with questions, and City Attorney Segal-George stated staff is always available to help. 10.
