* In an effort to reduce the possibility of exposure of residents to the
COVID-19 (Coronavirus) we are allowing limited public access into the
Commission Chambers and practicing social distancing with the Planning
and Zoning Board Members, staff, and residents.
1. CALL TO ORDER:
The meeting was called to order at 6:08 pm.
2. ROLL CALL:

A. Election of Officers
Mr. Paradise called for nominations for Chairperson, Vice Chair and Secretary. Member
Berk nominated Member Northey for Chairperson. Member Munoz nominated himself for
Chair. Member Ms. Northey nominated herself for Chair. The motion carries by the following
vote:
For: 3 - Member Northey, Member Berk and Member Pfeffer
Against: 1 - Member Munoz
Chairperson Northey called for nominations for Vice-Chair. Member Munoz nominated
himself, the motion passed unanimously. Chairperson Northey called for nomination, for
Secretary. Chairperson Northey nominated Member Pfeffer for Secretary. With there being
no more nominations the motion passed unanimously.

3. APPROVAL OF MINUTES & AGENDA:
A. Minutes of May 19, 2021
Motion by Susan Berk, seconded by Ruben Munoz, to accept the
Minutes of May 19, 2021. The motion carried by the following vote:
For: 4 - Chair Northey, Vice Chair Munoz, Secretary Pfeffer and Member
Berk
4. PRESENTATIONS/AWARDS/REPORTS:
A. Presentation - General overview of Accessory Dwelling Units (ADUs) /
Granny Flats.
Mr. Paradise entered into the record that this topic will be presented at the next meeting.
5. PUBLIC FORUM: Time permitted, public comment shall be permitted at the end of
agenda items only and shall not exceed two minutes.
Chairperson Northey opened public forum. There being no one, public forum was closed.
6. OLD BUSINESS:
7. NEW BUSINESS:
A. RESOLUTION NO. 2021-36 - Project No. CU21-0001 - A request to amend
Resolution No. 2020-01 approved by the City Commission on March 16,
2020, for a Community Residential Home Conditional Use to provide a
wider range of client services.
Mr. Paradise stated Resolution No: 2021-36 is a request to amend a condition previously
approved for a community residential home located at 2001 Dalton Avenue. He explained a
community residential home is a facility that gives care for certain user groups like the
elderly or disabled and can be located within a single family dwelling unit as a conditional
use. Community Residential Homes cannot be within a 1000 feet of another community
residential home. They can serve no more than six (6) clients. The intent being to ensure
that these facilities are small scale, neighborhood oriented and integrated into the
community. This community residential home was approved with conditions by the City
Commission on March 16, 2020. The Applicant has requested to remove the condition
regarding minimal to moderately disabled adults. Member Munoz asked about the
remaining conditions. Mr. Paradise confirmed all other conditions remain the same.

Member Pfeffer inquired if the parking area and access is going to be adequate. Mr.
Paradise answered affirmative.
Motion by Member Munoz and seconded by Member Pfeffer, to
recommend approval, Resolution No. 2021-36, Project No. CU21-0001 -
A request to amend Resolution No. 2020-01 approved by the City
Commission on March 16, 2020, for a Community Residential Home
Conditional Use to provide a wider range of client services.
For: 4 - Vice Chair Munoz, Chair Northey, Member Berk and

B. RESOLUTION NO. 2021-35 - Project No. CU21-0002 - Request to allow a
conditional use to permit a daycare center within an R1-A, single family
district for property located at 988 Elkcam Boulevard.
Mr. Paradise provided a summary of the item. He noted the applicant is requesting to
repurpose the building which previously served as a place of worship with a daycare use.
He stated the following conditions must be fulfilled: obtain a new business tax receipt prior
to the relocation of the daycare facility from 875 Elkcam Boulevard to 988 Elkcam
Boulevard, connect to central sewer when service comes immediately available right at the
property, maintain 25 foot buffers naturally vegetated on the North, East and West sides of
the property, install shrubs, within the 25 foot landscape buffer along Elkcam Boulevard,
provide foundation landscape plantings along the front of the building facing the street or
parking area, and prior to Certificate of Occupancy the applicant will provide an appropriate
dumpster location and enclosure design consistent with the City of Deltona Land and
Development Code.
Member Pfeffer inquired as to the number of children already at the facility in use. Mr.
Paradise suggested that the Applicant be better at answering these types of questions. Will
the playground be required to fenced. Mr. Paradise replied yes the playground will be
required to be fenced as per Department of Children and Families. Member Berk asked is
there a requirement of how often the trash must be removed and if is there is a rodent
problem within the city associated with these dumpsters. Mr. Paradise stated that this is a
contract between the exclusive hauler Waste Pro and the City. Trash will be picked up and
discarded at least once a week. Mr. Paradise stated there is not a rodent problem within
the City. However, on occasion the city may get complaints of vermin associated with
various activities. Member Munoz inquired about traffic flow and appropriate parking
requirements. Mr. Paradise confirmed traffic will be managed and this daycare will require
children be walked to the door and not permitted to walk in the parking lot alone.
Chairperson Northey inquired if the buffer will remain as they are and was the existing sign
staying. Mr. Paradise stated the sign will be refaced.
Ms. Karen Nehr 988 Elkcam Boulevard, the applicant, confirmed currently the daycare is

servicing children between the ages of two (2) years old and four (4) years old totaling 102
children. This facility will facilitate the VPK only. It was confirmed that the daycare is open to
any member of the public not only members of the church.
Chairperson Northey opened public forum.
Jose Serralles 1041 Elkcam Boulevard inquired if the zoning will change. Mr. Paradise
stated the zoning will not change. Mr. Serralles also brought to the attention of staff his
concerns regarding the speed of drivers. Mr. Paradise stated that the City is putting in five
(5) foot wide paved shoulders on each side of that roadway, between Fort Smith Boulevard
and Sylvia Drive. This will allow for vehicles to keep moving.
Jazlyn Heywood 2250 Fillmore Avenue spoke regarding her concerns about traffic and the
landscape buffers.. Ms. Heywood also had concerns about traffic and the buffers. Mr.
Paradise stated the daycare is going to involve staggered drop offs/pick-ups, which will
smooth out noticeable traffic spikes. The buffer will be monitored by the City. If they want to
alter the buffer, they will need to notice surrounding properties and alter the conditional use
approval. If the applicant does not stay consistent with the conditions, the City Code
Compliance Division will become engaged. Member Berk asked what is the distance
between the old and new facility. Mr. Paradise confirmed it is over a half mile. Member
Munoz made comment regarding the traffic and driving patterns of and in Deltona.
Indicating that speed and carelessness is a concern within the city. Chairperson Northey
noted that on Debary Road near Debary Elementary there is signage which posts the
speed of motorists. Mr. Paradise noted speeding is an issue within the city.
Chairperson Northey closed the public forum.
Motion by Member Munoz seconded by Member Pfeffer, Resolution No.

8. STAFF COMMENTS:
Mr. Paradise noted that these items will be going before the City Commission on
September 20, 2021.

Mr. Pfeffer inquired what the duties of the Secretary are.
