CALL TO ORDER: The meeting was called to order at 6:00 pm. 2. APPROVAL OF MINUTES & AGENDA: A. Minutes of April 19, 2023 Motion by Member Rodriguez, seconded by Member Sixma, to approve the Minutes of April 19, 2023, as presented. The motion carried unanimously. 4. PRESENTATIONS/AWARDS/REPORTS: None. 5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the agenda and shall not exceed four minutes. Please be courteous and respectful of the views of others. Personal attacks on Committee/Board members, City staff or members of the public are not allowed and will be ruled out of order by the Chair. Chair Alexander opened and closed public forum as there was none. 6. OLD BUSINESS: City of Deltona Page 1 Printed on 8/8/2023 Planning and Zoning Board Minutes July 19, 2023 None. 7. NEW BUSINESS: A. Ordinance No. 09-2023- Amending the official Zoning Map to Rezone an approximately 1.37 - acre parcel of land located at 3150 Howland Boulevard from Professional Business Zoning District (PB) to the City of Deltona Retail Commercial District (C-1). City Attorney Segal-George explained the process for the quasi-judicial hearing to the Board. Chair Alexander turned the meeting over to City Attorney Segal-George to swear in anyone with standing, along with the applicant and staff wanting to speak regarding the project. City Attorney Segal-George turned the meeting back over to Chair Alexander for ex-parte communication. Member Rodriguez, Member Pfeffer, Member Sixma, Secretary Amoroso, and Chair Alexander stated they did not have any ex-parte communication regarding the project. Member Gonzalez and Vice Chair Berk stated they did a site visit. Ms. Merced gave a presentation regarding Ordinance No. 09-2023. She explained this is a rezone of 3150 Howland Boulevard from Professional Business (PB) to Retail Commercial (C-1). She stated the property is surrounded by developed properties. She presented the Board with the maps, explaining the current zoning and proposed zoning. She spoke regarding the matters of consideration. She stated staff recommends the Planning and Zoning Board recommend the City Commission approve Ordinance No. 09-2023. Discussion occurred regarding the different uses allowed in PB and C-1 zoning. Mr. Ruiz explained the exact location of this project and surrounding areas. Member Gonzalez asked if the applicant or staff knew what fast-food restaurant was going into 3150 Howland Blvd. Mr. Holden, Quigg Engineering, explained the owner is still talking to different restaurants, but they would need to rezone it before someone would finalize coming in. Discussion occurred in reference to the commercial zoning in this area and traffic. Member Sixma explained the C-1 zoning is consistent with everything surrounding the property. Mr. Ruiz explained that the future land use is a vision for the future, and explained the matrix City of Deltona Page 2 Printed on 8/8/2023 Planning and Zoning Board Minutes July 19, 2023 in the Land Development Code in which staff uses to know what could be built. Mr. Holden thanked staff for their presentation. He explained trying to get a restaurant without having it zoned correctly is why there is not someone lined up yet. He explained the north side of the property has a power easement, therefore no trees would be removed and it would remain a natural buffer. He stated all properties within this section would be zoned C-1, except the church next door which would remain PB. Discussion occurred regarding the cross access agreement. Member Pfeffer stated they would like to control what the City is going to look like in the future. He expressed concerns regarding the traffic study and traffic on Howland Blvd. Member Sixma explained Howland Boulevard will eventually be as busy as Saxon Boulevard in Orange City. He stated it is not the Board's job to say what restaurant can go in a location, but to make sure it is compatible with the area. Motion by Member Sixma, seconded by Vice Chair Berk, to recommend the City Commission approve Ordinance No. 09-2023- amending the official Zoning Map to Rezone an approximately 1.37 - acre parcel of land located at 3150 Howland Boulevard from Professional Business Zoning District (PB) to the City of Deltona Retail Commercial District (C-1). The motion carried by the following vote: For: 5 - Member Alexander, Member Berk, Member Amoroso, Member Gonzalez and Member Sixma Against: 2 - Member Pfeffer and Member Rodriguez Member Gonzalez explained he has concerns and would like to see less of the fast food restaurants in the City. He stated he was voting yes because he would like to see commercial growth within the City. Member Pfeffer stated he voted no because they are zoning each parcel individually, and would like to do it in sections. Secretary Amoroso stated she voted yes because she would like to see a restaurant there. Vice Chair Berk explained she voted yes because it is consistent with the Comprehensive Plan and would like to see commercial in this area. She stated there would not impact to the environment and it would have a positive impact on the economy. She believes transportation is an issue, but hopes the City and Volusia County will work on this. Member Sixma stated he voted yes because it is compatible and consistent with the area. Member Rodriguez stated he voted against this because although the owner has a right to put anything on their property, he does not believe there is proper access to this. Chair Alexander stated he believes it is consistent with the future plan for the City. 8. STAFF COMMENTS: Mr. Ruiz introduced Ms. Kerr and Mr. Knight as new employees for the Planning and Development Department. 9. BOARD/COMMITTEE MEMBERS COMMENTS: Member Sixma stated he was happy that this parcel is bigger than the normal ones zoned C-1 in the City. Member Rodriguez explained he is not a planner, but he believes the C-1 classification is too broad in what is allowed. He expressed concerns regarding rezoning properties to C-1 because they will not know what is going there. Member Sixma asked if each member would visit the site before the meeting. 10.
