CALL TO ORDER: The meeting was called to order at 6:00 p.m. 2. ROLL CALL: Present: 8 - Chair Eric Alexander Vice Chair Susan Berk Secretary Rachel Amoroso Member Ron Gonzalez Member Dr. Allen Pfeffer Member Stony Sixma Alternate Andrea Cardo Alternate Adam Vazquez Excused: 2 - Member Manuel Rodriguez Alternate Tara D'Errico Absent: 1 - Alternate Steven Webster 3. APPROVAL OF MINUTES & AGENDA: A. Minutes of July 19, 2023 Motion by Member Sixma, seconded by Alternate Member Vazquez, to approve the Minutes of July 19, 2023 as presented. The motion carried unanimously. 4. PRESENTATIONS/AWARDS/REPORTS: A. Sunshine Presentation City Attorney Segal-George spoke regarding Sunshine Laws in Florida. She explained the importance of adhering to these laws in regards to quasi-judicial matters, what that means in the context of Planning and Zoning Board Meetings, alternate member participation, and the extension of these laws into online forums. She explained there are online courses available for further education and stated she would be happy to answer any questions pertaining to this. Discussion continued regarding wetlands and members visiting the sites on their own. City Attorney Segal-George explained site visit can be allowable, as they ask for ex-parte communication prior to discussion. She suggested that if a member notices something of concern, the City would be able to assist. Member Pfeffer stated that an official site visit meeting could allow for neighbors to voice concerns. Mr. Ruiz offered that member can reach out to planning staff for more information, and if they have any questions regarding agenda items. 5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the agenda and shall not exceed two minutes. Please be courteous and respectful of the views of others. Personal attacks on Committee/Board members, City staff or members of the public are not allowed and will be ruled out of order by the Chair. Chair Alexander opened and closed the public forum as there was none. 6. OLD BUSINESS: None. 7. NEW BUSINESS: A. Ordinance No. 10- 2023- Amending section 110-806, "Fences, Walls and Hedges", of article VIII, "Supplementary Regulations", of Chapter 110 "Zoning", of the Land Development Code of the City of Deltona. Mr. Ruiz introduced the Ordinance and explained the history of the City's Land Development Code. He stated the dates of previous Ordinances adopted in regards to fences, walls, and hedges. He explained to the public input that occurred at the City Commission workshop on May 8, 2023. Chair Alexander asked Mr. Ruiz to highlight the recommended changes. Mr. Ruiz stated the agenda packet contains the revisions, as it may be easier to refer to the written revisions directly. Vice Chair Berk asked questions regarding the visibility triangle on corner lots. Mr. Ruiz described where the visibility triangle would be in relation to the right -of- way and property boundary. He explained the visibility triangle helps to prevent obstruction of those at the intersection. Motion by Secretary Amoroso, seconded by Member Sixma, to approve Ordinance No. 10- 2023- Amending section 110-806, "Fences, Walls and Hedges", of article VIII, "Supplementary Regulations", of Chapter 110 "Zoning", of the Land Development Code of the City of Deltona. Alternate Member Vazquez asked how approving this would affect existing walls that would not be in compliance with the updated Ordinance. Mr. Ruiz stated it would be a code violation unless the property is in a PUD because it would have special conditions. Discussion occurred regarding the visibility triangle and having an illustration added for clarification. Chair Alexander opened and closed public comment as there was none. Member Pfeffer asked for the motion to include an amendment for a visibility triangle illustration and Alternate Member Vazquez agreed. Motion by Secretary Amoroso, seconded by Alternate Member Vazquez, to approve Ordinance No. 10- 2023- Amending section 110-806, "Fences, Walls and Hedges", of article VIII, "Supplementary Regulations", of Chapter 110 "Zoning", of the Land Development Code of the City of Deltona with the condition that the visibility triangle illustration be added. The motion carried by the following vote: For: 7 - Chair Alexander, Vice Chair Berk, Secretary Amoroso, Member Gonzalez, Member Pfeffer, Member Sixma and Alternate Vazquez 8. STAFF COMMENTS: Mr. Ruiz announced to the Board that this was his last Planning and Zoning Board meeting. Member Sixma and Chair Alexander thanked him for his service with the City. 9. BOARD/COMMITTEE MEMBERS COMMENTS: None. 10.
