City of Deltona 2345 Providence Blvd. Deltona, FL 32725 Minutes Planning and Zoning Board Wednesday, September 20, 2023 6:00 PM Deltona Commission Chambers 1. CALL TO ORDER: The meeting was called to order at 6:00 pm. 2. ROLL CALL: Also Present: Dinelia Santana, Jessica Entwistle, Jonathan Knight and Kaitlyn Apgar with Planning and Development Services. Present: 8 - Chair Eric Alexander Secretary Rachel Amoroso Member Ron Gonzalez Member Dr. Allen Pfeffer Member Stony Sixma Alternate Andrea Cardo Alternate Tara D'Errico Alternate Adam Vazquez Excused: 2 - Vice Chair Susan Berk Member Manuel Rodriguez Absent: 1 - Alternate Steven Webster 3. APPROVAL OF MINUTES & AGENDA: A. Minutes of August 16, 2023 Motion by Member Sixma, second by Member Gonzalez to approve the Minutes of August 16, 2023, as presented. The motion carried unanimously. 4. PRESENTATIONS/AWARDS/REPORTS: None. 5. PUBLIC FORUM: Time permitted, public comments shall be limited to items on the agenda and shall not exceed two minutes. Please be courteous and respectful of the views of others. Personal attacks on Committee/Board members, City staff or members of the public are not allowed and will be ruled out of order by the Chair. NEW BUSINESS: B. Resolution No. 2023-50- A Resolution of City Of Deltona, Florida; Granting a Conditional Use to allow a private school to operate at an existing church building for a property located at 600 Fort Smith Boulevard within an R1, Single- Family Residential Zoning District; Providing Conditions, Conflicts, Severability, and an Effective date. Mr. Knight introduced himself and spoke regarding Resolution 2023- 50. He explained the Conditional Use is to allow a private school. Discussion occurred regarding traffic, buffers, and the lack of a playground. Discussion continued regarding specialized learning and hours of operation. Ms. Lively, explained the dumpster location is waiting on Waste Pro's determination. She discussed the benefits of specialized learning and stated a playground will happen in the future, when funding is available. Discussion occurred regarding Ms. Lively renting the space. She explained the church may expand in the future. Chair Alexander consulted with Attorney George-Segal regarding the liability with the Board's decisions due to Member Pfeffer's concerns on enclosing the dense landscape behind the building. Ms. Lively clarified that they are not a special education school, but they have the tools to provide any type of school setting needed. Motion by Member Stony Sixma, seconded by Member Ron Gonzalez, to recommend City Commission to approve Resolution No. 2023-50, granting a Conditional Use to allow a private school to operate at an existing church building for a property located at 600 Fort Smith Boulevard within an R1, Single- Family Residential Zoning District with the condition stated. Resolution No. 2023-39 Granting a Variance to waive the minimum lot size requirement on an existing 100-foot wide lot with an area 0f 0.92 acres within the RE-1, Residential Estate One Zoning District located at 728 Riggs Avenue. Ms. Apgar spoke regarding Resolution 2023-39, she explained the need of a Variance and current zoning of RE-1, which has a one (1) acre minimum lot requirement. The property of discussion is 0.92 acres. Discussion occurred regarding the zoning, flood maps, and background of the property. Mr. Norton explained that he was planning on building a home, but due to the market he was unable. He has someone interested in buying the lot to build a house. Ruth Hall, 358 Pervis Lane, stated she's concerned about the lot not meeting all requirements. She explained she did the research for her property and this owner did not. Discussions occurred regarding the owner purchasing the property three (3) years ago. The Board questioned if the applicant was aware that it was unbuildable. Mr. Norton informed the Board that he received setbacks information from the City of Deltona, but nothing was mentioned at that time. Ruth Hall was asked to return to the podium by Chair Alexander to address water elevation questions by the Board. Ms. Hall explained the water elevation when it storms in their area. Attorney George-Segal explained water elevation is not relevant towards the Variance. John Hengehold, 310 Pervis Lane, stated his concerns regarding the size of the lot. Mr. Norton stated the property can accommodate the wells and water sources, while still meeting all requirements. Discussion occurred regarding the route of a Variance versus a Rezone application. Attorney George-Segal explained any questions being answered by the public has to be answered at the podium for the record. Chair Alexander asked the public how the Variance will impact the neighboring properties, stating this should not infringe on them in anyway. Leslie Robertson, 730 Riggs Avenue, stated her concern if a house is built on the lot, it would be very close to her home. Motion by Secretary Rachel Amoroso, seconded by Member Stony Sixma, recommend the City Commission approve the Resolution No. City of Deltona Page 3 Printed on 10/17/2023 Planning and Zoning Board Minutes September 20, 2023 2023-39 for a Variance to waive the minimum lot size requirement on an existing 100-foot wide lot with an area of 0.92 acres within the RE-1, Residential Estate One Zoning District located at 728 Riggs Avenue. The motion carried by the following vote: For: 4 - Secretary Amoroso, Member Gonzalez, Member Sixma and Alternate Cardo Against: 3 - Chair Alexander, Member Pfeffer and Alternate D'Errico 8.
