CALL TO ORDER: The meeting was called to order at 5:30 p.m. by Mayor Herzberg. 2. ROLL CALL – CITY CLERK: Present: 6 - Mayor Herzberg Commissioner Bradford Commissioner King Commissioner McCool Commissioner Ramos Commissioner Sosa Absent: 1 - Vice Mayor Avila-Vazquez 3. PLEDGE TO THE FLAG: 4. BUSINESS: A. Public Hearing - Ordinance No. 16-2022, pursuant to Sections 101.161 and 166.031, Florida Statutes, proposed Charter amendments to be submitted as a referendum at the General Election - Stacey Kifolo, Deputy City Manager (386) 878-8852. Strategic Goal: Effective Governance and Productive Government The Acting City Manager stated this was a request from Commissioner McCool and there was a consensus to move forward with the ordinance. The proposal has mileage outside the City boundary, this is first reading and it will go on the November ballot. The Commission discussed several distances, emergency concerns, starting point, and including "in-house" City Attorney. After discussion, the Commission concurred that in the last sentence in Section 7. Charter Officers. (3) CITY ATTORNEY; QUALIFICATIONS; POWERS AND DUTIES to include the words ..."in-house" City Attorney. Terry Ellis, Deltona, spoke about including Volusia County and then something beyond. Richard Bellach, Deltona, spoke about voting history, attendance, division and the right thing. Elbert Bryan, Deltona, spoke about voting history, including Volusia County, majority vote, paid expenses, and a "professional" manager, Mayor Herzberg closed public comments. The Commission discussed Charter Officer requirements, archaic thinking, distances, contract/benefits, voting history, salary, 2008 Charter Review Committee, political in fighting, and talent pool. Motion by Commissioner McCool, to approve Ordinance No. 16-2022 at first reading and to schedule second and final reading for August 15, 2022 with verbiage to state residency requirement includes Volusia County and/or 25 miles outside the City boundaries of Deltona. The motion died for lack of a second. The Commission and Acting City Manager discussed the distance. Mayor Herzberg called a recess at 6:15 p.m. and reconvened at 6:23 p.m. Motion by Commissioner McCool, seconded by Commissioner Ramos, to approve Ordinance No. 16-2022 at first reading and to schedule second and final reading for August 15, 2022. Verbiage in the motion should state that the City Manager or the in-house City Attorney should reside within Volusia County or within 25 miles of City boundaries. The Commission and Deputy City Manager discussed adding language "within the City". City Attorney Skip Fowler read the title of Ordinance No. 16-2022 for the record. The motion carried by the following vote: For: 5 - Mayor Herzberg, Commissioner King, Commissioner McCool, Commissioner Ramos, and Commissioner Sosa Against: 1 - Commissioner Bradford B. Resolution No. 2022-31 to Request a fiscal year 2022-2023 Contract with the City of Deltona from Sheriff Chitwood. John Peters, Acting City Manager (386) 878-8850. City of Deltona Page 2 Printed on 8/9/2022 Special City Commission Meeting Minutes August 8, 2022 Strategic Goal: Fiscal The Acting City Manager discussed a meeting with VSO (Volusia Sheriff's Office) who expressed interest in revisiting the method of reallocating VSO costs between the county and the contracted four cities. The county proposed method 3, but the Sheriff is in agreement with staff that method 6 is more fair and equitable. The Sheriff is allowed to enter into his own contract with municipalities separate from the county and the county has the right to appeal. The County Manager thought the four cities would be meeting to discuss moving forward and he expects that those discussions will still happen, but the resolution says this is the City's preferred method going forward and a starting point for any negotiations. The Commission and Acting City Manager discussed VSO budget and contract, $2 million overpayment, Exhibit B, offsetting costs, and no reimbursement. Mayor Herzberg opened and closed the public comments as there were none. Motion by Commissioner Bradford, seconded by Commissioner King, to approved Resolution 2022-31 to Request a fiscal year 2022-2023 Contract with the City of Deltona and Sheriff Chitwood. The motion carried by the following vote: For: 6 - Mayor Herzberg, Commissioner Bradford, Commissioner King, Commissioner McCool, Commissioner Ramos, and Commissioner Sosa 5. CITY MANAGER COMMENTS: The Acting City Manager stated staff has completed the draft rental ordinance which will come before the Commission at a workshop to go over it so the Commission is comfortable with it. 6.
