CALL TO ORDER: The meeting was called to order at 5:00 p.m. by Mayor Herzberg. 2. ROLL CALL – CITY CLERK: Present: 7 - Commissioner McCool Commissioner Ramos Mayor Herzberg Vice Mayor Avila-Vazquez Commissioner Bradford Commissioner King Commissioner Sosa 3. PLEDGE TO THE FLAG: 4. BUSINESS: ADD-ON ITEM: Update on Hurricane Ian. Mayor Herzberg stated there will be a fourth item added to the agenda and after discussion of all the items there will be a 15 minutes break so staff can set-up for the next meeting. Fire Chief Snyder gave a brief update on Hurricane Ian to include speed, location, sustained winds, track, forecast, time frame, wind field, creation of tornados, shelters and school closings, and State of Emergencies. The Commission and Fire Chief discussed schools and shelters, and special needs. The Interim City Manager read the emergency Ordinance filling in the blanks as necessary which will be completed by the City Clerk's Office before being signed. Motion by Commissioner Bradford, seconded by Vice Mayor Avila-Vazquez, to declare a State of Local Emergency effective immediately per the emergency Ordinance No. 23-2022. City of Deltona Page 1 Printed on 10/17/2022 Special City Commission Meeting Minutes September 26, 2022 Mayor Herzberg asked if with regards to the curfew the City could follow what is being done by the Volusia Sheriff's Office and the Commission concurred. Mayor Herzberg stated in regards to the amount of rainfall that Fire Chief Snyder put "up to 7 inches of rain" or whatever he is comfortable with. Commissioner King called for the vote. The motion carried by the following vote: For: 4 - Commissioner Ramos, Mayor Herzberg, Vice Mayor Avila-Vazquez, and Commissioner Bradford Against: 3 - Commissioner McCool, Commissioner King, and Commissioner Sosa A. Discussion re: Lawsuit settlement - Skip Fowler, City Attorney (386) 878-8872. Strategic Goal: Effective Governance and Productive Government The City Attorney stated he need approval from the Commission that is consistent, presumably, with the vote at the shade meeting. The agreement has been executed by Mr. Adams and the statutory time in which he has to change his mind because he is over the age of 40 has expired. So all he needs is the Commission's approval and the Mayor's signature. Commissioner McCool, Commissioner Bradford and Vice Mayor Avila-Vazquez provided their reasons for their vote. The Commission discussed documentation, lawsuits, legal recommendation, shade meeting, and public records. Motion by Commissioner Bradford, seconded by Vice Mayor Avila-Vazquez, to accept the settlement and allow the Mayor to execute the documents to finalize the lawsuit. Approval of budgeted purchases for FY22-23 - Mari Leisen, Finance Director Strategic Goal: Maintain current fiscal stability maximize alternative funding sources, and promote an effective system of checks and balances. Finance Director Mari Leisen explained she added four columns to reference the line item that each purchase order is budgeted through and the budgeted funds. The Commission and staff discussed "as needed" items, blanket purchase orders, and amendments. Motion by Commissioner Bradford, seconded by Commissioner Ramos, to approve the list of purchase orders for fiscal year 2022-2023. The motion carried by the following: For: 7 - Commissioner McCool, Commissioner Ramos, Mayor Herzberg, Vice Mayor Avila-Vazquez, Commissioner Bradford, Commissioner King, and Commissioner Sosa C. Discussion on Interim City Manager. Commissioner Bradford asked what the process is for an Interim City Manager moving forward and she that she received a resume from Jim Chisholm. The Commission discussed Interim City Manager Segal-Georges compensation and the legality of a City Attorney holding the Interim City Manager position. Mayor Herzberg opened public comments. Kathy Bryan, Deltona, spoke about the City Manager search, Mr. Chisholm, Mr. Peters, lawsuits, insurance premiums, the budget, Charter amendment, air time and social media. Jody Lee Storozuk, Deltona, spoke about the City Manager search, the election, communication and information, Union negotiations, dead weight, and hiring. Brandy White, Deltona, spoke about compensation, P&Z Meeting, and Mr. Chisholm. Tara D'Errico, Deltona, spoke about separation of duties, being proactive, long and short term needs, staff development, and business models. Richard Bellach, Deltona, spoke about Mr. Peters, an article, needing fighters, corruption, Mr. O'Grady's contract, recycling politicians, Mr. Chisholm, the election, conflict of interest, and compensation. Elbert Bryan, Deltona, spoke about previous mangers, lawsuits, head hunter search, Mr. Chisholm, and bad press. City of Deltona Page 3 Printed on 10/17/2022 Special City Commission Meeting Minutes September 26, 2022 Santiago Avila, Jr., Deltona, spoke about City Manager search, elected officials, Charter violations, attendance, and financials. Mayor Herzberg closed public comments. The Commission and Interim City Manager discussed future decisions, Mr. Peters' contract, Mr. Denny, Request For Proposal (RFP), Union negotiations, City Manager search, potential City Manager, the process, Range Riders, professional and management experience, growth, Charter amendment and advertising. Mayor Herzberg suggested to contact the previously selected search firms and get updated pricing and the Commission concurred. The Commission discussed the search process and Range Riders. The Interim City Manager stated she will contact the Range Riders, provide them the time line, and that the City is looking for an Interim City Manager which could be as long as six (6) months. Then she will ask for resumes which will be distributed to the Commission. Then she will setup public interviews as quickly as possible and the Commission can make a decision and the Commission concurred. Mayor Herzberg gave a brief overview of the items discussed. The Commission continued to discuss the previous search firms, Mr. Peters' contract, minutes, liability, union negotiations, shade meeting, closure and Mr. Denny. The Interim City Manager stated that she and the City Attorney met with Mr. Peters last week who notified them he had hired a lawyer and the City should expect communication with regards to his issues. 5.
