EXECUTIVE SESSION
1. CALL TO ORDER:
The meeting was called to order at 3:59 p.m. by Mayor Avila.
2. ROLL CALL – CITY CLERK:
Also in attendance was Attorney Dale Scott with Roper, P.A.

3. PLEDGE TO THE FLAG:
4. BUSINESS:
A. Discussion re: Lawsuit Settlement.
i. Mayor announces the commencement of the Executive Session with
an estimated length of up to an hour.
Mayor Avila stated the topic for discussion is a Class Action lawsuit and he announced the
commencement of the Executive Session with an estimated length of time not to exceed one and
a half hours (1 1/2 Hours).
ii. Mayor announces the names of each Commissioner in attendance,
the City Manager James V. Chisholm, City Attorney Marsha
Segal-George, Deputy City Manager Rick Karl, Attorney Dale Scott with
Roper, P.A., Public Works/Deltona Water Director Glenn Whitcomb, and
Deputy Public Works Director Phyllis Wallace.

Mayor Avila announced that each Commissioner was in attendance along with the City Manager,
City Attorney, and Attorney Dale Scott with Roper, P.A.
iii. Mayor closes the session to the public.
Mayor Avila closed the Executive Session to the public at 4:02 p.m. and he asked that anyone's
name he did not call to exit the room at this time.
iv. Discussion of Class Action lawsuit.
v. Mayor announces the termination of the Executive Session.
vi. Mayor reopens meeting and adjourns.
Mayor Avila reopened the meeting to the public at 4:58 p.m.

There being no further business, the meeting adjourned at 4:58 p.m.

6. ADJOURNMENT:
NOTE: If any person decides to appeal any decision made by the City Commission
with respect to any matter considered at this meeting or hearing, he/she will need
a record of the proceedings, and for such purpose he/she may need to ensure that
a verbatim record of the proceedings is made, which record includes the testimony
and evidence upon which the appeal is to be based (F.S. 286.0105).
Individuals with disabilities needing assistance to participate in any of these
proceedings should contact the City Manager in writing at
CityManager@deltonafl.gov or to Deltona City Hall, 2345 Providence Blvd.,
Deltona, FL 32725 at least 48 hours prior to the meeting at which the person
wishes to attend. The City is not permitted to provide the use of human physical
assistance to physically handicapped persons in lieu of the construction or use of
ramps or other mechanical devices in order to comply with Florida law. If proper
accommodations for handicapped access cannot be made at a particular public
meeting venue pursuant to a timely written request under Section 286.26 F.S., the
City Manager shall change the venue of that meeting to a location where those
accommodations can be provided.
