BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING FEBRUARY 18, 2014 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, February 18, 2014 with the following members present: Mayor Pro tem Hamp Baxley in the absence of Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson and Taylor Barbaree. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Pro tem Baxley called the meeting to order. He wished the Mayor, as well as those traveling with him, a safe and productive trip to China. Pastor Lyle Peluso, Dothan Vineyard Church, then led in prayer, afterwhich Mayor Pro tem Baxley led in the Pledge of Allegiance to the Flag. Commissioner Barbaree moved that the Minutes of the Meeting of February 4, 2014, be approved, motion seconded by Commissioner Ferguson and unanimously approved. Commissioner Barbaree presented and read a proclamation, proclaiming February 20, 2014 as “Arbor Day” in the City of Dothan. Dan Williams, Horticulturist, City of Dothan, was present for the proclamation. Commissioner Ferguson presented and read a proclamation, proclaiming February, 2014 as “Healthy Marriage Month.” Laura Stakelum, Healthy You, Inc., was present for the proclamation. Commissioner Kirkland presented and read a proclamation, proclaiming February 20-23, 2014 as “Fashion Week Dothan” in the City of Dothan. Vanessa Riley Harris, Ladie Vee’s Etiquette and Consulting, was present for the proclamation. Commissioner Ferguson acknowledged the original scope of the Howell School project has changed and asked if any action is required on the Commission’s behalf. City Manager West advised no action is required at this time. Commissioner Barbaree said several constituents contacted him yesterday to express gratitude to the Police Department for the good work they do. He acknowledged January was a very busy month and thanked Chief Greg Benton, Department Heads and staff for the job they do each and every day. Mayor Pro tem Baxley thanked Mayor Schmitz for all he is doing to help bring jobs and economic opportunity to this community. He said we have a gem in a mayor. Mayor Pro tem Baxley gave a special thanks to Commissioner Dorsey for hosting the “Health Day” event on Saturday, February 8th at Andrew Belle Community Center. He applauded Commissioner Dorsey for his efforts in providing this type of opportunity and outreach in his community. City Manager West, along with Chief Larry Williams, presented a service award to Ron Durham, for twenty-five years of service with the City. City Manager West, along with Public Works Director Jerry Corbin, presented a service award to Assistant Public Works Director Charles Metzger, for thirty years of service with the City. Glynis Gordon-Williams, representative of the Employer Support of the Guard & Reserve (ESGR) organization, presented a “Patriotic Employer” award to Chief Benton, who was nominated by Army Reserve member Michael Conner. Minutes of the Board of Commissioners – February 18, 2014, continued. City Manager West said the Wiregrass Museum of Art would like to postpone their presentation until a later date. City Manager West announced the Alabama High School Athletic Association’s Southern Regional Basketball Tournament began today and will run through Saturday, February 22nd in the Civic Center arena. Public Works Director Jerry Corbin provided an update on the South Saint Andrews resurfacing project. He anticipated the sewer work to be completed this week and said staff will then coordinate with the contractor to begin the resurfacing. City Manager West announced the presentation of checks from the Downtown Hoops Classic was recently held. He said a total of $48,000.00 was raised during the tournament for the sixteen participating teams. City Manager West announced the public hearing regarding the 2014 Community Development Block Grant competitive process will be held on Thursday, February 20th at 6:00 p.m. at First Missionary Baptist Church. City Manager West thanked everyone for their thoughts and prayers while he was out recovering from knee surgery. He expressed gratitude to those who stepped up during the winter storm event to make sure everything was handled properly, specifically Mr. Corbin who served as Acting City Manager during this time. Mayor Pro tem Baxley introduced Ordinance No. 2014-36 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by David Dennis located at 131 East Selma Street from R-4 District to L-I District. Commissioner Barbaree moved for immediate consideration, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Baxley, Dorsey, Newsome, Kirkland, Ferguson and Barbaree; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Ferguson then moved for adoption of Ordinance No. 2014-36, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Baxley, Dorsey, Newsome, Kirkland, Ferguson and Barbaree; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Pro tem Baxley introduced Resolution No. 2014-37 (recorded in Ordinance Book No._______at Page_______), amending the 2012 subrecipient agreement with DDRA for the purpose of increasing the budget for the Façade Improvement Program by $14,633.00. Commissioner Newsome moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. City Manager West clarified this money was budgeted for this purpose in 2008. Mayor Pro tem Baxley introduced Resolution No. 2014-38 (recorded in Ordinance Book No._______at Page_______), applying for a 100% reimbursable grant from the Alabama Department of Environmental Management – Alabama Recycling Fund in the amount of $300,000.00 to be used for the expansion and improvement of the city’s recycling program. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Pro tem Baxley introduced Resolution No. 2014-39 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract and issuing a Notice to Proceed to Saliba Construction Company, Inc. for the Westgate Recreation Center HVAC and Locker Room Renovations Project in the amount of $498,350.00 for the Base Bid and Alternates 3 and 4. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Pro tem Baxley introduced Resolution No. 2014-40 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Dick’s Sporting Goods for the sponsorship of Dothan Youth City Baseball/Softball for a one-year period. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Minutes of the Board of Commissioners – February 18, 2014, continued. Mayor Pro tem Baxley introduced Resolution No. 2014-41 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Dell TechDirect to allow Information Technology (IT) staff to perform “break/fix” hardware repair service for qualified Dell Products. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. City Manager West pointed out there is no cost associated with this agreement. Mayor Pro tem Baxley introduced Resolution No. 2014-42 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of January, 2014 in the amount of $12,803,394.02. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Pro tem Baxley introduced Resolution No. 2014-43 (recorded in Ordinance Book No._______at Page_______), re-appointing Shari Ezzell as a member of the Wiregrass Museum Board to serve a four year term beginning October 7, 2013 and expiring on October 6, 2017. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Pro tem Baxley introduced Resolution No. 2014-44 (recorded in Ordinance Book No. _______at Page_______), awarding the following bids and approving other purchases over $15,000.00 by the City.
