BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING MARCH 4, 2014 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, March 4, 2014 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Taylor Barbaree and Hamp Baxley. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Kenneth Robinson, Alabama Avenue Missionary Baptist Church, read a letter on behalf of his church commending the Police Department and Commissioner Dorsey for the efforts and work accomplished in their neighborhood. He then led in prayer, afterwhich Commissioner Dorsey led in the Pledge of Allegiance to the Flag. Commissioner Baxley moved that the Minutes of the Meeting of February 18, 2014, be approved, motion seconded by Commissioner Barbaree and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming March, 2014 as “Wiregrass Museum of Art-Youth Art Month.” Wiregrass Museum of Art’s Executive Director Joe Sette and Board President Scott Parsons, along with merit award winning students showcasing their works of art, were present for the proclamation. Mr. Parsons then provided an update on the Wiregrass Museum of Art. He said the Museum experienced significant improvements over the course of the past year in several measurable areas to include increased attendance, membership growth and numerous community outreach programs offered. On behalf of the Museum’s Board of Trustees, he recognized the staff and volunteers for the accomplishments made through their hard work and dedication. He thanked the City of Dothan for their partnership as they continue to work to make a difference in the community in 2014. Commissioner Dorsey announced a “Unity in the Community” event to take place on Saturday, March 8th from 12:00 p.m. until 3:00 p.m. in the neighborhood of Lakeview on Lennox Avenue and invited everyone to attend. Mayor Schmitz thanked Mr. Bob Woodall, who was present in the audience, for his commitment and participation in the recent economic development trip to China. City Manager West announced the City is hosting the USTA Southern Sectional Tennis Tournament on March 6th – 8th and the event will bring in 1,100 people from over nine states. City Manager West announced opening ceremonies will be held on March 14th for the Dothan National League and on March 15th for the Miracle League. City Manager West reminded everyone that Daylight Savings Time begins this weekend and relayed the Fire Department’s recommendation to change the batteries in your smoke detectors at this time. Mayor Schmitz introduced the application of Jansen Tidmore for a Special Retail Liquor License-More than 30 days (on premises) for Cheers Refreshment Services 2, located at 170 North Foster Street. Commissioner Barbaree moved for approval, motion seconded by Commissioner Baxley and unanimously carried. Minutes of the Board of Commissioners – March 4, 2014, continued. Mayor Schmitz introduced the application of Leobardo Gallegos for a Restaurant Retail Liquor License (on premises) for Rodeo Mexican Restaurant, located at 3251 Montgomery Highway. Commissioner Barbaree moved for approval, motion seconded by Commissioner Baxley and unanimously carried. Mayor Schmitz announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. Ms. Gloria Richter spoke regarding an ongoing issue with an overgrown lot and vacant house located at the corner of Dusy Street and Selma Street. She said she recently cut the weeds back in order for motorists to be able to see clearly at the intersection. She expressed appreciation to her Commissioner for his attention to this matter and what he has tried to do for her community. Commissioner Ferguson said he will stay on top of this issue. Commissioner Newsome said he has called several times about this area and has visited the site on numerous occasions. He requested that the lot be cleaned and kept clean. There being no further comments, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz announced a Public Hearing regarding the demolition and removal of unsafe structures. There being no one present to speak, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Ordinance No. 2014-46 (recorded in Ordinance Book No._______at Page_______), amending Chapter 6, Alcoholic Beverages of the Code of Ordinances by adding Article III, Entertainment Districts. Commissioner Barbaree moved for immediate consideration, motion seconded by Commissioner Baxley and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Barbaree and Baxley; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Barbaree then moved for adoption, motion seconded by Commissioner Baxley. Mr. Powell Brewton said the City has had two major changes in the past few years pertaining to alcoholic beverage regulations. Mr. Brewton said the Commission’s consideration of this request goes further than the previous two. He spoke of the negative effects of drug and alcohol abuse on families and said making alcohol more easily accessible may make matters even worse. He said he does not want his grandchildren to be faced with open consumption while enjoying a visit to a public fest in downtown Dothan. He said he was one of the organizing directors of The Downtown Group and is very disappointed to learn the organization is one of the supporters of this change. He requested the Commission not pass this measure. Commissioner Ferguson said he appreciates all The Downtown Group and the Dothan Downtown Redevelopment Authority does for downtown but he respectfully disagrees on this issue. He said he has seen a lot of growth downtown over the last nine years primarily resulting from public and private partnerships. He explained he is not convinced this ordinance will be a positive change and he expressed a concern for safety. He said he has been in contact with fourteen people in opposition and four people in support of this ordinance. For these reasons, Commissioner Ferguson said he cannot support this measure. Commissioner Newsome said he has observed what downtown redevelopment can do for a town the size of Dothan. He said our downtown is on the right track and he does not want to stop this momentum. He explained that he has had no experience where the introduction of alcohol raised the quality of life for anyone. He said he cannot support open containers on the street and the people of his district say no as well. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Barbaree and Baxley; “nay:” Newsome, Kirkland and Ferguson. The motion was carried by the majority of four "yeas" to three “nays.” Mayor Schmitz introduced Resolution No. 2014-47 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Minutes of the Board of Commissioners – March 4, 2014, continued. Mayor Schmitz introduced Resolution No. 2014-48 (recorded in Ordinance Book No._______at Page_______), declaring certain properties as creating a nuisance, constituting a hazard to the public health, safety and convenience of the citizens and authorizing the demolition and removal of said properties. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-49 (recorded in Ordinance Book No._______at Page_______), declaring certain personal property as obsolete and no longer needed for public or municipal purposes and authorizing the disposal of said property by whatever means is determined to be in the best interest of the City. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-50 (recorded in Ordinance Book No._______at Page_______), superceding the employment agreement between the City of Dothan and Michael West in favor of a new employment agreement effective March 5, 2014 and expiring on March 4, 2017. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Kirkland. Commissioner Newsome referred to Section 11. E. of the contract and asked why this issue was not placed on an administrative agenda. City Manager West said his understanding is this was brought up at an earlier meeting during the time he was out recovering from knee surgery. Mayor Schmitz said this was discussed at the January 21st meeting, and because he would be in China during the February 18th meeting, he requested the Commission’s consideration to postpone this item until today’s meeting so he could be present for the vote. Commissioner Newsome said that because Section 11 was not followed there has been a violation of the City Manager’s contract. He said this Commission has not had an open discussion of the City Manager’s contract. Commissioner Barbaree said he was part of the discussion to move the vote to today in order for Mayor Schmitz to be present and he has no problem voting on this item today. Commissioner Kirkland said the Commission has a lot of things happening right now and the City Manager has provided leadership, assistance and guidance. He said he is ready to vote today. Commissioner Ferguson said the City Manager has made an extra effort to explain and include him on items set in motion before his time on the Commission. He thanked City Manager West for his work ethic and commitment to the City. Commissioner Dorsey spoke regarding the financial stability of the City and thanked City Manager West for a job well done. Commissioner Newsome said the residents of the City have had no open discussion on an administrative agenda regarding this matter. Mayor Schmitz said he is grateful City Manager West has decided not to retire because continuity is very important and our City has done some incredible things since Mr. West has become the City Manager. Mayor Schmitz said he appreciates the City Manager’s hiring and leadership of independent, strong-minded department heads who he considers to be the best in any city. He said the City Manager supports economic development, the City is financially solid and unemployment has dropped drastically. He said he is proud and honored to continue working together with Mr. West should the Commission vote to do so. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Kirkland, Ferguson, Barbaree and Baxley; “nay:” Newsome. The motion was carried by the majority of six "yeas" to one “nay.” Mayor Schmitz introduced Resolution No. 2014-51 (recorded in Ordinance Book No._______at Page_______), authorizing eligible city ad valorem non-educational taxes to be abated under the Brownfield Tax Abatement Act for Atlantic and Southern Equipment, LLC. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Newsome. Commissioner Newsome said this is a great step forward and he appreciates Mayor Schmitz for working with others on this matter. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-52 (recorded in Ordinance Book No._______at Page_______), awarding the bid and entering into a contract with Majestic Homes and Chatham Construction, LLC, of Dothan, Alabama in the Minutes of the Board of Commissioners – March 4, 2014, continued. amount of $74,470.00 for the 2218 Ross Clark Circle Sanitary Sewer Project, and appropriating funds for said project. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-53 (recorded in Ordinance Book No._______at Page_______), approving the utilization of seizure funds to pay various allowable expenditures for Police Department operations in the amount of $31,252.64 and appropriating funds for said expenditures. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-54 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Microsoft Volume Licensing to better support all installed software versions and diminish compatibility issues between users at an estimated cost of $208,571.11 per year for three years. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-55 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Xerox Corporation to purchase a multifunction printing device work centre for an end-of-lease purchase price of $622.00 and for maintenance at a cost of $553.30 per month for a 12 month period. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-56 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Gosselin Design to provide architectural services for the CDBG Window Restoration for the Alfred Saliba Family Services Center, Exterior Finish Renovations of the Alfred Saliba Family Services Center, New Kitchen for Mama Tina’s Mission House, New Exterior for the Boys and Girls Club of the Wiregrass and the Building Expansion for Wiregrass Rehabilitation Center REAL Projects at a cost of $19,500.00. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said CDBG funds will also pay for these services. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-57 (recorded in Ordinance Book No._______at Page_______), appointing Patsy Greenwood as a member of the Community Development Advisory Board. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Leisure Services Director Elston Jones answered that Academy Sports was offered an opportunity but did not bid. Mr. Jones explained particulars were included on some of the bid items in order to serve the department as needed and sometimes the out of town vendors cannot meet those obligations, therefore limiting the number of bidders.
