BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING AUGUST 5, 2014 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, August 5, 2014 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., John Ferguson, Taylor Barbaree and Hamp Baxley. Commissioner Albert Kirkland was absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Eddie Littlefield, Harper’s Joy Assembly of God, then led in prayer, afterwhich Commissioner Dorsey led in the Pledge of Allegiance to the Flag. Mayor Schmitz announced Commissioner Kirkland is at a meeting today serving the City. Commissioner Baxley moved that the Minutes of the Meeting of July 15, 2014, be approved, motion seconded by Commissioner Barbaree and unanimously approved. Commissioner Ferguson recognized Joseph Hoekenga of Dothan High School as a recipient of the 2014 Dothan Alabama Municipal Electric Authority scholarship winner. He provided additional information regarding Mr. Hoekenga’s background and qualifications. Mr. Hoekenga was present for the recognition. Mayor Schmitz invited Rosalind James of the Alabama Cooperative Extension System (ACES) to the podium. Ms. James, State Program Coordinator for Alabama’s 4-H International Exchange Program, introduced the Japanese youth delegation who are visiting the Wiregrass region for one month, as well as their host families and chaperone. The delegation invited the Commission to attend their talent showcase being held today from 2:00 p.m. until 4:00 p.m. at Beverlye Magnet School. Mayor Schmitz presented and read a proclamation, proclaiming August 9, 2014 as “National Night Out” in the City of Dothan. Police Chief Greg Benton and Lieutenant Benny Baxley were present for the proclamation. They announced the annual National Night Out event will be held on Saturday, August 9th from 3:00 p.m. until 8:00 p.m. at the Dothan Civic Center. Mayor Schmitz and City Manager West expressed that this is a wonderful event and encouraged everyone to attend. City Manager West announced Water World will be open on weekends only after Tuesday, August 12th. City Manager West said the Dixie Boys (age 13) baseball team won their game yesterday at the Dixie Junior Boys World Series tournament in Bossier City, Louisiana and will continue in the competition. City Manager West announced the Alabama Parks and Recreation Association will hold a statewide archery tournament on Saturday, August 9th at Eastgate Park. City Manager West said the Dixie Angels (ages 9-10) softball team recently competed and won second place in the Dixie Angels Softball Girl’s World Series tournament held in Atoka, Tennessee. City Manager West announced the pool at Doug Tew Recreation Center is closed for repairs and will hopefully reopen today. Minutes of the Board of Commissioners – August 5, 2014, continued. City Manager West said the Back-to-School R.E.S.P.E.C.T. Rally held on Saturday, August 2nd at Rip Hewes Stadium was a success. He thanked everyone involved for their time and effort in making this a great event. Mayor Schmitz expressed appreciation to EEO Training Officer Darryl Mathews for his leadership. Mayor Schmitz introduced the application of Magnesh Patel for a Lounge Retail Liquor License, Class II (Package) (off premise) for KBC Beverages, located at 1330 Hartford Highway, Suite 5. Hearing no motion, the application died due to lack of a motion and second. Mayor Schmitz introduced the application of Jeffery L. Golden for a Lounge Retail Liquor License, Class I (on or off premise) for JGS Buckwild Saloon Dothan, located at 2855 Ross Clark Circle, Suite 116. Commissioner Barbaree moved for approval, motion seconded by Commissioner Baxley and unanimously carried. Mayor Schmitz introduced the application of Don McLure for a Wholesale Table Wine & Beer License for United Distributing Company, located at 1158 Jordon Avenue. Commissioner Barbaree moved for approval, motion seconded by Commissioner Baxley and unanimously carried. Mayor Schmitz introduced the application of Michael T. Martin for a Retail Table Wine License (off premise) for Herndon Oil Corporation #108 located at 812 West Main Street. Commissioner Newsome moved for approval, motion seconded by Commissioner Barbaree and unanimously carried. Mayor Schmitz introduced the application of Michael T. Mayor Schmitz announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Ordinance No. 2014-192 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Jeffrey Arnold located at 2194 Denton Road from R-1 (Residential Single-Family, Low Density) District to B-3 (Local Shopping) District. Commissioner Barbaree moved for immediate consideration, motion seconded by Commissioner Baxley and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Ferguson, Barbaree and Baxley; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Barbaree then moved for adoption of Ordinance No. 2014-192, motion seconded by Commissioner Baxley and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Ferguson, Barbaree and Baxley; “nay:” none. Commissioner Barbaree moved for immediate consideration, motion seconded by Commissioner Baxley and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Ferguson, Barbaree and Baxley; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2014-194 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on August 19, 2014. Commissioner Newsome moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-195 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Newsome moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-196 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2014-134 and 2014-162 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-197 (recorded in Ordinance Book No._______at Page_______), approving the assignment of the franchise previously granted to Care Ambulance by Ordinance No. 2005-139, to Dothan (Pilcher) Ambulance, including all obligations thereunder, effective Friday, August 8, 2014. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Ferguson. Fire Chief Larry Williams explained that Care Ambulance has made a business decision to leave Dothan and the ordinance requires their franchise agreement to be transferred to another service. Chief Williams said Joey Pilcher, owner of Dothan (Pilcher) Ambulance, has agreed to this assignment which will, in turn, allow the company to increase staff in order to maintain four ambulances in the 911 rotation. Chief Williams said he, along with City Manager West and City Attorney Len White, has evaluated this and does not foresee any public safety problems. He said the situation will be monitored and the franchise agreement will remain the same. Mr. Pilcher said he has had in-depth conversations with Mr. Walt Eismann of Care Ambulance regarding staffing and making the transition as smooth as possible. Mr. Pilcher said his company has taken applications from employees of Care Ambulance and they plan to hire at least fifteen people. He gave his assurance that the level of service provided will continue without interruption and stated that even though they will be the sole provider in Dothan, it is against his nature to take advantage of any situation like that. Commissioner Barbaree said he appreciates Mr. Pilcher working on the E911 Advisory Board. Commissioner Newsome said his concern is with the employees of Care Ambulance and he urged that every effort be made to ensure those employees remain employed in Dothan. Mr. Eismann thanked Mr. Pilcher and Chief Williams for their cooperation. He said leaving Dothan was a very difficult decision to make and he feels the assignment could not be put in better hands. Mayor Schmitz said he is grateful for the way Mr. Eismann is handling the transition and he thanked Mr. Pilcher for all he is doing. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-198 (recorded in Ordinance Book No._______at Page_______), approving a Summary Change Order with MidSouth Paving, Inc., for the 2013 City Street Resurfacing Project, which increases the total contract cost by $18,846.45 making the final adjusted contract Minutes of the Board of Commissioners – August 5, 2014, continued. price $2,540,443.45. Commissioner Baxley moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-199 (recorded in Ordinance Book No._______at Page_______), awarding the bid, entering into a contract, and issuing a Notice to Proceed to Mid-South Paving, Inc., for street resurfacing scheduled for 2014 for the sum of $2,833,215.50. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-200 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of 12” x 6” tap, 6” gate valve, and 11 linear feet of 6” ductile iron pipe to the right-of-way at America’s Best Value Inn, located at 2901 Ross Clark Circle. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-201 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the lowering in place of 150 linear feet of 12” DIP water main, the removal of 150 linear feet of 12” DIP water main, the installation of a 12” isolation valve and 12” sleeve, 12” x 10” tee and 10” valve, 13 linear feet of 10” DIP water main and the relocation of an existing fire hydrant on AL 12 (US 84 E) for new commercial subdivision located at the 2300 Block of East Main Street. Commissioner Newsome moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-202 (recorded in Ordinance Book No._______at Page_______), agreeing to future funding for the Andrew Belle Pool, Westgate Wellness Pool and the James Oates Park-Phase 1 Projects. Commissioner Barbaree moved for adoption, motion seconded by Commissioner Baxley. City Manager West confirmed for Commissioner Newsome that, if this resolution is adopted, the Andrew Belle Pool will be bid in November and under contract by the end of 2014 in order to satisfy the grant requirement. Commissioner Barbaree said it is his hope that local contractors will bid on these projects. Belvia Jones said she is a long time resident of the east side of Dothan and she spoke about change in the community. Ms. Jones asked the Commission to consider an indoor therapeutic pool for Andrew Belle to allow for year-round access before voting to commence this project. Larry Matthews concurred with Ms. Jones’ request and asked the Commission to either delay their vote or fund an indoor therapeutic pool at Andrew Belle. City Manager West confirmed for Commissioner Ferguson that this resolution is a commitment to take the money out of reserves in order to move forward with bidding these projects. City Manager West said contracts will then be individually brought before the Commission and the money will be appropriated when a project is approved. Mayor Schmitz acknowledged Angela Allgood for leading the community effort to raise money for the Westgate Wellness Pool and said he is grateful for her hard work. He said this pool will improve not only the social life for our senior citizens, but also the health and wellness of our community. Mayor Schmitz said the Andrew Belle Pool will serve 1,300 children and he is proud we are at this point. He said, while he understands the requests made by Ms. Jones and Mr. Matthews, he personally does not want to slow down the momentum and would like everyone to consider moving forward on all three projects. He noted the fact that City Manager West, staff and the Commission have been able to put money away so funds do not have to be borrowed. Commissioner Dorsey recognized Wiregrass Foundation President Barbara Alford for the organization’s contribution to, not only the construction of the Andrew Belle pool, but also for swimming lessons. Regarding the requests received from Ms. Jones and Mr. Matthews, Commissioner Newsome said this expansion of our Leisure Services activities and facilities is not the last. He said he has been campaigning for a pool at Andrew Belle for eleven years and finally, we are there. He described a vision for the City’s east side and said he would like to see the first phase of a wellness pool at Eastgate Park tied to the second phase of Jim Oates Park. Commissioner Barbaree said James Oates Park has been in deliberation for a long time and he is glad to see it finally coming to Minutes of the Board of Commissioners – August 5, 2014, continued. fruition today if it should be the will of the Commission. Commissioner Ferguson said he would like to clarify his position on this matter. He said he weighed the pros and cons, this is a lot of money and he does not take this vote lightly. He said he takes great comfort in the fact that we will pay cash for these projects and no money will be borrowed. He explained that while this is not the most important issue we are facing, and he places more pressing issues such as sewer, water and public safety needs before recreation, he believes these concerns are being addressed at an aggressive enough pace that he is comfortable doing this as well. He commended staff and City Manager West for reserving funds over the years to put us in this position. He thanked Bob Hendrix, Executive Director of the Dothan Area Convention and Visitors Bureau (DACVB), for his very generous partnership, along with Dr. Alford and the Wiregrass Foundation. He said these are public- private partnerships and a lot of great things can be accomplished with this mentality. Commissioner Baxley said building facilities like James Oates Park changes the landscape of what the DACVB can do, as far as bringing in tournaments and driving more people to Dothan. He said, long-term, this can put us in a unique position where more people are going to find Dothan to be a destination and he looks forward to this coming to fruition over the years. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-203 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Federal Bureau of Investigation to participation in the Organized Crime Drug Enforcement Task Forces for reimbursement of overtime expenses in the amount of $10,400.00. Commissioner Newsome moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-204 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Law Enforcement Support Office for the purpose of continuing the acquisition of surplus military property for an annual fee of $900.00 and to allow inspections of property and records. Commissioner Newsome moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-205 (recorded in Ordinance Book No._______at Page_______), approving an addendum to the subgrant agreement with the Alabama Department of Public Safety for participation in the federal grant from the U.S. Department of Justice, Office of Juvenile Justice and Delinquency Prevention by extending the grant end date from June 30, 2014 until September 30, 2014. Commissioner Baxley moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-206 (recorded in Ordinance Book No._______at Page_______), executing a Memorandum of Agreement with the Alabama Department of Public Safety to reimburse the City for certain expenses incurred in providing training to student officers at the Alabama Criminal Justice Training Center in the amount of $5,500.00. Commissioner Newsome moved for adoption, motion seconded by Commissioner Barbaree and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-207 (recorded in Ordinance Book No._______at Page_______), agreeing to donate a pontoon boat, engine and trailer to the Regional Land and Water Rescue Team from the Dothan Fire Department. Commissioner Baxley moved for adoption, motion seconded by Commissioner Newsome. Chief Williams explained that this equipment was originally donated to the City by Dr. John Davis’ family, but because of the amount of work required to make repairs, the Fire Department feels it is appropriate to donate it to the Regional Land and Water Rescue Team. He said the boat will still be a resource to the City. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-208 (recorded in Ordinance Book No._______at Page_______), accepting funding from the Dothan Area Convention and Visitors’ Bureau in the amount of $2,000,000.00 for the purpose of assisting with the construction of the ball complexes at James Oates Park. Minutes of the Board of Commissioners – August 5, 2014, continued. Commissioner Baxley moved for adoption, motion seconded by Commissioner Ferguson. Mr. Hendrix, who was joined by hoteliers and DACVB board members, explained that this funding is comprised of tourism lodging tax dollars they have been saving just for this kind of project, which will create more tourism and also enhance the quality of life for the citizens of Dothan. He said this is a win-win for everybody. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-209 (recorded in Ordinance Book No._______at Page_______), accepting funding from the Wiregrass Foundation in the amount of $500,000.00 for the construction of a pool at Andrew Belle Community Center. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Newsome. Dr. Alford said the Wiregrass Foundation is a grant making foundation and their job is to determine which proposals of the numerous they receive are the best fit for their goals and objectives. She said this one is perfect because it is a partnership with the City and involves community development and family engagement. She said the project is much needed for the health and wellness of our children and the Wiregrass Foundation is proud to be a part of it. Commissioner Newsome thanked Dr. Alford and the Wiregrass Foundation for looking beyond just the construction of the pool and in to training of the children who will be swimming at the facility. Dr. Alford said they really hope parents of the children will come as well and this will become a family location for this part of town. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-210 (recorded in Ordinance Book No._______at Page_______), appointing Deidre Peluso as a member of the Museum Board.
