BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING AUGUST 19, 2014 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, August 19, 2014 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Taylor Barbaree and Hamp Baxley. Also present were City Manager Michael West, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. City Clerk Tammy Danner was absent. Mayor Schmitz called the meeting to order. Pastor Jerome Lister, Jr., St. Walden Missionary Baptist Church, then led in prayer, afterwhich Commissioner Newsome led in the Pledge of Allegiance to the Flag. Mayor Schmitz asked everyone to include Police Chief Greg Benton’s Mother in their prayers. Commissioner Newsome moved that the Minutes of the Meeting of August 5, 2014, be approved, motion seconded by Commissioner Kirkland and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming August, 2014 as “Community Development Block Grant Month” in the City of Dothan. Planning Director Todd McDonald and Maurice Head were present for the proclamation. Commissioner Dorsey announced a neighborhood clean-up event to be held on August 30th on Lake Street, beginning at the intersection of Range Street and ending at the intersection of Allen Street. Commissioner Dorsey thanked Pastor Kenneth Robinson of Alabama Avenue Missionary Baptist Church for spearheading a U.S. Department of Agriculture funded afterschool program, which will operate at the church and feed area kids. Commissioner Newsome reported the railroad crossing on Newton Street is in terrible condition and in need of repair. Commissioner Kirkland presented a check in the amount of $566.00 to Mayor Schmitz to assist with the efforts of Grow Dothan, the economic development arm of the Dothan Area Chamber of Commerce, and he challenged the community to also contribute to the organization. City Manager West announced City offices will be closed on Monday, September 1st in observance of Labor Day and there will be no sanitation collection on this date. Garbage and recycling collection will be rescheduled for Wednesday, September 3rd. There will be no make-up day for trash collection. City Manager West said the Casting Crowns concert at the Civic Center and the Wiregrass Museum’s Yard Party for Art event are both taking place on Friday, August 22nd. He asked for everyone’s patience with parking downtown. City Manager West announced James Gregory will perform at the Opera House on September 6th, Bama Brawl will be held in the Civic Center on September 13th and Celtic Woman will perform at the Civic Center in April, 2015. City Manager West announced that the Wiregrass Economic Resource Summit is scheduled for September 17th from 7:30 a.m. until 12:30 p.m. at the Civic Center. He said this is a great opportunity to participate in the future economic development initiatives in our community. Minutes of the Board of Commissioners – August 19, 2014, continued. Mayor Schmitz announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Resolution No. 2014-213 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on September 16, 2014. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-214 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-215 (recorded in Ordinance Book No._______at Page_______), assessing properties for the cost of demolition of substandard structures and turning the amounts over to the county tax collector to be added to the next regular bills for taxes levied against the respective lots and/or parcels of land. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-216 (recorded in Ordinance Book No._______at Page_______), approving and adopting the updated City of Dothan Solid Waste Management Plan, which will serve as the basis for solid waste management with the City of Dothan for a ten-year planning period beginning January, 2015. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. Commissioner Barbaree requested the plan be placed on our website’s front page. Commissioner Newsome said this may require additional work on the part of the police force because of citizens calling them based on this plan, and he asked if this will necessitate additional personnel. City Manager West said it should not because the Environmental Services Division of the Public Works Department will handle complaints initially and the police will be involved only if needed. Commissioner Barbaree asked if it is possible to establish a phone number for citizens to report hazardous waste. Mr. West said they will check into this. Chief Williams advised that contacting the local Emergency Management Agency is currently the best route for reporting chronic problems and 911 should be contacted for emergencies. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-217 (recorded in Ordinance Book No._______at Page_______), approving the plans for improvements to SR-210 (Ross Clark Circle) from Fortner Street to Bauman Drive prepared by the Alabama Department of Transportation. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. Commissioner Barbaree asked if these plans can be placed on our website. Assistant Public Works Director Charles Metzger said the set of plans is too large to make available on the website but they will handle working with the public as far as detours, et cetera are concerned. Commissioner Barbaree asked when construction is predicted to begin and Mr. Metzger estimated it will be November or December. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-218 (recorded in Ordinance Book No._______at Page_______), entering into a contract, awarding the bid, and issuing a Notice to Proceed to H & L Construction, Inc. for the Jackson Circle Culvert Improvements project in the amount of $290,433.00. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Ferguson. City Manager West said this culvert is in an area with only one entrance/exit and is a safety issue. There being no further discussion, the resolution was unanimously adopted. Minutes of the Board of Commissioners – August 19, 2014, continued. Mayor Schmitz introduced Resolution No. 2014-219 (recorded in Ordinance Book No._______at Page_______), approving the utilization of seizure funds to pay various allowable expenditures for Police Department operations in the amount of $12,821.00 and appropriating funds for said expenditures. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-220 (recorded in Ordinance Book No._______at Page_______), amending Resolution No. 2013-431 with the U.S. Department of Justice United States Marshals Service to accept an additional $1,000.00 for reimbursement of overtime expenses related to the support of the Gulf Coast Regional Fugitive Task Force. Commissioner Newsome moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-221 (recorded in Ordinance Book No._______at Page_______), entering into an incentive agreement with United Parcel Service. Commissioner Ferguson moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-222 (recorded in Ordinance Book No._______at Page_______), entering into a contract with the Southeast Alabama Basketball Officials Association to provide certified referees to officiate during the downtown Hoops Classic Basketball Tournament at a cost of $105.00 per game. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-223 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Academy Sports + Outdoors for the sponsorship of the Dothan Leisure Services “Youth Fishing Day”. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. Commission Barbaree said he certainly appreciates Academy sponsoring this event but wonders why big conglomerates, like Coca-Cola, cannot sponsor more of our local events, especially in our Civic Center arena. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-224 (recorded in Ordinance Book No._______at Page_______), appointing Edward Vaughn as a member of the Board of Zoning Adjustment. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-225 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of July, 2014 in the amount of $12,961,935.14. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2014-226 (recorded in Ordinance Book No. _______at Page_______), awarding the following bids and approving other purchases over $15,000.00 by the City. Commissioner Ferguson then moved for adoption of Resolution No. 2014-226, motion seconded by Commissioner Kirkland. Commissioner Barbaree said he is grateful to see there are a lot of local vendors on these purchases and thinks the citizens who provide us with the resources to make these purchases are probably happy about it as well. There being no further discussion, the resolution was unanimously adopted.
