BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING FEBRUARY 3, 2015 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 A.M., Tuesday, February 3, 2015 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Susan Anderson, and Hamp Baxley. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Lyle Peluso, Dothan Vineyard Church, then led in prayer, afterwhich Commissioner Dorsey led in the Pledge of Allegiance to the Flag. Commissioner Baxley moved that the Minutes of the Meeting of January 20, 2015, be approved, motion seconded by Commissioner Kirkland and unanimously approved. Pastor Peluso introduced his friend and guest from the nation of Tanzania, Peter Msigwa, who serves as a Vineyard pastor, Member of Parliament and Shadow Minister of Tourism for the nation of Tanzania. Mr. Msigwa spoke about his country and invited everyone to come visit. On behalf of the Commission, Mayor Schmitz expressed gratitude to Mr. Msigwa for his friendship and presented him with a key to the City. Mayor Schmitz presented and read a proclamation, proclaiming February 7-14, 2015 as “National Marriage Week.” James Winfrey, III, Marriage and Relationship Skills Facilitator, Saliba Center for Families and Muriel Goosby were present for the proclamation. Mayor Schmitz presented and read a proclamation, proclaiming February, 2015 as “Library Hoopla Month.” Bettye Forbus, Library Director, and Charlotte Mitchell, Main Branch Manager, were present for the proclamation. Ms. Forbus requested everyone in the community fill out the library’s survey in order to provide them with information to help drive the strategic plan for the next five years. Mayor Schmitz invited Angela Dunning to speak regarding an upcoming event. Ms. Dunning announced the “2015 Bojangles Hits for Heroes” baseball event will kick off Friday, February 20th at Northcutt Field. She explained the goal of this event is to raise money to send care packages to soldiers through the United Services Organizations (USO). She said this year they are proud to partner with Jeep Sullivan’s Wounded Warrior Outdoor Adventures. She invited everyone to come out to show support for our military. Commissioner Anderson reminded District 5 residents that the special election to elect a new commissioner will be held on Tuesday, February 10th. Mayor Schmitz encouraged everyone to show up and vote. He thanked the candidates for opening themselves up to campaigning, to the public, to this hard work, and for the opportunity to serve. Mayor Schmitz said he attended a meeting yesterday where it was discussed that sequestration will kick in on October 1st of this year and Fort Rucker has been identified as the Army Base in Alabama that will be affected. He said his understanding is that if this happens, the impact will be a reduction in military and civilian personnel, which could possibly result in a loss of contractor personnel as well. He said a general will be coming to listen to the community on February 23rd, and he encouraged everyone to come to The Post Theatre at 6:00 p.m. on this date because it is important for us to express how much this means to our community. Minutes of the Board of Commissioners – February 3, 2015, continued. City Manager West said the environmental portion and the archeological review of the landfill expansion site have been completed. He asked Daniel Wells of CDG Engineers to provide an update in response to issues raised regarding this matter. Mr. Wells said he is the professional engineer, lead designer, and permit engineer for the landfill expansion. He gave a brief outline of the environmental impact studies performed prior to initiating designs and the concurrences associated with those studies. He explained that after all concurrences were received they proceeded with the design, and the completed design was submitted to Alabama Department of Environmental Management (ADEM). Mr. Wells said ADEM will take the design along with the concurrences and perform a review of their work, which will ultimately lead to a permit that includes land, water, and air criteria. He stated that there were no significant findings on the site, and they expect to have the permit in hand following ADEM’s review. Mr. Wells confirmed for City Manager West that there is nothing at this time that would prohibit moving forward with the expansion of the landfill. City Manager West reminded everyone that the Dothan Area Chamber of Commerce’s “Spotlight on Business” event will be taking place this afternoon in the Civic Center. City Manager West announced that the AHSAA South Regional Basketball Tournament will be held February 12th – 18th in the Civic Center with 56 teams participating, and he said we hope to see a lot of local support and visitors at this great event. City Manager West said the check presentation to schools who competed in the Downtown Dothan Hoops Classic was held on Friday, January 30th. He said $51,000.00 went back to the participating schools this year, and to date, this tournament has provided over $310,000.00 to participating schools. He thanked the Commission, the staff, and the public for their support in this endeavor. City Manager West said the second round of the Dothan Leadership Academy will be held February 16th – 18th at the Wiregrass Museum of Art, and he invited Commission members to make an appearance. Mayor Schmitz acknowledged that two people have signed up to speak under privileges of the floor regarding liquor licenses, and he advised they will be given the opportunity to speak after the application is introduced. Mayor Schmitz introduced the application of Joseph Elliott for a Lounge Retail Liquor License, Class I (on or off premises) for Legacy Lounge, located at 2086 Montgomery Highway. Commissioner Dorsey moved for approval, motion seconded by Commissioner Ferguson. Ronald Parish said he lives approximately 1,000 feet behind this address, he has been opposed to this property being a club since the initial business opened, and he is still opposed. Mr. Parish said he has not had any problem with noise coming from inside the building but the problem he has is with noise outside the club at the tiki lounge in the back and in the parking lot, trash around the club, and the club’s clientele. He suggested requiring a block fence to be put between this place and the subdivision and blocking off the driveway that comes out on Montezuma Avenue. He said this was successfully blocked in the past but the gate is now an eyesore. Rick McCommon said he is a neighbor of Mr. Parish. Mr. McCommon said he objects on the basis of the noise, and he concurred with Mr. Parish’s concerns. Mr. Elliott addressed the residents’ concerns and said his establishment will be run clean. He said he has been in business for two and a half years at his current location with limited problems. He said he is willing to put up a new gate today to solve the issue of people using the back driveway. He said he works off-duty officers for security and parking lot purposes; so, there should not be those issues in the parking lot. Commissioner Baxley commented that there have been issues with establishments in this neighborhood and there seems to be an onslaught of different institutions coming in to this area. He said, while he appreciates the amount of work Mr. Elliott has done to improve the look of the property, he expects this institution to not interfere with the neighbors’ enjoyment of their properties. Commissioner Baxley suggested Minutes of the Board of Commissioners – February 3, 2015, continued. closing off the open area in the back or doing something different with it so that the residents do not have the quiet enjoyment of their premises infringed upon. Commissioner Dorsey asked the applicant to explain his business operation. Mr. Elliott said the building’s interior has been redeveloped and the exterior has been renovated. He said the business will be similar to the way Pocket’s operated with pool tables and food but with some upgraded amenities. Commissioner Ferguson asked City Manager West about the process for these requests and said he would hate for someone to invest significant dollars without having a license and then be turned down. City Manager West advised that applicants must be able to pass fire and building inspections before receiving a license. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, and Anderson; “nay:” Baxley. The motion was carried by the majority of six "yeas" to one “nay.” Mayor Schmitz introduced the application of Joseph Elliott for a Pool Hall License, located at 2086 Montgomery Highway. Commissioner Dorsey moved for approval, motion seconded by Commissioner Ferguson, and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, and Anderson; “nay:” Baxley. The motion was carried by the majority of six "yeas" to one “nay.” Mayor Schmitz introduced the application of Fakir Sakir Dogruogullari for a Lounge Retail Liquor License, Class I (on or off premises) for Chill, located at 164 South Foster Street. Commissioner Newsome moved for approval, motion seconded by Commissioner Dorsey. Commissioner Baxley noted that there have been many issues with businesses at this establishment in the past. He requested assurance from the applicant that he will be in control of the operation, there will be no damage caused to the surrounding area or parking lots, and that he will work with the business owners in the area. Mr. Dogruogullari confirmed that he will do these things. Mayor Schmitz said we are grateful for his investment downtown. Commissioner Newsome confirmed with the applicant that his proposed investment of $150,000.00 in this location is firm. Commissioner Dorsey asked the applicant if he plans to relocate to Dothan. Mr. Dogruogullari said yes and added that he currently lives in Florida. There being no further discussion, the motion was unanimously carried. Mayor Schmitz introduced Resolution No. 2015-23 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2014-333 and 2015-1 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley. Commissioner Dorsey thanked Planning Director Todd McDonald and staff for doing a great job. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-24 (recorded in Ordinance Book No._______at Page_______), Entering into a permit agreement with the Alabama Department of Transportation for the installation of 110 feet of ACSR that will cross over US Highway 431/231 N/AL Highway 1 to provide three phase service for Church of Dothan located at 881 N. Oates Street. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Baxley and unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-25 (recorded in Ordinance Book No._______at Page_______), Entering into a cooperative agreement to join the Statewide Recycling Partnership. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Anderson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2015-26 (recorded in Ordinance Book No._______at Page_______), Approving Amendment #2 with Barge, Waggoner, Sumner, and Cannon, Inc. for additional professional services for the implementation of the Administrative Order on Consent with the United States Environmental Protection Agency and the Alabama Department of Environmental Minutes of the Board of Commissioners – February 3, 2015, continued. Management for the City’s wastewater system, which results in a cost increase in the amount of $4,480,300.00, making the adjusted contract price $11,581,350.00, and appropriating funds for said services. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome. City Manager West said the funding for this has been included in the $19,245,000.00 State Revolving Fund Loan received October, 2014. There being no further discussion, the resolution was unanimously adopted.
