REGULAR MEETING
MARCH 3, 2015
The Board of Commissioners of the City of Dothan, Alabama, met in regular
session in the Commission Chambers of the Roy Driggers Municipal Building at
10:00 A.M., Tuesday, March 3, 2015 with the following members present: Mayor
Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr.,
Albert Kirkland, John Ferguson, and Susan Anderson. Commissioner Hamp
Baxley was absent. Also present were City Manager Michael West, City Clerk
Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of
the Meeting, and the local news media representatives.
Mayor Schmitz called the meeting to order. Pastor Lynn Miley, Westwood
Presbyterian Church, then led in prayer, afterwhich Commissioner Kirkland led in
the Pledge of Allegiance to the Flag.
Mayor Schmitz announced Commissioner Baxley is absent today because he is
taking care of his family.
Commissioner Kirkland moved that the Minutes of the Meeting of February 17,
2015, be approved, motion seconded by Commissioner Anderson and
unanimously approved.
Mayor Schmitz presented and read a proclamation, proclaiming March, 2015 as
“Wiregrass Museum of Art-Youth Art Month.” Board President Ashley Maddox
was present for the proclamation. Ms. Maddox announced the winners of Youth
Art Month and the Art Box competition. On behalf of the Museum, she thanked the
City for allowing placement of the art boxes in the community.
Mayor Schmitz invited Precious Freeman from the Mural City Art Walk to the
podium. Ms. Freeman announced this year’s Mural City Art Walk will be Saturday,
February 7th from 10:00 a.m. until 5:00 p.m. in downtown. She invited everyone to
attend and support this event.
Commissioner Dorsey thanked everyone who attended the dental health fair at
Andrew Belle on Saturday, February 28th. He said this event was a success.
Commissioner Dorsey presented a petition with over 250 names of residents
requesting a sidewalk on Lingo Road, and he asked City Manager West to revisit
this matter with Public Works Director Jerry Corbin.
Commissioner Dorsey said he has observed a large number of garbage cans are
being left out on the side of the road, and he asked that the trash ordinance be
reviewed. City Manager West said the current ordinance requires residents to
remove their trash carts from the side of the road the day after their scheduled
pickup. City Manager West requested Mr. Corbin to have door hangers placed in
those areas where this issue is occurring.
Commissioner Dorsey announced that there will be a spotlight on all non-profit
organizations in the City on Saturday, March 14th from 10:00 a.m. until 1:00 p.m. at
Walton Park.
Commissioner Ferguson congratulated Police Chief Greg Benton on his retirement
announcement and thanked him for his years of service to the citizens of Dothan.
Commissioner Anderson presented a $3,329.00 environmental grant to Leisure
Services’ Assistant Director of Operations Kim Meeker and explained that she
recently received this grant from Patagonia, a vendor for her family’s retail
operation, to go toward the Forever Wild project. Mr. Meeker expressed
appreciation to Commissioner Anderson for her assistance with this project, and
he noted that she has garnered over $10,000.00 in grants for the City.
Commissioner Anderson thanked Mr. Meeker for his work on this great project.

Mayor Schmitz congratulated our community on yesterday’s announcement that
the Alabama State Games will be hosted this year for the first time by Dothan and
Ozark. He said this is an honor and an incredible opportunity for the Wiregrass.
The event will be held June 12-14, and opening ceremonies will take place in
Dothan on June 12th.
Mayor Schmitz said he is proud of our community for coming out and showing
support for Fort Rucker at the public meeting on Monday, February 23rd. He gave
an overview of Dothan’s presentation, which provided a regional viewpoint of the
economic impact, and he recognized all the speakers for doing an outstanding job.
He thanked Melissa McGill, Project Management and Administration, and Dean
Mitchell, Dothan Area Chamber of Commerce Director of External Affairs, for their
hard work in compiling the books which were provided to the leadership. He said
Judge Val McGee, Ozark resident and author of Origins of Fort Rucker, attended
the meeting. At this time a video created by Michael Wiley, which was shown at
the closing of the presentation, was played for the audience.
City Manager West said the large number of people in attendance at this public
meeting shows the impact and care our area has for Fort Rucker. He said he is
proud to be a part of this community.
City Manager West noted that the Dothan Civic Center had two sold out shows,
the Harlem Globetrotters and the Chris Tomlin concert, last week. He said he
believes this is a testimony to the kind of events we are drawing as well as a sign
that the economy is improving. He thanked Performing Arts Director Marshall
Perry and staff for doing a great job.
City Manager West announced grand opening ceremonies at Westgate Park will
be held on Friday, March 13th at 6:00 p.m. for Dothan National Little League and
on Saturday, March 14th at 9:00 a.m. for Dothan Miracle League.
Mayor Schmitz introduced the application of Paul McVay for a Lounge Retail
Liquor License, Class I, (on or off premise) for McLeods Publick House, located at
5540 West Main Street, Suites 8 & 9. Commissioner Dorsey moved for approval,
motion seconded by Commissioner Kirkland. Mayor Schmitz asked if anyone was
present who wished to speak and there were none. Mayor Schmitz noted this
business is currently in operation and he invited Mr. McVay to speak about a new
venture he has recently started. Mr. McVay explained how he, along with others
from the Wiregrass area, formed the Circle City Chaos, which is a women’s
professional flat track roller derby team. He said five bouts have been scheduled
at the Civic Center, they appreciate being in Dothan, and he thanked everyone for
any support that may be offered. Mayor Schmitz asked if there is any discussion
regarding the liquor license. Commissioner Ferguson asked if the only change is
the location of the business. Mr. McVay replied that this is correct and said they
are moving just 500 feet from their current location. Commissioner Ferguson said
there was a question about the radius from the new location to the church. He
asked if there was anyone present from the church who wished to speak on this
matter, and there were none. There being no further discussion, the motion was
unanimously carried.
Mayor Schmitz introduced the application of Mike Bryan for a Restaurant Retail
Liquor License (on premise) for Oak and Olive, located at 2620 Montgomery
Highway, Suites 1 & 2. Commissioner Kirkland moved for approval, motion
seconded by Commissioner Anderson. Mayor Schmitz asked if anyone was
present who wished to speak and there were none. Mayor Schmitz said Mr. Bryan
is the owner of Fatback’s and he has purchased Oak and Olive. There being no
further discussion, the motion was unanimously carried.
Mayor Schmitz introduced Resolution No. 2015-38 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with MDG, Inc. to
provide lobbying and governmental relations services for a twelve month period at
a cost of $48,000.00. Commissioner Kirkland moved for adoption, motion
seconded by Commissioner Dorsey. Mayor Schmitz invited Deborah Miller,
Principal of MDG, Inc., to speak. He noted two issues Ms. Miller will be helping us
with are the proposed electric tax on municipalities and future changes to our

E911 board. Ms. Miller said is a pleasure to work with Mayor Schmitz, City
Manager West, and the Commissioners. Commissioner Ferguson asked Ms. Miller
to contrast what MDG does compared to what our elected officials do in
Montgomery. Ms. Miller said her firm’s job is to assist the delegation, to make sure
the bills they introduce are brought forth, to communicate among the members,
and to advocate for the City. Mayor Schmitz said Ms. Miller was crucial in the
City’s recruitment of Commercial Jet because she worked hard to get necessary
legislation passed. There being no further discussion, the resolution was
unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-39 (recorded in Ordinance Book
No._______at Page_______), enabling the current commissary billing software
(owned and utilized) by the City of Dothan to create a fee for over-the-counter
medications issued to inmates in the City jail. Commissioner Kirkland moved for
adoption, motion seconded by Commissioner Ferguson and unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-40 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with International
Mountain Bicycling Association Trail Solutions to design the trail system at the
Forever Wild properties at a cost of $11,900.00. Commissioner Anderson moved
for adoption, motion seconded by Commissioner Kirkland and unanimously
adopted.
Mayor Schmitz introduced Resolution No. 2015-41 (recorded in Ordinance Book
No._______at Page_______), approving the Dothan Police Department Policy,
General Order 100-56, regarding members engaging in secondary or extra-duty
employment. Commissioner Kirkland moved for adoption, motion seconded by
Commissioner Dorsey. Mayor Schmitz confirmed with City Manager West that this
policy is to increase the rates charged for this type of employment. There being no
further discussion, the resolution was unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-42 (recorded in Ordinance Book
No._______at Page_______), declaring the Police K9, Number 802 (Rex) as no
longer needed for public or municipal purposes and agreeing to donate the said
K9 to Mark Thompson. Commissioner Ferguson moved for adoption, motion
seconded by Commissioner Kirkland. Mayor Schmitz said the Commission is
proud to do this. There being no further discussion, the resolution was
unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-43 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with the Organized
Crime Drug Enforcement Task Forces (OCDETF) Program for reimbursement of
overtime expenditures related to the Organized Crime Drug Enforcement Task
Force in the amount of $15,000.00. Commissioner Kirkland moved for adoption,
motion seconded by Commissioner Dorsey and unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-44 (recorded in Ordinance Book
No._______at Page_______), awarding the bid and entering into a contract with
Southern Software, Inc. for deployment and integration of Police software in the
amount of $372,408.00 and annual support in the amount of $56,000.00 for years
1 through 3. Commissioner Kirkland moved for adoption, motion seconded by
Commissioner Ferguson. City Manager West confirmed for Commissioner
Ferguson that the $56,000.00 is the annual cost of support, which includes
licensing fees, anticipated maintenance, and updates of the software. Major
Parrish said this amount will be less than what has been paid for the HTE
upgrades as well as the maintenance agreements. Danny McKinley,
representative from Southern Software, confirmed for Commissioner Ferguson
that this is the software needed for the E911 Next Generation and it is in full
compliance. There being no further discussion, the resolution was unanimously
adopted.
Mayor Schmitz introduced Resolution No. 2015-45 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with the Dothan City
Board of Education to provide food services for the Summer Food Service
Program for Children. Commissioner Anderson moved for adoption, motion
seconded by Commissioner Kirkland. City Manager West said this is an annual

contract the City does each year. There being no further discussion, the resolution
was unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-46 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with the Alabama
Department of Transportation (ALDOT) for the relocation of approximately 1,620
linear feet water main, four (4) fire hydrants and associated valves and fittings to
be installed on the right of way of Denton Road in conjunction with the ALDOT
Project No. ACBR58519-ATRP(010), Bridge Replacement CR25 (Denton Road)
over Rock Creek, at a non-reimbursable cost estimate of $271,772.28.
Commissioner Kirkland moved for adoption, motion seconded by Commissioner
Dorsey and unanimously adopted. City Manager West said funds have been set
aside to pay for this project.
Mayor Schmitz introduced Resolution No. 2015-47 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with the Alabama
Department of Transportation (ALDOT) for the abandonment of approximately 564
linear feet of existing PVC sanitary sewer pipe, abandoning 3 existing manholes,
installation of approximately 326 linear feet PVC sanitary sewer pipe and 2 new
sanitary sewer manholes to be installed on the right of way of Denton Road in
conjunction with the ALDOT Project No. ACBR58519-ATRP(010), Bridge
Replacement CR25 (Denton Road) over Rock Creek, at a non-reimbursable cost
estimate of $49,647.00. Commissioner Dorsey moved for adoption, motion
seconded by Commissioner Kirkland. Commissioner Newsome asked if there is a
completion date for this project. City Manager West advised that this project will be
controlled by ALDOT and Mr. Corbin estimated the work will take a year to
complete. There being no further discussion, the resolution was unanimously
adopted.
Mayor Schmitz introduced Resolution No. 2015-48 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with the United States
Tennis Association for the 2015 USTA $50,000.00 Women’s Tournament
(“Hardee’s Pro Classic”). Commissioner Kirkland moved for adoption, motion
seconded by Commissioner Dorsey and unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-49 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with the United States
Tennis Association to provide officiating services for the USTA $50,000.00
Women’s Tournament (“Hardee’s Pro Classic”). Commissioner Kirkland moved for
adoption, motion seconded by Commissioner Anderson and unanimously adopted.
City Manager West said this has been one of the best financial years in terms of
sponsorship in a long time.
Mayor Schmitz introduced Resolution No. 2015-50 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with Sungard Public
Sector for interface to integrate the City’s existing utility billing software with the
Milsoft IVR/OMS system in the amount of $8,000.00. Commissioner Newsome
moved for adoption, motion seconded by Commissioner Kirkland. Commissioner
Ferguson asked for an explanation of this item. City Manager West said this
basically means Sungard will make sure our utility billing system can communicate
with the new IVR/OMS system. City Manager West confirmed for Commissioner
Ferguson that this agreement does not include the phone upgrades that are also
necessary. Interim I.T. Director Robb Meredeth said this will keep the customer
information in sync across the two platforms. Commissioner Ferguson asked if the
“flat, delimited file” referenced in the agreement is an Excel spreadsheet and if so,
is there not someone on staff that can do this. Mr. Meredeth said it is a program
modification to the AS400 system that will extract all the data into that type of file
so that it can be imported into the new system on a regular basis. Commissioner
Anderson confirmed with Dothan Utilities Director Billy Mayes that this system will
communicate and show when someone reports an outage if that outage is due to
a delinquent bill. There being no further discussion and upon the motion being put
to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, and
Anderson; “nay:” Ferguson. The motion was carried by the majority of five "yeas"
to one “nay.”

Mayor Schmitz introduced Resolution No. 2015-51 (recorded in Ordinance Book
No._______at Page_______), agreeing to retain the SoZo Group LLC to provide
governmental affairs and economic development representation for a twelve
month period at a cost of $5,000.00 per month. Commissioner Kirkland moved for
adoption, motion seconded by Commissioner Newsome. Mayor Schmitz invited
George Harris, representative of the SoZo Group, to speak. Mayor Schmitz said
the Commission will be traveling to Washington, D.C. next week, and Mr. Harris
will be helping to identify the people in Congress who will look at the Fort Rucker
issue to overcome sequestration. Mayor Schmitz said another issue Mr. Harris is
helping with is to secure funds, which were previously allocated for the I-10
connector, for Ross Clark Circle improvements. Mr. Harris said ALDOT requires
official action from Washington in order to move the money, and since a
moratorium was passed on earmarks several years ago, there are issues to work
through to make this happen. Commissioner Ferguson asked if this requires action
from the appropriations committee to reclassify that funding or is it a separate bill.
Mr. Harris said one of the issues to be addressed is whether this will require
legislative action or if it can be done administratively. He said they prefer for this to
be done administratively, but if this is not possible, there are other options they are
pursuing as well that may work. Commissioner Newsome asked if they see any
stumbling blocks in doing this administratively. Mr. Harris said there will be an
issue of whether or not this requires legislative activity; however, there is some
renewed interest in reviewing the moratorium. Commissioner Dorsey asked Mr.
Harris how many cities other than Dothan does he represent, and Mr. Harris
replied that they currently represent three other cities. There being no further
discussion, the resolution was unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-52 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with WTVY-TV for
television advertising for Water World at a cost of $8,750.00. Commissioner
Kirkland moved for adoption, motion seconded by Commissioner Dorsey and
unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-53 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with WDHN-TV for
television advertising for Water World at a cost of $4,000.00. Commissioner
Kirkland moved for adoption, motion seconded by Commissioner Anderson.
Commissioner Ferguson noted the cost discrepancy between the two stations and
asked if there is a reason. Leisure Services Director Elston Jones said it is based
on ratings and slots. He explained that Aquatics Manager Kelly Carter researched
to identify the best slots in order to achieve the highest value of advertisement.
There being no further discussion, the resolution was unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-54 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with WOOF-FM for an
advertising package for the promotion of Water World at a cost of $6,000.00.
Commissioner Kirkland moved for adoption, motion seconded by Commissioner
Newsome. Commissioner Ferguson asked if all stations are solicited for proposals
and then they are chosen based on which is felt to be best. Mr. Jones said stations
are not solicited. He said past years have determined that the volume is more on
the FM side of radio than on AM and therefore, there are more FM stations listed.
Mr. Jones said radio, TV, and billboard advertisements are all based on research
through the years, as well as surveys, license plates, and other means. He said a
report will be provided to the Commission to show this information. Commissioner
Newsome asked if religious stations are being reached out to. Mr. Jones said Joy
FM is included, and he read a list of the radio stations. Commissioner Dorsey
asked if Facebook, Twitter, etc. are utilized and if so, are stats available to show
their effectiveness. Mr. Jones said Water World does have a Facebook page, and
this information will be included in the report. Commissioner Ferguson asked if a
target demographic, such as age, has been identified. Mr. Jones said they reach
out to everybody because children as well as adults take advantage of Water
World. Commissioner Ferguson said he personally thinks we need to solicit input
from every station, locally and beyond. Commissioner Newsome asked if Water
World is close to making money. Mr. Jones said no and this will be revealed in the
report as well. There being no further discussion, the resolution was unanimously
adopted.

television advertising for Water World at a cost of $1,500.00. Commissioner
Kirkland moved for adoption, motion seconded by Commissioner Ferguson and
unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-56 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with The Radio People
for radio advertising for Water World at a cost of $6,000.00. Commissioner
Kirkland moved for adoption, motion seconded by Commissioner Anderson and
unanimously adopted.
Mayor Schmitz introduced Resolution No. 2015-57 (recorded in Ordinance Book
No._______at Page_______), entering into an agreement with WECP-TV for
television advertising for Water World at a cost of $1,500.00. Commissioner
Dorsey moved for adoption, motion seconded by Commissioner Anderson.
Commissioner Ferguson noted this is a Panama City location, which is the home
of Shipwreck Island. City Manager West said this is based on license plates
counted in the parking lot and feedback which shows fairly good traffic coming
from this area. Commissioner Ferguson said TV channels 4 and 18 have a
presence in that market. Mayor Schmitz said these channels no longer broadcast
in the Panama City area. Mr. Jones said WECP-TV covers not only the Panama
City area but also the surrounding counties of Washington, Holmes, Jackson, etc.
and the report will show the number of people who travel from these counties to
Water World. In reference to the earlier mention of Joy FM, Commissioner
Anderson noted that this station is not included on today’s agenda and asked if
this is a separate proposal. City Manager West said there are several companies
who will accept a purchase order in lieu of a contract. There being no further
discussion, the resolution was unanimously adopted.

Display, Inc. for digital sign network advertising for Water World at a cost of
$5,000.00. Commissioner Kirkland moved for adoption, motion seconded by
Commissioner Anderson and unanimously adopted.
