BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING JULY 19, 2016 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, July 19, 2016 with the following members present: Mayor Mike Schmitz, Associate Commissioners Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Commissioner Kevin Dorsey was absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Clark Cornelius, Grace Anglican Mission Church, then led in prayer, afterwhich Commissioner Ferguson led in the Pledge of Allegiance to the Flag. Mayor Schmitz announced that Commissioner Dorsey is out of town today. Commissioner Kirkland moved that the Minutes of the Meeting of July 5, 2016, be approved, motion seconded by Commissioner Kenward and unanimously approved. Mayor Schmitz invited Steve Hardwick to the podium to share a vision he has for our community. Mr. Hardwick, along with Glenda Coleman and Shan Ash, spoke about the Angel of Hope statue which was inspired by Richard Paul Evans’ book The Christmas Box and explained that for parents who have endured the death of a child this statue provides a symbol of hope, a place to retreat, a place of healing, and a special place to grieve. Mr. Hardwick said he will raise the money needed to make and transport this memorial statue and he would like to place the statue in Dothan. He requested the City’s assistance with providing a home for the statue, and he presented the idea of placement in Poplar Head Park, at the library, or another location deemed appropriate. Mayor Schmitz said we are a community of heart and compassion and this is a great project. City Manager West said we will be proud to have this statue placed here and he added that there may be an area available at the Opera House which has been designed for a memorial. Commissioner Ferguson said he has received calls regarding solicitation taking place at homes and by other means and it seems some solicitors are becoming more aggressive. He said our ordinance is comprehensive and the public may not be aware of the regulations in place for this type of activity, such as the restricted hours of operation and other limitations. He asked if our media would be willing to help spread the word about this issue because if the public knows what is and is not allowed it will help curtail some of this activity. Commissioner Ferguson said he has received calls regarding the influx of donation boxes popping up all over the city and his understanding is that some of these companies are selling the donated items for profit. He noted a recent instance where boxes were placed at a business without the owner’s permission. He said he does not want to ruin the spirit of donation but does feel this should be managed so that it does not get out of hand. Mayor Schmitz said he recently had the opportunity to go to the annual air show in London with some local business leaders. He said the President of CAE USA Inc., who is in the process of spending over $80 million in a facility at our airport, introduced them to a number of companies they would like to see in Dothan and we truly believe this is the time for our airport to do expansions which will help to create first class jobs. Mayor Schmitz thanked the business leaders who attended the event for the hard work they put forth over those three days. Minutes of the Board of Commissioners – July 19, 2016, continued. City Manager West made the following announcements: • Graduation for the current class of the Junior Police Academy will be on Friday, July 22nd at 10:00 a.m. in the Dothan High School Auditorium and the public is invited to attend. This program has increased in popularity and may need to be expanded next year to accommodate the number of kids wanting to participate. • The Dothan Police Department will host the 2016 National Night Out event on Saturday, July 30th from 4:00 p.m. until 8:00 p.m. at the Dothan Civic Center. This event is an effort to engage citizens with our police department and other area law enforcement and will include demonstrations, displays, and entertainment. The public is invited to attend. • The new police firing range is being designed and constructed by Public Works Department Street Division and is expected to be completed before any activity begins at the Omussee Creek Wastewater Treatment Plant. • A free bidder enrollment seminar will be held on Tuesday, August 9th at 9:00 a.m. in the City Manager’s Conference Room for people who are interested in being on the City’s bidder list. • In response to questions raised regarding the keyless access control systems for all Fire Department facilities, Item #5 on the Administrative Meeting agenda will be held until clarification is provided and will be brought back for consideration within the next thirty days. With all of the activity happening around the country, there are some concerns about the security of our fire facilities and this keyless entry system will solve those concerns. There are other areas around the City that we may need to look at as well. • Please keep Public Works Director Jerry Corbin, who is recuperating from an injury, and Leisure Services Director Elston Jones’ wife, who is doing better but is still in ICU, in your prayers. Mayor Schmitz introduced the application of Tarik Y. Register, d/b/a Kirkland’s Bonding Company, LLC, for a Bail Bonding License, located at 1909 Montgomery Highway, Suite 402. Mayor Schmitz asked if Tarik Register was present and he was not. Mayor Schmitz asked if there was anyone present who would like to speak on this matter and there were none. Commissioner Kirkland moved for approval. Mayor Schmitz called for a second to this motion. The motion died due to lack of a second. Mayor Schmitz announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Ordinance No. 2016-200 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by multiple land owners, located in the Ardilla Community from L-I (Light Industrial) District to A-C & R-1 (Residential, Single-Family, Very Low Density and Residential, Single-Family, Low Density) Districts. Commissioner Ferguson moved for immediate consideration, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” City Manager West advised that one of the land owners had requested his address to be removed from the ordinance unless he is assured that the property will be grandfathered in and he can continue to operate his business there. Planning Director Todd McDonald confirmed that if there is an existing use there now the use can continue to be there by law. Commissioner Kirkland mentioned Minutes of the Board of Commissioners – July 19, 2016, continued. that Don Clements called him and requested that it be made public that he has opted out of this rezoning. Mr. McDonald confirmed that the parcels owned by Mr. Clements have been removed from this ordinance per his request. City Manager West provided the background and explanation for this city initiated rezoning. Commissioner Ferguson then moved for adoption of Ordinance No. 2016-200, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Schmitz introduced Ordinance No. 2016-201 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Dothan Community Church, located at 4390 Westgate Parkway from L-I (Light Industrial) District to A- C (Residential, Single-Family, Low Density) District. Commissioner Kenward moved for immediate consideration, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2016-201, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. Odom Road from O-I & R-1 (Office/Institutional & Residential, Single-Family, Very Low Density) Districts to R-1 & O-I (Residential, Single-Family, Low Density & Office/Institutional) District, respectively. Commissioner Ferguson moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Ferguson then moved for adoption of Ordinance No. 2016-202, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Schmitz, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2016-203 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-204 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on August 16, 2016. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Ferguson and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-205 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2016-148 and 2016-164 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Minutes of the Board of Commissioners – July 19, 2016, continued. Mayor Schmitz introduced Resolution No. 2016-206 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be in violation of Article III, Chapter 106 of the City of Dothan Code of Ordinance (repeat offenders) and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kenward moved for adoption, motion seconded by Commissioner Newsome. City Manager West pointed out that the repeat offender amendment the Commission made to the ordinance allows the City to process these properties more quickly. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-207 (recorded in Ordinance Book No._______at Page_______), declaring certain properties as creating a nuisance, constituting a hazard to the public health, safety and convenience of the citizens of the City of Dothan and authorizing the demolition and removal of the said structures. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-208 (recorded in Ordinance Book No._______at Page_______), assessing properties for the cost of demolition of substandard structures and turning the amounts over to the county tax collector to be added to the next regular bills for taxes levied against the respective lots and/or parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-209 (recorded in Ordinance Book No._______at Page_______), applying for and accepting a grant in the amount of $3,000.00 from the State of Alabama Historical Commission for the purpose of expanding the existing boundaries of the National Register Downtown Commercial District and agreeing to provide matching funds in the amount of $2,000.00, and appropriating funds for said grant. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome. Commissioner Kenward asked if this was budgeted or if it is coming from the fund balance. Mr. McDonald replied that it has not been budgeted. City Manager West confirmed this is coming from the fund balance and he said this is needed for the City to maintain the historical designation downtown. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-210 (recorded in Ordinance Book No._______at Page_______), approving the 2016 (Second Year) Annual Action Plan for the Community Development Block Grant (CDBG) Program. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-211 (recorded in Ordinance Book No._______at Page_______), amending the Community Development Block Grant Annual Action Plans for FY 2010, FY 2011, and FY 2012 to reprogram $145,008.31 to support Habitat’s Emergency Housing Repair and Weatherization program, Wiregrass Rehabilitation Center Equipment and DDRA Façade Improvement Program. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West provided the breakdown of what each organization will receive from this reprogramming of funds. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-212 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Alabama Department of Transportation for the purpose of administering U.S. Department of Transportation Financial Assistance for Transportation Planning. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome. City Manager West said the transportation bill has been renamed and new agreements are required to reflect the new name of the bill. He advised that this agreement is basically the same as what we have always done. Mayor Schmitz introduced Resolution No. 2016-213 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation for the installation of cured-in-place pipe (CIPP), PVC sanitary sewer gravity pipe, replacement of 1 manhole, lining of 5 manholes, reconnecting sanitary sewer laterals, pavement replacement in the trench area only, and removing and replacing of all conflicting items (curb, curb & gutter, gas main, water main, etc.) on Woodland Drive from W. Main Street to S. Orange Street. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said this is one of the projects included in the sewer rehab program. Commissioner Ferguson inquired into the timeline and other details. Assistant Public Works Director Charles Metzger advised that this project is in with several other projects designed by Polyengineering and is close to being bid. He provided details of the road work to be performed. Mayor Schmitz said this is a heavily traveled area and it is important that we communicate to the community what is going to happen before work begins. Mayor Schmitz introduced Resolution No. 2016-214 (recorded in Ordinance Book No._______at Page_______), entering into a Memorandum of Agreement with the Alabama Law Enforcement Agency (ALEA) for reimbursement of registration fees in the amount of $13,000.00 for student officers successfully graduating from the Alabama Criminal Justice Training Center (ACJTC) in Selma, Alabama. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Newsome and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-215 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Organized Crime Drug Enforcement Task Forces (OCDETF) Program for reimbursement of overtime expenditures related to the Organized Crime Drug Enforcement Task Force in the amount of $12,000.00, and appropriating funds for said project. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-216 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Dick’s Sporting Goods for sponsorship of the Dothan Leisure Services Youth Football and Soccer programs. None of them chose to bid. They have an advantage in that a local 3% preference is available to them. Like all bidders, they may view a copy of the previous bid tabulation sheet to be competitive in their pricing. All Dothan companies invited to bid may not handle these types of bids; such as, Todd and Sons and Azar's Uniforms, which may only bid on Police dress uniforms instead of Leisure Services uniforms. Unifirst only handles uniform rentals. When bidders do not submit a "no bid", the City can take them off the bidder's list after 3 attempts by law.
