BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING AUGUST 2, 2016 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, August 2, 2016 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, and Beth Kenward. Commissioner David Crutchfield was absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Shirley Strozier, First True Holiness Outreach, then led in prayer, afterwhich Commissioner Kenward led in the Pledge of Allegiance to the Flag. Mayor Schmitz announced that Commissioner Crutchfield is out of town. Commissioner Kirkland moved that the Minutes of the Meeting of July 19, 2016, be approved, motion seconded by Commissioner Kenward and unanimously approved. Commissioner Dorsey said he learned a lot of things during his trip to Arizona that he can bring back to our community and it is good to be back home. Mayor Schmitz said he had the honor of speaking to the 1,200 employees of Dothan City Schools this morning and the joy of taking the bus drivers to lunch yesterday at Golden Corral along with Commissioner Kenward. He said our bus drivers travel over 800,000 miles a year and carry over 6,000 children every day. He expressed what a responsibility this is in today’s world and said let’s pray for them and bless them. City Manager West made the following announcements: • The next project under the “Red Water Project” to replace aged waterlines begins this week. This a five month project with work taking place on North Appletree Street (from East Adams Street to East Newton Street) and East Burdeshaw Street (from North Appletree Street to North College Street). • The City will hold a free bidder’s registration seminar beginning at 9:00 a.m. on Tuesday, August 9th in the Civic Center Board Room to provide enrollment assistance to those interested in bidding on City projects. • The State Archery Tournament begins at 8:00 a.m. on Saturday, August 6th at Eastgate Park. • Water World has re-opened (after being closed due to a pump breakdown), will be open through Wednesday, August 3rd, and then will be open on weekends only through the Labor Day Holiday. City pools will close for the season after Wednesday, August 3rd with schools starting back. • Southeast Alabama Medical Center’s annual Men’s Health Fair will be held from 8:00 a.m. until 11:00 a.m. on Saturday, August 13th in the Civic Center. This event is open to the public and is a good opportunity for men to receive free health screenings. • School starts back beginning Thursday, August 4th and children will be riding buses and walking. Please take this into consideration and use extra care, especially in school zones. The police will concentrate in these areas. • The 2016 National Night Out event was held on Saturday, July 30th at the Dothan Civic Center with a phenomenal turnout. The Dothan Police Minutes of the Board of Commissioners – August 2, 2016, continued. Department and other area public safety agencies came together to hold this great event to demonstrate the positive interaction between police and the community. Mayor Schmitz recognized Javier Cepero, a member of Boy Scout Troup 38, as being present in the audience. Mayor Schmitz introduced the application of Johnny Wilson for a Lounge Retail Liquor License – Class II (off premise) for Vans Package Store, located at 307 Columbia Highway. Mayor Schmitz asked if there was anyone present to speak on this matter and there were none. Mayor Schmitz confirmed that Mr. Wilson was present in the audience. Commissioner Newsome moved for approval, motion seconded by Commissioner Kirkland. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Mayor Schmitz introduced the application of Michael C. Prichard for a Lounge Retail Liquor License – Class I (on or off premise) for Featured Players Cabaret, located at 3178 Hartford Highway. Mayor Schmitz asked if there was anyone present to speak on this matter and there were three. Brandy Givens introduced herself as an owner and operator of Trinity Learning Center. Ms. Givens said Trinity is a preschool and childcare facility located right across the street from this address and she said they have concerns about the distance. She said they measured with a range finder and found the distance to be between 438 and 480 feet to their property line and she understands that it is supposed to be 600 feet. Sandra Ball, resident of District 4, said this property has an entrance on Hartford Highway and Trawick Road and she witnessed a vehicle pulling through the parking lot because they did not want to wait for the light. She said this is one of her concerns because Hartford Highway is a four lane road. Ms. Ball said her other concerns are that the subdivision she lives in comes in behind the property, the back of some of the homes can be seen from the property, and Emmanuel Christian School is located nearby on Earline Road. David Parnell said he recently moved into Mallard Landing, a small community just down the street from this property. He said his concerns are that there are two Hispanic churches within walking distance of this building and there are only residential properties after this property – no other nightclubs or on premise sales of liquor in this area. He said it seems to him out of place to try to put a nightclub or something of that nature. He said his concern is that it would be a hindrance to property values in this area as well as congestion as far as the traffic. Mayor Schmitz confirmed that Mr. Prichard was present in the audience and he called for a motion. Hearing no motion, the application died due to lack of a motion and second. Mayor Schmitz introduced Resolution No. 2016-221 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on September 6, 2016. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-222 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2016-165 and 2016-203 and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-223 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Northstar Engineering Services for Construction Engineering and Inspection (CE&I) services for sidewalk improvements to Westgate Parkway, for a not to exceed amount of $57,425.00, and appropriating funds for said services. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, and Kirkland; “nay:” Ferguson and Kenward. The motion was carried by the majority of four "yeas" to two “nays.” Minutes of the Board of Commissioners – August 2, 2016, continued. Mayor Schmitz introduced Resolution No. 2016-224 (recorded in Ordinance Book No._______at Page_______), accepting a request from M4 Development, LLC for sanitary sewer flows and sanitary sewer gravity line along Murphy Mill Road right- of-way for Cottages at Bethlehem Road. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-225 (recorded in Ordinance Book No._______at Page_______), amending accounts in the 2016 and 2017 Fiscal Year Budgets to fund an additional Wastewater Collections Pump Station Crew to assist in meeting the preventive maintenance program requirements for compliance with the Administrative Order on Consent. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2016-226 (recorded in Ordinance Book No. _______at Page_______), awarding the following bids and approving other purchases over $15,000.00 by the City.
