BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING JANUARY 17, 2017 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, January 17, 2017 with the following members present: Mayor Pro tem John Ferguson, Associate Commissioners Kevin Dorsey, Albert Kirkland, Beth Kenward, and David Crutchfield. Mayor Mike Schmitz and Commissioner Amos M. Newsome, Jr. were absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Pro tem Ferguson called the meeting to order. He announced that Mayor Schmitz was called to an important meeting for economic development, and he said hopefully there will be some good news resulting from that meeting soon. He also announced that Commissioner Newsome was unable to be here today due to some health issues. Pastor Matt Vickers, Selma Baptist Church, then led in prayer, afterwhich Mayor Pro tem Ferguson led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of January 3, 2017, be approved, motion seconded by Commissioner Kenward and unanimously approved. Commissioner Crutchfield presented and read a proclamation, proclaiming the week of January 16, 2017 as “Public Education Week for the City of Dothan.” Dothan Education Foundation President Gindi Prutzman, Communications Director Meagan Dorsey, and other representatives were present for the proclamation. Commissioner Kenward said the Commission’s strategic planning session with Lyle Sumek was held this past Friday and Saturday, and she explained that this is a systematic process the Commission goes through each year to prioritize items they plan to accomplish in the coming year. She said the Commission takes the direction of the City very seriously and they take the opinions of our citizens into account. She expressed appreciation to the citizens for giving the Commission the opportunity to participate in these planning sessions each year. City Manager West made the following announcements and comments:  City offices were closed on Monday, January 16th in observance of Martin Luther King, Jr. Day. Regarding the sanitation schedule, Monday residents will receive garbage and recycling pick-up on Wednesday, January 18th.  A work session for the City Commission will be held in the Board Room on Thursday, January 19th at 10:00 a.m. to discuss stormwater issues and to provide an update on the Environmental Protection Agency’s Administrative Order on Consent.  A “How to Do Business with the City of Dothan” free workshop will be conducted on Thursday, February 16th in the City Commission Chambers beginning at 6:00 p.m. These workshops are held twice each year.  Baseball and softball registration is underway and will continue through Saturday, January 21st at the recreation centers for the respective leagues.  The Troy University Pied Pipers will present a musical in the Dothan Opera House at 6:00 p.m. on Tuesday, January 31st and this event is free to the public. The musical will also be presented during the day for local schools. Minutes of the Board of Commissioners – January 17, 2017, continued. Mayor Pro tem Ferguson introduced Ordinance No. 2017-15 (recorded in Ordinance Book No. _______at Page_______), amending Chapter 10, Animals, of the Code of Ordinances of the City of Dothan, in its entirety. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Dorsey, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of five “yeas” to no “nays.” Commissioner Kenward then moved for adoption of Ordinance No. 2017-15, motion seconded by Commissioner Kirkland. Commissioner Kenward said this ordinance revision was a combined effort between the animal services team and several advocacy groups in our community. She invited Animal Services Manager William Banks and Chief Animal Services Officer Renee Skipper to the podium to highlight some of the changes made to the ordinance. Mr. Banks discussed clarifications that were made to make the ordinance both easier for the public to understand and for staff to enforce. There being no further discussion, and upon the motion being put to vote, those voting “yea,” were Dorsey, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of five “yeas” to no “nays.” Mayor Pro tem Ferguson introduced Resolution No. 2017-16 (recorded in Ordinance Book No._______at Page_______), confirming the costs incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2016-283 and Resolution Number 2016-324 and turning the costs over to the County Tax Collector so that the amount can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2017-17 (recorded in Ordinance Book No._______at Page_______), confirming the costs incurred in notification and abatement of certain properties determined to be nuisances by Resolution Number 2016-326 and Resolution Number 2016-335 and turning the costs over to the County Tax Collector so that the amount can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2017-18 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and calling for a public hearing to be held on the matter during the regularly scheduled commission meeting on February 7, 2017. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2017-19 (recorded in Ordinance Book No._______at Page_______), submitting an application with the State of Alabama Department of Education for participation in the At-Risk Afterschool Program for children, entering into an agreement with the United States Department of Agriculture for administration of the program and entering into an agreement with the Dothan City Board of Education for providing the food services. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Leisure Services Director Elston Jones explained that this is a new program, and he said they are looking forward to starting out with about 200 meals at Andrew Belle Center and about 100 meals at Wiregrass Recreation Center. He said Commissioner Dorsey approached Leisure Services with this idea some time back as an opportunity to serve children after school and the idea was recently revisited. City Manager West noted that the resolution references the summer food service program. Mr. Jones said he will verify if this is a typographical error or if the afterschool program is an extension of the summer program. There being no further discussion, the resolution was unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2017-20 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Minutes of the Board of Commissioners – January 17, 2017, continued. the U.S. Department of Justice through the United States Marshals Service, to accept funding in the amount of $11,500.00 for reimbursement of overtime costs for officers working Gulf Coast Regional Fugitive Task Force cases. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2017-21 (recorded in Ordinance Book No._______at Page_______), entering into a contract with the Southeast Basketball Officials Association to provide a clockkeeper and bookkeeper to officiate during the 2017 South Regional Tournament at a cost of $45.00 per game. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2017-22 (recorded in Ordinance Book No._______at Page_______), appointing Mike Palmer as a member of the Planning Commission and Neil Holloway as a supernumerary member of the Planning Commission. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Commissioner Kirkland recognized and thanked Mike Palmer for the knowledge he brings and for serving on the Planning Commission as a supernumerary member for many years. There being no further discussion, the resolution was unanimously adopted. Mayor Pro tem Ferguson introduced Resolution No. 2017-23 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of December, 2016 in the amount of $14,762,386.84. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted.
