BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING FEBRUARY 21, 2017 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, February 21, 2017 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Amos M. Newsome, Jr., Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Reverend Juan Celzo, St. Columba Catholic Church, then led in prayer, afterwhich Commissioner Crutchfield led in the Pledge of Allegiance to the Flag. Commissioner Kirkland moved that the Minutes of the Meeting of February 7, 2017, be approved, motion seconded by Commissioner Dorsey and unanimously approved. Mayor Schmitz welcomed Dothan Area Convention and Visitors Bureau (CVB) Executive Director Bob Hendrix back. He said he is thankful Mr. Hendrix is here today and is recovering well. Mayor Schmitz presented and read a proclamation, proclaiming February 23, 2017 as “Arbor Day.” Dan Williams, Horticulturist, City of Dothan and Sylvia Steckley, Dothan Garden Study Club, were present for the proclamation. Mayor Schmitz honored Dr. Myland Brown for his lifetime of achievements and contributions, recognized him as being an extraordinary citizen of the community, and presented him with a Key to the City. Commissioner Dorsey said a group that meets regularly at Andrew Belle Community Center has brought to his attention the need for a ramp to be made accessible for the elderly and handicapped, and he asked City Manager West to check into this request. Commissioner Newsome said he recently visited Fairlane Park and has safety concerns with the section around the bridge that crosses the drain area and an exposed guy wire with no markings. City Manager West said these issues will be addressed immediately. Commissioner Kirkland encouraged everyone to come out and enjoy the fun of the Mardi Gras Parade on Saturday, February 25th from 2:00 p.m. until 4:00 p.m. He said the parade will begin at Solomon Park and end up downtown. Commissioner Crutchfield announced that the Azalea Dogwood Trail will take place on Sunday, February 26th with the ribbon cutting beginning at 1:50 p.m. and the Trail following at approximately 2:00 p.m. He said although there was not enough participation to hold the pageant this year, he hopes everyone will come out to the Trail and hopefully the pageant can return next year. He expressed appreciation to the citizens who got together and tried to get the pageant going, and he thanked Leisure Services Director Elston Jones and his staff who worked really hard to try to make this work and hopefully push it forth to next year. Mayor Schmitz announced a fun and educational event is beginning today at the National Peanut Festival Fairgrounds in partnership with Workforce Development Region 10, the business community, Wallace Community College, Houston County Career Center, and Dothan Technology. He said this event will take place over the next three days and will provide approximately 6,000 8th graders from sixteen counties with hands on experience in high paying technical and industrial Minutes of the Board of Commissioners – February 21, 2017, continued. jobs that require skills but do not require four year degrees. He said he is proud of this community for coming together to expose students to these careers and for creating skilled workers for the future. Veterans of Foreign Wars (VFW) Award Presentations were given by former VFW State Commander Ed Pritchard and VFW Post 3073 Commander John Seay to Corporal William Kaufmann, Law Enforcement Officer of the Year; Scott Forehand, Firefighter of the Year; and Brady Reeder, EMT of the Year. City Manager West invited Leisure Services Assistant Director of Operations Kim Meeker to make a presentation. Mr. Meeker said the City was honored at an event in Birmingham last week for becoming the Tournament of the Year for 2016 for hosting the Alabama Mixed Doubles Championship. He said the City has hosted this tournament for seventeen years and it brings over 600 people every year to stay in our hotels. He recognized Mr. Hendrix for his partnership and continued support, and he recognized Westgate Tennis Center (WTC) Manager Hubie Casey for the outstanding job WTC does in putting this type of event together. Mr. Casey said a lot of hard work goes into this tournament, and he thanked Water World staff for throwing an excellent player party every year. He expressed appreciation for Tina McCord, who heads up hospitality for Leisure Services, and he said her staff does an excellent job of taking care of everyone. City Manager West made the following announcements and comments:  The new sliding door, replacing the previous door damaged by a motor vehicle, has now been installed at the main post office.  The AHSAA South Regional Basketball Tournament continues today and tomorrow in the Civic Center arena.  Leisure Services is hosting the 14 and 18 year old State Basketball Tournament this weekend.  The “Hits for Heroes” baseball event is currently being held at Westgate Park and will end with the last game at 7 p.m. on Saturday, February 25th. Mayor Schmitz recognized Emergency Management Agency Director Chris Judah for having been present in the audience. Mayor Schmitz introduced Ordinance No. 2017-44 (recorded in Ordinance Book No. _______at Page_______), annexing certain property owned by Bryan M. Applefield, located at 4827 South Park Avenue into the City limits. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2017-44, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Ordinance No. 2017-45 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Maurice E. Sigmon, located at 219, 279, 317, and 333 Fortner Street from L-I (Light Industry) District to B-3 (Local Shopping) District. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2017-45, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Minutes of the Board of Commissioners – February 21, 2017, continued. Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Ordinance No. 2017-46 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by Carolyn Thomas, located at 618 Taylor Road from A-C (Agricultural Conservation) District to R-A (High Density Apartments) District. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2017-46, motion seconded by Commissioner Crutchfield. Commissioner Ferguson said he has received calls regarding this item, there have been no development plans presented to the City, and this is strictly a rezoning request at this time. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Ordinance No. 2017-47 (recorded in Ordinance Book No. _______at Page_______), rezoning property owned by C.W.S. LLC, located on the north side of Fortner Street and adjacent to Laver Hills Estate from A-C (Agricultural Conservation) District to R-3 (High Density Single-Family Residential Detached) District. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2017-47, motion seconded by Commissioner Kenward. Commissioner Kenward said she has received calls regarding this item and wanted to clarify that this is a neighborhood development with large lot homes and the only reason for the R-3 zoning is because the side yards for these particular lots are smaller than the R-2 dimensional requirements. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of seven “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2017-48 (recorded in Ordinance Book No._______at Page_______), assessing properties for the cost of demolition of substandard structures and turning the amounts over to the county tax collector to be added to the next regular bills for taxes levied against the respective lots and/or parcels of land. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West confirmed for Commissioner Ferguson that this resolution is a combination of advertisement fees being recouped as well as demolition costs and a property may only have advertisement fees in cases where the property owner has taken action to bring the structure into compliance. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-49 (recorded in Ordinance Book No._______at Page_______), approving a Final Contract Summary Change Order with Arrington Curb & Excavation, Inc., for the construction of the Campbellton Highway and Southgate Road Roundabout, which results in a cost increase in the amount of $38,616.22 making the final adjusted contract price $405,254.92. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West confirmed for Commissioner Ferguson that this change order is not for the damage where the incident took place. He explained that the increase is largely because of the additional excavation required. There being no further discussion, the resolution was unanimously adopted. Minutes of the Board of Commissioners – February 21, 2017, continued. Mayor Schmitz introduced Resolution No. 2017-50 (recorded in Ordinance Book No._______at Page_______), approving a Final Change Order with L & K Construction Company, Inc. to deduct $3,516.00 from the original contract amount, resulting in a final contract price of $127,950.00, and a final completion date of February 28, 2017. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-51 (recorded in Ordinance Book No._______at Page_______), entering into a supplemental agreement with CDG Engineers & Associates, Inc. for professional engineering services for ROW Acquisitions for the Alabama Transportation Rehabilitation and Improvement Program (ATRIP) Bridge Replacement on Brookside Drive in the amount of $20,629.00, and appropriating funds for said services. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. City Manager West explained that the original contract was done with the anticipation the bridge could be enlarged within the existing ROW but the completed design has revealed that this is not possible. Commissioner Ferguson asked if it is standard for the City to hire out for this process. Public Works Director Jerry Corbin said it is required because this is an ATRIP project. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-52 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Marty Robbins Roofing Co., Inc. for the partial roof replacement at the Alfred Saliba Family Services Center in the negotiated amount of $43,633.00, with $40,000.00 to be paid out of CDBG funds and $3,633.00 to be paid from the General Services budget. Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said this company was the only bidder and General Services Director Randy Morris negotiated the amount down from $46,500.00. City Manager West confirmed for Commissioner Dorsey that the City owns this entire building. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-53 (recorded in Ordinance Book No._______at Page_______), submitting a Cooperative Agreement to join the statewide recycling effort to educate and inform citizens of the benefits of recycling. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West explained that we have done this in the past, it does not cost us anything, and the television advertisements will air locally if we participate. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-54 (recorded in Ordinance Book No._______at Page_______), entering into a permit agreement with the Alabama Department of Transportation to lower approximately 70 linear feet, plus necessary bends, of 8” ductile iron water main along U.S. Highway 231 South (beginning at Milepost No. 12.55 and ending at Milepost No. 12.57). Commissioner Newsome moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-55 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with APD Urban Planning and Management to prepare a Comprehensive Affordable Housing Study at a cost of $107,465.00, of which $50,000.00 will be provided by the Dothan Housing Authority (DHA), and appropriating funds for said Study. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Newsome asked who will work with this company to ensure satisfactory completion of the Study, and City Manager West responded CDBG Administrator Maurice Head and a representative of the DHA. DHA Executive Director Glenn Franklin and DHA Board Member David Jamison were present in the audience. Commissioner Dorsey thanked Mr. Franklin for working closely with the City. Mayor Schmitz said Mr. Franklin will be retiring soon, and he expressed gratitude to him for his many years of service to this community. Commissioner Ferguson requested more information regarding municipal government’s role in housing and what is intended to be done with the data compiled from the Study. Minutes of the Board of Commissioners – February 21, 2017, continued. City Manager West said the shortage of affordable housing has been identified and discussed by the Commission and also by staff. He explained that the Study will identify further information and ways to address the shortage, and it will then be up to the Commission to make a decision regarding their role. Mayor Schmitz said affordable housing and senior housing has become a priority in the City and this Study will be a direct look at our community to see our strengths, our weaknesses, and opportunities for DHA and private businesses to overcome some of these shortages. Commissioner Ferguson expressed concern about spending this amount of money to compile data without knowing what our response will be or having a clear plan. Mayor Schmitz said the issue cannot be addressed until we know the real problems and this is information the Study will provide. He said this is important because we can then look at where we are, what is needed, and how we can make our community better. Commissioner Kenward asked for the timeline, and Mr. Head said the Study will take approximately nine months to complete. City Manager West said the information will be available for the Commission’s January 2018 planning session. Mr. Head confirmed for City Manager West that the consultant will present the findings to the Commission and to the public. Mr. Head confirmed for Commissioner Newsome that the Study is not over until DHA and the City are satisfied with what has been done. Commissioner Dorsey said affordable housing was identified and agreed upon by all as a top priority in the Commission’s recent strategic planning session. He said DHA’s commitment of $50,000.00 towards the cost of this Study speaks volumes that this is very important for the City. Commissioner Ferguson said he is not necessarily opposed to this, but the City is not in the housing business, and DHA is funded by the federal government. Mayor Schmitz said in his opinion this Study will allow our City to attract private investors because we can show the shortages, and hopefully they will come and invest in our City and help the citizens, and this is his goal. Commissioner Newsome said the existing housing projects in the City have been renovated multiple times and are approaching their end of life. He mentioned other areas in the City with older homes that are also approaching their end of life. He said we are trying to find something that could be put in these locations that will be affordable for the people who are living there and this Study will provide us with an idea of how to move forward. He said this is the first time we have taken a stand that cost money out of the general fund to look for housing and he thinks this is a step forward. He said we will be looking at this very closely. Commissioner Kenward said this year more baby boomers are aging into the Medicare system and onto Social Security than ever before and this problem is going to continue. She said our seniors are of the utmost importance, we have to give them safe, affordable housing options, and this is our attempt to get ahead of the curve. There being no further discussion and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Newsome, Kirkland, Kenward, and Crutchfield; “nay:” Ferguson. The motion was carried by the majority of six "yeas" to one “nay.” Mayor Schmitz introduced Resolution No. 2017-56 (recorded in Ordinance Book No._______at Page_______), entering into a contract with Global Rental Company, Inc. for rental of utility trucks, at no cost to the City. Commissioner Kenward moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-57 (recorded in Ordinance Book No._______at Page_______), accepting a Grant Award in the amount of $2,500.00 from the Dothan Elks Lodge to purchase eleven picnic tables and one recycled plastic bench to be placed at the Forever Wild trail heads, and appropriating funds for said grant award. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West thanked Dothan Elks Lodge, and Commissioner Kenward applauded them for using recycled plastic. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-58 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Angelia Turner to provide event planning services for the “2017 Hardee’s Pro Classic”, a USTA Tennis Tournament to be held April 15-23, 2017 in the amount of $5,000.00. Commissioner Kenward moved for adoption, motion seconded by Commissioner Minutes of the Board of Commissioners – February 21, 2017, continued. Dorsey. City Manager West said this is being funded by the CVB. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-59 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Dick’s Sporting Goods for the sponsorship of Dothan Leisure Services Youth Baseball/Softball for 2017. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-60 (recorded in Ordinance Book No._______at Page_______), declaring certain personal property as obsolete and no longer needed for public or municipal purposes and authorizing the disposal of said property by whatever means is determined to be in the best interest of the City. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey. Commissioner Newsome asked what happened to the 2015 Ford Expedition, and City Manager West explained that the vehicle was totaled in a wreck. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-61 (recorded in Ordinance Book No._______at Page_______), authorizing the Dothan Police Department to conduct a Traffic Homicide Investigation Training Course to be held at the Troy University-Dothan Campus held on June 5-16, 2017 and charge a registration fee of $150.00 for each attendee. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Commissioner Newsome Mayor Schmitz introduced Resolution No. 2017-62 (recorded in Ordinance Book No._______at Page_______), approving payment of invoices for the month of January, 2017 in the amount of $14,192,167.90. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield. Commissioner Newsome said these amounts have been high the last several months. City Manager West said this amount is actually down from the amounts over the past few months, and he explained that these amounts depend largely on the number of pay periods in a month and utilities purchased to resell to our customers based on consumption. There being no further discussion, the resolution was unanimously adopted. A coin toss is used to break tie bids. The award was determined by a coin toss by Elston Jones, called by Tammy Danner and witnessed by Charlotte Langford. Commissioner Kirkland then moved for adoption of Resolution No. 2017-63, motion seconded by Commissioner Crutchfield. Commissioner Ferguson inquired about one of the low bidders receiving the 3% local vendor preference, and he asked if it matters that the business is located outside of the Dothan city limits. City Manager West confirmed that businesses must be located inside the city limits in order to receive the 3% preference. Purchasing Agent Charlotte Langford confirmed with Commissioner Ferguson the bid and vendor in question, and she said she will review this bid to ensure items are awarded to the correct lowest bidder.
