BOARD OF COMMISSIONERS CITY OF DOTHAN, ALABAMA REGULAR MEETING SEPTEMBER 19, 2017 The Board of Commissioners of the City of Dothan, Alabama, met in regular session in the Commission Chambers of the Roy Driggers Municipal Building at 10:00 a.m., Tuesday, September 19, 2017 with the following members present: Mayor Mike Schmitz, Associate Commissioners Kevin Dorsey, Albert Kirkland, John Ferguson, Beth Kenward, and David Crutchfield. Commissioner Amos M. Newsome, Jr. was absent. Also present were City Manager Michael West, City Clerk Tammy Danner, Assistant City Clerk Wendy Shiver, who recorded the Minutes of the Meeting, and the local news media representatives. Mayor Schmitz called the meeting to order. Pastor Lyle Peluso, Dothan Vineyard Church, then led in prayer, afterwhich Commissioner Ferguson led in the Pledge of Allegiance to the Flag. Mayor Schmitz said since this is his last meeting it is appropriate that Pastor Lyle Peluso is here today because he has had such a big impact on his son’s life. Commissioner Kenward moved that the Minutes of the Meeting of September 5 and September 10, 2017 be approved, motion seconded by Commissioner Kirkland and unanimously approved. Commissioner Ferguson moved to amend the Minutes of August 16, 2016 to add discussion regarding Resolution Number 2016-234, motion seconded by Commissioner Kenward and unanimously carried. Commissioner Kenward then moved to approve the Minutes of August 16, 2016 as amended, motion seconded by Commissioner Ferguson and unanimously approved. Mayor Schmitz presented and read a proclamation, proclaiming October, 2017 as “Disability Employment Awareness Month.” Darryl Ellis, Business Relations Consultant, Alabama Department of Rehabilitation Services (ADRS) and other representatives were present for the proclamation. Mayor Schmitz presented and read a proclamation, proclaiming September 25, 2017 as “Family Day – A Day to Eat Dinner with Your Children.” Susan Trawick, Dothan-Houston County Substance Abuse Partnership (DHCSAP), along with Dothan High School Juniors and DHCSAP Youth Council Members Lauren Beauchamp and Molly Mathews were present for the proclamation. Commissioner Dorsey thanked Public Works Director Jerry Corbin and his staff, those in the blue shirts who are sometimes overlooked, for the great job they do in picking up trash and limbs. He said they make his job a lot easier because he did not receive many calls about this after the storm this past weekend. He said he would like to take this time to thank them and requested Mr. Corbin to deliver this message. He said he plans on coming out toward the end of the week to do something special for them. Commissioner Kirkland thanked Dothan Utilities staff and our department heads for the planning and hard work they did in preparing for the hurricane and responding after the storm. He said we have had a good week and it could have been bad if not for their efforts. Commissioner Kirkland expressed his appreciation to Mayor Schmitz and said he has enjoyed working with him for the past six and a half years. Commissioner Kenward said we will now see recycling bins in our parks, and she thanked Leisure Services and Mr. Corbin’s team for making this happening. She said this is a wonderful thing and a step in the right direction. She listed water bottles, soda cans, paper, and cardboard as items that can be put in the blue cans. She said this will be a pilot program to see how it works and she would love to see the need for more blue cans. She said the more we recycle, the longer our landfill will last. Minutes of the Board of Commissioners – September 19, 2017, continued. Commissioner Kenward announced an upcoming event hosted by the Dothan Police Department to help raise funds for a new animal shelter and rehome the sixty dogs rescued from the puppy mill operation in March. A video slideshow of the animals available for adoption was played during this announcement. She said these dogs have dramatic before and after stories, they are ready for a home, and have all been spayed, neutered, and chipped. She said the “Paws for a Cause” event will be held on Thursday, September 28th in the Civic Center arena. Doors will open at 5:00 p.m. with a silent auction beginning at 6:00 p.m. and lasting until 7:30 p.m. She said this is a family friendly event and concessions will be available. Tickets are $10 in advance, $12 at the door, and kids 10 & under are free. She encouraged everyone to come support the Dothan Police Foundation and to witness what happens with these special animals who deserve a second chance. She said the event flyer has been posted on the Dothan District 5 Facebook page, it will soon be posted on the City’s website and the Dothan Police Foundation’s website, and donations can also be made online. Commissioner Crutchfield thanked all of the department heads for the preparations and planning they did ahead of the approaching hurricane. He said this, along with the services being restored as quickly as possible, was impressive. Commissioner Crutchfield said Leisure Services has been doing a lot of work on the walking and running trail at Westgate. Commissioner Crutchfield thanked Mayor Schmitz for making his last year and a half of learning enjoyable, and he looks forward to continuing to work with him in his new role as School Board Chair. The Commission then made a presentation to Mayor Schmitz and gifted him a framed picture of the Joseph statue along with a key to the city. Commissioner Ferguson said this statue is important to Mayor Schmitz, the Commission wanted to offer a small token on their behalf to thank him for his leadership, optimism, and positive support, and he is leaving Dothan better than he found it. Mayor Schmitz said he appreciates our incredible community for the generosity shown to the evacuees who came from Florida to seek shelter from the storm. He said many churches opened up for the hundreds of people who needed places to stay and many letters and emails have been received in appreciation for this hospitality. Mayor Schmitz said he is grateful for the “Roast and Toast” fundraiser held on Thursday, September 14th. He said over 700 people attended this event and got to hear about the Saliba Family Services Center which was created by former Mayor Alfred Saliba in the 1990s. Mayor Schmitz said it was a wonderful evening, and he is looking forward to working with Mayor-elect Mark Saliba. City Manager West gave kudos to our team at the City who started preparing days in advance of the storm. He said he wants everybody to know what a great City team we have and what a great job they did in making preparations. He said he is proud to be a part of this team who were there ready to respond. City Manager West said a volunteer team of Dothan Utilities Electric Division employees is in Lakeland, Florida right now and he has received Facebook messages and emails from people thanking us for restoring their power. City Manager West made the following announcements and comments:  The Run-off Election for Associate Commissioner District 2 is today. Polls are open until 7:00 p.m. at the Civic Center and Wiregrass Recreation Center. If you live in District 2, get out and vote!  Troy University is bringing musical group Populus to the Dothan Opera House tonight. This event will be held at 7:00 p.m. and is free to the general public. Performances for school groups are being held today at 9:30 a.m. and 12:30 p.m. This is a very talented group and a great gift from Troy University to our City. Minutes of the Board of Commissioners – September 19, 2017, continued.  A public involvement meeting will be held tonight at Selma Baptist Church from 5:00 p.m. until 7:00 p.m. for general discussion of the Honeysuckle Corridor Study, and proposals for changes to help alleviate traffic will be on display. The public is invited to attend.  The Grand Opening of the Westgate Wellness Pool will be held Saturday, September 23rd at 10:00 a.m. There were some electrical problems yesterday, but the pool is now back up and running. This has been a great addition.  As announced by Commissioner Kenward, “Paws for a Cause” will be a great event to come to on Thursday, September 28th.  The swearing-in ceremony for the new mayor and the commissioners will be Monday, October 2nd at 6:00 p.m. in the Civic Center. This will be a wonderful time and everyone is invited to come.  The next “How to Do Business with the City of Dothan” seminar will be held on Tuesday, October 3rd in the City Commission Chambers. This is a biyearly event and is free to the public. Networking begins at 5:30 p.m. and the program begins at 6:00 p.m.  Today’s meeting will be adjourned until September 26th at 10:00 a.m. to canvas the results of the District 2 Run-off Election. City Manager West expressed his appreciation to Mayor Schmitz for his support and his leadership, and he said he sincerely appreciates that we have a team of elected officials and staff who have worked very well together. Mayor Schmitz introduced the application of Mishal R. Patel for a Retail Beer License (Off Premise) for Northview American Country Store, located at 3356 Reeves Street. Commissioner Kirkland moved for approval, motion seconded by Commissioner Dorsey. Mayor Schmitz asked if there was anyone present to speak on this matter and there were none. There being no discussion and upon the motion being put to vote, the motion was unanimously carried. Commissioner Kenward made a motion to remove the application of Chun Huang for a Restaurant Retail Liquor License (On Premise) for Ichiban Buffet and Grill located at 4863 Montgomery Highway, Suite 300, motion seconded by Commissioner Kirkland and unanimously approved. This application was removed from the agenda because the newspaper advertisement reflected an incorrect address. The request will need to be re-advertised with the correct address for consideration at the Tuesday, October 3rd meeting. Mayor Schmitz announced a Public Hearing regarding the abatement and removal of noxious or dangerous weeds. There being no one present to speak, Mayor Schmitz declared the Public Hearing closed. Mayor Schmitz introduced Ordinance No. 2017-294 (recorded in Ordinance Book No. _______at Page_______), amending Chapter 54, Law Enforcement of the Code of Ordinances by adding Article IV, Authority of Chief of Police Disposal of Property/Firearms. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2017-294, motion seconded by Commissioner Ferguson and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. Mayor Schmitz introduced Ordinance No. 2017-295 (recorded in Ordinance Book No. _______at Page_______), amending Chapter 6, Alcoholic Beverages, Section 6-102, of the Code of Ordinances of the City of Dothan, to revise the boundary of the Entertainment District. Commissioner Kirkland moved for immediate consideration, motion seconded by Commissioner Crutchfield and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Commissioner Kirkland then moved for adoption of Ordinance No. 2017-295, motion seconded by Commissioner Kenward and upon the motion being put to vote, those voting “yea,” were Schmitz, Dorsey, Kirkland, Ferguson, Kenward, and Crutchfield; “nay:” none. The motion was carried by the majority of six “yeas” to no “nays.” Mayor Schmitz introduced Resolution No. 2017-296 (recorded in Ordinance Book No._______at Page_______), declaring certain properties which are overgrown with weeds, scrub, wild bushes, grass and other vegetable growth as injurious to the health, safety and welfare of the community as nuisances and ordering that the properties be abated. Commissioner Kenward moved for adoption, motion seconded by Commissioner Kirkland and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-297 (recorded in Ordinance Book No._______at Page_______), confirming the cost incurred in notification and abatement of certain properties determined to be in violation of Article III, Chapter 106 of the City of Dothan Code of Ordinance (repeat offenders) and turning the costs over to the County Tax Collector so that the amounts can be added to the next regular bills for taxes levied against the respective lots and parcels of land. Commissioner Crutchfield moved for adoption, motion seconded by Commissioner Kenward and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-298 (recorded in Ordinance Book No._______at Page_______), entering into a Professional Service Agreement with PPM Consultants, Inc., for environmental consulting services to implement Brownfield’s Assessment Grant, in an amount not to exceed $276,000.00, and appropriating funds for said grant. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West said this is a 100% grant. Mayor Schmitz said this is a great thing for our City. City Manager West clarified for Commissioner Ferguson that by hiring the consultant to do the evaluations, the City is implementing the assessment grant. Commissioner Ferguson noted that this agreement is less than the total grant amount, and he asked what happens with the remaining grant funds. Planner Bob Wilkerson explained that there is an allocation for training, travel, and supplies. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-299 (recorded in Ordinance Book No._______at Page_______), approving Tax Incentive Abatements for Wayne Farms, LLC for their VRT Project, located at 808 Ross Clark Circle. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Mayor Schmitz said this is another improvement and addition to Wayne Farms. He said they have hired over 600 employees in the last year, and we are grateful for them and those jobs. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-300 (recorded in Ordinance Book No._______at Page_______), entering into Memorandum of Agreements (MOU) between Houston County and the City of Dothan for the purpose of leasing two (2) tower spaces, located at 231 Helms Road, Dothan and 283 Recreation Road, Dothan. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West said part of this agreement is that they will fund a study to make sure their radio equipment will not interfere with ours, and once this is done, the next step will be to negotiate a lease which will be brought before the Commission for approval. Mayor Schmitz introduced Resolution No. 2017-301 (recorded in Ordinance Book No._______at Page_______), submitting an application to the State of Alabama Department of Education for participation in the At-Risk Afterschool Food Service Program for Children, entering into an agreement with the United States Department of Agriculture for administration of the program and entering into an agreement with the Dothan City Board of Education to provide food services. Commissioner Kenward moved for adoption, motion seconded by Commissioner Crutchfield. City Manager West said this is a great program. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-302 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the Southern Regional Council on Aging (SARCOA) to administer and operate the Nutrition/Transportation Program of Title III of the Older Americans Act. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Ferguson. City Manager West said this is a great program that allows us to feed senior citizens at Rose Hill and deliver meals to senior citizens. Mayor Schmitz said both this program and the program approved under the previous item help people in need, and we are proud to be part of that assistance. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-303 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with the State of Alabama Department of Economic and Community Affairs to accept payments from ADECA for eligible households under the Low Income Home Energy Assistance Program (LIHEAP), for the period of October 1, 2017 through September 30, 2018. Commissioner Dorsey moved for adoption, motion seconded by Commissioner Kirkland. City Manager West said this program helps low income people with their electric bills and is administered through the Southeast Alabama Community Action Partnership (formerly HRDC). City Manager West confirmed for Commissioner Crutchfield that there is a limited amount allowed, but because it is not administered by the city, this amount is not known. City Manager West confirmed for Commissioner Kenward that the City refers requests to the Southeast Alabama Community Action Partnership, as well as other places that help people. Commissioner Dorsey asked how we get this out to the citizens, and City Manager West replied that most needing assistance know about these resources. City Manager West confirmed for Mayor Schmitz that we will also put this out on social media. There being no further discussion, the resolution was unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-304 (recorded in Ordinance Book No._______at Page_______), declaring certain personal property as obsolete and no longer needed for public or municipal purposes and authorizing the disposal of said property by whatever means is determined to be in the best interest of the City. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Dorsey and unanimously adopted. Mayor Schmitz introduced Resolution No. 2017-305 (recorded in Ordinance Book No._______at Page_______), amending various accounts in the 2017 Fiscal Year Budget. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said this is to clean up accounts prior to closing out the books for this year. Mayor Schmitz introduced Resolution No. 2017-306 (recorded in Ordinance Book No._______at Page_______), renewing the agreement with the Alabama Fire College to be designated as a Regional Training Center. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said kudos to Fire Chief Larry Williams because this allows us to train people here rather than send them somewhere else. Mayor Schmitz agreed and he said we have a great team. Mayor Schmitz introduced Resolution No. 2017-307 (recorded in Ordinance Book No._______at Page_______), endorsing the efforts of the Alabama Bicentennial Commission and resolves to aid the Alabama Bicentennial Commission in Minutes of the Board of Commissioners – September 19, 2017, continued. promoting, planning, and executing the Commission’s historic, educational, celebratory, and cultural initiatives by forming or supporting a Community Celebration Committee to observe and commemorate the bicentennial of the State of Alabama. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. City Manager West said the Dothan Area Convention & Visitors Bureau is handling these efforts. Mayor Schmitz introduced Resolution No. 2017-308 (recorded in Ordinance Book No._______at Page_______), entering into an agreement with Academy Sports + Outdoors for the sponsorship of the Dothan Leisure Services “Youth Fishing Day”. Commissioner Kirkland moved for adoption, motion seconded by Commissioner Kenward. Mayor Schmitz said we appreciate Academy Sports. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the City of Dothan, Alabama as follows: Section 1.
